THE COMMISSIONERS COURT OF BRAZOS COUNTY WILL MEET IN REGULAR
SESSION ON 14 FEBRUARY 2006 AT 9:00 A.M. IN THE COMMISSIONERS
COURTROOM OF THE BRAZOS COUNTY COURTHOUSE, 300 E. 26TH STREET,

11. Permission to accept property for sale at Public Auction from the Sheriffs Office Jail
that has been deemed abandoned property.
12. Request from Wickson Creek Special Utility District to construct a road bore in the right
of way of Riley Road approximately 0.8 mile from its intersection with Grassbur Road
for water line installation. Site is located in Precinct 2.
13. Request from Isaac Butler, Precinct 4 Constable, for permission to appoint John Paul
Wyatt as a non-paid Deputy Constable.
14. Treasurer's Reports for the Month of December 2005, and the Quarter ending
12/31/2005.
15. Payment authorization to A-1 Automatic Door in the amount of $480.00 for a trip call on
warranty repairs to the overhead door requested by Building Maintenance. The incorrect
vendor was called for these repairs.
16. Payment authorization to Specialties Photography in the amount of $98.98 for the 2005
Commissioners Court photo. The print ordered was not provided in the correct size until
after the deadline for payments on 2005 purchase orders had passed.
17. Payment authorization to Wilton's Office Works in the amount of $147.86 for office
supplies for the County Judge's office. Supplies were ordered on a 2005 purchase order,
which has been closed.
18. Change in meeting time and location for the 21 February 2006 regular session of the
Brazos County Commissioners Court.
19. Announcement of interest items and possible future agenda topics.
20. Call for citizen input and/or concerns.
21. Agency / Board / Committee reports by Court members.

COMMISSIONERS' COURT
REGULAR MEETING
FEBRUARY 14, 2006
A regular meeting of the Commissioners' Court of
Brazos County, Texas was held in the Brazos County
Commissioners Courtroom in the Courthouse in Bryan,
Brazos County, Texas, beginning at 9:00 a.m. on Tuesday,
February 14, 2006 with the following members of the Court
present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Mallard gave the invocation and led the
pledge of allegiance.
There was no citizen input/and or concerns.
The Court next considered Budget Amendment #05/06-19.1
through 19.2, which would reallocate funds for the County
Attorney, and Building Maintenance. On motion by Commissioner
Cauley, seconded by Commissioner Peters, the Court voted
unanimously to approve the budget amendment as submitted, a
copy of which is attached hereto.

The Court next considered a request from the Road and
Bridge Department to change the 2006 Salary Schedule to
accommodate the following change. Move $2,434.00 from Class
2641, Position, 1, group 15, Step 12 to Class 2645, Position
6, Group 12, Step 5. The change is in effort to realign
personnel more correctly. On motion by Commissioner
Wassermann, seconded by Commissioner Cauley, the Court voted
unanimously to approve the request.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted.
The next matter before the Court was consideration of the
Burn Ban. Commissioner Mallard moved to lift the ban. There
was no second to the motion. Chuck Frazier, Emergency
Management Coordinator reported that even though the KB Index

was down, the grass was still extremely dry and all the Fire
Chiefs recommended keeping the burn ban in place. The County
Judge then moved to continue the burn ban. The motion was
seconded by Commissioners Peters and Wassermann.
Commissioners Wassermann, Peters, Cauley and the County Judge
voted "Aye". Commissioner Mallard voted "No". The motion
carried.
The County Judge read aloud Proclamation #06-004
designating February 18, 2006 as "Brazos Valley Area Alumnae
Chapter of Delta Sigma Theta Sorority, Inc. Day throughout the
Brazos Valley. The Court commends the community service
organization on the 20th Anniversary of their Chapter and for
its contribution to our county. The County Judge then
presented the signed Proclamation to Mary Broussard, LaVerne
Young Hawkins and Helen Washington representing the sorority.
The next matter for consideration was approval of tax
refund applications from the following individuals and/or
companies:
a) Chih-Ysan & Fu Yung Lee, Over Payment $117.19
b) Matthew J. & Dale Messing, Over Payment $13.22
c) Theresa Thompson, Over Payment $50.00
d) Ben Vierra, Over Payment $121.23
e) Melvin J. White, Over Payment $47.42
f) Anahi Ocampo, Over Payment $201.63
On motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the tax refund

applications.

The next matter before the Court was certification of
services to evacuees of Hurricanes Katrina and Rita. The
Brazos Animal Shelter and the Brazos Valley Council of
Governments each submitted costs for reimbursement that were
reviewed and found to be reasonable, necessary and directly
related to Hurricanes Katrina and/or Rita events and appear
eligible for FEMA assistance. On motion by Commissioner
Peters, seconded by Commissioner Wassermann, the Court voted
unanimously to certify the services of the Brazos Animal
Shelter and the Brazos Valley Council of Governments for FEMA
assistance.
The Court next considered acceptance of property for sale
at public auction. The Sheriff's Office has deemed seven
televisions that were not reclaimed by former inmates as
abandoned property and wishes to include them in the public
auction. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to accept the
abandoned property for inclusion with other county property in
the public auction.
The Court next considered the request from Wickson Creek
Special Utility District to construct a road bore for
waterline installation in the right-of-way of Riley Road

approximately 0.8 mile from its intersection with Grassbur
Road for water line installation. The site is located in
Precinct 2. The County Engineer stated that all appeared to be
in order and recommended approval. On motion by Commissioner
Peters, seconded by Commissioner Cauley, the Court voted
unanimously to approve the request from Wickson Creek Special
Utility District and authorized the installation. A copy of
the request is attached hereto.
The Court next considered a request from Constable
Precinct 4, Isaac Butler, to appoint Joseph Paul Wyatt, as
non-paid Deputy Constable. On motion by Commissioner Cauley,
seconded by Commissioner Peters, the Court voted unanimously
to approve the request from Constable Butler to appoint Joseph
Paul Wyatt as non-paid Deputy Constable subject to appointment
being within the allotted number of deputies.
On motion by the County Judge, seconded by Commissioner
Peters, the Court voted unanimously to receive, approve and
order filed as submitted the Treasurer's report for December
2005. A copy is attached to and made a part of these minutes.
The next matter before the Court was consideration of a
payment authorization to A-1 Automatic Door in the amount of
$480.00 for a trip call on warranty repairs on an overhead
door in the jail. On motion by Commissioner Cauley, seconded

by Commissioner Peters, the Court voted unanimously to approve
payment.
The Court next considered a payment authorization to
Specialties Photography in the amount of $98.98 for a group
photograph of the Commissioners Court. On motion by
Commissioner Cauley, seconded by Commissioner Peters, the
Court voted unanimously to approve payment.
The next matter before the Court was consideration of a
payment authorization to Wilton's Office Works in the amount
of $141.76. On motion by the County Judge, seconded by
Commissioner Cauley, the Court voted unanimously to approve
payment.
The Court next considered changing the meeting time and
location of the regular session of the Commissioners Court
meeting to be held February 21, 2006. This is necessitated
due to the County Judge's and Commissioners banquet to be held
at the time as the evening meeting. On motion by the County
Judge, seconded by Commissioner Peters and Cauley, the Court
voted unanimously to change the meeting time and location from
6:00 p.m. at the Brazos Center to 9:00 a.m. in the
Commissioners Courtroom.

a) Spoke in reference to the online legal
library. The wireless internet is complete
and live as we speak. He scheduled a
workshop for this Friday at 10:00 a.m. to
discuss security procedures before we start
wireless use. He would like an agenda item
next Tuesday to approve the policies.
b) He spoke with Clara Mounce, City of Bryan
Librarian about subscriptions there.
c) There will be a meeting on expunction of
electronic records coming up on Thursday at
9:00 a.m. The Information Technology
Department is currently handling it but
planning transition to have individual
departments handle this in addition to
expunctions of paper records.
There was no citizen input and/or concerns.

met with several legislators including
Senators Cornyn, Carter, and Hutchinson,

There are currently nine spots in Texas
being considered for the plant. This is a
billion dollar industry.
b) Brian Pratt in the Auditor's office is
working on the FEMA Report for our
legislators because we are not being
reimbursed for some expenses. Our
legislative representatives said they
would intervene for Brazos County with
FEMA.
Commissioner Cauley
a) Leon County is experimenting with putting
by-products on their county roads. The
County Engineer informed the Court that
his department has also done this.

Certification of Shelter Costs
The County of Brazos, Texas, as an eligible Applicant for Public Assistance, hereby
certifies that the following organizations, including faith-based organizations provided
sheltering services to evacuees of Hurricane Katrina and/or Hurricane Rita. The County
has met with these organizations and reviewed the costs submitted for reimbursement.
The sheltering costs incurred by the organizations are reasonable, necessary, and directly
related to Hurricane Katrina and/or Hurricane Rita events, and appear eligible for FEMA
assistance. (A FEMA Project Officer will prepare a Project Worksheet with the County.)
The organizations will receive payment from the eligible applicant, the County of
Brazos, Texas, when the local jurisdiction receives payment from the Governor's
Division of Emergency Management.

ITEM: Request from Wickson Creek Special Utility District to construct a road bore in the
right of way of Riley Road approximately 0.8 mile from its intersection with Grassbur Road
for water line installation. Site is located in precinct 2.
SOURCE OF FUNDS: N/A
REQUIREMENTS:
1. No work will be permitted between front slope and/or back slope.
2. All installation(s) shall be constructed in designated utility easements, if applicable. If no
utility easement exists, the installation(s) shall be 1) within 3-5' of and parallel to the right-of-
way line and/or 2) in the case of a road bore, perpendicular to the right-of-way line.
3. If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county right-of-way.
4. Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test
shall be conducted by an independent geotechnical testing firm; copies of all test results shall
be fumished to the office of the Brazos County Engineer.
5. Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Hichwavs, published by the Texas Department of
Transportation, and all other State and Federal laws governing utility construction.

1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that he, or his designated inspector, may
inspect the actual installation.
2. All damage to the roadways and rights-of-way will be repaired to their
original condition to the satisfaction of the County Engineer.
3. Brazos County reserves the right to require Applicant to relocate or
lower any such line at no cost to Brazos County, should same
become necessary due to widening or lowering, or other alteration of
the roadway or right-of-way.
4. Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines in the right-of-way.
5. The line will be constructed and maintained on the County right-of-way in
accordance with the Utility Accommodation Policy which was adopted by the
Texas Department of Transportation on May 29, 1989.
6. The line or lines will be constructed no less than twenty-four inches (24")
lower than the lowest part of the drainage or bar ditch and the drainage is to
be considered at least two feet (2') below the center of the roadway.
7. All sites will be barricaded during the construction period.
