County Policy on reimbursement from employees' pay after termination. 10. Out of state travel for Commissioner Mallard to attend a legislative trip with the Chamber of Commerce in Washington, D.C. Dates of travel are 7 -10 May 2007. 11. Amendment to the Interlocal Agreement with the Texas Department of Transportation approved on 12/19/2006 for the purpose of supplying armed peace officers and related supplies and services. Amendment addresses overtime charges. 12. Request from the Precinct 2 Constable's Office for funds from the County Records Management Fund to purchase five file cabinets at approximately $495 each for an estimated total of $2475.00. 13. Request from the Precinct 2 Constable's Office for permission to dispose of four body armors that are all over five years old. 14. Award of Bid 2007 -025, Asphalt, Oil and Emulsion, as follows based on best price: Primary Vendor, all products except CRS -2: SemMaterials, LP CRS -2: Cleveland Asphalt. Secondary Vendor, AE Prime: Ergon Asphalt SS -1 & HFRS -2: Cleveland Asphalt CRS -2 & HFRS -2P: Martin Asphalt 15. Requisition #00013431 to Schultz Industries, Inc. for portable bleachers for the Expo Center Pavilion. 16. Permission to sell surplus emergency vehicle equipment to the Precinct 2 Volunteer Fire Department without offering at public auction, as per Chapter 23.152, subsection (1) of the Local Government Code. 17. Award of the Annual Contract for scale maintenance to Houston Fairbanks Scales for the truck scale located at the Road & Bridge Department, based on best price. Contract term is 4/03/07 through 4/02/08, with an option for renewal. 18. Renewal of the Maintenance Agreement for the Ricoh copier in the Road & Bridge Department. 19. Award of Bid 2007 -031, Purchase of two 6 -8 yard Dump Trucks, to Hogan's Trucks, based on best price. 20. Acceptance of the Open Range addition into the Brazos County road maintenance system; the road (Open Range Court) and drainage structures are in compliance with the Brazos County Subdivision and Development Regulations. Long and Lakewood Drive for the purpose of replacing a roadway culvert to drain water from the road for the health, safety and welfare of the general public. Site is located in Precinct 4. 22. Payment authorization to the LaSalle Hotel for lodging for three witnesses whose dates to testify were changed. A purchase order was requested, but could not be used when their reservations were changed to a different location. 23. Convene into Executive Session pursuant to §551.071 of the Texas Government Code to consult with an attorney regarding pending or contemplated litigation. 24. Convene into Executive Session pursuant to §551.072 of the Texas Government Code to discuss real property. 25. Consider and possible action on the Executive Sessions. 26. Acknowledgement of the Monthly Reports submitted in March 2007. These reports are available for review in the County Judge's Office. 27. Announcement of interest items and possible future agenda topics. 28. Call for citizen input and/or concerns. 29. Agency / Board / Committee reports by Court members. 30. VOL PAGE COMMISSIONERS' COURT REGULAR MEETING APRIL 3, 2007 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, April 3, 2007 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1, Absent; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Peters gave the invocation and led the pledge of allegiance. Under citizen input /and or concerns the following spoke: Maggie Charleton, President of the Democratic Party a) Ms. Charleton voiced concerns over the following issues: 1. Poling Places - She has some concerns about voting in public schools. Anyone can walk into a school on this day. Also it is quite a disruption for the students. 2. Paper Ballots - Many people don't understand computer voting and do not Vol q3 Page q4 Commissioners Court meeting April 3, 2007 check that they have voted the way they wanted. She would like to see a voting machine paper trail so that votes can be verified. Duane Peters, Commissioner, Precinct 2 a) Introduced Jennifer Salazar as the new Human Resources Department Director County Judge a) Announced that the Commissioners Court meeting scheduled for April 17 will be cancelled because of the lack of a quorum. 11 The next matter before the Court was a request from the Precinct 3 Constable for permission to move $960 from the Deputy position (1610) to the Clerk III position (1606). On motion by Commissioner Mallard, seconded by Commissioner Cauley, the Court voted unanimously to approve the request. The Court next considered Budget Amendment #06/07 -22.1 through 22.6 that would reallocate funds for Road and Bridge Department, Human Resources Department, Constable, Precinct 3, and Juvenile Services - TJPC -G- Program Sanctions; and transfer funds from Contingency to the Commissioners Office. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The next matter before the Court was a request from the County Attorney's Office to reclassify a regular part -time Vol q3 Page 95 Commissioners Court meeting April 3, 2007 3 Secretary position to a temporary Secretary position with the option of changing the temporary position back to a regular part -time position with benefits at a later date. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the request. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the changes as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 7029746 through 7029932 On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as submitted. The next matter before the Court was consideration of the 2006 Annual Review and Status Report for the Research Valley Partnership. Todd McDaniel, President of the Research Valley Partnership introduced Bob Malaise, Vice President to give the annual report. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to accept the report. A copy is attached. On motion by Commissioner Mallard, seconded by Commissioner Cauley, the Court voted unanimously to approve the proposed policy. A copy is attached. The next matter for consideration by the Court was a request submitted by Commissioner Kenny Mallard seeking approval for out of state travel for himself to attend a legislative trip with the Chamber of Commerce in Washington, D.C. during the week of May 7 through the 10, 2007. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to grant the request from Commissioner Mallard and approved payment of out of state travel expense for Commissioner Kenny Mallard. The next matter before the Court was to consider an Amendment to the Interlocal Agreement with the Texas Department of Transportation ( TxDOT), approved on December 19, 2006 for the purpose of providing uniforms, armed peace officers and equipment for law enforcement, general surveillance and traffic control. The Amendment to the Interlocal Agreement between TXDOT and Brazos County covers overtime charges of peace officers by reducing the number of officers working, increasing the number of days to be worked and adjusting the pay rates to Vol q3 Page 97 Commissioners Court meeting April 3, 2007 9 reflect overtime wages. The total number of hours to be worked has been increased to 50 weeks instead of 48 weeks, the rates for each officer has been increased to cover overtime wages, and the number of officers has been reduced from 2 to 1. The maximum amount for the contract is changed from $71,505 to $70,439. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the Amendment to the Interlocal Agreement with the Texas Department of Transportation. A copy of the Order is attached hereto. The next matter before the Court was a request from Constable, Precinct 2, Donald Lampo, for funds from the County Records Management Fund for the purchase of five (5) file cabinets for his office. Cost for the file cabinets is estimated at $495.00 each. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the request. The Court next considered a request from Constable, Precinct 2, Donald Lampo for permission to dispose of four (4) pieces of body armor. The equipment is over five (5) years old and due to the sensitivity of the equipment, it is not suitable for placement in the auction. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the request. Becky Stephens, Assistant Purchasing Agent, made the following recommendations: Primary Vendor - All Products except CRS -2- SemMaterials, LP Primary Vendor - CRS -2- Cleveland Asphalt Secondary Vendor -AE Prime -Ergon Asphalt Secondary Vendor -SS -1 & HFRS- 2- Cleveland Asphalt Secondary Vendor -CRS -2 & HFRS -2P- Martin Asphalt On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendation of the Assistant Purchasing Agent and award the contract as noted above. A copy of the bid tabulation is attached. The next matter before the Court was consideration of a requisition #00013431 to Schultz Industries, Inc. in the amount of $17,300.00 to purchase equipment for the Exposition Center. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the requisition. The Court next considered the sale of vehicle emergency equipment to Precinct 2 Volunteer Fire Department. Authority to sell this property without offering at public auction is in Local Government Code Chapter 263.152, Subsection (1). On Vol 93 Page I q Commissioners Court meeting April 3, 2007 7 motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the sale. The Court next considered the Truck Scale Maintenance Contract. Marcia Mann, Senior Buyer, recommended awarding the contract to Houston Fairbanks Scales. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendation of the Senior Buyer and award the contract to Houston Fairbanks Scales. A copy of the bid tabulation is attached. The next matter before the Court was consideration of the renewal of the Maintenance Agreement for the Ricoh copier in the Road and Bridge Department. The contract period begins October 1, 2006 through May 31, 2010. On motion by Commissioner Cauley, seconded by Commissioner Mallard, the Court voted unanimously to approve the renewal of the Maintenance Agreement for the Ricoh copier. A copy is attached. The Court next considered awarding Bid No. 2007 -031, Purchase of Dump Trucks. Pat Howard, Purchasing Agent, recommended acceptance of the bid submitted by Hogan's Trucks. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to accept the Vol 9 3 Page W Commissioners Court meeting April 3, 2007 g recommendation of the Purchasing Agent and award the contract to Hogan's Trucks. A copy of the bid tabulation is attached. The next matter before the Court was consideration of acceptance of Open Range Addition into the Brazos County road maintenance system. The road and the drainage structures are in compliance with the Brazos County Subdivision and Development Regulations. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to accept Open Range Road and the drainage structures into the Brazos County road maintenance system. The Court next considered authorizing work outside of county rights -of -way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Ellie Rust on J. C. Long and Lakewood Drive in Precinct 4 to replace a roadway culvert to drain water from the road. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to authorize the work. The next matter before the Court was consideration of a payment authorization in the amount of $650.88 to the LaSalle Hotel for lodging for witnesses. No purchase order was done for the LaSalle. On motion by Commissioner Peters, seconded Vol gt3 Page /b/ Commissioners Court meeting April 3, 2007 9 by Commissioner Cauley, the Court voted unanimously to approve the payment authorization At 9:33 a.m. the County Judge announced the meeting closed to the public so that the Court could meet in Closed Executive Session to discuss pending litigation as allowed under Section 551.071 of the Texas Government Code. Those attending the session were Candy Gallego, Executive Assistant, Bill Ballard, Legal Counsel, Ruth McLeod, Administrative Assistant and Linda Muegge, Right -of -way Agent. The County Judge then proceeded to discuss the purchase of real property pursuant to Section 551.072 of the Texas Government Code. At 10:07 a.m. the County Judge announced the meeting open to the public and that no action would be taken on the Closed Executive Sessions. At the time of notification from the employee, the employee will be required to complete a form to stop all Health and/or Dental insurance and optional deductions. Notification of the last day must be done before the first payroll of the following month. If an employee or Elected Official/Department Head fails to contact the Human Resource Department in a timely manner and the deductions occur, the Elected Official or Department Head on behalf of the employee, or the employee will be required to request reimbursement of the deduction from Commissioners Court. If the Commissioners Court approved the reimbursement and the deductions have been pre - taxed, the full amount deducted will not be reimbursed. The reimbursement will be reduced by the taxes owed on the pre -taxed deduction and the employee's taxes plus the County's taxes will be submitted to the IRS.
