BRAZOS COUNTY COMMISSIONERS COURT
THE COMMISSIONERS COURT OF BRAZOS COUNTY WILL MEET IN REGULAR
SESSION ON 30 MAY 2006 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM
OF THE BRAZOS COUNTY COURTHOUSE, 300 E. 26' STREET, SUITE 115,

1. Invocation and Pledge of Allegiance - Commissioner Peters.
2. Call for citizen's input and/or concerns.
3. Presentation of continuing education certificates by Dr. Alma Fonseca to those who
participated in the V. G. Young Institute of County Government's 48th Annual County
Judges and Commissioners Continuing Education conference.
Consider and take action on agenda items 4 - 20:

5. Reclassification of the Clerk position in the Precinct 4 Constable's Office (Division

10. Addition of the 9-1-1 District to the County's health insurance plan.
11. Permission to accept the following property donated to the Brazos County Juvenile
Services Department:
a. Trolley passes from Brazos Transit District; estimated value is $200.00.

Jones-Butler Road for sanitary sewer line installation. Site is located in Precinct 1
17. Request from B.W.O.C., Inc. to construct two (2) road bores for a natural gas pipeline in
the right of way of Opersteny Lane, with payment of $1000.00 (check #28870). Site is
located in Precinct 2.
18. Request from Creek Meadow Partners to construct a six (6) inch force main sanitary
sewer line in the right of way of Greens Prairie Trail, Woodlake Drive and Greens Prairie
Road. Site is located in Precinct 1.
19. Payment authorization in the amount of $570.00 to Traci Thomas for a youth
development workshop held on 20 May 2006 for the Juvenile Services Department. A
purchase order was not obtained in advance.

20. Payment authorization from the Road & Bridge Department in the amount of $12,472.10
to Colorado Materials. P.O. #19100 was closed out by mistake.

REGULAR MEETING
MAY 30, 2006
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos County Commissioners
Courtroom in the Courthouse in Bryan, Brazos County, Texas,
beginning at 9:00 a.m. on Tuesday, May 30, 2006 with the
following members of the Court present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Peters gave the invocation and led the
pledge of allegiance.
There was no citizen input/and or concerns.
The first matter before the Court was the presentation of
continuing education certificates by Dr. Alma Fonseca to those
who participated in the V. G. Young Institute of County
Government's 48th Annual County Judges and Commissioners
Continuing Education Conference.
The Court next considered Budget Amendment #05/06-34.1
through 34.8 that would reallocate funds for the Certificates

of Obligation 2004-Justice of the Peace Building, Juvenile
Services, Magistrate, Non-Departmental, Information
Technology, Exposition Center; transfer funds from Road and
Bridge Contingency to Certificates of Obligation 2003-
Sheriff's Administration Building, and from Contingency to
Certificates of Obligation 2005. On motion by Commissioner
Cauley, seconded by Commissioner Peters, the Court voted
unanimously to approve the budget amendment as submitted, a
copy of which is attached hereto.
The next matter before the Court was the reclassification
of the Clerk position in the Constable Precinct 4 Office.
Constable Butler made the following request:

On motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the
reclassification but will increase the Step to 6 rather than a

The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. Commissioner Cauley moved to approve. Commissioner
Wassermann, seconded the motion. Commissioners Wassermann,

Mallard, Cauley and the County Judge voted "Aye".
Commissioner Peters abstained because his daughter's name
appears on the change of status list.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
7019753 through 7019983
On motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted.
The next matter for consideration by the Court was Brazos
County Order #06-003, prohibiting outdoor burning in Brazos
County. On motion by the County Judge, seconded by
Commissioner Cauley, the Court voted unanimously to remove
this item from the agenda.
The Court next considered payment of lodging expenses for
Commissioner Mallard while attending the Texas High Speed Rail
and Transportation meetings. The cost exceeded the maximum
paid by the County. The County Judge moved to approve.
Commissioner Peters seconded the motion. Commissioners
Wassermann, Peters, Cauley and the County Judge voted "Aye".
Commissioner Mallard abstained. The motion carried.
The next matter before the Court was the addition of the
Brazos County 9-1-1 District employees to the County's health

insurance. On motion by Commissioner Mallard, seconded by
Commissioner Peters, the Court voted unanimously to approve
the addition of the Brazos County 9-1-1 District employees to
the County's health insurance.
The Court next considered authorizing acceptance of
donated property from Brazos Transit District. The District
has offered the Juvenile Services department 200 Trolley
Passes with an estimated value of $200.00. On motion by
Commissioner Cauley, seconded by Commissioner Peters, the
Court voted unanimously to accept the donated property.
The next matter for consideration was approval of tax
refund applications from the following individuals and/or
companies:
a) David Blevins, Over Payment $242.64
b) Norma Reyes Bragg, Over Payment $335.52
c) William H. & Monica Bauerschlag, Over Payment
$32.88
d) D&S Water Services, Over Payment $116.17
e) Leann Floyd, Over Payment $362.90
f) Alan E. & Beatrice F. Minde, Over Payment $33.34
g) Curtis & Angela Strong, Over Payment $825.30
On motion by Commissioner Peters, seconded by Commissioner
Wassermann, the Court voted unanimously to approve the tax
refund applications.
The Court next considered the declaration of surplus
property as salvage. This property was advertised for sale in
accordance with Local Government Code §263.152 and received no

bids. On motion by Commissioner Peters, seconded by
Commissioner Cauley, the Court voted unanimously to declare
the property as salvage and authorized its destruction or
other disposal. A list of the property is attached.
The next matter before the Court was the appointment of
individuals to serve on the committee to select a company/firm
for collection services per RFP 2006-032. On motion by the
County Judge, seconded by Commissioner Cauley, the Court voted
unanimously to appoint the following individuals to serve on
the committee:
a) Lloyd Wassermann, Commissioner Precinct 1
b) E. Duane Peters, Commissioner Precinct 2
c) Rod Anderson, Assistant County Attorney
d) Tanya Skinner, Collections Supervisor
e) George Boyett, Justice of the Peace, Precinct 3
f) Charles Ellis, Justice of the Peace, Precinct 1
g) Steve Smith, 361st District Court Judge
The next matter for consideration was consideration of
Amendment #1 to the Contract for Construction Manager At Risk
Services between Owner and Construction Manager. On motion by
the County Judge, seconded by Commissioner Peters, the Court
voted unanimously to approve Amendment #1 and authorized the
County Judge to execute the document. A copy is attached.
The Court next considered the request from Aggieland
Builders, LLC to construct a road bore in the right-of-way of
Jones Butler Road for sanitary sewer line installation. The

sites are located in Precinct 1. The County Engineer stated
that all appeared to be in order and recommended approval. On
motion by Commissioner Wassermann, seconded by Commissioner
Peters, the Court voted unanimously to approve the request
from Aggieland Builders, LLC and authorized the installation.
A copy of the request is attached hereto.
The Court next considered the request from B.W.O.C., Inc.
to construct two (2) road bores for a natural gas pipeline in
the right-of-way of Fickey Road and Opersteny Lane. The site
is located in Precinct 2. Company Check No. 28870 in the
amount of $1,000.00 for the permit accompanies the request.
The County Engineer stated that all appeared to be in order
and recommended approval. On motion by Commissioner Peters,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the request from B.W.O.C., Inc. and authorized the
installation. A copy of the request is attached hereto.
The Court next considered the request from Creek Meadow

The Court next considered a payment authorization in the
amount of $570.00 to Traci Thomas for a youth development

seconded by Commissioner Cauley, the Court voted unanimously

The next matter before the Court was consideration of a
payment authorization in the amount of $12,472.01 to Colorado
Materials. The purchase order had been closed out by mistake.
On motion by Commissioner Wassermann, seconded by Commissioner
Cauley, the Court voted unanimously to approve the payment
authorization.
Under announcement of interest items and possible future
agenda topics the following spoke:

a) Stated the need for an Expo Committee
meeting.
Kay Hamilton, Treasurer
a) The 4th of July falls on a Tuesday. The
Court will need to decide soon if they are
going to reschedule the Commissioners
Court meeting on not.

a) He asked Commissioner Mallard about progress
on the High Speed Rail. Commissioner
Mallard replied that American and
Continental Airlines were showing interest
in joining the group.
There being no further business to come before the Court,
the meeting was adjourned.

AMENDMENT NO.1
TO AGREEMENT BETWEEN OWNER AND CONSTRUCTION MANAGER
Pursuant to Section 1,B of the Agreement, dated October 31, 2005 between Brazos
County, Texas (Owner) and Hunt Construction Group, Inc. (the Construction Manager),
for 1) Brazos County Exhibit Hall; Arena, Stall Bams and 2) Brazos County Sheriffs
Office Building (the Project), the Owner and Construction Manager establish a
Guaranteed Maximum Price and Contract Time for the Work as set forth below.
ARTICLE I GUARANTEED MAXIMUM PRICE
The Construction Manager'0 Guaranteed Maximum Price for the Work, including the
estimated Cost of the Work as defined in Article 6 and the Construction Manager's Fee as
defined in Article 5, is Twenty-Two Million Forty Thousand Four Hundred Fifty-Four
Dollars (E22,M,454.00) This Price is for the performance of the Work in
accordanoOVAdi tE`eContractDocuments listed and attached to this Amendment and -
Exhibit A Drawings, Specifications, addenda and General,
Supplementary and otter -CndiUons of the Contract on which the Guaranteed

ASSUMPTIONS & CLARIFICATIONS - EXPOSITION CENTER
May 16, 2006
1.) The following VE items have been incorporated into the GMP:
A. VE #1 - Change the metal roof at the concessions/restrooms to a composite
shingle roof at the covered arena.
B. VE #14 - Revise the feeders for service from the City transformer to the
packaged unit MSB from 2500A to 1200A, 277/480V/3P.
C. VE #15 - Relocate panel C4 to hallway of stairway #118, change panel C4
from 100A to 225A, change feeder from 100A to 225A and relocate branch
circuits C2-1, 2,3,11,29,31,34 to panel C4.
2.) The Contingency amount has been reduced and separated as follows:
A. Construction Contingency ($400A00.00) - To be utilized by Hunt
Construction throughout the course of the project to cover coordination and
completion of miscellaneous scope items between trades, overtime costs and
other items required to complete the work shown on the construction
documents.
B. Owner Contingency ($100,000.00) -To be utilized by Brazos County to
cover owner requested changes or architect clarifications and modifications.
3.) The following RFI's are included in the GMP: RFI's 1-5, 7-19 and 22-35. These
RFI's were incorporated into Post Bid Addendum #1.
4.) The electrical subcontractor is only furnishing and installing conduits with pull
strings (in-wall & underground) for the Telecommunications, based on the
information provided by Bill Holland dated April 4, 2006. All other work associated
with the telecommunications will be by Brazos County.
5.) This GMP includes additional cost for storing and handling the pre-engineered metal
building. Materials will be stored on a pad prepared by Brazos County.
6.) As discussed during the meeting on April 25, 2006, Brazos County will provide the
necessary materials testing for the project.
7.) The GMP amount is based on utilizing the subcontractors listed on the bid analysis
included with the April 27, 2006 GMP letter.
8.) The cost for a registered survey is not included in the GMP.
9.) An allowance is not being carried in the GMP to cover utility company service
charges. Utility company service charges are not included in the GMP.
- 10.) The Guaranteed Maximum Price for the Exposition Center is $15,538,256.

ASSUMPTIONS & CLARIFICATIONS - SHERIFF'S OFFICE
The following VE items are included in the GMP:
A. VE #7 - Delete solid surface countertop edge per detail 18/A6.12 and replace
with hardwood edge.
B. VE #9 - Delete Lamni-art plastic laminate and replace with Wilsonart, Pionite,
Nevamar or Formica.
C. VE #10 -Replace plastic laminate on plywood with melamine on
particleboard in the General Supply Room 209, details 3 & 4/A6.06.
D. VE #11 - Delete the vehicle lift.
E. VE #12 - Utilize PVC for the sanitary and storm underground in lieu of cast
steel.
F. VE #14- Provide alternate plumbing fixture package. The L-2H and trap
primers shall be submitted as scheduled and specked.
G. VE #17 - Use 2-3/16, 3/41b. Density insulation sealed w/ 3" FSK tape in lieu
of 2" llb. Density sealed w/ fab. & mastic at all ductwork.
H. VE #21 - Removal of DDC controls from the unit heaters UH's. Unit to stand
alone, w/ electric heat.
1. VE #26 - Supply and install recessed pendent sprinkler heads in lieu of
concealed. The public corridors shall have concealed sprinkler heads

0. VE #40 - Use similar masonry shapes manufactured by Southwest Products in
lieu of the specified brand manufactured by Trenwyth. (The masonry
subcontractor is having Southwest match the color samples provided by
WHJ and providing drawings of the shapes Southwest can manufacture.)
(Pending Approval - we are currently carrying a $50,000.00 savings in
the GMP for the masonry special shapes)
2.) The Contingency amount has been reduced and separated as follows:

contractor to provide underground storm drainage around the building. This cost is
based on a proposed modification to the RFI #4 response from Garrett Engineering.

5.) The following is a cost breakdown for the Metal Evidence Lockers (Multi Tier and
Pass Thru) and Mobile Shelving: The above mentioned along with the landscape &
irrigation and signage is not currently included in the GMP.

2) Mobile Shelving w/ 5 carriages as specified $73,462.00
3) Mobile Shelving w/ 2 carriages $54,865:00 VE #42 - system may be
expanded to 5 carriages at a later date when funds are available.

SOURCE OF FUNDS: N/A
REQUIREMENTS:
1) No work will be permitted between front slope and/or back slope.
2) All installation(s) shall be constructed in designated utility easements, if applicable. If no utility
easement exists, the installation(s) shall be 1) within 3-5' of and parallel to the right-of-way line-and/or
2) in the case of a road bore, perpendicular to the right-of-way line.
3) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county right-of-way.
4) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test shall be
conducted by an independent geotechnical testing firm; copies of all test results shall be furnished to
the office of the Brazos County Engineer.
5) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic Control
Devices for Streets and Highways, published by the Texas Department of Transportation, and all other
State and Federal laws governing utility construction.

B.W.O.C. proposes to lay a 3" pipeline from its recently completed well on the Raymond
J. Fickey property located on Fickey School Road. The pipeline will come from the well
location and run in a southerly direction and then turn in a westerly direction to the
intersection of the Raymond J. Fickey west property line and Fickey School Road.
B.W.O.C. will then bore (bore #1) under Fickey School Road to the H. 0. Wilson
property located on the west side of Fickey School Road. The proposed pipeline route
will then be adjacent to an existing Patterson Petroleum pipeline on the H.O. Wilson
property and go in a southerly direction to the intersection of the southern property line of
the H. 0. Wilson property with Opersteny Road. B.W.O.C. will then bore (bore #2)
under Opersteny Road to the James D. Wilson, Jr. property located on the south side of
Opersteny Road. The pipeline will then continue in southerly direction on the James D.
Wilson, Jr. property to the ETC main line further south.
B.W.O.C. proposed operations:
--Both bores will be initiated and compled-on the adjoining landowner's property (as
noted above). The bores will a minimum of 2' deep under the bottom of the bar ditches
and will be approximately 8' -10' under the base of the county roads.
--The pipe to be used is a 0.188" X 3" 5LX42 steel fussion bond coated pipe which will
be laid in 6" casing, with insulators, through the bores.

Department of Transportation dated 1989.
8. That all sites will be barricaded during the construction period.
9. That the normal charge is $500.00 per crossing and/or $130.00 per rod when paralleling the roadway
established by the Commissioners Court on December 21, 2004.
10. Ditch line shall be compacted to 90% standard density ASTM-Test Method No. 0.698; test shall be
conducted by an Independent geotechnlcal testing firth; copies of all test results shall be furnished to
the office of the Brazos County Engineer.
11. Construction shall be in strict conformance to the latest Texas Manual on Uniform Traffic Control
