Canvas of the ballots received and tallied by the County Clerk in the matter of the proposal for county improvement of roads and assessment of costs in the Hunter's Creek subdivision in accordance with Texas Transportation Code Chapter 253. 15. Order 07 -002 for improvement of the roads in the Hunter's Creek subdivision to comply with Brazos County standards for roads and the assessment of the costs of the improvement against the record owners based upon the declaration that the improvement of the roads in Hunter's Creek subdivision are necessary for the public health, safety and welfare of the residents and of the County. 16. Extension of the current contract for water treatment with Fort Bend Services until the end of the current fiscal year (9/30/07) at the same rate. 17. Payment authorization from Emergency Management in the amount of $2,005.94 to Verizon for the telephone number database used in the Emergency Notification System; an invoice was generated by Verizon prior to a purchase order being created. 25. Payment authorization from Juvenile Services in the amount of $1,179.85 to Prostar Industries, Inc. for cleaning and laundry supplies at the Juvenile Detention Center. Overlapping orders resulted in an invoice that exceeded the purchase order. 26. Convene into Executive Session pursuant to §551.087 of the Texas Government Code to discuss economic development negotiations. 27. Convene into Executive Session pursuant to §551.072 of the Texas Government Code to discuss real property. 28. Consider and possible action on the Executive Sessions. 29. Suite 114 • Bryan, Texas 77803 e Fax (979) 361 -4503 COMMISSIONERS' COURT REGULAR MEETING FEBRUARY 13, 2007 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, February 13, 2007 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Mallard gave the invocation and led the pledge of allegiance. There was no citizen input /and or concerns. The first matter before the Court was a presentation on the proposed Park Hudson Trail Park land improvements. David Storrie, Director of Special Projects with the City of Bryan gave the presentation. The next matter before the Court was approval of the Park Hudson Trail Park land improvements as a project plan expenditure within Tax Reinvestment Zone #8. The City of Vol q1 Page to � Commissioners Court meeting February 13, 2007 2 Bryan needs official approval by the Commissioners Court so that it can be funded. No additional debt is going to be issued and it is going to be paid directly out of the increment being collected from the City of Bryan, Brazos County and Bryan Independent School District. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the request subject to the project not exceeding $1.6 million dollars. The Court next considered Budget Amendment #06/07 -17.1 through 17.5 that would reallocate funds for Building Maintenance, 272nd District Court, Tax Office; transfer funds from Contingency to the General Capital Improvement Fund, Jail Division. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The next matter before the Court was to consider the change of status of employees. There were no Personnel Action Requests submitted. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted to take no action. The Court next considered the following Claims as submitted by the County Treasurer for payment: 7028039 through 7028288 Vol q( Page 6 1 Commissioners Court meeting February 13, 2007 3 On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the Claims as submitted. The next matter before the Court was a request from Justice of the Peace, Precinct 4 for the following funds from the JP Technology Fund: a. $3,950.98 from account 67203000 for minor computer hardware; b. $386.98 from account 60500000 for office equipment. Commissioner Cauley moved for approval. After some discussion, Commissioner Cauley withdrew his motion. Then on motion by the County Judge, seconded by Commissioner Peters, the Court voted unanimously to remove the item from the agenda. The Court next considered a request from Justice of the Peace, Precinct 4 for funds from the JP Technology Fund. The following amounts were requested: a. $439.00 from account #67203000 (computer hardware) to purchase a computer b. $446.00 from account 6767000 (printers) to purchase a color laser printer C. $1167.00 from account #60500000 (Office equipment) to purchase four monitors and a color inkjet printer. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the request. The County Judge read aloud Proclamation #07 -023 designating the 8 week period of February 17 through April 14, Vol q I Page V Commissioners Court meeting February 13, 2007 4 2007 as "Walk Across Texas ". On motion by Commissioner Peters, seconded by Commissioners Wassermann, Mallard, Cauley and the County Judge, the Court moved to proclaim the 8 week period of February 17 through April 14, 2007 as "Walk Across Texas ". The Court urges all citizens to participate in the eight weeks of fun and fitness and increase their physical activity level. The County Judge then presented the signed Proclamation to Dr. Alma Fonseca, representing Extension Service. Dr. Fonseca invited everyone to Wolf Pen Trails on Saturday, February 10, 2007 at 10:00 a.m. to kick off the event. The next matter before the Court was consideration of the annual funding addendum for fiscal year 2007 with the City of Bryan for the Brazos County Public Health District. The City of Bryan agrees to contribute $10,000 for the fiscal year 2007 commencing on October 1, 2006 and ending on September 30, 2007. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the funding addendum. A copy is attached. The Court next considered the reclassification of the following Exposition Center positions: Vol Operations Manager, Class 0826, Position 1 From: Group 22, Step 14 To: Group 26, Step 6 Page 0 Commissioners Court meeting February 13, 2007 5 Building & Grounds Supervisor /Arena Events Manager, Class 0830, Position 1 From: Group 21, Step 2 To: Group 24, Step 4 On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the reclassifications. The next matter before the Court was a request from Precinct 1 Justice of the Peace, for a temporary Clerk I position for the period of March through September 2007. The cost to the County would be $14,053.24 based on 151-� pay periods. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to approve the request. Half of the funding will come from the County Judge's temporary position and the other half will come from Contingency funds. The Court proceeded to canvass the results of the ballots received and tallied by the County Clerk in the matter of the proposal for County improvement of roads and assessment of costs in the Hunter's Creek Subdivision in accordance with the Texas Transportation Code Chapter 253. There were 35 votes in favor of the road improvements and assessment of costs and no votes opposed. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to accept as Vol q i Page '1 0 Commissioners Court meeting February 13, 2007 6 true the totals as tabulated by the County Clerk. The next matter before the Court was to consider adopting Order #07 -002 for County improvement of roads and assessment of costs in the Hunter's Creek Subdivision as allowed by the Texas Transportation Code Chapter 253. The notice of proposed intention was published at least twice in the Eagle, a Public Hearing was held to consider the possible improvements and $500 assessment, ballots were mailed by certified mail to the property owners and the returned voted ballots were tabulated by the County Clerk. On motion by Commissioner Mallard, seconded by Commissioner Peters, the Court voted unanimously to adopt the Order for the improvement of the roads in the Hunter's Creek Subdivision and the assessment of no more than $500 against each property in the subdivision. A copy of the Order is attached hereto. The Court next considered the renewal of the annual contract with Fort Bend Services for water treatment. If approved, the term of the contract will be extended until the end of the current fiscal year being September 30, 2007 with no increase in rates. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to approve the renewal of the annual contract with Fort Bend Services. The Court next considered awarding Bid No. 2007 -015, Vol q I Page 1 / Commissioners Court meeting February 13, 2007 7 Decking Timber. Becky Stephens, Assistant Purchasing Agent, recommended acceptance of the bid submitted by Kennedy Saw Mills. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to accept the recommendation of the Assistant Purchasing Agent and award the contract to Kennedy Saw Mills. A copy of the bid tabulation is attached. The Court next considered awarding Bid No. 2007 -017, Material Hauling. Since no bids were received, Becky Stephens, Assistant Purchasing Agent, recommended "No Award" for this bid and suggested receiving quotes and process an annual contract for these services instead of going through the bid process. The Court next considered awarding Bid No. 2007 -018, Shop Supplies, and Auto Parts. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to accept the recommendation of the Assistant Purchasing Agent and award the contract to Austin White Lime. The next matter before the Court was the selection of individuals to serve on a committee charged with the selection of the Architect /Engineering Services for the addition to the Detention Center in Brazos County. On motion by Commissioner Vol q I Page 13 Commissioners Court meeting February 13, 2007 9 Cauley, seconded by Commissioner Wassermann, the Court voted unanimously to appoint the following individuals to serve on the committee: Wayne Dicky Kenny Mallar Duane Peters Bill Ballard Gary Arnold Pat Howard - - Jail Administrator i - Commissioner Precinct 3 Commissioner Precinct 2 County Attorney's Office - Road and Bridge Department Purchasing Agent (non voting member) On motion by Commissioner Cauley, seconded by Commissioner Wassermann, the Court voted unanimously to appoint the previously named individuals to serve on the committee. The Court next considered authorizing work outside of county rights -of -way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the BETCO facility property on Harvey Mitchell Parkway to load and haul donated sand using Brazos County equipment and employees. The sand will be used on County projects. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to authorize the work. The next matter before the Court was consideration of a payment authorization from Emergency Management in the amount of $2005.94 to Verizon for the telephone number database used in the Emergency Notification System; an invoice was generated by Verizon prior to a purchase order being created. On motion by the County Judge, seconded by Commissioner Peters, the Court voted unanimously to approve the request. At 9:47 a.m. the County Judge announced the meeting closed to the public so that the Court could meet in Closed Executive Session to discuss economic development negotiations as allowed under Section 551.087 of the Texas Government Code. Bill Ballard, Court Counsel, Ruth McLeod, Temporary Director of Human Resources, Candy Gallego, Executive Assistant, Debbie Lockledge, Administrative Assistant, Mark Carrabba, Stuart Vol ct I Page Commissioners Court meeting February 13, 2007 11 Kling, Linda Muegge, County Right -of -Way Agent, and Richard Vance, County Engineer were asked to stay for the Executive session. At 10:09 a.m. the County Judge announced the meeting open to the public and announced that no action would be taken on the Closed Executive Session. At 10:09 a.m. the County Judge announced the meeting closed to the public so that the Court could meet in Closed Executive Session to discuss the purchase of real property as allowed under Section 551.072 of the Texas Government Code. At 10:20 a.m. the County Judge announced the meeting open to the public and announced that no action would be taken on the Closed Executive Session. Under Agency /Board /Committee reports by Court members, the following spoke: Commissioner Mallard a) There will be a Housing Finance meeting at 3:00 p.m. on Thursday at the Brazos Valley Council of Governments Office. They have invited area lenders to attend the meeting and learn all about the program. County Judge a) He made a trip to Austin last week to attend a meeting on over weight trucks. They are trying to get the legislators to increase the fees and have money come back to the counties. Roads are being destroyed. b) He and the Commissioners will be in Austin later on today through Thursday to attend a conference. There being no further business to come before the Court, the meeting was adjourned. WHEREAS, The commissioners court published notice of the proposed improvement and assessment at least twice in the Bryan Eagle, a newspaper of general circulation in the county. The published notice stated the date the commissioners court would hold a public hearing to consider the proposed improvement and assessment. WHEREAS, On January 16, 2007 the Brazos County Commissioners Court met pursuant to §253.005 of the Texas Transportation Code in a Public Hearing to consider the possible improvement of roads in the Hunters Creek Subdivision and a $500 maximum assessment against each property in the subdivision. WHEREAS, On January 16, 2007, each owner of record in the Hunters Creek Subdivision, was sent a ballot, by certified mail, in order to vote on whether the Commissioners Court should order the improvement and assessment. Along with the ballot was an addressed stamped envelope for the return of the completed ballot to the Brazos County Clerk. WHEREAS, On February 13, 2007, a date not later than the 30`h day after the date of the public hearing, the County Clerk tallied the returned ballots and declared the results to the Commissioners Court. WHEREAS, the returned ballots indicated a vote of � For and QAgainst. A majority of returned ballots were in favor of the improvement and assessment. WHEREAS, the Commissioners Court may provide the time, terms and conditions of payment and default of the assessment. THEREFORE, the Brazos County Commissioners Court hereby declares that the improvement of the roads in the Hunter's Creek subdivision are necessary for the public health, safety, or welfare of the residents and of the county and the commissioners court hereby Orders the improvement of the roads to comply with Brazos County standards for roads and assesses the costs of the improvement pro rata against the record Order #07-002 X13 owners of the real property of the subdivision in the amount of $500.00.
