VOL 60 PAGE a Iq COMMISSIONERS' COURT REGULAR MEETING NOVEMBER 14, 2006 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, November 14, 2006 with the following members of the Court present: Randy Sims, County Judge, Absent; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4, Presiding; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Cauley asked the Rev. Jones to give the invocation and the Commissioner led the pledge of allegiance. Commissioner Cauley skipped item number two on the agenda and proceeded to hear a presentation on the proposed Downtown Bryan Tax Increment Reinvestment Zone #21. Jessica Guidry with the Downtown Bryan Economic Development Association (DBEDA) gave the presentation and asked for support of the downtown project. Commissioner Cauley then proceeded to consider item two Vol Page d 5D Commissioners Court meeting November 14, 2006 2 which is citizen input/and or concerns. The following spoke: a) Katie Blanchard, with (DBEDA) asked the Court to support the downtown project. b) Mr. John Henry, with (DBEDA) also asked for support of the project. The next matter before the Court was consideration of a request for a waiver of the 60 day notice requirement for the proposed Downtown Bryan Tax Increment Reinvestment Zone #21. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the request for waiver. Commissioner Mallard asked that we work closely with the "The District" who will be constructing the parking garage here. The Court next considered Budget Amendment #06/07-6.1 through 6.4 that would reallocate funds for the District Clerk-Collections Department, TEEX State Homeland Security Grant, Emergency Management; and transfer funds from Contingency to Capital Projects. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Wassermann, seconded by Vol Page a5I Commissioners Court meeting November 14, 2006 3 Commissioner Peters, the Court voted unanimously to approve the changes as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 7025308 through 7025611 On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the Claims as submitted. The next matter before the Court was consideration of the cancellation of the Commissioners Court meeting for November 28, 2006. Due to the Thanksgiving holidays, there would not be enough time to prepare an agenda for that meeting. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously cancel the Commissioners Court meeting of November 28, 2006. The Court next considered a request from Commissioner Lloyd Wassermann for mileage reimbursement for the months of August and September 2006 from the 2007 budget. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the request. The next matter for consideration was approval of tax refund application from the following individual and/or company: Vol 9~ Page 95 h Commissioners Court meeting November 14, 2006 4 a) Olivia Johnson-Simonich, Over Payment $1,100.00 On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the tax refund application. The Court next considered awarding Bid No. 2007-001, Road Signs and Sign Posts. Becky Stephens, Assistant Purchasing Agent made the following recommendation: Primary Vendor - Vulcan, Inc. Secondary Vendor - Hall Signs, Inc. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to accept the recommendation of the Assistant Purchasing Agent and award the contract as noted above. A copy of the bid tabulation is attached. The next matter for consideration was approval for the Purchasing Agent to advertise Bid 2007-006, Construction of Two Lane Roadway Bridges at: a. Bridge 106-001 (Alexander Road over Wickson Creek Tributary) b. Bridge 106-003 (Alexander Road over Wickson Creek Tributary) c. Rock Prairie West over Hopes Creek (this will be a new bridge replacing 3-72 inch culverts that deteriorated within 7 years of installation due to soil conditions. d. Bridge 175-002 (Weedon Loop over Wickson Creek) On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to authorize the Vol ~9- Page d-53 Commissioners Court meeting November 14, 2006 5 Purchasing Agent to advertise for bids for the above referenced Construction of Two Lane Roadway Bridges. The Court next considered awarding Bid No. 2007-002, Heavy Machinery Rental. Becky Stephens, Assistant Vol 89 Page a5 Commissioners Court meeting November 14, 2006 6 Purchasing Agent recommended acceptance of the bid submitted by Young Contractors, Inc. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to accept the recommendation of the Assistant Purchasing Agent and award the contract to as noted above. A copy of the bid tabulation is attached. The next matter before the Court was consideration of Requisition 00011790 in the amount of $106,685.79 to Brazos United Roofing, Inc. to replace the roof at the Road and Bridge Department offices. This was contingent upon Court approval of budget amendment 06/07-6.3. It was approved earlier in this meeting. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the requisition and authorized the County Judge to execute two Letters of Intent as well as the Proposal Acceptance. The Court next considered requisition 0011779 in the amount of $59,058.38 to Anixter,Inc. for cabinets and cabling for the Maxwell Center. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the requisition. The Court next considered acceptance of a Special Warranty Deed for right-of-way on Whites Creek Road in Vol 1 $ Page -)95 Commissioners Court meeting November 14, 2006 7 Precinct 1. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to authorize the County Judge to accept on behalf of Brazos County a Special Warranty Deed from Richard A. Harris and Martha R. Harris for the expansion and improvements to Whites Creek Road. The next matter before the Court was the establishment of a date and time for a Public Hearing to consider a request from Duck Haven Ltd., developer of Duck Haven Estates, for the abandonment of a 0.0624 acre portion of County right-of-way at the southwest end of Drake Drive in Precinct 1. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to hold a Public Hearing on Tuesday, December 5, 2006 at 10:00 a.m. The Court next considered a requisition to Dallas Dodge in the amount of $33,838.00 for the purchase of vehicles for the CLEAR TEAM. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the requisition. The Court acknowledged receipt of and order filed as submitted the Treasurer's Quarter Ending September 30, 2006 Investment Report. A copy is attached to and made a part of these minutes. Commissioners Court meeting November 14, 2006 8 The Court next heard a presentation of the quarterly delinquent tax report presented by Shelburne Veselka, representative of McCreary, Veselka, Bragg & Alen, P. C. Attorneys at Law. Under announcement of interest items and possible future agenda topics the following spoke: Commissioner Mallard a) Said that the Road and Bridge Department had helped him look at a bad curve in his precinct and what can be done to correct this. May need a workshop on this topic. Commissioner Cauley a) Reminded the Court that there will be a special called meeting at 10:00 a.m. on Wednesday, November 15th in room 108 to canvass votes of the General Election. Under citizen input and/or concerns, the following spoke: Sheriff a) Gave the Court an update on the jail population. Last night, there were 573 people in jail. Under Agency/Board/Committee reports by Court members, the following spoke: Commissioner Mallard a) Last Thursday and Friday, he met with the Tex 21 Group. He brought back reports on transportation issues that affect us. He will have comments sent to him for the Commissioners to review. The Brazos County Investment portfolio earned an average yield of 5.2420% on the quarterly average balance of $5,501,055.44 invested with TexPool for the period ending 09/30/2006. Investment interest deposited during the quarter was $72,359.77. The year-to-date investment interest earned was $249,824.79 with an ending balance of $5,525,043.38 invested with TexPool as of 09/30/2006. The average Earnings Credit Rate on checking account interest for the quarter ending 09/30/2006 was 5.45% netting $798,196.19 on an average depository balance of $58,848,177.91. Year-to date checking account total interest deposited was $2,911,592.58. Investment Strategy At the end of the third quarter of 2006, yields from various investment products were as follows: CITIBank accounts 5.51% daily liquidity 110% collateralized Texpool 5.2648% daily liquidity Agencies of the Federal 5.22% 6-month maturity Government 5.14% 12-month maturity Commercial Paper 5.45% 3-month maturity Treasury Bills 5.05% 3-month maturity 4.93% 2-year The investment opportunities available to Brazos County that would exceed the rate being earned on the CITIBank accounts have maturity dates in the 18-month to 2-year range and are not collateralized. Purchasing agencies in that range could present a maturity risk with little, if any, justifying reward. The depository contract provides a rate that adjusts as rates increase (3-month Treasury rate . 55 basis points) which continues to produces a competitive rate with the least amount of risk of loss of principal (110% collateralized) as well as the least amount of maturity risk (daily liquidity). Economic Summary from Raymond James Financial Services: • U.S. economy continued to slow into the third quarter of 2006. • The housing market slowdown has generated increased anxieties about the overall economy, but a recession is likely to be avoided. • Core inflation has continued to edge higher; however, slower growth and some stability in energy prices should help reduce inflation into 2007. • Federal Reserve officials refrained from raising rates at the August 8, 2006, policy meeting. The tone of the policy statement suggests that further increases in short-term interest rates are possible, but unlikely. • The Federal Reserve should keep short-term interest rates unchanged for the foreseeable future. The next move is just as likely to be higher as lower. Because of the current economic conditions, the interest rate and collateral provided by the current depository contract, and the maturity risk associated with a product that would produce a higher rate than the depository bank, the Brazos County investment strategy remains unchanged with a concentration of County funds in the Brazos County depository.
