Request from the City of College Station for a waiver of the requirement that no later than the 60`t' day before the date of the public hearing the City Council notify each taxing unit that levies real property taxes in the proposed reinvestment zone that the City intends to establish the reinvestment zone, as set forth in the Texas Tax Code §311.003(e). 10. Appointment of Commissioner Mallard to the proposed Tax Increment Reinvestment Zone #16 Board to discuss the reinvestment zone project and finance plans. 11. Contract with TAMU Challenge Works for the Juvenile Services Community Coalition (JSCC) and TAMU Challenge Works Program. Contract period is 1 January 2006 to 31 August 2006. 12. Authorization for $3,780.00 of the funds budgeted to replace the Sheriff s Office Channel 2 repeater to be used to retrofit the tower. 13. Acceptance of the offer by the Office of the Attorney General of Texas to redirect and process all child support payments, at no cost, in orders established prior to 1 January 1994 from the local registry to the State Disbursement Unit, effective February 2006. 14. Renewal of the optional life insurance policy with Jefferson Pilot Financial Insurance Company, effective 1 February 2006. 15. Brazos County's annual contribution of $2,000.00 to The Corporation for Texas Regionalism, which serves as an advocate for cities and counties during the legislative sessions and works to maintain communication with legislators during the off years. 16. Tax Refund Applications for the following: a. Learon Dove Mack 17. Exemption for Ben Sanford and Associates from competitive bidding in accordance with Local Government Code, professional services (consulting). 18. Sole Source status for Microview Systems of Houston to install the digital video recording upgrade / expansion for the Detention Center. 19. Permission to advertise Bid 2006-016, Removal of Existing Uand Construction of Two Lane Roadway Bridges at the following locations: a. Ferrill Creek Road at Ferrill Creek b. Deep Well Road at Sparks Branch Creek c. Silver Hill Road at Thompson Creek 20. Amending Plat of Lot 26-R, Block 1, Duck Haven Subdivision Phase One, 2.000 acres, B. Request for permission to enter the private property of Carol L. Silva and Hank Jenkins- Smith located off Shellbournes Hill (Estates at River Run) for the purpose of accessing a drainage channel to correction an erosion problem for the health, safety and welfare of the general public. Site is located in Precinct 1. 22. Revised Final Plat of North Country Phase Eleven, 40.86 acres, G. H. Coleman survey, A-10, volume 261, page 18 (official records of Brazos County), Brazos County, Texas. Site is located in Precinct 2. 23. Request from Anthony L. Jones for approval of the following variances to the Brazos County Subdivision and Development Regulations in the proposed Las Palomas Subdivision; site is located in Precinct 1: a. allow minimum 70' road right of way width (for curb and gutter street) to be reduced to 50% b. allow minimum 10' side lot utility easement and setback to be reduced to 5'; 24. Acceptance of a Special Warranty Deed from Equine Center Land Company for improvements to Deep Well Road located in Precinct 2. 25. Acknowledgement of the 2005 Racial Profiling Statistical Report for the Precinct 1 Constable's Office. 26. VOL 77 PAGE 3 COMMISSIONERS' COURT REGULAR MEETING JANUARY 24, 2006 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, January 24, 2006 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk, Absent. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Wassermann gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns. The Court next considered Budget Amendment #05/06-16.1 through 16.2, which would reallocate funds for the Purchasing Department and transfer funds from Contingency to various departments. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. Vol 7 Page 4 Commissioners Court meeting January 24, 2006 2 The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the changes as submitted. The next matter before the Court was acceptance of funds donated specifically for the Brazos County Volunteer Fire Department by the following businesses or organizations: a) B.W.O.C., Inc. $5,000 b) American Petroleum Institute $1,500 Brazos Valley Chapter on motion by the County Judge, seconded by Commissioners Wassermann, Peters, Mallard and Cauley the Court voted unanimously to accept the donations and distribute the total evenly to all precincts. The Court next considered the following Claims as submitted by the County Treasurer for payment: 7015368 through 7015585 On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the Claims as submitted. The Court next considered the continuation or renewal of the Declaration of Local State of Disaster. On motion by the County Judge, seconded by Commissioner Peters, the Court voted Vol -27 Page 6 Commissioners Court meeting January 24, 2006 3 unanimously to continue with the Declaration of Local State of Disaster. The County Judge said that he hopes we will have enough rain by next week to lift the burn ban. On motion by Commissioner Wassermann, seconded by Commissioner Cauley, the Court voted unanimously to adopt Resolution #06-003 authorizing the County Judge to file a grant application with the Brazos Valley Council of Governments (BVCOG) for a regional solid waste grants program grant; authorizing Jay Bragg, Regional Environmental Planner, to act on behalf of Brazos County in all matters related to the application; and pledging that if a grant is received, Brazos County will comply with the grant requirements of the Brazos Valley Council of Governments, the Texas Commission on Environments Quality and the State of Texas. The next matter before the Court was a request from the City of College Station for a waiver of the requirement that no later than the 60th day before the date of the public hearing the City Council notify each taxing unit that levies real property taxes in the proposed reinvestment zone that the City intends to establish the reinvestment zone, as set forth in the Texas Tax Code Section §311.003(e). Mrs. Kim Foutz, Director of Economic Development for the City of College Station was present to answer any questions. On motion by Vol -77 Page & Commissioners Court meeting January 24, 2006 4 Commissioner Mallard, seconded by Commissioner Peters, the Court voted unanimously to approve the request for waiver. The Court next considered the appointment of a representative of the Court to the proposed Tax Increment Reinvestment Zone #16 Board to discuss the reinvestment zone project and finance plans. On motion by the County Judge, seconded by Commissioner Wassermann, the Court voted unanimously to appoint Commissioner Mallard to the Tax Increment Reinvestment Zone #16 Board. The next matter before the Court was approval of a Contractual Agreement between Brazos County Juvenile Services Department and Texas A&M University Challenge Works Program for services to clients which enable client growth and development through the provision of a safe, drug-free environment. The cost to Brazos County will be $750.00 per workshop session. The contract period begins on January 1, 2006 and will terminate on August 31, 2006. On motion by the County Judge, seconded by Commissioner Wassermann, the Court voted unanimously to enter into contractual agreement with Texas A&M University. A copy of the contractual agreement is attached. The Court next considered a request from the Sheriff's office for funds to retrofit the existing Sheriff's Office Vol 77 Page 7 Commissioners Court meeting January 24, 2006 5 Channel 2 Repeater. The Sheriff is requesting $3,780.00 of budgeted funds to be used to pay for the retrofit of the tower. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the request. The next matter before the Court was consideration of an offer by the office of the Attorney General (OAG) to process, at no cost, pre-1994 child support payments made through the county. On motion by the County Judge, seconded by Commissioner Peters, the Court voted unanimously to accept the offer. A copy is attached. The Court next considered renewal of policy with Jefferson Pilot Financial. In a letter to the County, Jefferson Pilot showed no change in rates for the current year, and guarantees the rates for 12 months from the renewal date. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the renewal with Jefferson Pilot Financial. A copy of the renewal letter is attached. The next matter before the Court was a letter from the Brazos Valley Council of Governments asking the County for a contribution to the Corporation for Texas Regionalism that serves as an advocate for cities and counties during the Vol 7 7 Page 9 Commissioners Court meeting January 24, 2006 6 legislative sessions and during the off years. This is an annual contribution. On motion by Commissioner Cauley, seconded by the County Judge, the Court voted unanimously to contribute $2,000.00. The next matter for consideration was approval of a tax refund application from the following individual: a) Learon Dove Mack, Over Payment $46.78 On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the tax refund application. The Court next considered the addition of Ben Sanford and Associates to the list of vendors who are exempt from competitive bidding requirements as allowed by Local Government Code § 262.024(a)(4). On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to include Ben Sanford and Associates on the list of vendors who are exempt from competitive bidding requirements. The next matter before the Court was the designation of Microview as the sole source provider for the expansion of the video system at the detention center. Microview installed the original system and the use of Microview on the upgrade and expansion of the detention center digital video recording Vol 7 Page 7 Commissioners Court meeting January 24, 2006 7 system will insure that the video system in all three areas of the jail are compatible and can be viewed at remote locations using a single software program. On motion by Commissioner Mallard, seconded by Commissioner Cauley, the Court voted unanimously to designate Microview as the sole source provider for the expansion of the video system at the detention center. The next matter for consideration was approval for the Purchasing Agent to advertise Bid 2006-016, Removal of Timber Bridges and Construction of Two Lane Roadway Bridges. The agenda incorrectly stated the removal of existing box culverts. The locations are as follows: a) Ferrill Creek Road at Ferrill Creek b) Deep Well Road at Sparks Branch Creek c) Silver Hill Road at Thompson Creek On motion by Commissioner Wassermann, seconded by Commissioner Cauley, the Court voted unanimously to authorize the Purchasing Agent to advertise for the previously noted bids. The Court next considered approval of the Amending Plat of Lot 26R, Block 1, Duck Haven Subdivision Phase One, 2.00 Acres in Precinct 1. Richard Vance, County Engineer, stated that he had reviewed the plat and stated that all was in order. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to approve the Amending Plat of Lot 26R, Block 1, Duck Haven Subdivision Vol -7~ Page /o Commissioners Court meeting January 24, 2006 Phase One, 2.00 Acres as submitted. 8 The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Carol L. Silva and Hank Jenkins-Smith on Shellbournes Hill in River Run Estates in Precinct 1 to access a drainage channel to correct erosion problems. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to authorize the work. The Court next considered approval of the Revised Final Plat of North Country Phase Eleven, 40.86 Acres in Precinct 2. Richard Vance, County Engineer, stated that he had reviewed the plat and all appeared to be in order. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the revised final plat of the North Country Phase Eleven, 40.86 acres as submitted. The Court next considered a request from Anthony L Jones, a local builder, for two variances to the Subdivision and Development Regulations for a small subdivision located in Precinct 1. The subdivision is to be developed to the City of College Station's ordinances and specifications. The variances requested are as follows: Vol 77 Page /1 Commissioners Court meeting January 24, 2006 9 a) Allow minimum 70 foot road right-of-way width to be reduced to 50 feet. b) Allow minimum 10 foot side lot utility easement and setback to be reduced to 5 feet. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to approve the variances requested. The Court next considered acceptance of a Special Warranty Deed for right-of-way on Deep Well Road in Precinct 2. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to authorize the County Judge to accept on behalf of Brazos County a Special Warranty Deed from the Equine Center Land Company for the expansion and improvements to Deep Well Road. The Court acknowledged receipt of the 2005 Racial Profiling Statistical Report for the Precinct 1 Constable's office. The County Judge asked if everything was ready to do so? Commissioner Mallard said that the city want to know the county's vision. b) The Intergovernmental Committee met yesterday. They saw a video based on college age renting. They are trying to work out problems between renters and owners that are neighbors. C) Also at the Intergovernmental Committee meeting, John Happ discussed creating another thoroughfare to take pressure off of Northgate, they discussed the EOC and Mr. Happ was elected as the new chairman. Kay Hamilton, Treasurer a) Handed out information on the interest rates. Commissioner Mallard had asked for this information at the last Commissioners Court meeting. Dear Judge Sims: It was a pleasure talking to you last week and our discussion on the need for the burn ban in Brazos County was something of particular interest to our Company and to our industry in general. As a tax paying entity and a significant asset owner in Brazos County we sometimes forget how critical the local VFD's can be to the safety of our rural operations. When we see media coverage of the grass fires, both locally and throughout the State, it brings home to us how at risk many of our facilities are to outside incidents and how much we may rely on the VFD's for protection: , With the additional workload that has been placed on the VFD's during this prolonged dry spell it is easy to understand that they are now faced with the need to raise additional funds to replace equipment and supplies. THAT IN CONSIDERATION OF THE PROMISE TO; 1. Accept, Perform, and complete in contract with the Probation Department and in accordance with the Program known as the TAMU Challenge Works Program, hereinafter called the TAMU Challenge Works Program, subject to and pursuant to the terms and conditions of the guidelines submitted by the Probation Department. All rules, regulations, and guidelines pertinent and applicable thereto, and further subject to all terns and conditions of this agreement. 2. Account for all program funds received, in cash, whether paid with state or matching funds. 3. Maintain and make available for inspection, audit, or reproduction, by any authorized representative of the Brazos County Auditor and State of Texas, books, documents and other evidence pertaining to the cost and expense of this TAMU Challenge Works Program. 4. Pursue the goals and values of the Brazos County Juvenile Probation Department through providing services to clients, which enable client growth and development to the client's fullest potential. This development will be through the provision of a safe, drug-free environment. 5. Notify the Brazos County Juvenile Service Department in writing of any changes in curriculum or topics covered. The Probation Department reserves the right to eliminate any topics not deemed appropriate for discussion. II. GOALS, OUTPUTS, & MEASURABLE OUTCOMES 1. All juveniles assigned to the Program will be accepted into the Program and will be expected to participate. V01. _7~ PAGE a 7 2. Service provider agrees to provide a minimum of seven (7) hours of Instruction. 3. Service provider agrees to cooperate fully with any program evaluation instigated by Brazos County Juvenile Services. III. CONTRACT PERIOD The contract period will begin on the I" day of January 2006, and will terminate the 315` day of August 2006. IV. THE BRAZOS COUNTY JUVENILE SERVICES DEPARTMENT DOES HEREBY AGREE TO: 1. Delegate to TAMU Challenge Works the authority and duties for services rendered in the application; 2. Provide the TAMU Challenge Works $750.00 per workshop for services rendered as outlined in the application. 3. Receive from TAMU Challenge Works a report of services rendered. 4. Payment will be made in the form of a check issued by the Brazos County Treasurer's Office no later than 30 days from receipt of original billing. Brazos County will not accept copies or faxed invoices. The original invoice is required for payment. No special payment exceptions will be made. Please do not call for status or payment unless past the 30 day time period. V. TERMINATION 1. Termination for cause shall be based upon contingencies as follows: (a) If TAMU Challenge Works fails to provide the services called for in this contract within the specified term herein or extension thereof; or (b) If TAMU Challenge Works fails to perform any other provisions of this contract, or so fails to perform the services as to endanger performance of this contract in accordance with its terms, and in either of these two circumstances does not correct such failure within a period of 10 days (or such extensions as VOL72 PAGE 9 X authorized by the Probation Department in writing) after receiving notice of default. (c) This contract shall not be terminated for failure to perform the contract arising out of causes beyond the control and without fault or negligence of TAMU Challenge Works. (d) The decision of the termination of the Probation Department shall be final and conclusive unless within 60 days from the date of receipt of a written copy of the decision the TAMU Challenge Works mails or otherwise furnishes to the Probation Department a written appeal addressed to the Brazos County Juvenile Board. The decision of the Juvenile Board shall be final and conclusive' absent a showing of fraud, caprice, arbitrariness or gross error implying bad faith in which case suit may be brought in some court of competent jurisdiction. 2. In the event of the failure of the TAMU Challenge Works and the Probation Department to agree as provided under paragraph IV 2, the Probation Department shall pay TAMU Challenge Works the amounts for completed services not yet paid for. VI. OFFICIALS NOT TO BE BENEFITTED No officer, member or employee of the Texas Juvenile Probation Commission and no member of the governing body of the locality or localities in which the program is situated or being carried out who exercised any functions or responsibilities in the review or approval of the undertaking or carrying out of the project, shall participate in any decision relating to this contract which affects his personal interest or have any personal or pecuniary interest, direct or indirect, in this contract or the proceeds thereof. VII. MINORITIES The Probation Department will not discriminate against any application for the TAMU Challenge Works Program because of race, color, religion, sex, or national origin. These payments are not eligible for federal reimbursement; therefore, the OAG must pay for all expenses associated with processing these receipts with State funds. Processing the payments on orders established prior to January 1, 1994 has been cost prohibitive in the past. The OAG recently negotiated a new SDU contract that includes substantially lower payment processing rates than the previous contract. We would like to pass the benefits of the new SDU contract along to the counties by offering to process, at no cost, pre-1994 child support payments made through the county. If you accept this offer, the OAG will begin redirecting these payments to the SDU in February 2006. We are requesting counties wait until the TXCSES/STRADUS Integration (TSI) project has been implemented before the pre-1994 order/case information is entered onto the OAG's system. TSI is scheduled for implementation in February 2006.
