REGULAR MEETING
NOVEMBER 21, 2006
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos Center 3232 Briarcrest
Drive, in Bryan, Brazos County, Texas, beginning at 6:00 p.m.
on Tuesday, November 21, 2006 with the following members of the
Court present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Mallard gave the invocation and led the
pledge of allegiance.
There was no citizen input/and or concerns.
The Court next considered Budget Amendment #06/07-7.1
through 7.5, which would reallocate funds for Constable,
Precinct 1, Information Technology Department (IT), County
Clerk, Jail Administration; and correct budget amendment
06/07-6.3 On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is

attached.

The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve
the change of status as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the Claims as
submitted.
The next matter before the Court was consideration of the
reappointment of Wayne Wilson to serve as Brazos County's
Agricultural Representative on the Brazos Valley Groundwater
Conservation District. On motion by the County Judge, seconded
by Commissioner Mallard, the Court voted unanimously to approve
the reappointment of Wayne Wilson to serve as Brazos County's
Agricultural Representative on the Brazos Valley Groundwater
Conservation District. The term of the appointment is from
January 1, 2007 through December 31, 2010.
The Court next considered the reappointment of Mayor Ron
Silvia to the Board of Directors for the Brazos Valley Council

of Governments. On motion by Commissioner Wassermann, seconded
by Commissioner Peters, the Court voted unanimously to approve
the reappointment of Mayor Ron Silvia to the Board of Directors
for the Brazos Valley Council of Governments. The term of the
appointment is from October 1, 2006 through September 20, 2007.
The Court next considered a request from Constable
Precinct 1, Archie Clark, to appoint Jose Gonzales, Jr., as
non-paid Deputy Constable. On motion by Commissioner
Wassermann, seconded by Commissioner Peters, the Court voted
unanimously to approve the request from Constable Clark to
appoint Jose Gonzales, Jr. as non-paid Deputy Constable subject
to appointment being within the allotted number of deputies.
The County Judge read aloud Proclamation #06-015
designating the week of November 12 through 18, 2006 as "County
Extension Agent Week". The Court joins with the 254 Texas
Counties marking the centennial of the employment of the first
Cooperative Extension Agent. This highly successful agency is
as vital now as it was 100 years ago. Eric Zimmerman,
Cooperative Extension Agent presented each member of the Court
with a commemorative paperweight and Dr. Alma Fonseca,
Cooperative Extension Agent reminded the Court members of the
Elected Officials Luncheon in December. On motion by the
County Judge, seconded by Commissioners Wassermann, Peters,

Mallard and Cauley the Court moved to proclaim the week of
November 12 through 18, 2006 as "County Extension Agent Week"
throughout Brazos County.
The next matter for consideration by the Court was the
institution of a ban on out door burning. There was no
recommendation for a ban from the Emergency Management
Coordinator. On motion by the County Judge, seconded by
Commissioner Peters, the Court voted unanimously to not
institute a ban on out door burning.
The Court next considered a request from Juvenile Services
for permission to pay the following invoices for contract
placement from the FY2007 budget. The invoices were received
after the deadline for FY 2006 payments. The invoices are as
follows:
a) Therapeutic Family Life $3,450.00
b) Lutheran Social Services $3,546.00
On motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to approve the payment of
the above noted invoices.
The next matter before the Court was a request from
Commissioner Mallard for payment of lodging expenses while
attending the TEX-21 Statewide Quarterly Meeting in Fort Worth,
Texas. The billing for one night exceeded the per diem
approved by the Commissioners Court. On motion by the County

Judge, seconded by Commissioner Cauley, the Court voted
unanimously to approve payment of lodging expenses for
Commissioner Mallard.
The next matter for consideration was approval of tax
refund applications from the following individuals and/or
companies:
a) First American Real Estate Tax, Over Payment $35.01
b) Countrywide Home Loans, Over Payment $10.85
On motion by Commissioner Wassermann, seconded by Commissioner
Cauley, the Court voted unanimously to approve the tax refund
applications.
The Court next considered acceptance of seized property
awarded to the Sheriff's Office in the Justice of the Peace,
Precinct 2 Place 1 Court. If accepted, the property will be
sold at public auction. Property items are as follows:

b) Sony Jam Box
c) Band Saw
d) RCA Camcorder
On motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to accept the seized
property named previously and to sell it at public auction.
The next matter before the Court was consideration of the
following requisitions to purchase equipment for the Sheriff's
Office and Constable vehicles:

On motion by Commissioner Peters, seconded by Commissioner
Mallard, the Court voted unanimously to approve the
requisitions.
The Court next considered Change Order No. 0001 between
Unisys Corporation and Brazos County, to be added to the
original contract. This is for the installation of fiber optic
cable. The original contract amount was $759,825.00. This
Change Order in the amount of $137,772.00 increases the
contract amount to $879,597.00. On motion by Commissioner
Cauley, seconded by Commissioner Peters, the Court voted
unanimously to approve Change Order No. 0001. A copy is
attached.
The next matter before the Court was consideration of
requisition 00011827 to John Deere Company, Inc. in the amount
of $6,022.86 for the purchase of a mower for the Brazos Center.
On motion by Commissioner Peters, seconded by Commissioner
Wassermann, the Court voted unanimously to approve the
requisition.
The Court next considered the request from Wickson
Special Utility District to construct a road bore for water

Engineer stated that all appeared to be in order and
recommended approval. On motion by Commissioner Peters,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the request by Wickson Special Utility District and
authorized the installation. A copy of the request is
attached hereto.
The County Judge next considered an Addendum to the
Agenda that was a request from the Purchasing Department for
permission to advertise Bid 2007-007 for seal coat projects in
Precincts 1,2,3 and 4. On motion by Commissioner Cauley,
seconded by Commissioner Peters, the Court voted unanimously
to approve the request.
Under announcement of interest items and possible future
agenda topics the following spoke:

a) Said that there will be a Pandemic Flu
exercise to be held on December 6 and
7 at the Emergency Operations Center
(EOC).

SCOPE OF WORK
➢ Unisys will provide and install Corning fiber optic cable as listed below. Please note
that we have chosen to use an indoor/outdoor plenum rated fiber to eliminate the
need for transitions to plenum rated fiber thus eliminating several possible points of
failure. Once inside the buildings, the fiber will be run in plenum rated innerduct for
protection and ease of identification. The cables will be terminated on each end in a
Panduit enclosure using fusion spliced SC pigtails.
➢ Unisys will meet with all concerned parties prior to the start of the project to establish
a timeline and sequence of events to ensure problem free project.

➢ F1 A total of 192 strands will be placed from Caldwell Center to IDF1 in the
Courthouse. This will be accomplished by running 4-48 strand single mode fiber
cables. We have been told by Corning that a 192-strand cable in not made in an 1/0
Plenum configuration.
➢ F2, F3, and F4 A riser rated 24-strand single mode fiber optic cable will be run
from Courthouse IDF1 to the appropriate floor.
➢ F5, F6, and F7 An 1/0 Plenum rated 24-strand single mode fiber optic cable will
be run from Courthouse IDF1 to the appropriate building.

➢ F8 An 1/0 Plenum rated 48-strand single mode fiber optic cable will be run from
Caldwell Center to the Library. The customer will be responsible for the
establishment of the underground pathway.
➢ F9 An 1/0 Plenum rated 48-strand single mode and a 24-strand multi mode fiber
optic cable will be run from Caldwell Center to the Annex. A hybrid cable was not
available in an 1/0 Plenum configuration. The customer will be responsible for the
establishment of the underground pathway.
➢ F10 An 1/0 Plenum rated 48-strand single mode fiber optic cable will be run
from Caldwell Center to the Bryan Utilities Building. The customer will be responsible
for the establishment of the underground pathway.
➢ F11 An existing 24-strand single mode fiber optic cable will be cut and routed
to an enclosure to create a junction point. This will be done 12 strands at a time to
eliminate any downtime. We have been told that there is slack in the cable to
accomplish this, our quote is based on existing slack.
➢ Please see the materials list for quantities and description of materials to be
installed.
➢ No tax, bond, or overtime included.

Any additional work not specified in this scope of work or any additional work request
from customer may result in a change order.

Design/Build and Relocations
The primary fiber installation is based on normal working hours, Monday thru Friday, 8am to
5pm. Some of the work is scheduled during off hours to accommodate splicing of fiber cabling
and connections to meet the requirements of the County. Project delays outside of Unisys
Corporations control, including but not limited to delay by other trades or customer could result
in additional cost to customer.
This quotation is based on asbestos-free environment.
This proposal pricing is good for a period of 15 days. Due to the current volatility of
the copper market and other materials, our suppliers will only guarantee materials pricing
for two weeks.
This quotation assumes that detailed "As-Built" drawings (floor plans), key sheets, cable/jack
configuration including all existing inside and outside cable plant will be provided by customer
and will be ready prior to cable installations.
Schedule: I have scheduled to start the fiber runs on November 27 and completion by December
15. The priority installations will be installed first.
The total cost for the fiber installation is: $137,772.00

ITEM: Request from Wickson Creek Special Utility District to construct a road bore for
water line installation in the right of way of Dilly Shaw Tap Road approximately 0.5 mile
from its intersection with FM 2038 North. Site is located in Precinct 2.
SOURCE OF FUNDS: N/A
REQUIREMENTS:
1. No work will be permitted between front slope and/or back slope.
2. All installation(s) shall be constructed in designated utility easements, if applicable. If no
utility easement exists, the installation(s) shall be 1) within 3-5' of and parallel to the right-of-
way line and/or 2) in the case of a road bore, perpendicular to the right-of-way line.
3. If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county right-of-way.
4. Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test
shall be conducted by an independent geotechnical testing firm; copies of all test results shall
be furnished to the office of the Brazos County Engineer.
5. Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of
Transportation, and all other State and Federal laws governing utility construction.

REQUEST FOR PROPOSED INSTALLATION IN COUNTY RIGHT-OF-WAY
TO THE COMMISSIONERS' COURT OF BRAZOS COUNTY, TEXAS
BRAZOS COUNTY COURTHOUSE
BRYAN, TEXAS 77803
Formal notice is hereby given that (applicant) Wickson creek Special Utility District
proposes to place a (type) Waterline within y_ across_ the right-of-way of
(road) 9365 DILLY SHAW TAP ROAD in Brazos County, Texas as follows:
The location or description of the proposed installation is more fully shown by 3
copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that he, or his designated inspector, may
inspect the actual installation.
2. All damage to the roadways and rights-of-way will be repaired to their
original condition to the satisfaction of the County Engineer.
3. Brazos County reserves the right to require Applicant to relocate or
lower any such line at no cost to Brazos County, should same
become necessary due to widening or lowering, or other alteration of
the roadway or right-of-way.
4. Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines in the right-of-way.
5. The line will be constructed and maintained on the County right-of-way in
accordance with the Utility Accommodation Policy which was adopted by the
Texas Department of Transportation on May 29 1989.
6. The line or lines will be constructed no less than twenty-four inches (24")
lower than the lowest part of the drainage or bar ditch and the drainage is to
be considered at least two feet (2') below the center of the roadway.
7. All sites will be barricaded during the construction period.
Construction of this line will begin on or after the 21 day of NOVEMBER , 2006
