12. Request from Purchasing for an additional Mastercard to be issued to the Coliseum
Complex Director for travel expenses.
13. Permission to advertise RFP 2006-038, Telephone System for Brazos County
Administration Building and Maintenance for all locations.
14. Request from Purchasing for permission to exercise the renewal option in the mail
processing contract with DeLucia Mail Service for an additional one year period with
no increase in cost. Term of agreement is 1 October 2006 through 30 September 2007.
15. Request from Brighton Energy LLC to construct a road bore for a 4 inch natural gas
pipeline in the right of way of Dilly Shaw Tap Road approximately 4,000 ft. east of its
intersection with Fickey Road. Site is located in Precinct 2.
16. Request from Brighton Energy LLC to construct a road bore for a 3 inch natural gas
pipeline in the right of way of Ferrell Creek Road approximately 10,000 ft. east of its
intersection with North FM 2038. Site is located in Precinct 2.
17. Request from Verizon Communications to construct a road bore and set a pedestal in
the right of way of Marino Road. Site is located in Precinct 2.
18. Payment authorization in the amount of $111.94 from the Precinct 3 Constable to GT
Distributors for ammunition purchased in fiscal year 2005 on PO # 6947.
19. Payment authorization in the amount of $1,028.71 from the Sheriffs Office to The
Sharper Image for an air purifier and related items. Vendor will not accept a purchase
order.
20. Convene into Executive Session pursuant to §551.072 of the Texas Government Code
to discuss real property.
21. Consider and possible action on the Executive Session.
22. Announcement of interest items and possible future agenda topics.
23. Call for citizen input and/or concerns.
24. Agency / Board,' Committee reports by Court members.

COMMISSIONERS' COURT
REGULAR MEETING
AUGUST 1, 2006
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos County Commissioners
Courtroom in the Courthouse in Bryan, Brazos County, Texas,
beginning at 9:00 a.m. on Tuesday, August 1, 2006 with the
following members of the Court present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4, Absent;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens
and officials that were in attendance.
Commissioner Peters gave the invocation and led the
pledge of allegiance.
Under citizen input/and or concerns the following spoke:
County Judge
a) Said that he had just gotten notice that there is a
hurricane brewing
The next matter before the Court was a presentation to
Brazos County of a 2005 Safety Award by the Texas Association
of Counties (TAC). Ernest Galindo representing TAC presented
the award. The award was earned for the County's record of

involvement and commitment to safety in the workplace as well
as for controlling their Workers Compensation claims.
The Court next considered Budget Amendment #05/06-42.1
through 42.5 that would reallocate funds for Capital
Projects-Commissioners Court, County Clerk Management Fund,
Agriculture Extension Service, Juvenile Services-Academy, and
County Judge. On motion by Commissioner Peters, seconded by
Commissioner Mallard, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is
attached hereto.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Peters, seconded by
Commissioner Wassermann, the Court voted unanimously to
approve the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
7021861 through 7022065
On motion by Commissioner Peters, seconded by Commissioner
Wassermann, the Court voted unanimously to approve the Claims
as submitted.
The next matter before the Court was consideration of
Brazos County Order #06-005 prohibiting outdoor burning in

Brazos County for ninety (90) days. Chuck Frazier, Emergency
Management Coordinator, said that two (2) fire chiefs are
recommending instituting a ban. The KBDI mean is over 500
currently. On motion by the County Judge, seconded by
Commissioner Peters, the Court voted unanimously to adopt the
order prohibiting outdoor burning in Brazos County. The
order is effective immediately.
The Court next considered establishing a standard hourly
rate for visiting bailiffs. On motion by the County Judge,
seconded by Commissioner Peters, the Court voted unanimously
to approve payment of $19.50 per hour for visiting bailiffs.
The Court next considered a request from Constable
Precinct 2, Donald Lampo, to appoint Peter E. Glidewell, as
Deputy Constable. On motion by Commissioner Peters, seconded
by Commissioner Mallard, the Court voted unanimously to
approve the request from Constable Lampo to appoint Peter E.
Glidewell as Deputy Constable.
On motion by the County Judge, seconded by Commissioner
Peters, the Court voted unanimously to receive, approve and
order filed as submitted the Treasurer's report for June
2006. A copy of which is attached to and made a part of these
minutes.

The Court next considered cancellation of the
Commissioners Court meeting for Tuesday, August 15, 2006.
Because most Commissioners will be attending a TAC conference
on that date, there will be no quorum. On motion by
Commissioner Mallard, seconded by Commissioner Peters, the
Court voted unanimously to cancel the Commissioners Court
meeting for Tuesday, August 15, 2006.
The Court next considered approval of a MasterCard to be
issued to Tom Quarles, Coliseum Complex Director for travel
expenses. On motion by the County Judge, seconded by
Commissioner Wassermann, the Court voted unanimously to
approve the issuance of a MasterCard to Tom Quarles.
The next matter for consideration was approval for the
Purchasing Agent to advertise Proposal 2006-038, Telephone
System for Brazos County Administration Building and
maintenance for all locations. On motion by Commissioner
Wassermann, seconded by Commissioner Peters, the Court voted
unanimously to authorize the Purchasing Agent to advertise
for proposals.
The Court next considered exercising the renewal option
in the mail processing contract with DeLucia Mail Service.
DeLucia has agreed to continue services with no increase in
cost to the County. On motion by Commissioner Mallard,

seconded by Commissioner Peters, the Court voted unanimously
to exercise the renewal option for another year.
The Court next considered the request from Brighton
Energy LLC to construct a road bore for a 4 inch natural gas
pipeline in the right-of-way of Dilly Shaw Tap Road

Road. The site is located in Precinct 2. Included with the
request is company check no. 31062 in the amount of $500.00
for the permit. The County Engineer stated that all

the Court voted unanimously to approve the request from

The Court next considered the request from Brighton
Energy LLC to construct a road bore for a 3 inch natural gas
pipeline in the right-of-way of Ferrell Creek Road
approximately 10,000 feet east of its intersection with North
FM 2038. The site is located in Precinct 2. Included with
the request is company check no. 31061 in the amount of
$500.00 for the permit. The County Engineer stated that all
appeared to be in order and recommended approval. On motion
by Commissioner Peters, seconded by Commissioner Mallard, the

Court voted unanimously to approve the request from Brighton

The Court next considered the request from Verizon

The next matter before the Court was consideration of a

Precinct 3 Constable to GT Distributors for ammunition
purchased in fiscal year 2005 on PO #6947. On motion by
Commissioner Mallard, seconded by Commissioner Wassermann,
the Court voted unanimously to approve the payment
authorization.
The Court next considered a payment authorization in the
amount of $1,028.71 from the Sheriff's department to The
Sharper Image for the purchase of an air purifier and related
items. On motion by Commissioner Peters, seconded by

Commissioner Wassermann, the Court voted unanimously to
approve the payment authorization.
At 9:18 a.m. the County Judge announced the meeting
closed to the public so that the Court could meet in Closed
Executive Session to discuss the purchase of real property as
allowed under Section 551.072 of the Texas Government Code.
At 9:52 a.m. the County Judge announced the meeting open
to the public. On motion by the County Judge, seconded by
Commissioner Peters, the Court voted unanimously to hire an
appraiser for various properties and other professionals as
needed and instructed Commissioner Mallard to negotiate for
the purchase of property.
There were no announcements of interest items and
possible future agenda topics.
There was no citizen input and/or concerns.
There were no Agency/Board/Committee reports by Court
members.
There being no further business to come before the
Court, the meeting was adjourned.

ORDER NO. 06-005
PROHIBITING OUTDOOR BURNING IN BRAZOS COUNTY
WHEREAS, the Commissioners Court of Brazos County finds that circumstances
present in all or part of the unincorporated area of the county create a public safety hazard that
would be exacerbated by outdoor burning;
IT IS HEREBY ORDERED by the Commissioners Court of Brazos County that all
outdoor burning is prohibited in the unincorporated area of the county for ninety (90) days from
the date of adoption of this Order, unless the restrictions are terminated earlier based on a
determination made by the Texas Forest Service or this Court. This Order is adopted pursuant to
Local Government Code § 352.081 and other applicable statutes. This Order does not prohibit
outdoor burning activities related to public health and safety that are authorized by the Texas
Natural Resources Commission for (1) firefighter training; (2) public utility, natural gas pipeline
or mining operations; (31 planting or harvesting of agricultural crops; or (4) burns that are
conducted by a prescribed burn manager certified under Section 153.048, Natural Resources
Code, and meet the standards of Section 153.047, Natural Resources Code.
In accordance with Local Government Code §352.081 (h), a violation of this Order is a
Class C misdemeanor, punishable by a fine not to exceed $500.00.

gas pipeline in the right of way of Dilly Shaw Tap Road approximately 4,000 ft. east of its
intersection with Fickey Road. Company Check No. 31062 in the amount of $500.00 for
the permit accompanies this request. Site is located in Precinct 2.

SOURCE OF FUNDS: N/A
REQUIREMENTS:
1) No work will be permitted between front slope and/or back slope.
2) All installation(s) shall be constructed in designated utility easements, if applicable. If no utility
easement exists, the installation(s) shall be 1) within 3-5' of and parallel to the right-of-way line and/or
2) in the case of a road bore, perpendicular to the right-of-way line.
3) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county right-of-way.
4) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; lest shall be
conducted by an independent geotechnical testing firm; copies of all test results shall be furnished to
the office of the Brazos County Engineer.
5) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic Control
Devices for Streets and Highways, published by the Texas Department of Transportation, and all other
State and Federal laws governing utility construction.

3) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's responsibility to
do so and to remove all cleared brush, trees etc. from county right-of-way.
4) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test shall be
conducted by an independent geolechnical testing firm; copies of all test results shall be furnished to
the office of the Brazos County Engineer.
5) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic Control
Devices for Streets and Highways, published by the Texas Department of Transportation, and all other
State and Federal laws governing utility construction.

Line Installation
July 18, 2006
To The Commissioner's Court of Brazos County
ATTENTION COUNTY JUDGE:
Formal notice is hereby given that VERIZON COMMUNICATIONS will construct
a communication line within the right-of-way of a County Road in Brazos County,
Texas as follows:
Verizon will dig up an existing cable along Marino Road 54 feet
northwest of the property comer of Marino Road RV Park. We
will make a buried splice at this location and set a pedestal at
the edge of the right-of-way. We will then pull a cable under
Marion Road thru a bore and conduit that is being provided by
Bayer Electric and set a pedestal at the edge of the northeast
right-of-way of Marino Road.
The location and description of this line and associated appurtenances is
more fully shown by four (4) copies of drawings attached to this notice. The line
will be constructed and maintained on the County Road right-of-way in
accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly
understood that the tender of this notice by the Verizon Southwest Incorporated
does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or
right now granted by law or may be granted in the future and any provision or
provisions so construed shall be null and void.
Construction of this line will begin on or after August 9, 2006.
