SESSION ON 6 FEBRUARY 2007 AT 9:00 A.M. IN THE COMMISSIONERS

9. Appointment of Sharon Maass to the Local Workforce Development Board,
representing Public Assistance. Term of appointment is 3/01/07 to 6/20/09.
10. Reappointment of the following individuals to the Brazos County Emergency Services
District #1 Fire Commissioners Board as fire commissioners, effective 1 January 2007
through 31 December 2007.
a. Lynn Elliott
b. Jim Carroll
11. Classified Line Ad contract with The Bryan- College Station Eagle. Contract term is
November 2006 through October 2007.
12. Tax Resale Deed in the amount of $1,000.00 to be paid by Louis Rodriguez, Jr. for
property located at Lot 11, Block 3, Stovall Addition, City of Bryan, Brazos County,
Texas.
13. Request from Building Maintenance for a transfer of $15,984.00 in DDEA funds for the
purchase of an Epilog Mini 24" 35 -watt laser engraver.
14. Request from Justice of the Peace, Pct. 4 for the following funds from the JP
Technology Fund (Division 24005000):
a. $3,950.98 from account #67203000 for minor computer hardware;
b. 386.98 from account #60500000 for office equipment.
15. Exemption for Milliman Consultants and Actuaries from competitive bidding:
professional services -- consulting, per Statute 262.024(a)(4).
16. Requisition 00012724 to Absolute Innovations, Inc. in the amount of $16,667.00 for the
purchase of equipment for the Exposition Center.
17. Corrections to Change Order #0002 and Change Order #0003, approved on 23 January
2007, for the new Information Technology Building.
18. Change Order #0004 in the amount of $830.00 to remove electrical to power supply for
the training room desks in the new Information Technology Building.
19. Bryan Texas Utilities' cost estimate of $53,300.79 to relocate an overhead electrical
line (at the County's request) on Old Reliance Road to accommodate a road widening
project. Site is located in Precinct 2.
20. Request for permission to enter Richard Ward's property located off North Dowling
Road for the purpose of re- working the ditch to drain water from the roadway for the
health safety and welfare of the general public. Site is located in Precinct 1.
21. Request for permission to enter Juan Pinalez's property located off North Dowling for
the purpose of re- working the ditch to drain water from the roadway for the health,
safety and welfare of the general public. Site is located in Precinct 1.

22. Request from Verizon Communications to construct a road bore and 5,423 feet of
buried cable in the right of way of Ferrill Creek Road at a minimum depth of 30 inches.
Site is located in Precinct 2.
23. Request for a variance to Brazos County Subdivision and Development Regulations for
water distribution lines and sanitary sewer collection lines in Creek Meadow
Subdivision (in ETJ /City of College Station) to be installed per Bryan/College Station
Unified Design Guidelines for Water & Sanitary Sewer. City of College Station is
currently in the annexation process of this subdivision. Site is located in Precinct 1.
24. Acceptance of a Special Warranty Deed from Carroll J. Cooper and wife Sherrell Ann
Cooper for improvements to Alexander Road located in Precinct 2.
25. Acceptance of a Special Warranty Deed from James T. Opersteny for improvements to
Alexander Road located in Precinct 2.
26. Acceptance of a Special Warranty Deed from the Paul Emola Estate for improvements
to Alexander Road located in Precinct 2.
27. Payment authorization in the amount of $775.38 from Jail Administration to Scarmardo
Produce, Inc. The invoice exceeded the amount remaining on blanket P.O. #07001500.
28. Payment authorization in the amount of $495.00 from Jail Administration to Alpine-
Pinnacle, Inc. Order was shipped as a duplicate by mistake and, therefore, had no P.O.
29. Announcement of interest items and possible future agenda topics.

COMMISSIONERS' COURT
REGULAR MEETING
FEBRUARY 6, 2007
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos County Commissioners
Courtroom in the Courthouse in Bryan, Brazos County, Texas,
beginning at 9:00 a.m. on Tuesday, February 6, 2007 with the
following members of the Court present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk, Absent.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Cauley asked the Reverend Jones to give the
invocation. Commissioner Cauley then led the pledge of
allegiance.
Under citizen input /and or concerns, the County Judge
introduced Kyle Sullivan and Lee Ann Meeker who are attending
Commissioners Court as part of a government class project.
The Court next considered Budget Amendment #06/07 -16.1
through 16.11 that would reallocate funds for the MPO, Non-
Departmental, 272nd District Court, County Court at Law #1,
Information Technology Department (IT), Constable, Precinct 4,

Magistrate, Constable, Precinct 3, and TEEX Homeland Security
Grant; and transfer funds from Contingency to General Capital
Improvement Fund, Constable, Precinct 2. Commissioner Cauley
moved to approve. Commissioner Peters seconded the motion.
After some discussion in which the County Judge noted that
budget amendment 16.10 was asking for funds from Contingency.
But he felt the funds should come out of DDEA funds.
Commissioner Mallard moved to amend the original motion asking
Constable, Precinct 3 to take funds from DDEA for this
purchase. The County Judge seconded the motion and it carried
unanimously. Commissioner Cauley and Peters then withdrew
their original motion and second. Then Commissioner Mallard
moved to approve all budget amendments with the exception of
16.10. Commissioner Peters seconded the motion and it carried
unanimously. A copy of which is attached hereto.
The next matter before the Court was a request from the
District Attorney's office for permission to create a
temporary position in the District Attorney's office and hire
a temporary file clerk using funds from one of the open legal
secretary positions in that office. On motion by Commissioner
Cauley, seconded by Commissioner Wassermann, the Court voted
unanimously to approve the request.

The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Peters, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the changes as submitted.
The next matter before the Court was consideration of a
payment authorization to Kone Elevator in the amount of
$1,361.85. This total is on four invoices from October 3,
2006 through November 8, 2006. In service calls were
determined to be outside the maintenance agreement. On motion
by Commissioner Peters, seconded by Commissioner Cauley, the
Court voted unanimously to approve the payment authorization.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the Claims as
submitted.
The County Judge read aloud Proclamation #07 -022
designating February 11, 2007 as "2 -1 -1 Day" in Brazos County.
The Court encourages everyone to support 2 -1 -1 in its efforts
to connect people with health and human services through
information and referral. On motion by Commissioner Peters,

seconded by Commissioner Cauley the Court moved to proclaim
February 11, 2007 as "2 -1 -1 Day" throughout Brazos County and
approve Proclamation 07 -022. The County Judge then presented
the signed Proclamation to Hank Rorabak, representing the
local United Way.
The next matter before the Court was the appointment of
an individual to serve on the Local Workforce Development
Board representing Public Assistance. On motion by
Commissioner Mallard, seconded by Commissioner Cauley, the
Court voted unanimously to appoint Sharon Maass to serve on
the Local Workforce Development Board. Her term is from March
1, 2007 to June 20, 2009.
The Court next considered the reappointment of two
individuals to serve on the Brazos County Emergency Services
District #1 Fire Commissioners Board. On motion by
Commissioner Wassermann, seconded by Commissioner Cauley, the
Court voted unanimously to appoint Lynn Elliott and Jim
Carroll to serve on the board
2007 through December 31, 2007.

The next matter before the Court was entering into
contract with the Bryan - College Station Eagle for classified
line ads for the Human Resources Department. The rate is
$1.00 per line with a minimum of six (6) lines. On motion by

Commissioner Cauley, seconded by Commissioner Wassermann, the
Court voted unanimously to approve the contract. A copy is
attached.
On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to authorize
the County Judge to execute a Tax Resale Deed to the following
individual:
Louis Rodriguez, Jr. - Lot 11, Block 3, Stoval
Addition, City of Bryan, Brazos County
The next matter before the Court was a request from the
Building Maintenance Department to transfer $15,984.00 in DDEA
funds for the purchase of an Epilog Mini 24 inch 35 watt laser
engraver. On motion by Commissioner Peters, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the request.
The Court next considered a request from Justice of the
Peace, Precinct 4, for funds from the JP Technology Fund for
the purchase of a laptop, two printers, a monitor and other
supplies. Commissioner moved to approve. Commissioner Peters
seconded the motion. Commissioner Mallard stated that he
understood the need for the monitors but really needs a reason
for the color laser printers. Commissioner Peters agreed with
him. They discussed giving the office two regular printers
instead or one color laser printer. Commissioners Cauley and

Peters withdrew their motion and second. Then on motion by
Commissioner Mallard, seconded by Commissioner Peters and
Cauley, the Court voted unanimously to table consideration
until such time as they can get more information.
The Court next considered an Exemption from Competitive
Bidding Requirements of Local Government Code, Section
262.024(a)(4). On motion by Commissioner Peters, seconded by
Commissioner Wassermann, the Court voted unanimously to
approve the Exemption of Competitive Bidding Requirements for
Milliman Consultants and Actuaries, for Professional Services-
Consulting.
The next matter before the Court was consideration of
requisition no. 00012724 to Absolute Innovations, Inc. in the
amount of $16,667.00 for the purchase of equipment for the
Exposition Center. On motion by Commissioner Peters, seconded
by Commissioner Mallard, the Court voted unanimously to
approve the requisition.
The Court next considered a correction to Change Order
#0002 and Change Order #0003 for the Information Technology
Department (IT) building. Change Order #0002 is to provide
and install the Card access system provided by A -1 Fire and
Security Equipment. Change Order #0003 in the amount of
$24,456.00 is for a list of changes that are attached. On

motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to approve the
corrections. A copy of each Change Order is attached.
The next matter before the Court was approval of Change
Order #0004 for the Information Technology Department (IT)
building. This will be for removal of electrical to supply
power for training room desks and will increase the contract
amount by $830.00. On motion by Commissioner Peters, seconded
by Commissioner Cauley, the Court voted unanimously to approve
Change Order #0004. A copy is attached.
The Court next considered acceptance of the Bryan Texas
Utilities cost estimate of $53,300.79 for relocation of an

accommodate a road widening project. On motion by
Commissioner Peters, seconded by Commissioner Wassermann, the
Court voted unanimously to accept the Bryan Texas Utilities

The Court next considered authorizing work outside of
county rights -of -way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Richard Ward on
North Dowling Road in Precinct 1 to re -work the ditch to drain

water from the roadway. On motion by Commissioner Wassermann,
seconded by Commissioner Cauley, the Court voted unanimously
to authorize the work.
The Court next considered authorizing work outside of
county rights -of -way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Juan Pinalez on
North Dowling Road in Precinct 1 to re -work the ditch to drain
water from the roadway. On motion by Commissioner Wassermann,
seconded by Commissioner Peters, the Court voted unanimously
to authorize the work.
The Court next considered the request from Verizon to
construct a road bore and 5,423 feet of buried cable in the
right -of -way of Ferrill Creek Road at a minimum depth of 30
inches. The site is located in Precinct 2. The County
Engineer made the following comment:
The cable will be placed between address
#11381 and #12750 ( Ferrill Creek Road);
all creeks and driveways will be bored
along this route.
On motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to approve the request
from Verizon and authorized the installation subject to
Verizon complying with the stipulation noted above. A copy of
the request is attached hereto.

The Court next considered a request for variance to

2. On motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to accept on behalf of Brazos County a Special Warranty
Deed from the estate of Paul Emola for the expansion and
improvements to Alexander Road.
The next matter before the Court was consideration of a
payment authorization to Scarmardo Produce, Inc. in the amount
of $775.38 for food for the jail. The invoice exceeded the
purchase order amount. On motion by Commissioner Cauley,
seconded by Commissioner Peters, the Court voted unanimously
to approve the payment authorization.
The Court proceeded to consider a payment authorization
in the amount of $495.00 to Alpine - Pinnacle, Inc. the vendor
shipped out a second order by mistake. An employee used items
and didn't realize that a purchase order had not been created.
On motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to approve the payment
authorization.
Under announcement of interest items and possible future
agenda topics the following spoke:

Eric Caldwell, Director of the Information
Technology Department (IT)
a) He stated that the dates for relocating the
IT Department are firming up as meetings
have taken place with the other departments.
He told all to be expecting an E -Mail soon
specifying the dates. February 22, 23, and
24 are the target dates.
Commissioner Mallard
a) He has discussed the bidding process on health
insurance with the cities of Bryan and College
Station.
There was no citizen input and /or concerns.

Under Agency /Board /Committee reports by Court members,
the following spoke:
Sheriff
a) He went to the Jail Commission to ask for a
variance to the 60 beds limit. He was reduced
to 48 beds because of square footage. He is
ordering beds as we speak. This should help
the jail remain under capacity. He thanked
the Judge and the Jail Administrator for going
with him. The variance is good for one year
and then it will be reviewed.
There being no further business to come before the Court,
the meeting was adjourned.

CLASSIFIED LINE AD CONTRACT
BRASOZ CO. HUMAN RESOURCES Advertiser) agree to publish a minimum of 6 lines per issue in the
Bryan /College Station Eagle at a rate of 1.00 per line per day beginning November 2006 and to expire on
October 2007 for 12 months.
Advertiser understands this contract will automatically renew for a like period of time, unless canceled, in writing, 30 days
prior to the expiration of the current contract, by either party.
Advertiser further understands that failure to meet requirements of contract publication days, minimum lines daily; will
result in forfeiture of contract and all ads billed at open rate.
The advertiser will be guaranteed a set price per line for the contract period without regard to the number of lines/inches
run. This contract rate is based on nine column format.

REQUIREMENTS:
1) No work will be permitted between front slope and /or back slope.
2) All installation(s) shall be constructed in designated utility easements, if applicable. If no utility
easement exists, the installation(s) shall be 1) within 3 -5' of and parallel to the right -of -way line and /or
2) in the case of a road bore, perpendicular to the right -of -way line.
3) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's responsibility to
do so and to remove all cleared brush, trees etc. from county right -of -way.
4) Ditch line shall be compacted to 90% standard density ASTM -Test Method No. D -698; test shall be
conducted by an independent geotechnical testing firm; copies of all test results shall be furnished to
the office of the Brazos County Engineer.
5) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic Control
Devices for Streets and Highways, published by the Texas Department of Transportation, and all other
State and Federal laws governing utility construction.

ATTENTION COUNTY JUDGE:
Formal notice is hereby given that VERIZON COMMUNICATIONS will construct
a communication line within the right -of -way of a County Road in Brazos County,
Texas as follows:
Verizon will place a buried communications cable 3 feet in the
right -of -way of Ferrill Creek Road for a distance of 5423 feet at
a minimum depth of 30 inches. The cable will be placed between
L107/PD23 at 11381 Fen ill Creek Road and just before the power
pole at 12750 Ferrill Creek Road. We will directional bore the
road at L107 /PD 23 and will also bore all creeks and driveways
along this route.
The location and description of this line and associated appurtenances is
more fully shown by four (4) copies of drawings attached to this notice. The line
Will be constructed and maintained on the County Road right -of -way in
accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly
understood that the tender of this notice by the Verizon Southwest Incorporated
does not constitute a waiver, surrender, abandonment or impairment of any

Based on various meetings and phone conversations the following variance is being requested
for the above referenced project The variance is more specifically described as follows:
❖ Installation of water distribution lines and sanitary sewer collection lines within the right -
of-ways of the Creek Meadow Subdivision. Water distribution lines and service leads
will be sleeved under the pavement and two (2) feet beyond the back of curb;
It is our estimatation that the requested variance should be granted for the following reasons:
1) City of College Station is currently in the annexation process of this subdivision. Per
phone conversations with Mr. Lance Simms, Acting Director of Development Services &
Planning, annexation should occur sometime during the fall of 2007. Therefore, the
Creek Meadow subdivision should be within the CoCS city Limits within the year and out
of the maintenance responsibility of the County;
2) Typical installation design guidelines, as illustrated by the B /CS Unified Design
Guidelines for Water & Sanitary Sewer, recommended placement of all public utilities
within the right -of -way of a street (see attached excerpt of the B /CS Unified Design
Guideline manual). Therefore, utility construction will be in compliance with CoCS
standards;
3) Typically utility installation is not desirable within the County right -of -way primarily
because of maintenance or relocation issues_ The Commissioner's Court has already
issued a variance which will remove maintenance responsibility from the County for
anything behind the curb. Also, it is unforeseeable that any street would require
widening which would be the primary "trigger" for utility relocation.
