THE COMMISSIONERS COURT OF BRAZOS COUNTY WILL MEET IN REGULAR

the capital purchase of P.A. sound equipment for the Exposition Complex.

11. Requisition 00013914 in the amount of $14,086.00 to Boon Edam Tomsed, Inc. for the
capital purchase of turnstiles for the Exposition Complex.
12. Requisition 00013915 in the amount of $5,995.20 to Visiontron Corp. for the capital

16. Request for permission to enter Jim Owen Jones' property located off Hunter's Run
(Hunter's Creek subdivision) for the purpose of repairing erosion (at address numbers
10033 and 10037). Area will be seeded, fertilized and polyjute fabric will be added for
erosion control. Site is in Precinct 3 and will be maintained until vegetation is
established.
17. Request for permission to enter Herman Homeyer's property located off Elmo Weedon
Road for the purpose of opening the creek channel (to promote adequate drainage)
extending from the county right of way line into his property for approximately 100
feet. Area will be seeded, fertilized and polyjute fabrick will be added for erosion
control. Site is in Precinct 2 and will be maintained until vegetation is established.
18. Request from Wickson Creek Special Utility District to construct a road bore for water
line installations in the right of way of Dilly Shaw Tap Road approximately 0.4 mile
from its intersection with FM 2038. Site is located in Precinct 2.
19. Announcement of interest items and possible future agenda topics.
20. Call for citizen input and/or concerns.
21. Agency/ Board/ Committee reports by Court members.

COMMISSIONERS' COURT
REGULAR MEETING
MAY 15, 2007
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos Center 3232 Briarcrest
Drive, in Bryan, Brazos County, Texas, beginning at 6:00 p.m.
on Tuesday, May 15, 2007 with the following members of the
Court present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3, Late;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk, Absent.
The attached sheet contains the names of the citizens and
officials that were in attendance.
The County Judge gave the invocation and led the pledge
of allegiance.
There was no citizen input /and or concerns.
The Court next considered Budget Amendment #06/07 -27.1
through 27.4, which would reallocate funds for the 85th
District Court, Constable, Precinct 2, HAVA General Compliance
and Capital Projects- Commissioners Court. On motion by
Commissioner Cauley, seconded by Commissioner Peters, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached.

The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Peters, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the change of status as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Peters, seconded by Commissioner
Wassermann, the Court voted unanimously to approve the Claims
as submitted.
The County Judge read aloud Proclamation #07 -003
celebrating the 50th anniversary of KBTX -TV television station
in the Brazos Valley. The Court recognizes KBTX -TV for its 50
years of faithful and dedicated service both on the air and in
the Brazos Valley. On motion by the County Judge, seconded by
Commissioners Wassermann, Peters, and Cauley the Court voted
unanimously to adopt Proclamation #07 -003.
The next matter before the Court was approval of a first
amendment to the contract Brazos County and ACS State & Local
Solutions, Inc. for full service computerized indexing, optical
imaging systems and services for vital and real property
records, commencing upon execution through July 9, 2008. The

cost to Brazos County will be as follows:
1- 100 Instruments $4.38 each
101 -200 Instruments $4.34 each
201- 1,700 Instruments $4.08 each
1,700- up $2.03 each
$0.40 per document service fee and
One time Setup /Customization $2,000

The original contract has 18 months on the original term. The
amendment if approved shall commence immediately upon execution
and shall expire on July 9, 2008. There are two twelve month
renewal options to commence upon expiration of the previous
term upon the same terms and conditions. On motion by
Commissioner Peters, seconded by Commissioner Cauley, the Court
voted unanimously approve the first amendment to the contract
with ACS State & Local Solutions, Inc. and authorize the County
Judge to execute the document. A copy of the contractual
agreement is attached.
The next matter for consideration was approval of tax
refund applications from the following individuals and /or
companies:
a. Antler Development, over payment $163.15
b. Kelly H. Baxter (3), over payment $7.45, $4.30, $4.82
c. Decimal Transcription Solutions, over payment $28.24
d. Scott & Nancy Donaldson, over payment $299.51
e. Stone Haven Management Corp., over payment $415.84
f. Weingarten Investments, Inc., over payment $222.00
On motion by Commissioner Wassermann, seconded by Commissioner
Cauley, the Court voted unanimously to approve the tax refund

The Court next considered approval of requisition
#00013899 in the amount of $2,044.00 to Troxell Communications
Inc. for a portable sound system for the Exposition Center.
On motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the
requisition.
The next matter before the Court was approval of
requisition #00013913 in the amount of $4,490.00 to InLine
Barricades & Metal for barriers for the Exposition Center. On
motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the
requisition.
The Court next considered approval of requisition
#00013914 in the amount of $14,086.00 to Boon, Edam Tomsed,
Inc. for turnstiles for the Exposition Center. On motion by
Commissioner Peters, seconded by Commissioner Wassermann, the
Court voted unanimously to approve the requisition.
The next matter before the Court was approval of
requisition #00013915 in the amount of $5,995.20 to Visiontron
Corp. for stancions for the Exposition Center. On motion by
Commissioner Cauley, seconded by Commissioner Peters, the
Court voted unanimously to approve the requisition.

The Court next considered approval of requisition
#00013916 in the amount of $7,120.00 to Geneva Scientific Inc.
for plastic barricades for the Exposition Center. On motion by
Commissioner Cauley, seconded by Commissioner Peters, the
Court voted unanimously to approve the requisition.
The next matter before the Court was approval of
requisition #00013873 in the amount of $48,364.15 to CDI
Equipment LTD for a forklift for the Road and Bridge
Department. Originally the purchase of a 5,000 lb. forklift
was approved in the capital budget in the amount of
$24,610.00. On motion by Commissioner Wassermann, seconded by
Commissioner Peters, the Court voted unanimously to approve
the requisition.
The Court next considered approval of requisition
#00013861 in the amount of $5,175.00 to CDW Government, Inc.
for the purchase of a Fujitsu Scanner for the District Clerk's
Office. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve
the requisition.
The Court next considered authorizing work outside of
county rights -of -way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Jim Owen Jones on

Hunter's Run in Hunter's Creek Subdivision in Precinct 3 to
repair erosion at address numbers 10033 and 10037. The area
will be seeded, fertilized and polyjute fabric will be added
for erosion control. On motion by Commissioner Mallard,
seconded by Commissioner Cauley, the Court voted unanimously
to authorize the work.
The Court next considered authorizing work outside of
county rights -of -way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Herman Homeyer on
Elmo Weedon Road in Precinct 2 to open the creek channel to
promote adequate drainage, extending from the county right -of-
way line into his property for approximately 100 feet. The
area will be seeded, fertilized and polyjute fabric will be
added for erosion control. On motion by Commissioner Peters,
seconded by Commissioner Cauley, the Court voted unanimously
to authorize the work.
The Court next considered the request from Wickson Creek

Road. The site is located in Precinct 2. The County Engineer
stated that all appeared to be in order and recommended

Commissioner Wassermann, the Court voted unanimously to
approve the request from Wickson Creek Special Utility
District and authorized the installation. A copy of the
request is attached hereto.
Under announcement of interest items and possible future
agenda topics the following spoke:
Commissioner Mallard
a) Said that the CUC will meet tomorrow
in Austin.
County Judge
a) He will be going to Houston tomorrow
with the Research Valley Partnership to
visit Conoco.
b) He asked his administrative assistant
to find a date to meet with John McBeth
to discuss the parking garage. The
administrative assistant stated that
she was looking at a date in June.
c) He informed the Court that the
Hotel /Motel tax passed.
There was no citizen input and /or concerns.
Under Agency /Board /Committee reports by Court members,
the following spoke:
Commissioner Mallard
a) He went to Washington D.C. last week
with the Chamber of Commerce. They
visited with lots of representatives
of Brazos County but they did not get
to sit down with the senators. Their
time is limited but the group did
convey their agenda to them.

OPTICAL IMAGING SYSTEMS AND SERVICES FOR VITAL AND REAL
PROPERTY RECORDS, BRAZOS COUNTY, TEXAS

KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF BRAZOS
This First Amendment for Full Service Computerized Indexing, Optical Imaging Systems
and Services for Vital and Real Property Records (herein the "Contract "), is made and
entered into by and between BRAZOS COUNTY, a political subdivision of the State of
Texas, on behalf of its County Clerk, hereinafter referred to as "Client ", and ACS
STATE & LOCAL SOLUTIONS, INC., a New York corporation,, n/k/a
ACS /Government Records Management, 2800 W. Mockingbird Lane, Dallas, Texas
75235, hereinafter referred to a "Provider".
RECITALS
WHEREAS, Client and the Provider entered into a Contract for microfilming,
indexing and storage and maintaining on -line Real Property Records and Vital Statistics
Records of Brazos County, Texas on July 10, 2005.
WHEREAS, the original Contract still has one and a half (1' /2) years on its
original term; and
WHEREAS, the Client desires to redact personal information from records filed
for official recording; and
WHEREAS, The Provider has systems technology available to integrate into
Brazos County's computerized recording system; and
WHEREAS, the parties wish to alter their current Contract to provide for this
upgrade in technology.
NOW THEREFORE, KNOW ALL MEN BY THESE PRESENTS that for and in
consideration of the upgrade in services the parties agree to the terms and conditions set
forth herein. All terms and conditions of the contract remain in place unless stated in this
amendment.
CONSIDERATION
Client agrees to pay for Providers Full Service Redaction services, as those services are
described, as follows:
See Exhibit "A" attached — Pricing and Description of Systems and Services
Exhibit A is attached hereto and made a part hereof for all purposes.
The cost for these Systems and Services have been negotiated by the General Services
Commission of the State of Texas. These negotiated prices are offered to Brazos County
through the CISV Catalogue Purchasing Program of the General Services Commission.

DURATION
This Amendment shall commence immediately upon execution and shall expire at
midnight on July 9, 2008, subject to the annual appropriation of currently available funds
by the Brazos County Commissioners Court. Client shall have two twelve month renewal
options to commence upon expiration of the previous term upon the same terms and
conditions stated herein. The Client shall notify the Provider in writing of its decision to
exercise this option 30 days prior to the expiration of the original term. Such renewal
terns shall be upon the same terms and conditions as set forth herein.

Pricing and Service Description
ACS will implement Full Service Redaction Services into the existing recording and
indexing process. All current functionality of the system will remain intact. The current
Brazos County recording and cashiering processes will remain as currently exists. Each
day's filings will be recorded and transmitted to the ACS Dallas lab. At this point, ACS
will electronically redact all required personal data as prescribed and approved by the
Brazos County Clerk (ie. SS #s, bank account #s, etc.). A trained operator will then
inspect each page for accuracy and completeness. Any corrections will be made at this
time. Two sets of data will be returned and imported back to Brazos County Clerk's
computer system. The redacted set of data will be available on public workstations and
the ACS supported internet site while the original set of data is accessed by secured
Brazos county personnel.
The costs for this added redaction service is:
1) A $0.40 per document service fee will be added to the existing Full Service Indexing
pricing model as follows:

101- 200 Instruments - $4.34 each
201- 1,700 Instruments - $4.08 each
1,701 - Up - $2.03 each

(The set up is for consultation to determine redaction rules for Brazos County documents,
testing and samples)

ITEM: Request from Wickson Creek Special Utility District to construct a road bore for
water line installations in the right of way of Dilly Shaw Tap Road approximately 0.4 mile from its
intersection with FM 2038. Site is located in precinct 2.
SOURCE OF FUNDS: N/A
REQUIREMENTS:
I. No work will be permitted between front slope and/or back slope.
2. All installation(s) shall be constructed in designated utility easements, if applicable. If no
utility easement exists, the installation(s) shall be 1) within 3 -5' of and parallel to the right -
of -way line and/or 2) in the case of a road bore, perpendicular to the right -of -way line.
3. If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county right -of -way.
4. Ditch line shall be compacted to 90% standard density ASTM -Test Method No. D -698; test
shall be conducted by an independent geotechnical testing firm; copies of all test results shall
be furnished to the office of the Brazos County Engineer.
5. Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of
Transportation, and all other State and Federal laws governing utility construction.

REQUEST FOR PROPOSED INSTALLATION IN COUNTY RIGHT -OF -WAY
TO THE COMMISSIONERS' COURT OF BRAZOS COUNTY, TEXAS
BRAZOS COUNTY COURTHOUSE

Formal notice is hereby given that (applicant) Wickson Creek special Utility District
proposes to place a (type) waterline within_ across x the right -of -way of
(road) 9801 DILLY SHAW TAP ROAD in Brazos County, Texas as follows:
The location or description of the proposed installation is more fully shown by _ 3
copies of the drawings attached to this notice.
I understand and agree that
1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that he, or his designated inspector, may
inspect the actual installation.
2. All damage to the roadways and rights -of -way will be repaired to their
original condition to the satisfaction of the County Engineer.
3. Brazos County reserves the right to require Applicant to relocate or
lower any such line at no cost to Brazos County, should same
become necessary due to widening or lowering, or other alteration of
the roadway or right -of -way
4. Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines in the right -of -way.
5. The line will be constructed and maintained on the County right -of -way in
accordance with the Utility Accommodation Policy which was adopted by the
Texas Department of Transportation on May 29, 1989,
6. The line or lines will be constructed no less than twenty -four inches (24 ")
lower than the lowest part of the drainage or bar ditch and the drainage is to
be considered at least two feet (2') below the center of the roadway.
7. All sites will be barricaded during the construction period.
Construction of this line will begin on or after the 15 day of 14AY 20 06
