Payment authorization in the amount of $129.95 from the Magistrate's Office to Wilton's Office Works. A purchase order was not in place when this order was filled. 21. Consider and possible action on the Executive Session. 23. Announcement of interest items and possible future agenda topics. 24. Call for citizen input and/or concerns. 25. VOL q6 PAGE a� COMMISSIONERS' COURT REGULAR MEETING JANUARY 9, 2007 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, January 9, 2007 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Mallard gave the invocation and led the pledge of allegiance. There was no citizen input /and or concerns. The Court next considered Budget Amendment #06/07 -12.1 through 12.5 that would reallocate funds for the County Clerk, Information Technology Department (IT), Justice of the Peace, Precinct 2, Place 2, Capital Projects- Commissioners Court, and Clear Team. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached Vol Q0 Page a5 Commissioners Court meeting January 9, 2007 hereto. OA The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the changes as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 7026925 through 7027129 On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the Claims as submitted. The next matter for the Court's consideration was an Interlocal Agreement between Brazos County and the City of College Station to provide for Animal Control Services. The Sheriff asked the Court to not act on the contract because they should be operational by February 1, 2007. The County Judge replied that the Court has to approve it in order to pay for past services. Bill Ballard, legal counsel for the Court said he would fine tune the contract if the Sheriff will be ready sooner than March. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to remove this item from the agenda. On motion by County Judge, seconded by Commissioner Peters, the Court voted unanimously to appoint the following individuals to serve on the Board for the term of January 1, 2007 through December 31, 2008: a. This property was advertised for sale in accordance with Local Government Code §263.152 and received no bids. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to declare the property as salvage and authorized its destruction or other disposal. A list of the property is attached. The next matter before the Court was consideration of requisition 00012351 to East Texas Mack Sales LP in the amount of $86,108.00 for the purchase of a truck tractor for the Road and Bridge Department. Vol q O Page On motion by Commissioner Cauley, g-7 Commissioners Court meeting January 9, 2007 q seconded by Commissioner Wassermann, the Court voted unanimously to approve the requisition. The Court next considered requisition 00012271 to Caldwell Country Chevrolet in the amount of $21,061.00 for the purchase of a vehicle for the Exposition Center. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the requisition. The Court next considered awarding Bid No. 2007 -008, Concrete. Becky Stephens, Assistant Purchasing Agent recommended acceptance of the bid submitted by Transit Mix Concrete and Materials. On motion by Commissioner Cauley, seconded by Commissioner Mallard, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to Transit Mix Concrete and Materials. A copy of the bid tabulation is attached. The Court next considered awarding Bid No. 2007 -010, Equipment Lubricants. Becky Stephens, Assistant Purchasing Agent recommended acceptance of the bid submitted by Universal Lubricants. On motion by Commissioner Wassermann, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to Universal Lubricants. Becky Stephens, Assistant Purchasing Agent made the following recommendation: Primary Vendor: Vulcan Construction Secondary Vendor: Martin Marietta Materials On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendation of the Assistant Purchasing Agent and award the contract as noted above. A copy of the bid tabulation is attached. The Court next considered awarding Bid No. 2007 -012, Fencing Supplies. Becky Stephens, Assistant Purchasing Agent made the following recommendations: Woodson Lumber - Items 1 -3.2 and 6 -7 Conroe Wood Products - Items 4 -4.4 Brazos Bottom Crop Care - Items 5 -5.5 On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract as noted above. A copy of the bid tabulation is attached. The Court next considered awarding Bid No. 2007 -013, Fence Building. Becky Stephens, Assistant Purchasing Agent made the following recommendation: Primary Vendor - Hurst Fencing Secondary Vendor - Hurricane Fence Vol qo Page P.R Commissioners Court meeting January 9, 2007 67 The County Judge asked if Hurst was truly the best price. Gary Arnold with the Road and Bridge Department, explained while Hurricane is cheaper the price of the fence, Hurst is cheaper in total because of man hours and special fees. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract as noted above. A copy of the bid tabulation is attached. The Court next considered awarding Bid No. 2007 -014, Motor Grader Blades. Becky Stephens, Assistant Purchasing Agent made the following recommendations: Primary Vendor - Romco Equipment Secondary Vendor - Valk Manufacturing On motion by Commissioner Wassermann, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract as noted above. A copy of the bid tabulation is attached. The Court next considered the request from Verizon to construct 1,253 feet of buried cable in the right -of -way of Golden Trail at a minimum depth of 30 inches. The cable will be placed outside the platted 16 foot public utility easement due to fences, heavy brush and trees. The site is located in Precinct 3. The County Engineer made the following comment: Vol �� Page J6 Commissioners Court meeting January 9, 2007 7 All creeks, trees and driveways will be directionally bored along this route. Installation will provide communication services to Candlebrook Subdivision. On motion by Commissioner Mallard, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from Verizon and authorized the installation subject to Verizon complying with the stipulation noted above. A copy of the request is attached hereto. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to receive, approve and order filed as submitted the Treasurer's report for November 2006. A copy is attached to and made a part of these minutes. The next matter before the Court was consideration of a payment authorization to Sysco Food Services in the amount of $421.07. On motion by the County Judge, seconded by Commissioner Peters, the Court voted unanimously to approve the payment authorization. The Court next considered a payment authorization to Wilton's Office Works in the amount of $129.95. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the payment authorization. Kay Hamilton, County Treasurer thanked the Information Technology Department (IT) and the Auditor's Office for all their help on payroll. Vol qa Page 31 Commissioners Court meeting January 9, 2007 g At 9:19 a.m. the County Judge announced the meeting closed to the public so that the Court could meet in Closed Executive Session to discuss pending litigation as allowed under Section 551.071 of the Texas Government Code. At 10:15 a.m, the County Judge announced the meeting open to the public and that no action would be taken on the Closed Executive Session. Under announcement of interest items and possible future agenda topics the following spoke: Commissioner Mallard a) Reminded the Court that there is a CUC meeting tomorrow in Austin, beginning at noon. There was no citizen input and /or concerns. Under Agency /Board /Committee reports by Court members, the following spoke: Commissioner Mallard a) The IGC met on Friday. They are working on Future Gen in Leon County. They had a presentation on the EOC and radio system. On January 18th, there will be a meeting in Washington County to see if they want to join in the Agreement to apply for a grant on radios. There being no further business to come before the Court, the meeting was adjourned. Installation will provide communication services to Candlebrook Subdivision. REQUIREMENTS: 1) No work will be permitted between front slope and /or back slope. 2) All installation(s) shall be constructed in designated utility easements, if applicable. If no utility easement exists, the installation(s) shall be 1) within 3 -5' of and parallel to the right -of -way line and /or 2) in the case of a road bore, perpendicular to the right -of -way line. 3) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's responsibility to do so and to remove all cleared brush, trees etc. from county right -of -way. 4) Ditch line shall be compacted to 90% standard density ASTM -Test Method No. D -698; test shall be conducted by an independent geotechnical testing firm; copies of all test results shall be furnished to the office of the Brazos County Engineer. 5) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic Control Devices for Streets and Highways, published by the Texas Department of Transportation, and all other State and Federal laws governing utility construction.
