Mutual Aid Agreement between all counties which comprise the Gulf Coast Planning Region for the purpose of securing for each Party the benefits of mutual aid and protection of life and property in the event of a disaster and/or emergency. 14. Request from the Sheriffs Office for approval to pay lodging expenses in excess of what Brazos County allows for two investigators who traveled to the Dallas area to conduct interviews and obtain additional evidence in the case of Baby Joseph. 15. Resolution 06-009 authorizing Judge Sims to request reimbursement for the purchase of body armor from the OJP Bullet Proof Vest Partnership Grant through the use of electronic signatures, and granting Judge Sims as CEO the ability to delegate the responsibility for use of the accepted electronic signature to the Brazos County Auditor. 16. Change Order No. 001 for the Sheriffs Administration Building in the amount of $26,823.00. 17. Contract between Brazos County and The Eagle for municipal advertising, with no change in rates from the current year. Contract term is 1 July 2006 through 30 June 2007. 18. Acknowledgement of Lori Kessler, Deputy Clerk in the District Clerk's office, for receiving a Certificate of Appreciation from the United States Department of Homeland Security for outstanding support of the U.S. Immigration & Customs Enforcement's Operation Two Step. 24. Acknowledgement of certificate of completion for the required course of training on the Texas Public Information Act and the Texas Open Meetings Act for the following elected officials: a. Lloyd Wassermann 25. Acknowledgement of the Monthly Reports submitted in June 2006. These reports are available for review in the County Judge's Office. 26. COMMISSIONERS' COURT REGULAR MEETING JULY 11, 2006 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, July 11, 2006 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Peters gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns. The first matter before the Court was the transfer of $5,500 from the Sheriff's Capital Budget Funds to Minor Computer Hardware for the purchase of computer hardware necessary to support the Sheriff's Arbitrator in-car digital video systems. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the transfer of funds. Vol ~a Page 48 Commissioners Court meeting July 11, 2006 2 The Court next considered Budget Amendment #05/06-39.1 through 39.13 that would reallocate funds for the Treasurer, Risk Management, D.A. Crime Fund, Juvenile Services, CO Issue 2004, Sheriff, Constable Precinct 2, Constable Precinct 3, 272nd District Court, Capital Projects, Road and Bridge Department, and Agricultural Extension Service; transfer funds from Juvenile Services and Justice of the Peace Precinct 3 to Contingency. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The next matter before the Court was a request from the Jail Administrator requesting permission to reclassify Position 1541-1 to Position 1505-12. Both positions perform the same essential duties, and are in the same pay group. On motion by Commissioner Wassermann, seconded by Commissioner Cauley, the Court voted unanimously to approve the request. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the changes as submitted. Vol W Page ~ 1 Commissioners Court meeting July 11, 2006 3 The Court next considered the following Claims as submitted by the County Treasurer for payment: 7020973 through 7021315 On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the Claims as submitted. Then on motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to approve claim number 7021316. The next matter for consideration by the Court was the reinstatement of Brazos County Order #06-003, prohibiting outdoor burning in Brazos County. On motion by Commissioner Mallard, seconded by Commissioner Peters, the Court voted unanimously to remove the burn ban from the agenda. The Court next considered endorsement of the National Incident Management System (N.I.M.S.) training plan for Brazos County as prepared by Emergency Management. Chuck Frazier, Emergency Management Coordinator, explained plans for the training and gave the Commissioners a list of county employees who need the training to satisfy the federal requirement. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to endorse the training plan. The next matter before the Court was consideration of an Vol Sa Page 50 Commissioners Court meeting July 11, 2006 4 Interlocal Agreement between Brazos County and the Brazos Valley Council of Governments concerning usage of the 9-1-1 database for the purpose of emergency notification. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to approve the agreement. A copy is attached. The Court next considered approval of a Mutual Aid Agreement with Walker County. Walker County is preparing a grant application for Homeland Security funds and one of the requirements for the grant is to have mutual aid agreements with surrounding counties. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the Mutual Aid Agreement with Walker County. A copy is attached. The next matter before the Court was a request from the Sheriff's Office for approval to pay lodging expenses in excess of the per diem rate of $85.00. Two investigators traveled to the Dallas area to conduct interviews and obtain additional evidence in the Baby Joseph case and were unable to find lodging within the approved rate. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve payment of lodging expenses in excess of the per diem rate for the investigators. Vol ~ a Page 51 Commissioners Court meeting July 11, 2006 5 The next matter before the Court was consideration of Resolution 06-009, authorizing the County Judge to request reimbursement for the purchase of body armor from the OJP Bullet Proof Vest Partnership Grant. On motion by the County Judge, seconded by Commissioner Peters, the Court voted unanimously to adopt Resolution #06-009 authorizing the County Judge to request reimbursement in the amount of $6,846.75 from the OJP Bullet Proof Vest Partnership Grant and to delegate responsibility for the use of the application of the accepted electronic signature to the Brazos County Auditor. The Auditor's office will submit to the County Judge for review and examination a recap summarizing the purpose of the information transmitted and the funding anticipated. The Court next considered Change Order Number 1 for the Sheriff's Administration Building in the amount of $26,823.00. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve Change Order Number 1. A copy is attached. The next matter before the Court was consideration of a contract between Brazos County and The Eagle for municipal advertising with no change in rates from the current year. The Court next considered the award of Bid 2006-033. Becky Stephens, Assistant Purchasing Agent recommended acceptance of the bid submitted by Texas Communications for the construction of a communication tower and building at Millican. On motion by Commissioner Cauley, seconded by Commissioner Wassermann, the Court voted unanimously to accept the recommendation of the Assistant Purchasing Agent and award the bid to Texas Communications. A copy of the bid tabulation is attached. The Court next considered approval of the minutes of the Commissioners' Court meetings held in May 2006 on the following dates: Regular Meetings -2nd, Stn, 16th, 23rd, 30th Workshop Meeting - 2nd, 16th On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the minutes as submitted. The Court next considered the request from Wickson Special Utility District to construct a road bore for water line installation in the right-of-way of Marino Road approximately 1,450 feet from its intersection with State Highway 21. The sites are located in Precinct 2. The County Vol 9 a Page 53 Commissioners Court meeting July 11, 2006 7 Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the request from Wickson Special Utility District and authorized the installation. A copy of the request is attached hereto. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Joe Bonifazi on Dilly Shaw Tap Road in Precinct 2 to park county equipment and vehicles. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. Courses Level l Level 2 Level 3 Level 4 IS-100 Intro to ICS IS-200 Basic ICS F.E.M.A. IS - 700 N.LM.S, An Introduction F.E.M.A. IS - 800 National Response Plan, An Introduction In response to Homeland Security Presidential Directive No. 5, Brazos County Commissioners' Court Order No. 05-004 (dated August 2, 2005) adopted the National Incident Management System (N.I.M.S.). This requires that many Brazos County employees achieve certain levels of N.I.M. S. training by the federal deadline of October 1, 2006. Attached is a spreadsheet listing county employees, by department, who I feel need N.I.M.S. training to satisfy the federal requirement, as well as the level of training I feel would be sufficient for each employee. Elected officials and/or department heads are welcome to contact me to discuss this list. WHEREAS, Brazos County has expressed interest in assisting Burleson, Leon and Robertson counties with providing an emergency notification system to the all their citizens, and; WHEREAS, Dialogic Communications Corporation (DCC) provides a service to Brazos County to assist municipalities and other organizations with emergency notification systems, and; WHEREAS, it would be to the mutual benefit to all entities to establish a county-wide alerting system, and; WHEREAS, the emergency notification system will be securely located under the protection of the Brazos County 9-1-1 Emergency Communications District, therefore having access to the 9-1-1 database obtained for the purpose of an emergency notification system for Burleson, Leon and Robertson counties, and; WHEREAS, The State law provides and the Texas Attorney General has concluded, that the 9-1-1 database information is confidential and is not available for public inspection. (Texas Health & Safety Code, Section 771.061(a); Texas Attorney General Open Records Decision 661, 1999. Release of the data contained in the 9-1-1 database is to be used for the purpose of warning or alerting citizens regarding information in an emergency situation where property or human life is in jeopardy and is to be maintained as confidential and not subject to public inspection in accordance with Texas Health & Safety Code, Section 771.061(a). THEREFORE, The purpose of this agreement is to be in full compliance with Rule 251.13 stated by the Commission on State Emergency Communications (CSEC) "The Use of the 9-1-1 Database for Emergency Notification Services." In accordance with rule 251.13, all parties agree that the 9-1-1 database will only be used in an emergency situation and will be kept confidential and not available to the public for inspection in accordance with Texas Health and Safety Code, Section 771.061 (a). 2 Due to the confidential nature of the 9-1-1 database information and privacy of citizens with unlisted and unpublished numbers, BVCOG will retain the right to withdraw their assistance if Brazos County or DCC, does not maintain the confidentiality of the information or misuse of the emergency notification service. Charges for activation of the system will be the sole responsibility of Brazos County and any agreement it has with Burleson, Leon and Robertson counties. BVCOG will not be liable for any costs incurred by the entity with 9-1-1 PSAPs associated with the countywide emergency notification system. This Agreement supersedes any and all other agreements, either oral or in writing between the parties hereto with respect to the subject matter hereof, and no other agreement, statement or promises relating to the subject matter of this Agreement which is not contained herein shall be valid or binding. The term of this Agreement shall be for a period of one (1) year from and after the date of execution hereof subject to other terminations rights of the parties as established in this document. At the end of the initial one (1) year term, unless either part gives written notice of termination, this Agreement shall automatically be extended for two (2) years. Either party may terminate this Agreement upon thirty (30) days written notice to the other party. BVCOG By: Tom Wilkinson, Executive Director Brazos County By: Brazos County Judge Date: Date: 7l (/-Za' VOE Fa PAGE 97 GULF COAST PLANNING REGION REGIONAL COUNTY-LEVEL MUTUAL AID AGREEMENT State of Texas § County of Walker § This Mutual Aid Agreement (Agreement) is entered into by, between, and among the following counties, all of which are Parties hereto and which comprise the Gulf Coast Planning Region: Austin County, Texas Brazoria County, Texas Brazos County, Texas Chambers County, Texas Colorado County, Texas Fort Bend County, Texas Galveston County, Texas Grimes County, Texas Harris County, Texas Leon County, Texas Liberty County, Texas Matagorda County, Texas Montgomery County, Texas Polk County, Texas San Jacinto County, Texas Walker County, Texas Waller County, Texas Wharton County, Texas Recitals The Parties recognize the vulnerability of the people and communities located in their jurisdictions to damage, injury, and loss of life and property resulting from emergencies and/or disasters and recognize that disasters and/or emergencies may present equipment and manpower requirements beyond the capacity of each individual Party. The Parties recognize that in the past mutual aid has been provided between or among the Parties in the form of personnel, supplies and equipment during emergencies and/or disasters as well as during cleanup periods. The governing officials of the Parties desire to secure for each Party the benefits of mutual aid and protection of life and property in the event of a disaster and/or emergency. The Parties wish to make suitable arrangements for furnishing mutual aid in coping with emergencies and/or disasters and are authorized and make this Agreement pursuant to Chapter 791 of the Texas Government Code, Chapter 418 of the Texas Government Code, and Executive Order of the Governor of the State of Texas, RP 12, dated April 3, 2002. Page 1 of 26 Gulf Coast Region - Regional County-Level Mutual Aid Agreement June 2006 The Parties recognize that a formal agreement for mutual aid would allow for better coordination of effort, provide that adequate equipment is available, and help ensure that mutual aid is accomplished in the minimum time possible and desire to enter into an agreement to provide mutual aid consistent with the mutual aid plans developed by the respective jurisdictions and approved by the governing bodies of the jurisdictions. NOW, THEREFORE, the Parties agree as follows: Terms 1. Recitals. The recitals set forth above are true and correct. 2. Party's Emergency Management Plan. Each Party shall prepare and keep current an emergency management plan for its jurisdiction to provide for emergency/disaster mitigation, preparedness, response and recovery. The emergency management plan shall incorporate the use of available resources, including personnel, equipment and supplies, necessary to provide mutual aid. The emergency management plan shall be submitted to the Governor's Division of Emergency Management. 3. Emergency Management Director. The County Judge of each county participating in this Agreement shall serve as the Emergency Management Director for its respective jurisdiction and shall take al steps necessary for the implementation of this Agreement. Each County Judge may designate an Emergency Management Coordinator who shall serve as an assistant to the presiding officer of the county for emergency management purposes. 4. Upon Request. Upon request of the Emergency Management Director or the designated Emergency Management Coordinator, each Party hereto shall furnish mutual aid in coping with an emergency and/or disaster and the forces necessary to provide such mutual aid to a requesting Party subject to the terms of this Agreement. 5. Conditions. Any furnishing of resources under this Agreement, which includes but is not limited to equipment, supplies, and personnel, is subject to the following conditions: a. a request for aid shall specify the amount and type of resources being requested, shall state the location to which the resou?ces are to be dispatched, and shall state the time period for which such resources are requested; b. the Party rendering aid shall take such action as is necessary to provide and make available the resources requested, provided however, that the Party rendering aid, in its sole discretion, shall determine what resources are available to furnish the requested aid; C. the Party rendering aid shall report to the officer in charge of the requesting Party's forces at the location to which the resources are dispatched; and d. the Party rendering aid shall be released by the requesting Party when the services of the Party rendering aid are no longer required or when the officer in charge of the Party rendering aid forces determines, in his sole discretion, that further assistance should not be provided. In the event of a disaster or emergency affecting one Party hereto, the Party requesting mutual aid shall serve as the coordinating agency for that event, which includes coordinating the call-up and assignment of resources to the affected area. b. In the event of a widespread emergency or disaster affecting more than one Party, each affected Party shall utilize its respective State of Texas Department of Public Safety Disaster District Committee. C. The Offices of Emergency Management shall maintain a current listing of all Parties to this Agreement. Such listing shall include personnel to be contacted in each county, appropriate telephone and facsimile numbers, and other information that would be needed in order to contact each Party in the event of an emergency or disaster. 7. Declaration of Disaster. In the event of a declaration of a local state of disaster by a Party pursuant to Chapter 418 of the Texas Government Code, this Agreement shall be in effect. 8. Waiver of Claims Against Parties. Each Party hereto waives all claims against the other Parties hereto for compensation for any loss, damage, personal injury, or death occurring as a consequence of the performance of this Agreement, except those caused in whole or in part by the negligence of an officer or employee of another Party. 9. Costs. A Party rendering aid may be reimbursed by the requesting Party for costs incurred pursuant to this Agreement in furnishing mutual aid. Personnel who are assigned, designated or ordered by their governing body to perform duties pursuant to this Agreement shall receive the same wages, salary, pension, and other compensation and benefits for the performance of such duties, including injury or death benefits and worker's compensation benefits, as though the service had been rendered within the limits of the jurisdiction where the personnel are regularly employed. All wage and disability payments, except for the payments the requesting Party is required to pay under the Interlocal Cooperation Act, pension payments, damage to equipment and clothing, medical expenses, and expenses of travel, food and lodging shall be paid by the Party in which the employee in question is regularly employed. 10. Equipment and Personnel. All equipment used by the Party rendering aid under this Agreement will, during the time the aid is being furnished, be owned, leased, or rented by it and all personnel acting for the Party rendering aid under this Agreement will, during the time the aid is being furnished, be paid by the Party rendering aid. At all times while equipment and personnel of a Party rendering are traveling to, from or within the geographical limits of the requesting Party in accordance with the terms of this Agreement, such personnel and equipment shall be deemed to be employed or used, as the case may be, in the full line and cause of duty of the Party rendering aid. In addition, such personnel shall be deemed to be engaged in a governmental function of their entity. No Party waives or relinquishes any immunity or defense on behalf of itself, its officers, employees and agents as a result of its execution of this Agreement and the performance of the covenants contained herein. 12. Emending Funds. Each Party which performs services or furnishes aid pursuant to this Agreement shall do so with funds avaiiable from current revenues of the Party. No Parry shall have any liability for the failure to expend filsnds to provide aid hereunder. 13. Termination. It is agreed that any Party hereto shall have the right to terminate its participation in this Agreement upon Ninety (90) days written notice to the other Parties hereto. 14. Term. This Agreement shall become effective as to each Party when approved and executed by that Party. This Agreement shall continue in force and remain binding on each and every party until such time as the governing body of a Party terminates its participation in this Agreement. Termination of participation in this Agreement by a Party(ies) shall not affect the continued operation of this Agreement between and among the remaining Parties and this Agreement shall continue in force and remain binding on the remaining Parties. 15. Entire . This Agreement contains all commitments and agreements of the Parties as to mutual aid to be rendered during or in connection with an emergency and/or effect if not contained herein. No other oral or written commitments of the parties shall have any force or effect if not contained herein. Notwithstanding the preceding sentence, it is understood and agreed that certain signatory Parties may have heretofore contracted or hereafter contract with each other for mutual aid in emergency and/or disaster situations, and it is agreed that this Agreement shall be subordinate to any such individual contract. 16. Other Mutual Aid Agreements. To assist each other in the process of mutual aid response planning, each Party agrees to inform the other Parties of all mutual aid agreements that each Party has with other municipalities, entities, counties, and state or federal agencies. 17. Ratification. Each Party hereby ratifies the rendering and/or receiving of mutual aid taken prior to the date of this Agreement. 18.Interlocal Cooperation Act. The Parties agree that mutual aid in the context contemplated herein is a "governmental function and service" and that the Parties are "local governments" as those terms are defined in the Interlocal Cooperation Act. 19. Notice.
