20. Request from Jail Administration to reclassify Job Classification 1503 — Lieutenant
from pay group 23 to pay group 25.
21. Request from Jail Administration for the following position reclassification:
from: position 1512 -12 Transport Deputy Group 16 Step 3
to: position 1505 -13 Sergeant — Jail Group 20 Step 2
22. Request from the Community Supervision and Corrections Department to utilize
Courthouse annex space vacated by the Information Technology Department pending
the completion of new office space.
23. Request from Verizon Communications to construct buried cable installations in the
right of way of Stewart's Meadow beginning approximately 425 ft. north of Old Jones
Road and extending a distance of 813 ft.; cable will be placed 2 ft. off the road surface
at a minimum depth of 42 inches. Site is located in Precinct 4.
24. Request from Wickson Creek Special Utility District to construct a road bore for water
line installations in the right of way of Wallis Road approximately 1500 ft. from iuts
intersection with State Highway 21. Site is located Precinct 2.
25. Final plat of Creek Meadows Section IA and IB, 78.88 acres, Samuel Davidson
survey, A -13 and Jesse Bledsoe survey, A -71 (ETJ City of College Station), Brazos
County, Texas. Site is located in Precinct 1.
26. Final plat of Indian Lakes Phase 1, lots 8 -R Block 9 and H.O.A. Lot I -R Block 10,
being an amended plat of the resubdivision of Indian Lakes Phase 1. lot 8 block 9 and
H.O.A. 10, 11.747 acres, J. M. Barrera survey, A -69, (ETJ City of College Station),
Brazos County, Texas. Site is located in Precinct 1.
27. Payment authorizations (2) in the amounts of $105.96 and $190.31 to Wilton's Office
Works from the Justice of the Peace 2.1's office for office supplies. The amounts
exceeded the amount remaining on the blanket purchase order.
28. Payment authorization in the amount of $1,521.33 for services rendered to the Brazos
County Bail Bond Board by Tina Snelling of Sheiness, Scott, Grossman & Cohn, LLP.

COMMISSIONERS' COURT
REGULAR MEETING
APRIL 10, 2007
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos County Commissioners
Courtroom in the Courthouse in Bryan, Brazos County, Texas,
beginning at 9:00 a.m. on Tuesday, April 10, 2007 with the
following members of the Court present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk, Absent.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Cauley gave the invocation and led the
pledge of allegiance.
There was no citizen input /and or concerns.
The Court next considered Budget Amendment #06/07 -23.1
through 23.6 that would reallocate funds for the Sheriff's
Office, County Attorney's Office and Jail Administration;
increase the Road and Bridge Department Contingency amount,
adjusted budget for LEOSE Accounts in Constables offices,
County Attorney, District Attorney and Sheriff's office; and
transfer funds from Contingency to the 85th District Court. On

motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the budget
amendment as submitted, a copy of which is attached hereto.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Peters, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Peters, seconded by Commissioner
Wassermann, the Court voted unanimously to approve the Claims
as submitted.
The next matter before the Court was consideration of the
cancellation of the regular session of Commissioners Court for
April 17, 2007. This is necessitated due to there not being a
quorum available on that date. On motion by the County Judge,
seconded by Commissioner Cauley, the Court voted unanimously
to cancel the Commissioners Court meeting for April 17, 2007.
The next matter before the Court was consideration of
Resolution 07 -007 recognizing the need for interagency
communication interoperability and cooperation, and Brazos

County's willingness to participate in the Texas Radio
Coalition for the purpose of planning and developing a
statewide wireless interoperable communication system. On
motion by Commissioner Cauley, seconded by Commissioner
Mallard, the Court voted unanimously to authorize the County
Judge to bring back to the Brazos County Commissioners Court
the planning, financial, and other information necessary for
the Brazos County Commissioners Court to make spending and
policy making decisions necessary to participate in
implementing such a system.
The Court next considered a request from the Brazos
County Bail Bond Board for permission to retain counsel to
represent them in a pending legal matter. On motion by
Commissioner Peters, seconded by Commissioner Cauley, the
Court voted unanimously to approve the request to retain Ms.
Tina Snelling of Sheiness, Scott, Grossman and Cohn LLP to
represent the County in Cause Number 07- 000588- CV -85.
The next matter for consideration by the Court was a
request submitted by the 361st District Judge Steve Smith
seeking approval for out of state travel for himself. Judge
Smith would be traveling to Reno, Nevada to attend a
Comprehensive Search and Seizure course at the National
Judicial College on May 21 -24, 2007. On motion by Commissioner

Cauley, seconded by Commissioner Mallard, the Court voted
unanimously to grant the request from the District Judge and
approved payment of out of state travel expense for Judge
Smith.
The next matter for consideration was approval of tax
refund applications from the following individuals and /or
companies:
a) Carol Jean Bomnskie, over payment $762.68
b) Rene & Sonia Bustamante, over payment $8.01
c) Jonna R. Epps, over payment $208.33
d) Mark S. & Stacy Lynn Golden, over payment $18.00

On motion by Commissioner Peters, seconded by Commissioner
Mallard, the Court voted unanimously to approve the tax refund
applications.
The next matter before the Court was consideration of
Change Order #07001432 -3 in the amount of $5,765.00 to
Hurricane Fence Company for an additional gate and labor to
move the entrance back fifty feet at the Exposition Center
Complex. On motion by Commissioner Peters, seconded by

Commissioner Wassermann, the Court voted unanimously to
approve Change Order #07001432 -3. A copy is attached.
The Court next considered requisition 00013529 to Briggs
Equipment, in the amount of $9.311.00 for the purchase of a
Genie GS -1530 Self propelled Scissor Lift for the Exposition
Center. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve
the requisition.
The next matter before the Court was consideration of
requisition 00013535 to Hogan's trucks Unlimited in the amount
of $115,763.74 for the purchase of two (2) 2008 International,
Model 4300 6 -8 yard Dump Trucks as per Bid 2007 -031. On
motion by Commissioner Wassermann, seconded by Commissioner
Cauley, the Court voted unanimously to approve the
requisition.
The Court next considered requisition 00013536 to Powers
Industries LTD Inc., in the amount of $10,400.00 for the
purchase of a Portable Yard Ramp for the Exposition Center.
On motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to approve the
requisition.
The next matter before the Court was consideration of
requisition 00013537 to Mapp Caster & Supply Inc., in the

amount of $11,130.00 for the purchase of fourteen (14) 2 -yard
Hoppers for the Exposition Center. On motion by Commissioner
Cauley, seconded by Commissioner Peters, the Court voted
unanimously to approve the requisition.
The Court proceeded to consider Amendment No. 5 to the
contract with Hunt Construction for Construction Manager
Services, adding all labor, equipment and other items
necessary to furnish and install components required for the
IT portion of work on the Sheriff's Administration Building.
The Amendment is in the amount of $109,512.00; $104,044.00 was
taken out of the IT budget and $5,468.00 was taken out of the
Owner Contingency line item. This makes the Guaranteed Maximum
Price for the work at $24,451,117.00 for the Exposition Center
and the Sheriff's Administration
Building.

Court voted unanimously to approve Amendment No. 5. A copy is
attached.
The next matter before the Court was consideration of
requisition 00013497 to Charles R. Bell, Jr, in the amount of
$2,934.00 to treat and remove black algae from the I.T.
building. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve the
requisition.

The Court next considered authorizing acceptance of
property from the Sheriff's Department. There are fourteen
(14) television sets that were not reclaimed by former
inmates. On motion by Commissioner Wassermann, seconded by
Commissioner Peters, the Court voted unanimously to accept the
property, and offer it for sale at public auction.
The next matter before the Court was consideration of
requisition 00013432 to KC Fitzgerald Authorized Dealer Snap
On Tools in the amount of $6,680.00 to purchase a
truck /automotive wheel balancing machine for the Road and
Bridge Department. On motion by Commissioner Wassermann,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the requisition.
The Court next considered a request from the Jail
Administrator, Wayne Dicky, for permission to reclassify the
position 1503 - Lieutenant from Pay Group 23 to Pay Group 25.
The position will be funded from unexpended funds for
positions 1518 -01 and 1518 -02. On motion by Commissioner
Cauley, seconded by Commissioner Peters, the Court voted
unanimously to approve the request.
The next matter before the Court was a request from the
Jail Administrator, Wayne Dicky, for permission to reclassify
position 1512 -12 - Transport Deputy Group 16 Step 3 to

Position 1505 -13 Sergeant - Jail Group 20 Step 2. The
position will be funded from Position 1518 -01. Position 1518-
01 will then remain vacant for the remainder of this fiscal
year and then be eliminated in the next budget cycle. On
motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to approve the request.
The next matter before the Court was a request from the
Community Supervision and Corrections Department for
permission to utilize Courthouse Annex space vacated by the
Information Technology Department. On motion by Commissioner
Cauley, seconded by Commissioner Mallard, the Court voted
unanimously to approve the request.
The Court next considered the request from Verizon to

Engineer stated that all appeared to be in order and
recommended approval. On motion by Commissioner Peters,
seconded by Commissioner Wassermann, the Court voted
unanimously to approve the request from Wickson Creek Special
Utility District and authorized the installation. A copy of
the request is attached hereto.
The Court next considered approval of the Final Plat of
Creek Meadows Subdivision Section lA and Section 1B 78.88
Acres in Precinct 1. Richard Vance, County Engineer, stated
that he had reviewed the plat and all appeared to be in order.
On motion by Commissioner Wassermann, seconded by Commissioner
Peters, the Court voted unanimously to approve the final plat

submitted.
The Court next considered approval of the Final Plat of

a) He visited with Don Plitt in reference to
OSF situations. Each home site that has a
septic system has to be checked each year.
The Health Department is feeling
overwhelmed. He has some concerns and would
like to have a workshop to discuss this.
b) He would like to discuss the parking garage
with John Happ.
County Judge
a) He received an E -Mail from Donald Lee about
the 2007 tobacco distribution of 15 percent
more than last year. There is a total of
$82.7 million approved for distribution.
b) TAC 2007 County Management Institute will
be held in Austin on May 2 through 4, 2007.
c) The Extension Office invites everyone to
attend the Brazos Area Hay Producers
Association meeting on Friday, April 13,
2007 at 10:30 a.m. at Circle X Land &
Cattle Company.
d) There will be a Brazos Valley Council of
Governments Board of Directors meeting on
Wednesday at 11:00 a.m. Commissioner Cauley
will attend for the County Judge.

a) Thanked the Road and Bridge Department for
their help. He then invited everyone to
attend a reception after Court as a county
employee appreciation.

the last weekend in April.

RESOLUTION
WHEREAS, individual governmental entities within the State of Texas operate various public safety and
public service wireless communication systems; and
WHEREAS, the governmental entities recognize the need for interagency communication,
interoperability, and cooperation; and
WHEREAS, the governmental entities using these systems are becoming more interdependent, and
would benefit from statewide integration of these systems and shared information flow; and
WHEREAS, the Brazos County Commissioners Court believes that it is time to participate with other
governmental entities in consideration of, and planning for, a statewide wireless interoperable
communication system composed of existing or future local and regional radio systems that are under
local control; and
WHEREAS, a cooperative effort between these government entities is necessary to facilitate financing,
planning, and development of a statewide wireless interoperable communication system.
NOW, THEREFORE, BE IT RESOLVED by the Brazos County Commissioners Court that:
1. the Brazos County Commissioners Court is interested in cooperating with other participating
governments to come together as the Texas Radio Coalition for the purpose of planning and
developing a statewide wireless interoperable communication system composed of existing or
future local and regional systems under local control, and will pursue this goal with other
participating governments;
2. the County Judge is hereby authorized to assign appropriate staff to attend Texas Radio Coalition
and other meetings to develop a plan for a statewide wireless interoperable communication system;
3. the County Judge is hereby authorized to identify funding from whatever source of funds that may
be available for such a cooperative intergovernmental project, including federal, state, local, or
private grant funds; and
4. the County Judge is hereby authorized to bring back to the Brazos County Commissioners Court
the planning, financial, and other information necessary for the Brazos County Commissioners
Court to make spending and policy- making decisions necessary to participate in implementing
such a system.

The Steering Committee for the Sheriff's Administration Building requested Hunt
Construction to provide all labor, equipment and other items necessary to furnish and
install components required for the IT portion of work for the sum of $109,512.00. This
cost is based on specifications, diagrams and parts list provided by Brazos County IT
Department during an onsite meeting February 26, 2007 and subsequent discussions.
To accomplish this, $104,044.00 was taken out of the attached budget's IT line item and put
in Hunt's line item, the remaining balance of $5,468.00 was taken out of the Owner
Contingency line item from Hunt's budget. No new money was added to the Sheriff's
Adm. Budget.
Amendment No. 5 is for the addition of $104,044.00 to be added to the total contract of
Hunt Construction, which makes the Guaranteed Maximum Price for the work at
$24,451,117.00 for the Exposition Center and Sheriffs Administration Building.

TO AGREEMENT BETWEEN OWNER AND CONSTRUCTION MANAGER
Pursuant to Section 2.2 of the Agreement, dated October 31, 2005 between Brazos
County, Texas (Owner) and Hunt Construction Group, Inc. (the Construction Manager),
for Brazos County (the Project), the Owner and Construction Manager establish a
Guaranteed Maximum Price and Contract Time for the Work as set forth below.
ARTICLE I GUARANTEED MAXIMUM PRICE
The Construction Manager's Guaranteed Maximum Price for the Work, including the
estimated Cost of the Work as defined in Article 6 and the Construction Manager's Fee as

The Contractor hereby Warrants and Guarantees to the property owner that if 50% of

Tidy Roof is a safe biodegradable algaecide product approved by the Environmental
Protection Agency. Tidy Roof is not harmU to trees or shrubbery when properly
applied.
Sealed surfaces will allow Algae to grow under the Sealer. Therefore we cannot treat
this Algae until the Sealer is removed. This treatment leaves a residue on glass that
prevents Algae from growing. However, the glass may appear hazy or streaky until
cleaned with a glass cleaner. We will not clean the glass as a professional glass cleaner
would. When we use manlifts to access the building the tires may leave imprints in the
grass or rubber marks on the sidewalks and driveways.

REQUIREMENTS:
1) No work will be permitted between front slope and /or back slope.
2) All installation(s) shall be constructed in designated utility easements, if applicable. If no utility
easement exists, the installation(s) shall be 1) within 3 -5' of and parallel to the right -of -way line and /or
2) in the case of a road bore, perpendicular to the right -of -way line.
3) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's responsibility to
do so and to remove all cleared brush, trees etc. from county right -of -way.
4) Ditch line shall be compacted to 90% standard density ASTM -Test Method No. D -698; test shall be
conducted by an independent geotechnical testing firm; copies of all test results shall be furnished to
the office of the Brazos County Engineer.
5) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic Control
Devices for Streets and Highways, published by the Texas Department of Transportation, and all other
State and Federal laws governing utility construction.

a communication line within the right -of -way of a County Road in Brazos County,

understood that the tender of this notice by the Verizon Southwest Incorporated
does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or
right now granted by law or may be granted in the future and any provision or

Formal notice is hereby given that (applicant) Wickson Creek Special [Utility District
proposes to place a (type) waterline within_ across g_ the right -of -way of
(road) WALLIS ROAD in Brazos County, Texas as follows:
The location or description of the proposed installation is more fully shown by 3
copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 12 hours prior to the beginning
of construction in order that he, or his designated inspector, may
inspect the actual installation.
2. All damage to the roadways and rights -of -way will be repaired to their
original condition to the satisfaction of the County Engineer.
3. Brazos County reserves the right to require Applicant to relocate or
lower any such line at no cost to Brazos County, should same
become necessary due to widening or lowering, or other alteration of
the roadway or right -of -way.
4. Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines in the right -of -way.
5. The line will be constructed and maintained on the County right -of -way in
accordance with the Utility Accommodation Policy which was adopted by the
Texas Department of Transportation on May 29, 1989,
6. The line or lines will be constructed no less than twenty -four inches (24 ")
lower than the lowest part of the drainage or bar ditch and the drainage is to
be considered at least two feet (2') below the center of the roadway
7. All sites will be barricaded during the construction period.
Construction of this line will begin on or after the 21 day of MARCH 2Og7_

DATE OF COURT MEETING: April 10, 2007
ITEM: Request from Wickson Creek Special Utility District to construct a road bore —
water line installations in the right of way of Wallis Road approximately 1,500 ft. from its
intersection with State Highway 21. Site is located in precinct 2.
SOURCE OF FUNDS: N/A
REQUIREMENTS:
1. No work will be permitted between front slope and /or back slope.
2. All installation(s) shall be constructed in designated utility easements, if applicable. If no
utility easement exists, the installation(s) shall be 1) within 3 -5' of and parallel to the right -of-
way line and/or 2) in the case of a road bore, perpendicular to the right -of -way line.
3. If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county right -of -way.
4. Ditch line shall be compacted to 90% standard density ASTM -Test Method No. D -698; test
shall be conducted by an independent geotechnical testing firm; copies of all test results shall
be furnished to the office of the Brazos County Engineer.
5. Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of
Transportation, and all other State and Federal laws governing utility construction.
