To make arrangements, call (979) 361-4102. vUL -2(o hr~g COMMISSIONERS' COURT REGULAR MEETING JANUARY 10, 2006 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, January 10, 2006 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Peters gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns. The Court next considered Budget Amendment 405/06-14.1, that would reallocate funds for the Sheriff's Department. On motion by commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Vol ~ Page I & 9 Commissioners Court meeting January 10, 2006 2 Requests. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the changes as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 7014871 through 7015143 On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the Claims as submitted. The next matter before the Court was consideration of a continuation or renewal of the Declaration of Local State of Disaster, as established with Brazos County Proclamations 05- 013 and 06-001 under Section §418.108 of the Government Code. On motion by Commissioner Wassermann, seconded by Commissioner Cauley, the Court voted unanimously to continue the Declaration until March 6, 2006. The Sheriff noted that ten (10) citations were written this week. The Court next considered the appointment of a representative to the Board of Directors for Keep Brazos Beautiful, Inc. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to appoint Commissioner Lloyd Wassermann as the Court's representative to the Board of Directors for Keep Brazos Beautiful, Inc. The Vol 4 Page 1-)0 Commissioners Court meeting January 10, 2006 3 appointment takes effective immediately and will continue through December 31, 2008. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to adopt Resolution #06- 001 nominating Commissioner Mallard to serve on the Texas Conference of Urban Counties Policy Committee for the 2006- 2007 biennium. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to adopt Resolution #06- 002 appointing Edward Luna as the County's representative on the Brazos County Appraisal District Board of Directors, effective immediately and to continue through December 31, 2007. The next matter before the Court was approval of the Bond of Tax Assessor and Collector as required by Texas Tax Code Annotated, Section 6.28. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the Bond of Tax assessor and Collector for Gerald L. "Buddy" Winn. The Court next considered the reclassification of a Human Resources Technician Position. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to reclassify the position from the current Group Vol -7 Page 171 Commissioners Court meeting January 10, 2006 4 12, Step 2 to Group 17, Step 2 and increase the salary from $22,901.00 to $29,328.00. A copy of the job description is attached. The next matter for consideration was approval of tax refund applications from the following individuals and/or companies: a) Jim K. & Katherine L. Ray, Over Payment $12.22 b) Michael R. Stanford, Over Payment $70.32 On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the tax refund applications. The next matter before the Court was Certification of Shelter Costs for services provided to evacuees of Hurricane Katrina and/or Rita. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to certify that the following organizations, including faith based organizations provided sheltering services to evacuees of Hurricane Katrina and/or Rita and are eligible for FEMA assistance: a) Bryan Independent School District b) College Station Independent School District c) Family Medical Center d) Parkway Baptist Church e) Twin City Mission f) The United Way Vol 7 (f Page 17 a Commissioners Court meeting January 10, 2006 5 The Court next considered approval of the minutes of the Commissioners' Court meetings held in October 2005 on the following dates: Regular Meetings - 4th, 11th, 18th, 25th Workshop Session - 4th On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the minutes as submitted. The Court next considered the request from 7711 Corporation to construct a road bore for a gas pipeline in the right-of-way of Dilly Shaw Tap Road approximately 1.8 miles from its intersection with FM 974 (Tabor Road). Included with the request is a company check #19595 in the amount of $500.00. The site is located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. Commissioner Peters moved to approve the request from 7711 Corporation and authorize the installation. Commissioner Wassermann seconded the motion. Commissioners Wassermann, Peters, Mallard and Cauley voted "Aye". The County Judge abstained. The motion carried and a copy of the request is attached hereto. The next matter before the Court was consideration of a payment authorization to Sherri Roberts in the amount of Vol -7 (e Page 113 Commissioners Court meeting January 10, 2006 6 $130.00 for sign language interpreting services. The services were used during a meeting with a deaf victim in an upcoming case. The District Attorney's office failed to request a purchase order before the meeting. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the payment authorization. The Court next considered a payment authorization to Barbara Sanford Ph.D. Psychologist in the amount of $1,005.00 for expert witness testimony. The expert witness was on the stand longer than anticipated and when the bill was submitted, it exceeded the purchase order by $505.00. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the payment authorization. The next matter before the Court was a third payment authorization submitted by the District Attorney's office. This one was to Cynthia A. Boyd, Therapist in the amount of $800.00 for expert witness testimony. The invoice amount exceeded the purchase order by $100.00. The purchase order was voided and the payment authorization issued. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the purchase order. The Court acknowledged receipt of the Road and Bridge Department Work Activity Synopsis Report for October 2004 Vol 7 4 Page 1-74 Commissioners Court meeting January 10, 2006 through September 2005. A copy is attached. 7 The Court acknowledged receipt of the Constable, Precinct 3 Racial Profiling Statistical Report for 2005. Under announcement of interest items and possible future agenda topics the following spoke: Commissioner Mallard a) Informed the Court that there is a CUC luncheon meeting this Thursday at noon if anyone is interested in going. There was no citizen input and/or concerns. There were no Agency/Board/Committee reports by Court members. There being no further business to come before the Court, the meeting was adjourned. In addition to our normal duties of grading roads, patching, picking up trash, cutting and burning brush, maintaining equipment and maintaining solid waste collection sites, we have accomplished the following: 1. Upgraded 9.03 miles of road from gravel to paved 2. Total reconstruction of 3.37 miles of county roads (rebuild deteriorated paved roadway) 3. Resealed approximately 60.20 miles of roadway (a new wearing surface) 4. Placed 68,346 gallons of HSRS2 and 48,259 gallons of AEP on county roads 5. Placed 11.66 miles of 1 `/2 " hotmix overlay on county roads 6. Placed 1,529.56 tons of coldmix on county roads (patching) 7. Placed 3,889.83 tons of grade 4 rock on county roads 8. Placed 2,958.91 tons of 0-66 rock on county roads 9. Placed 81,648.71 tons of base on county roads 10. Placed 1015.82 tons of washed sand on county roads 11. Placed 19 rolls of poly jute in county right of way for erosion control 12. Installed 305 culverts varying in size from 15 inches to 84 inches 13. Negotiated for 14 parcels of land for right of way 14. Installed approximately 18,403 linear feet (L.F.) of fencing 15. Replacement of 2 bridge structures, one on Harper's Ferry Road and the other on Burt Road 16. Bladed 5.3 miles of roads for Intergovernmental contracts with the City of Kurten and Wixon Valley; reconstructed 2,132 L.F. of Oak Lake Road 17. Pavement Management Information System: updated pavement and road maintenance Master Lists / programs; 2 major projects and 163 minor projects 28. Hurricanes Katrina and Rita relief (food, water, clothing, 250 beds) $11,934.74 in equipment, labor and supplies. 29. Vehicle Maintenance Shop: A. Serviced and maintained approximately 153 pieces of equipment, not including chainsaws, weed eaters, water pumps or generators. We also began servicing these smaller pieces of equipment. Since purchasing a chain sharpener we have been able to lengthen the life of our chains significantly. This has also cut down on repairs by outside venders. V0 0 PAGE 01 B. Installed four air conditioning systems in rubber-tired equipment that was not originally equipped with air conditioners. The lowest bid for installing these systems was $4,500.00. We installed them in our shop for approximately$2,200. Since the purchase of a 134a refrigerant recycler, we have been doing all our own air conditioner repairs. C. Began a more extensive oil-sampling program. We average approximately 36 samples per month, totaling 432 samples this year. Up from 200 samples last year. Of these samples 85 were Cat samples for warranty purposes. The remainder of samples is free to the County through our lubricants vender. D. Our oils are now kept in bulk tanks with air pumps. These tanks are outside the shop and plumbed to the inside to hose reels with counters. We no longer have to hand pump oil from drums. This eliminated a large mess, while creating much more space in our parts room. This is due to the area of the county that most of the citations were written. There were no searches conducted. There were 98.3% of the total citations written to the white race for hazardous traffic violations. Again, these numbers show that the white race is high due to the area of the county we work.
