THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
1 MAY 2007 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE BRAZOS

MAY 1, 2007
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos County Commissioners
Courtroom in the Courthouse in Bryan, Brazos County, Texas,
beginning at 9:00 a.m. on Tuesday, May 1, 2007 with the
following members of the Court present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Peters asked the Reverend Jones to give the
invocation and then Commissioner Peters led the pledge of
allegiance.
There was no citizen input /and or concerns.
The County Judge read aloud Proclamation #07 -029
designating the month of April 2007 as "National Relay for
Life" month. The Court joins with the local Chapter of the
American Cancer Society to urge all citizens to join in this
campaign to save lives, create awareness and continue the
fight against cancer. On motion by the County Judge, seconded

by Commissioner Cauley the Court moved to proclaim the month
of April, 2007 as "National Relay for Life Month" throughout
Brazos County. The County Judge then presented the signed
Proclamation to Ms. Jennifer Newsom, representing Relay for
Life who invited everyone to attend on Friday, May 4, 2007.
The Court next considered Budget Amendment #06/07 -25.1
through 25.3 that would reallocate funds for the Constable,
Precinct 3, District Clerk, and General Capital Improvement
Fund. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.
The next matter before the Court was a request from the
Sheriff's Office to move $3,265.00 from Class 1415, Position 5
to Class 1421, Position 1. This would allow the person
assuming the Training Coordinator position to do so with no
decrease in pay. The County Judge questioned if the personnel
action form was correct because it didn't seem to jive with
this request. The County Auditor determined that both were
correct. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve
the request.

The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Peters, seconded by Commissioner
Wassermann, the Court voted unanimously to approve the Claims
as submitted.

next matter
for
consideration
by the Court was a
request
submitted by
the
Metropolitan
Planning Officer,
seeking approval for out of state travel for herself. Ms.
Linda LaSut traveled to Philadelphia, Pennsylvania, to attend
the APA national Conference on April 13 through 17, 2007. On
motion by the County Judge, seconded by Commissioner Cauley,
the Court voted unanimously to grant the request from the
Metropolitan Planning Officer Attorney and approved payment of
out of state travel expense for Ms. Linda LaSut.
The Court next considered acceptance of Whitetail Run
into the Brazos County road maintenance system. Whitetail Lane
and the drainage structures are in compliance with the Brazos

County Subdivision and Development Regulations. The site is
located in Precinct 2. On motion by Commissioner Peters,
seconded by Commissioner Cauley, the Court voted unanimously
to accept Whitetail Lane and the drainage structures into the
Brazos County road maintenance system.
The next matter before the Court was consideration of a
request for variance to the Brazos County Subdivision and
Development Regulations for an existing structure in Edge
Store Addition, to encroach on the 50 foot setback requirement
and to encroach on the 20 foot public utility easement. The
site is located in Precinct 2. On motion by Commissioner
Peters, seconded by Commissioner Cauley, the Court voted
unanimously to approve the request for variance contingent
upon TxDOT approval and the variance applies only to the
building.
The next matter for consideration was approval of tax
refund applications from the following individuals and /or
companies:
a. Benjamin Knox Gallery, over payment $1,482.34
b. Yasir A. Flores & Glenda M. Escobar, over payment
$3,783.57
c. Sam's Auto Sales, over payment $42.04
d. Stephanie L. Phillips, over payment $120.00
e. John Charles and Denise Tolbert, over payment $148.13
f. CitiFinancial, Inc., over payment $70.38

On motion by Commissioner Peters, seconded by Commissioner
Wassermann, the Court voted unanimously to approve the tax
refund applications.
The next matter before the Court was consideration of a
payment authorization to The Eagle in the amount of $134.29.
The District Attorney's office did not obtain a purchase order
in advance. On motion by the County Judge, seconded by
Commissioner Peters, the Court voted unanimously to approve
the payment authorization.
The Court next considered a payment authorization to
Flowers Baking Company in the amount of $479.70. The purchase
order was closed out. On motion by Commissioner Cauley,
seconded by Commissioner Wassermann, the Court voted
unanimously to approve the payment authorization.

On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve
the minutes as submitted.
The next matter for consideration was approval for the
Purchasing Agent to advertise the following bids:
a. Bid 2007 -035, Pharmaceuticals
b. Bid 2007 -036, Gasoline and Diesel Fuel
c. RFP 2007 -037, Contractor for Brazos County
Administration Building.
d. Bid 2007 -038, Uniform Rental
e. Bid 2007 -039, Temporary Employment Service
On motion by Commissioner Peters, seconded by Commissioner
Wassermann, the Court voted unanimously to authorize the
Purchasing Agent to advertise for bids for above mentioned
services.
The Court next considered awarding Bid No. 2007 -034,
Cleaning and Sealing Joints and Cracks on County Roadways.
Becky Stephens, Assistant Purchasing Agent, recommended
acceptance of the bid submitted by SCR Construction Company.
On motion by Commissioner Wassermann, seconded by Commissioner
Peters, the Court voted unanimously to accept the
recommendation of the Assistant Purchasing Agent and award the
contract to SCR Construction Company. A copy of the bid
tabulation is attached.
The next matter before the Court was consideration of
requisition 00013750 in the amount of $3,612.00 to Pitney

Bowes for the purchase of an upgrade to the postage machine to

Commissioner Peters, seconded by Commissioner Cauley, the
Court voted unanimously to approve the requisition.
The Court next considered requisition 00013767 to Tennant

The next matter before the Court was consideration of a

$41,788.71 for the purchase of furniture for the Exposition
Center. On motion by the County Judge, seconded by
Commissioner Peters, the Court voted unanimously to approve
the requisition.
The Court next considered requisition 00013770 in the
amount of $1,384.340 to Palmer Snyder for portable folding
bars and bar covers for the Exposition Center. On motion by
Commissioner Peters, seconded by Commissioner Mallard, the
Court voted unanimously to approve the requisition.

a) The final set of plans for the Administration
Building is in her office. She will need the
plans approved by every department.

a) Asked the Jail Administrator about the Jail
population. Mr. Dicky responded that it was
at 568 last night. They had so many women there
that they had to release five (5) because of
classification.

RE: Variance Request
Dear Sirs,
On behalf of our client, Teresa Bordeau, we have submitted a Preliminary Plat of a 1.889
acre tract in the Thomas W. Blakey Survey, A -6, located at the northeast corner of FM 974 and
Edge Cut Off Road. There is an existing wood frame building that was once used as a general
store, and it is the wish of our client to restore the building to its former use.
The building sits within 4 feet of the existing right -of -way of FM 974. We would like to
request a variance to encroach on the 50' setback line required by County Subdivision
regulations when platting a parcel of land, along with a variance to encroach on the 20' public
utility easement required under the Subdivision regulations.
Due to the age and condition of the building, it is our client's belief that the historical
value should be considered when reviewing this request. She understands that any future
development of the property must meet current County standards with regard to the Subdivision
regulations. It is also understood that should the building become unusable for the purpose of a
store, the building will have to be relocated or removed from the premises to meet current
standards.

consideration.
