VoL ~7 PAGE ot( COMMISSIONERS' COURT REGULAR MEETING OCTOBER 17, 2006 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos Center 3232 Briarcrest Drive, in Bryan, Brazos County, Texas, beginning at 6:00 p.m. on Tuesday, October 17, 2006 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Mallard gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns. The Court next considered Budget Amendment #05/06-52.1 through 52.4, which would reallocate funds for Commissioners Court, Constable, Precinct 3, Constable, Precinct 4; and increase the budget of the Alternative Dispute Resolution Center. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is Vol 97 Page al a Commissioners Court meeting October 17, 2006 2 attached. The Court next considered Budget Amendment #06/07-2.1 through 2.8 which would reallocate funds for the CLEAR Team, CO Issue 2005; transfer funds from Contingency to Courthouse Security, Constable, Precinct 1, County Court at Law #1, Community Supervision Support, County Auditor Juvenile Services, Constable, Precinct 2, Environmental Protection, Constable, Precinct 4; and carry forward the balance of FY2006 State Homeland Security Grant to FY 2007. On motion by Commissioner Cauley, seconded by Commissioner Mallard, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the change of status as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 7024245 through 7024574 On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as submitted. Vol gi Page a~ 3 Commissioners Court meeting October 17, 2006 3 The next matter before the Court was consideration of a ban on outdoor burning. The County Judge moved to not institute a burn ban. Commissioner Cauley seconded the motion. After some discussion the County Judge and Commissioner Cauley amended their motion and second to include omitting the item from the agenda for the next Commissioners Court meeting. The motion carried unanimously. The Court next considered entering into contract with Big Brothers Big Sisters of Brazos Valley for mentoring services to at risk children. Cost to Brazos County will be $10,000.00. The term of the contract begins on the date the contract is signed and terminates on September 30, 2007. On motion by Commissioner Cauley, seconded by Commissioner Mallard, the Court voted unanimously to enter into contract with Big Brothers Big Sisters of Brazos Valley. The County Judge stated that he would like a copy of their mentoring program. The next matter before the Court was consideration of the renewal of the contract with Portia Smith for the Positive and Total Difference II Program. There are no changes from the last contract. Cost to the County will be $45.00 per program participant if over 14 participants, $50 per program participant if under 13 participants. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court Vol 0 Page '211 Commissioners Court meeting October 17, 2006 q voted unanimously to renew the contract with Portia Smith for the Positive and Total Difference II Program. The Court next considered a request from the Brazos Center for permission to reclassify the Assistant Director/Scheduler position from a non-supervisory position to a supervisory position. Chief Deputy On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the request. The next matter for consideration by the Court was a request submitted by the Jail Administrator seeking approval for out of state travel for Sergeant Pauline Alonzo and Correctional Health Professional Michelle Ziegelmann to attend the National Conference on Correctional Health Care in Atlanta, Georgia October 29 through November 1, 2006. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to grant the request from the Jail Administrator and approved payment of out of state travel expense for Sergeant Pauline Alonzo and Michelle Ziegelmann. The next matter for consideration was approval of tax refund applications from the following individuals and/or companies: a. Tim Williams, Over Payment $197.12 b. Sandra & Larry L. Whitener, Over Payment $14.01 c. Edward & Christine Lansford, Over Payment $15.52 On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the tax refund applications. Pat Howard, Purchasing Agent and Ben Sanford & Associates, Inc. Consultants, recommended acceptance of the RFP submitted by Affiliated Telephone. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to Affiliated Telephone. A copy of the bid tabulation is attached. The Court next considered awarding Bid No. 2006-049, Janitorial Supplies. Pat Howard, Purchasing Agent, recommended acceptance of the bid submitted by Ray Criswell. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to Ray Criswell. A copy of the bid tabulation is attached. The Court next considered acceptance of a Special Warranty Deed for right-of-way on Ferrill Creek Road in Precinct 2. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to authorize the County Judge to accept on behalf of Brazos County a Special Warranty Deed from Carrabba Brothers, Ltd. for the expansion and improvements to Ferrill Creek Road. Vol S7 Page 217 Commissioners Court meeting October 17, 2006 7 Under announcement of interest items and possible future agenda topics the following spoke: County Judge a) Said that he will place on the agenda for the next Commissioners Court meeting a variance for a plat. Commissioner Mallard a) The County has been reviewing the Subdivision and Development Regulations to see if changes need to be made. The CUC will conduct a meeting on December 7, 2006, in Austin on this topic. Commissioner Cauley a)He feels the County should decide if it is going to follow the regulations or going to continue giving variances. There was no citizen input and/or concerns. Under Agency/Board/Committee reports by Court members, the following spoke: County Judge a) He received a report from the Research Valley Partnership on how the County is doing with it's investment in new industry coming into the County. Commissioner Peters a) Saturday is Hazardous Material Collection Day in the County. Provide, with funds received under this contract, one-to-one mentoring to a minimum of 10 at-risk youth residing in Brazos County. BBBSBV expects to provide services to a minimum of 300 Brazos Valley youth by December 2007. 3. Monitor each "match" in compliance with BBBSA policies and Standards of Practice. 4. Provide quarterly reports of ongoing matches and quarterly reports of activities. 5. Prepare a year-end report of program that includes evidence of the impact of program on youth participating in program. Payment Terms In consideration of the services described above, Brazos County Commissions Court hereby agrees to pay the Contractor a maximum fee of $10,000.00. Taxes BBBSBV is a not-for-profit 501-c-3 agency operating as an agency of BBBS of Central Texas. Payment will be made in the form of a check issued by the Brazos County Treasurer's Office no later than 30 days from receipt of original billing. Brazos County will not accept copies or faxed invoices. The original invoice is required for payment. No special payment exceptions will be made. Please do not call for status or payment unless past the 30 day time period. Each billing shall contain the name of the client or clients for whom payment is being requested, a brief description of services provided, date services were rendered, and the rate at which services have been billed. D. The SERVICE PROVIDER shall comply with all applicable licensing and certification requirements. Failure to comply with this requirement will be treated as a default. Copies of all applicable licensing and certification requirements shall be provided to the SERVICE AGENCY. The SERVICE PROVIDER shall adhere to all applicable state and federal laws and regulations pertinent to the subcontractor's provision of services to the SERVICE AGENCY. E. The SERVICE PROVIDER shall disclose any pending or initiated criminal or governmental investigations related to SERVICE PROVIDER to the SERVICE AGENCY. F. The SERVICE PROVIDER shall be required to provide certification of eligibility to receive state funds as required by the Texas Family Code Section 231.006. The SERVICE AGENCY shall provide the SERVICE PROVIDER with the "Affidavit of Eligibility to Receive State Funds" form, which shall be completed by the SERVICE PROVIDER and mailed to the SERVICE AGENCY. G. The SERVICE AGENCY shall notify the SERVICE PROVIDER when state funds are used to pay for services. The SERVICE PROVIDER shall be required to account separately for the receipt and expenditure of state funds received from the SERVICE AGENCY. H. The SERVICE PROVIDER shall use Generally Accepted Accounting Principles in accounting for funds 1. The SERVICE PROVIDER receiving whole or partial payment with any state grant funds received from the Commission shall retain all applicable records for a minimum of three years or until any pending audits and all questions arising therefrom have been resolved and shall make available for the Commission inspection, all contractual agreements with SERVICE PROVIDER subcontractors. J. The SERVICE PROVIDER contract funded in whole or in part with grant funds shall be subject to termination without penalty, either in whole or in part, if funds are not available or are not appropriated by the Texas Legislature. K. The SERVICE PROVIDER shall be monitored at least twice during the fiscal year for programmatic and financial compliance. The purpose of the monitoring is to ensure performance of and compliance with contractual provisions between the SERVICE AGENCY and SERVICE PROVIDER in accordance with the Private Service Provider Contract .Requirements. L. In the event of a default of the SERVICE PROVIDER, the SERVICE AGENCY may cancel or suspend the agreement. M. The SERVICE AGENCY is responsible for monitoring the SERVICE PROVIDER and the exercise of reasonable care to enforce all terms and conditions of the agreement. N. No officer, member or employee of Brazos County Juvenile Services, and no member of its governing body, and no other public official of the governing body of the locality or localities in which the services is situated or being carried out who exercises any functions or responsibilities in the review or approval of the undertaking or carrying out of this agreement shall participate in any decision relating to this agreement which affects his personal interest or have any personal or pecuniary interest, direct or indirect, in this agreement or the proceeds thereof. 0. Termination for cause shall be based upon contingencies as follows: (a) If the SERVICE PROVIDER fails to provide the services called for in this contract within the specified term herein or extension thereof; or (b) If the SERVICE PROVIDER fails to perform any other provisions of this contract, or so fails to perform the services as to endanger performance of this contract in accordance with its terms, and in either of these two circumstances does not correct such failure within a period of 10 days ( or such extensions as authorized by the SERVICE AGENCY in writing) after receiving notice of default. (c) This contact shall not be terminated for failure to perform the contract arising out of causes beyond the control and without fault or negligence of the SERVICE PROVIDER. (d) The decision of the termination of the SERVICE AGENCY shall be final and conclusive unless within 60 days from the date of receipt of a written copy of the decision the SERVICE PROVIDER mails or otherwise furnishes to the SERVICE AGENCY a written appeal addressed to the Brazos County Juvenile Board. The decision of the Juvenile Board shall be final and conclusive absent a showing of fraud, caprice, arbitrariness or gross error implying bad faith in which case suit may be brought in some court of competent jurisdiction. (e) Either party may terminate this agreement by giving thirty (30) days written notice to the other party hereto of the intention to terminate. (f) In the event of contract termination the SERVICE AGENCY shall pay to the SERVICE PROVIDER the amounts for completed services not yet paid for. P. In any legal action arising under this agreement, the laws of Texas shall apply and venue shall be in Brazos County. 0. The SERVICE AGENCY will not discriminate against any application for The Mentor Program because of race, color, religion, sex, or national origin. The SERVICE PROVIDER, by the same token, must ensure that program participants may not be refused acceptance therein, because of race, color, religion, sex, or national origin, unless professional evaluations indicate certain and explicit conditions exist for special programs. The new switchroom printer and terminal are not needed, as vendor technicians and county personnel can use laptops. The savings are $1149.48. A revised financial spreadsheet for the fiber remote is attached. The final pricing is: $33,634.07 Fiber Remote for Technology Building $29,443.80 Annual Maintenance for all locations 2. Remote alarm monitoring of the Courthouse and Detention Center is included in the maintenance price quoted. 3. The recommended Nortel Fiber Remote Cabinet which will serve the Information Technology and later the Administration buildings has a total of 120 talk paths back to the Courthouse system, and so is virtually non-blocking. 4. A major limitation of the remote cabinet as expressed in the report was its failure to support 911 calls directly. In other words, the Courthouse address would be given out to the Public Safety Answering Point. After further discussion with ATI, they can make this work as desired and the Administration Building address will be provided.
