THE COMMISSIONERS COURT OF BRAZOS COUNTY WILL MEET IN A
WORKSHOP SESSION ON MONDAY 14 MAY 2007 AT 2:00 P.M. IN THE
COMMISSIONERS COURTROOM OF THE BRAZOS COUNTY COURTHOUSE, 300
E. 26TH STREET, SUITE 115, BRYAN, TEXAS.

2. Presentation by a Texas County & District Retirement System (TCDRS)
representative on pension payout limitations.

WORKSHOP SESSION
MAY 14, 2007
The Commissioners' Court of Brazos County, Texas met in a
Workshop Session in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 2:00
p.m. on Monday, May 14 2007 with the following members of the
Court present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4, Absent;
Karen McQueen, County Clerk.
Attached is a list of the citizens and officials in
attendance.
The Commissioner's Court met to hear a presentation by a
Texas County & District Retirement System (TCDRS)
representative on pension payout limitations. Howard Miller,
from TCDRS gave the presentation on TCDRS and IRC Section 415
Compliance. This section puts a payment limit on what TCDRS
can pay retirees. Mr. Miller stated there are options for the
County to consider such as doing nothing or adopting a
qualified replacement plan that would payout the difference
owed to the retiree. In essence, the County would be escrowing
amounts that the employee might be shorted.

Then the County would have to decide how to report the income
to the IRS whether on a 1099 or a W -2 form.

The foregoing minutes of the Commissioners Court Workshop
held May 14, 2007, have been examined and approved in open
