WORKSHOP SESSION

WORKSHOP SESSION ON MONDAY 19 MARCH 2007 AT 10:00 A.M. IN THE
COMMISSIONERS COURTROOM OF THE BRAZOS COUNTY COURTHOUSE, 300
E. 26TH STREET, SUITE 115, BRYAN, TEXAS.

Indigent Screening for Court Appointed Attorneys
D -MED has been successfully serving public and private organizations since 1987 by providing services
that reduce costs, increase operational efficiency and recover outstanding funds. Using the experience
gained from evaluating eligibility for charity care in hospitals, D -MED now offers automated capabilities
that support indigent identification for programs such as the attorney appointment process.
National Association of Counties (NACo) Partnership
D -MED has entered into a partnership with NACo to provide automated indigent screening services to
counties throughout the United States. This indigent screening capability plays a significant role in
providing accurate, objective and consistent application of business rules when evaluating a defendant's
eligibility to receive a court appointed attorney. This capability can also play an important role in
supporting other county processes when evaluation of an individual's financial status is needed.
Dallas County, Texas awarded the nationally bid cost recovery/cost containment RFP Number 2005 -131-
1713 to D -MED for delivery of these services. This publicly solicited contract by Dallas County makes it
easy for counties to use this service, because most counties in the United States have the ability to
piggyback on a publicly solicited contract by a lead public agency through the use of an Interlocal
Agreement. Counties do not need to bid for these services, which saves time and money.
Real issues
Many counties pay a significant amount of money to provide court appointed attorneys for defendants
who claim to be indigent but, in fact, have the resources to pay for their own legal defense. Recurring
issues include:
• Lack of automated eligibility tools results in a manually intensive process.
• Inability to quickly validate the legitimacy of a defendant's demographic and financial data.
• The requirement to interview defendants multiple times to obtain evidence of financial need.
• Inability to authenticate if a defendant is indigent and unable to pay for an attorney.
• Inability to identify defendants who are able to pay for all or a portion of their own legal defense.
• Inability to identify resources that can be used for payment.
• Inability to set up and monitor payment terms for defendants who have the ability to pay.
Real Solutions
Counties can realize immediate and ongoing savings by using an automated system that provides
verifiable evidence of a defendant's demographics and financial status. Using D -MED's proven system
to perform this function offers numerous features and benefits that include:
• A pre - defined interview process that speeds data gathering and entry.
• Immediate availability and validation of demographic and financial data.
• Verification of eligibility for a court appointed attorney, based on consistent enforcement of
business rules.
• Identification of defendants who are indigent and unable to pay for an attorney.
• Identification of defendants who have the resources to pay for all or a portion of their own legal
defense.
• Identification of resources that can be used for payment.
• Preparation of a fully completed affidavit of indigence ready to be printed and signed.
