16. Permission to advertise RFP 2006-036, Legal Representative for Indigent Juveniles.
17. Renewal of the current contract with Asure Carpet Cleaning for three months beginning
10/01/06 through 12/431/06, with no increase in prices.
18. State contract purchase of the following equipment for the Detention Center kitchen:
a. gas steamer
b. gas convection oven
c. 80 gallon gas kettle
19. Requisition for the construction of the Millican communication tower and building as
per Bid 2006-033 (#00009826).
20. Requisition for the purchase of radio equipment for the Millican communication tower
(#00009821).
21. Requisition for electrical service to the Millican communication tower site
(900009828).
22. Request from Verizon Communications to construct a road bore (at minimum depth of
30 inches) for 25 pair cooper cable installation in the right of way of C6 Ranch Road
and Steep Hollow Road. Site is located in Precinct 2.

23. Permission to enter Brian and ko in Konecny's property located off Steep Hollow
Road for the purpose of clearing brush at.d trimming low hanging tree limbs along the
fence line (of the roadway curve) to create better silo distance for the health, safety and
welfare of the general public. Site is located in Precinct 2.
24. Permission to enter Debra Diamond Tucker's property located off Hopes Creek Road
for the purpose of improving the creek channel for approximately 150 feet to control
erosion under the bridge for the health, safety and welfare of the general public. Site is
located in Precinc/ /
25. Amending plat of the amending plat of lots 12-A and 13-A, block 2 of Tuscany Trace,
recorded in volume 5973, page 008 (official records of Brazos County), B.B.B. and
C.R.R. survey, A-82, Brazos County, Texas. Site is located in Precinct 1.
26. Payment authorization in the amount of $1510.10 to the Attorney General of Texas for
reimbursement of mileage and hotel expenses during the investigation and trial of The
State of Texas vs. Queen Walker.
27. Payment authorization in the amount of $1,466.87 to City Paint & Body for repairs to
the patrol vehicle for Constable Butler, Precinct 4. A purchase order was not obtained
in advance.
28. Payment authorization in the amount of $453.95 to Kone Elevator for repairs to an
elevator door that were not covered under the maintenance agreement. A blanket
purchase order was not in place
29. Announcement of interest items and possible future agenda topics.
30. Call for citizen input and/or concerns.
31. Agency/ Board/ Committee reports by Court members.

COMMISSIONERS' COURT
REGULAR MEETING
JULY 18, 2006
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos Center 3232 Briarcrest
Drive, in Bryan, Brazos County, Texas, beginning at 6:00 p.m.
on Tuesday, July 18, 2006 with the following members of the
Court present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4,
Absent;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Wassermann gave the invocation and led the
pledge of allegiance.
Under citizen input/and or concerns the following spoke:
Oscar Chappel
Complained about Pease street being closed for two
(2) days.
The Court next considered Budget Amendment #05/06-40.1
through 40.13, which would correct an error found in budget
amendment 05/06-7.1; transfer funds from Contingency to the
Health Department, Constable, Precinct 4, Building

Maintenance; and reallocate funds for the Juvenile Services,
Community Supervision, Jail Administration (2), C.O. Issue
2004, Information Technology, C.O. Issue 2005, County Clerk.
On motion by Commissioner Peters, seconded by Commissioner
Mallard, the Court voted unanimously to approve the budget
amendment as submitted, a copy of which is attached.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Peters, seconded by
Commissioner Wassermann, the Court voted unanimously to
approve the change of status as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
7021317 through 7021397
On motion by Commissioner Peters, seconded by Commissioner
Mallard, the Court voted unanimously to approve the Claims as
submitted.
The next matter before the Court was a request from
Justice of the Peace, Precinct 3, George Boyett for permission
for the purchase of equipment from the JP Technology Fund,
Minor Computer Hardware. On motion by Commissioner Mallard,
seconded by Commissioner Wassermann, the Court voted
unanimously to approve the request for the purchase of the

following items:

The Court next considered the appointment of Presiding
Judges and Alternate Judges for the Republican Party for
Elections conducted by Brazos County. On motion by
Commissioner Wassermann, seconded by Commissioner Peters, the
Court voted unanimously to approve the names submitted. A copy
of the list is attached.
The Court next considered the appointment of Presiding
Judges and Alternate Judges for the Democratic Party for
Elections conducted by Brazos County. On motion by
Commissioner Peters, seconded by Commissioner Mallard, the
Court voted unanimously to approve the names submitted. A copy
of the list is attached.
The Court next considered a request from Constable
Precinct 4, Isaac Butler, to appoint Samuel Gonzalez, as non-
paid Deputy Constable. On motion by Commissioner Peters,
seconded by Commissioner Wassermann, the Court voted
unanimously to approve the request from Constable Butler to
appoint Samuel Gonzalez as non-paid Deputy Constable subject
to appointment being within the allotted number of deputies.

The Court next considered a request from Constable
Precinct 2, Donald Lampo, to appoint Terri G. Lee, as non-paid
Deputy Constable. On motion by Commissioner Peters, seconded
by Commissioner Wassermann, the Court voted unanimously to
approve the request from Constable Lampo to appoint Terri G.
Lee as non-paid Deputy Constable subject to appointment being
within the allotted number of deputies.
The next matter for consideration was approval of tax
refund applications from the following individuals and/or
companies:
a) Dale & Bobby Claypool, Over Payment $8.13
b) Daric & Kayla Green, Over Payment $500.00
c) Gary F. & Paula McCauley $23.08
On motion by Commissioner Mallard, seconded by Commissioner
Peters, the Court voted unanimously to approve the tax refund
applications.
On motion by the County Judge, seconded by Commissioner
Peters, the Court voted unanimously to receive, approve and
order filed as submitted the Treasurer's report for May 2006.
A copy is attached to and made a part of these minutes.
The next matter before the Court was consideration of
Change Order No. 002 for the Exposition Center allowing for
changes in the floor boxes in the Exhibit Hall and revisions in
the Stall Barn which would increase the contract amount by

$160,201.00. On motion by Commissioner Peters, seconded by
Commissioner Wassermann, the Court voted unanimously to approve
Change Order Number 2. A copy is attached.
The Court next considered awarding Bid No. 2006-034,
Flexible Base/Screenings/Sand. Becky Stephens, Assistant
Purchasing Agent, made the recommendations as per the attached
bid tabulation sheet. On motion by Commissioner Wassermann,
seconded by Commissioner Peters, the Court voted unanimously to
accept the recommendations of the Assistant Purchasing Agent
and awarded the contract as noted in the attached bid
tabulation sheet.
The Court next considered the declaration of surplus
property as salvage. This property was advertised for sale in
accordance with Local Government Code §263.152 and received no
bids. On motion by the County Judge, seconded by Commissioner
Peters, the Court voted unanimously to declare the property as
salvage and authorized its destruction or other disposal.
The next matter for consideration was approval for the
Purchasing Agent to advertise Proposal 2006-036, Legal
Representative for Indigent Juveniles. On motion by
Commissioner Peters, seconded by Commissioner Mallard, the
Court voted unanimously to authorize the Purchasing Agent to
advertise for proposals for legal representation of indigent

juveniles.
The next matter before the Court was consideration of
renewal of current contract with Asure Carpet Cleaning for an
additional three months. Asure has agreed to provide services
for this period with no increase in prices. On motion by
Commissioner Peters, seconded by the County Judge, the Court
voted unanimously to approve the renewal for the period of
October 1, 2006 through December 31, 2006.
The Court next considered approval of a requisition to
Stepco Restaurant Supply in the amount of $23,967.31 for the
purchase of a steamer, convection oven and a kettle. On motion
by Commissioner Peters, seconded by Commissioner Mallard, the
Court voted unanimously to approve the requisition.
The Court next considered approval of a requisition to
Texas Communications in the amount of $67,750.00 for the
construction of the communication tower and building at
Millican per bid #2006-033. On motion by Commissioner
Wassermann, seconded by Commissioner Peters, the Court voted
unanimously to approve the requisition.
The Court next considered approval of a requisition to
Motorola in the amount of $50,058.15 for the purchase of Radio
equipment for the communication tower at Millican. On motion
by Commissioner Peters, seconded by Commissioner Mallard, the

Court voted unanimously to approve the requisition.
The Court next considered approval of a requisition to
City of Bryan BTU in the amount of $7,537.90 for 200 amp,
120/240 volt single phase service located at 21550 Kathy
Flemming Road for the communication tower at Millican. On
motion by Commissioner Mallard, seconded by Commissioner
Wassermann, the Court voted unanimously to approve the
requisition.
The Court next considered the request from Verizon to
construct a road bore (at minimal depth of 30 inches) for 25
pair copper cable installation in the right-of-way of C6 Ranch
Road and Steep Hollow Road in Precinct 2. The County Engineer
stated that all appeared to be in order and recommended
approval. On motion by Commissioner Peters, seconded by
Commissioner Wassermann, the Court voted unanimously to approve
the request by Verizon and authorized the installation. A copy
of the request is attached hereto.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Brian and Robin
Konecny on Steep Hollow Road in Precinct 2 to clear out brush
and trim low hanging tree limbs along the fence line. On

motion by Commissioner Peters, seconded by Commissioner
Wassermann, the Court voted unanimously to authorize the work.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Debra Diamond
Tucker on Hopes Creek Road in Precinct 1 to improve the creek

bridge. On motion by Commissioner Wassermann, seconded by
Commissioner Peters, the Court voted unanimously to authorize

Trace in Precinct 1. Richard Vance, County Engineer, stated
that he had reviewed the plat and found it to be in order. On
motion by Commissioner Wassermann, seconded by Commissioner
Peters, the Court voted unanimously to approve the Amending
Plat of the Amending Plat of Lots 12-A and 13-A, Block 2 of
Tuscany Trace as submitted.
The next matter before the Court was consideration of a
payment authorization in the amount of $1,510.10 submitted by
the Attorney General of Texas for reimbursement of mileage and
hotel expenses during the investigation and trial of the State

of Texas vs. Queen Walker. The County Judge stated that he
was not happy with this billing and could not vote for
approval. Commissioner Peters moved to approve. Commissioner
Mallard seconded the motion. Commissioner Peters and Mallard
voted "Aye". Commissioner Wassermann and the County Judge
voted "No". The motion for approval failed.
The Court next considered a payment authorization in the
amount of $1,466.87 to City Paint & Body for repairs on a
patrol car for Constable, Precinct 4. No purchase order was
obtained. On motion by Commissioner Peters, seconded by
Commissioner Mallard, the Court voted unanimously to approve
the payment authorization.
The next matter before the Court was consideration of a
payment authorization in the amount of $453.95 to Kone
Elevator to service the three courthouse elevators. No
purchase order was obtained. On motion by the County Judge,
seconded by Commissioner Peters, the Court voted unanimously
to approve the payment authorization.
There were no announcements of interest items and
possible future agenda topics.

advertising is working.

Corbyn, attached is a sketch for the stall barn drops. This using this method we would mount the unistrut directly
to the pudins and the weight per sq ft would be approx. 120lbs per 400 sq ft, or .3 Ibs per sq ft. It is my
understanding that Brian is putting together a drawing of the new stall layout which we will need to accurately
estimate a hanging grid system.

The owner is proposing to change the lighting setup that occurs in the stalls of the Stall Barn between frame lines
5 and 7 and 11 and 13 in the "clouded" areas on the attached electrical floor plan. It seems that this system will
only amount to 0.3 pounds per square foot. Since we already have 3psf collateral, that includes lighting, this
doesn't seem to actually be an addition. But, I wanted to let you review this so you could confirm my feelings.

ITEM: Request from Verizon Communications to construct a road bore (at minimal depth
of 30 inches) for 25 pair copper cable installation in the right of way of C6 Ranch Road
and Steep Hollow Road. Site is located in Precinct 2.
SOURCE OF FUNDS: N/A
REQUIREMENTS:
1) No work will be permitted between front slope and/or back slope.
2) All installation(s) shall be constructed in designated utility easements, if applicable. If no utility
easement exists, the installation(s) shall be 1) within 3-5' of and parallel to the right-of-way line and/or
2) in the case of a road bore, perpendicular to the right-of-way line.
3) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's responsibility to
do so and to remove all cleared brush, trees etc. from county right-of-way.
4) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test shall be

ATTENTION COUNTY JUDGE:
Formal notice is hereby given that VERIZON COMMUNICATIONS will construct
a communication line within the right-of-way of a County Road in Brazos County,
Texas as follows:
Verizon Communications will place a 25 pair copper cable along,
parallel to and 5' inside the north R.O.W. of Steep Hollow Road at
C6 Ranch Road. We will make a dig up on the existing cable and
then place the new cable in the easement of C6 Ranch Road. We
will also bore under C6 Ranch Road and make another dig up to
serve the existing 6 pair cable now serving C6 Ranch Road. The
cable will be a minimum of 30' deep.
The location and description of this line and associated appurtenances is
more fully shown by four (4) copies of drawings attached to this notice. The line
will be constructed and maintained on the County Road right-of-way in
accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly
understood that the tender of this notice by the Verizon Southwest Incorporated
does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or
right now granted by law or may be granted in the future and any provision or
provisions so construed shall be null and void.
Construction of this line will begin on or after August 2, 2006.
