THE COMMISSIONERS COURT OF BRAZOS COUNTY WILL MEET IN REGULAR

1. Invocation and Pledge of Allegiance — Commissioner Mallard.
2. Call for citizen's input and/or concerns.
Consider and take action on agenda items 3 -14:

4. Request from the County Attorney's Office for permission to reclassify an
Investigator /Supplemented position (Class 0522, Position 1, Group 20, Step 2) to a full -
time Receptionist position (Class 0522, Position 1, Group 17, Step 8) with the current
annual budgeted amount.

Sheriffs Administration Building, Exposition Complex and County Administration
Building, as recommended by telecommunication consultant Ben Sanford and
designated committees.
13. Request from Wickson Creek Special Utility District to construct a road bore for water
line installations in the right of way of Golden Mist (Rainbow Acres subdivision)
approximately 1,200 ft. from its intersection with Roans Chapel Road. Site is located
in Precinct 3.
14. Final Plat of Tabor Road Substation Subdivision, lot 1, block 1, recorded in volume
326, page 663 and volume 7251, page 220, official records of Brazos County, 9.02
acres, S. F. Austin League No. 10, A -63, Bryan ETJ, Brazos County, Texas. Site is
located in Precinct 2.
15. Acknowledgement of the Investment Report for the quarter ending 3/31/07.

COMMISSIONERS' COURT
REGULAR MEETING
MAY 8, 2007
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos County Commissioners
Courtroom in the Courthouse in Bryan, Brazos County, Texas,
beginning at 9:00 a.m. on Tuesday, May 8, 2007 with the
following members of the Court present:
Randy Sims, County Judge, Absent;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3, Absent;
Carey Cauley, Jr., Commissioner of Precinct 4,
Presiding;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Cauley asked the Reverend Jones to give the
invocation and then Commissioner Cauley led the pledge of
allegiance.
There was no citizen input /and or concerns.
The Court next considered Budget Amendment #06/07 -26.1
through 26.2 that would transfer funds from Contingency to
Human Resources, and transfer funds from the General Fund back
into Contingency. On motion by Commissioner Peters, seconded
by Commissioner Wassermann, the Court voted unanimously to

approve the budget amendment as submitted, a copy of which is
attached hereto.
The Court next considered a request from the County
Attorney's Office for permission to reclassify an
Investigator/ Supplemented position, Class 0522, Position 1,
Group 20, Step 2 to a full time Receptionist position Class
0522, Position 1, Group 17, Step 8. No additional monies will
be needed. On motion by Commissioner Peters, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the reques.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Peters, seconded by
Commissioner Wassermann, the Court voted unanimously to
approve the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the Claims as
submitted.
The next matter before the Court was the revision of the
Fixed Asset Policy. The Auditor's office is recommending

removing Legal Books and LCD /Plasma Monitors from the list.
On motion by Commissioner Wassermann, seconded by Commissioner
Peters, the Court voted unanimously to approve the revision of
the Fixed
Asset
Policy.

seconded by
Commissioner Cauley, the Court voted unanimously to receive,
approve and order filed as submitted the March 2007
Treasurer's Report. A copy is attached to and made a part of
these minutes.
The next matter for consideration was approval of tax
refund applications from the following individuals and /or
companies:
a. Thomas R. Brady, over payment $10.00
b. Richard & Lori Ann Reeder, over payment $12.12
c. Valerie & Penny Woodcock, over payment $36.37
On motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the tax refund
applications.
The Court next considered a contract for municipal
advertising with The Eagle. The rates remain unchanged with
the daily rate being $12.95 /inch and the Sunday /Holiday rate
being $13.65 /inch. On motion by Commissioner Peters, seconded
by Commissioner Wassermann, the Court voted unanimously to
approve the contract. A copy is attached.

The next matter before the Court was consideration of
Amendment No. 6 between Brazos County and Hunt Construction.
The amendment will add $250,000.00 to the Owner Contingency
fund to cover the cost for the water, road, and electrical to
the Metal Building and any other changes that might occur
before completion. On motion by Commissioner Cauley, seconded
by Commissioner Peters, the Court voted unanimously to approve
Amendment No. 6. A copy is attached.
The Court next considered the selection of
telecommunications systems for the new Sheriff's
Administration Building, Exposition Complex and County
Administration Building. Telecommunications Consultant, Ben
Sanford and the designated committees recommended Affiliated
Telephones, Inc. On motion by Commissioner Wassermann,
seconded by Commissioner Peters, the Court voted unanimously
to accept the recommendation of the consultant and the
committees and selected Affiliated Telephones, Inc. A copy of
the tabulation sheet is attached.
The Court next considered the request from Wickson Creek
Special Utility District to construct a road bore for
waterline installation in the right -of -way of Golden Mist in
the Rainbow Acres Subdivision. The site is located in
Precinct 3. The County Engineer stated that all appeared to be

in order and recommended approval. On motion by Commissioner
Peters, seconded by Commissioner Wassermann, the Court voted
unanimously to approve the request from Wickson Creek Special
Utility District and authorized the installation. A copy of
the request is attached hereto.
The Court next considered approval of the Final Plat of
Tabor Road Substation Subdivision, Lot 1, Block 1, 9.02 Acres
in Precinct 2. Richard Vance, County Engineer, stated that he
had reviewed the plat and all appeared to be in order. On
motion by Commissioner Peters, seconded by Commissioner
Wassermann, the Court voted unanimously to approve the final
plat of Tabor Road Substation Subdivision, Lot 1, Block 1,
9.02 Acres as submitted.
The Court acknowledged receipt of and ordered filed as
submitted the Treasurer's Quarter Ending Investment Report for
March 31, 2007. A copy is attached to and made a part of
these minutes.
Under announcement of interest items and possible future
agenda topics the following spoke:
Bill Ballard, Court Counsel
a) Made the Commissioners aware of an incident
at the Brazos Center. A local dealership
was test driving vehicles there while a
wedding reception was going on. There was
reckless driving involved. The dealership
was contacted but the Court should probably

look at a policy on cars pared on our
property.
There was no citizen input and /or concerns.
There were no Agency /Board /Committee reports by Court
members.
There being no further business to come before the Court,
the meeting was adjourned.

To move funds from building renovations for original furniture for the I.T. department. Furniture
does not alify as a capital asset and should be in the office furniture account. These purchases
were already approved by Court and are not an increase in furniture urchases.
Actual costs for Maxwell Center remodeling have come in and the building is completed,
therefore this amendment will move $150,000 of the $200,040 transferred from General Fund in
October 2006 back to the General Fund contingency.

RE: Fixed Asset Policy
This office respectfully requests that the following items be removed as Listed Items
in the Fixed Asset Policy.
Legal Books — The Legal Books are no longer maintained in their current paper
format. The move to electronic media and subscriptions has resulted in these items no
longer fitting the criteria for listed items.
LCD /Plasma Monitors — The prices on these items have dropped so rapidly that
tracking these items has resulted in an inconsistent application of policy.
If this policy revision is approved, we would like it to take place immediately. Upon
approval we will remove these items from the fixed asset system.

CONTRACT FOR MUNICIPAL ADVERTISING
Date: June 29, 2007
To earn a reduced rate on municipal display advertising published in The Eagle, the undersigned Advertiser
hereby agrees to purchase space in The Eagle and to abide by all terms and conditions of this Contract.
Starting Date: July 1. 2007
Length of Contract: Twelve Months
Expiration Date: June 30, 2008
Rate: Daily: $12.95 inch. Sunday/ Holiday: $13.65 inch
In the proposed system, the City will be guaranteed a set price per inch for the contract period without regard to
the number of inches run each month, nor will there be a minimum number of inches required.
This contract is based on nine column format. Ads running in retail on six column format would be converted to
nine column equivalents and the rate applied (as noted above).
A carrying charge of 11/2% per month will be charged on all accounts not paid in full by the 15th day of the month
following advertising insertion. The Advertiser also covenants to pay all costs incurred by The Eagle enforcing
this Contract, including collection and attorney's fees (up to 50% of the amount in default) should the Advertiser
default in payment.
For value received, Advertiser assigns to The Eagle all right, title and interest to all layouts of advertisements
placed with The Eagle which represent the creative effort of the newspaper and/or utilization of its own
illustrations, labor, composition or material. Advertiser understands that because of said assignment, he cannot
authorize photographic or other reproduction of any such advertising layout appearing in The Eagle in any other
publication without the express written consent of The Eagle.
It is further understood that this assignment does not preclude Advertiser from supplying to other publications
similar or identical material or information for production of advertisements by such publications or from
suggesting the content or form of such advertisements.
If disaster, work stoppage, newsprint rationing, or other emergency shall cause publishing difficulties, the
Publisher shall have the right to revise this Contract so as to prorate the available space on an equitable basis.

AMENDMENT N0. 6
TO AGREEMENT BETWEEN OWNER AND CONSTRUCTION MANAGER
Pursuant to Section 2.2 of the Agreement, dated October 31, 2005 between Brazos
County, Texas (Owner) and Hunt Construction Group, Inc. (the Construction Manager),
for Brazos County (the Project), the Owner and Construction Manager establish a
Guaranteed Maximum Price and Contract Time for the Work as set forth below.
ARTICLE I GUARANTEED MAXIMUM PRICE
The Construction Manager's Guaranteed Maximum Price for the Work, including the
estimated Cost of the Work as defined in Article 6 and the Construction Manager's Fee as
defined in Article 5, is Twenty-four Million Seven Hundred One Thousand One Hundred

SUBSTANTIAL COMPLETION DATE - SHERIFF'S OFFICE
1.) The substantial completion date for the Sheriff s Office has been adjusted from July
15, 2007 to August 8, 2007. This adjustment was necessary due to the sheetrock
installation being suspended from March 28, 2007 to April 20, 2007 or Eighteen (18)
working days. This direction came from Brazos County during the meeting on March
28, 2007.

Exposition Complex Changes / Vendor & Financial Summary
A full report was presented on May 1. Upon further discussions with county
personnel and recommended vendor Affiliated Telephone (ATI), the following
changes and clarifications were made:
1. Supplying Exposition Complex common equipment and analog licenses to
support all 150 exhibitor floor jacks simultaneously was reduced to 75. If needed,
these can be added later with ease at about the same price. Using the patch panel
wiring system, these 75 ports can be moved to any jacks on the floor in order to
support various exhibitor configurations.
Netting the equipment, license, labor and manufacturer discount, the final Expo
pricing would be $51,436.73. This represents a savings of $11,790.17. Budget
totals are attached.
2. We also decided to make the Sheriff Office / Detention Center second T1 back
to the courthouse PBX go over county - provided fiber already in place. This would
give diverse routing for the Sheriff Office / Detention Center trunking and avoid
monthly DIR/Verizon charges of about $250 per month. The net equipment
increase will be $788.86 at that location.
3. It was discussed in the report meeting that the Adult Supervision move delay
could result in labor savings for the Administration Building move. However, it
was determined that this delay had already been incorporated into the RFP, so that
cost will stay the same. However, the report budget total expenditure included the
IT Building, which should not have been part of that, resulting in a great
improvement of the Admin Building balance.
4. A summary of the vendor ratings from the report is also attached.

REQUIREMENTS:
1. No work will be permitted between front slope and /or back slope.
2. All installation(s) shall be constructed in designated utility easements, if applicable. If no
utility easement exists, the installation(s) shall be 1) within 3 -5' of and parallel to the right -of-
way line and /or 2) in the case of a road bore, perpendicular to the right -of -way line.
3. If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county right -of -way.
4. Ditch line shall be compacted to 90% standard density ASTM -Test Method No. D -698; test
shall be conducted by an independent geotechnical testing firm; copies of all test results shall
be furnished to the office of the Brazos County Engineer.
5. Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of
Transportation, and all other State and Federal laws governing utility construction.

Formal notice is hereby given that (applicant) Wickson creek special utility District
proposes to place a (type) waterline within_ across_ x the right -of -way of
(road) 11650 GOLDEN MIST in Brazos County, Texas as follows:
The location or description of the proposed installation is more fully shown by 3
copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that he, or his designated inspector, may
inspect the actual installation.
2. All damage to the roadways and rights -of -way will be repaired to their
original condition to the satisfaction of the County Engineer.
3. Brazos County reserves the right to require Applicant to relocate or
lower any such line at no cost to Brazos County, should same
become necessary due to widening or lowering, or other alteration of
the roadway or right -of -way.
4. Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines in the right -of -way.
5. The line will be constructed and maintained on the County right -of -way in
accordance with the Utility Accommodation Policy which was adopted by the
Texas Department of Transportation on May 29, 1989.
6. The line or lines will be constructed no less than twenty -four inches (24 ")
lower than the lowest part of the drainage or bar ditch and the drainage is to
be considered at least two feet (2') below the center of the roadway
7. All sites will be barricaded during the construction period.
Construction of this line will begin on or after the -9-- day of MAY 2007

This report is made in accordance with provisions of Gov.Code 2256, The Public Funds Investment Act, which
requires quarterly reporting of investment transactions to the Commissioners' Court.
The Brazos County Investment portfolio earned an average yield of 5.2818% on the quarterly average
balance of $5,647,651.14 invested with TexPool for the period ending 03/31/2007. Investment interest
deposited during the quarter was $73,235.12. Actual ending balance for March 2007 was $5,672,168.51.
The average Earnings Credit Rate on checking account interest for the quarter ending 03/31/2007 was
5.50% netting $842,354.74 on an average depository balance of $62,154,500.32.
Investment Strategy
There are no investment opportunities currently available to Brazos County that would exceed the rate being
earned on the funds on deposit with Citibank. Additionally, the depository contract provides a rate that
adjusts as rates increase (3 -month Treasury rate + 55 basis points) which continues to produces a
competitive rate with the least amount of risk of loss of principal (110% collateralized) as well as the least
amount of maturity risk (daily liquidity).
Because of the interest rate and collateral provided by the current depository contract as well as the
protection from maturity and liquidity risks associated with other products, the Brazos County investment
strategy remains unchanged with a concentration of County funds in the Brazos County depository. Brazos
County maintains a minimal balance invested with Texpool in order to maintain an active Texpool account.
Summary of Portfolio Changes
The deposit of interest is the only portfolio change to balances at this time and the Weighted Average Maturity
of investments remains at 1 day due to the liquidity of funds invested with TexPool and on deposit at CitiBank of
Texas.
