BRAZOS COUNTY COMMISSIONERS COURT
THE COMMISSIONERS COURT OF BRAZOS COUNTY WILL MEET IN REGULAR
SESSION ON 3 JANUARY 2006 AT 9:00 A.M. IN THE COMMISSIONERS
COURTROOM OF THE BRAZOS COUNTY COURTHOUSE, 300 E. 26TH STREET,
SUITE 115, BRYAN, TEXAS.
1. Invocation and Pledge of Allegiance - Commissioner Mallard
2. Call for citizen's input and/or concerns.
3. Status of the Local State of Disaster.
Consider and take action on agenda items 4 -12:
4. Budget Amendment 05/06-13.1 thru 05/06-13.2.
5. Personnel Change of Status.
6. Payment of Claims.
7. Amendment to the Interagency Contract between Brazos County, the Texas Department
of Transportation and the cities of Bryan and College Station for the Development of a
Regional Transportation Operations Concept, extending the contract until 31 March
2006.
8. Reappointment of the following individuals as fire commissioners on the Brazos County
Emergency Services District #4 Fire Commissioners Board, effective 1 January 2006 thru
31 December 2007:
a. Anderson Jones, now serving as President
b. Pat Fagan
c. Sue Moody

9. Appointment of the following individuals as fire commissioners on the Brazos County
Emergency Services District #3 Fire Commissioners Board, effective 1 January 2006 thru
31 December 2007:
a. Jerry Merker, President reappointment
b. James Stuckey, Vice President new appointment
c. Bill Milberger, Secretary reappointment
d. Raymond Plagens, Treasurer reappointment
e. Rusty Lewis, Assistant Treasurer reappointment
10. Suspension of the $30.00 Family Protection Fee following the issuance of Attorney
General Opinion GA-0387 regarding this fee. This fee was adopted by the Brazos
County Commissioners Court on 15 November 2005, effective 1 January 2006.
11. Request for permission to advertise the following bids
a. Bid 2006-014 Decking Timber
b. Bid 2006-015 Bridge Pilings
c. Bid 2006-016 Bridge Repairs
d. Bid 2006-017 Material Hauling
e. Bid 2006-018 Shop Supplies / Auto Parts
f. Bid 2006-019 Hydrated Lime
g. Bid 2006-020 Asphalt, Oil & Emulsion
12. Amendment to the Group Medical Insurance Plan Policy regarding coverage of lab and
x-ray, when the office visit is on another day.
13. Acknowledgement of the Monthly Reports submitted in December 2005. These reports
are available for review in the County Judge's Office.
14. Announcement of interest items and possible future agenda topics.
15. Call for citizen input and/or concerns.
16. Agency / Board / Committee reports by Court members.
17. Convene into Executive Session pursuant to §551.074 of the Texas Government Code to
discuss personnel matters.
18. Consider and possible action on the Executive Session.
19. Adjourn
The Brazos County Courthouse is wheelchair accessible. Handicap parking spaces are available. Any request for sign

REGULAR MEETING
JANUARY 3, 2006
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos County Commissioners
Courtroom in the Courthouse in Bryan, Brazos County, Texas,
beginning at 9:00 a.m. on Tuesday, January 3, 2006 with the
following members of the Court present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
The County Judge gave the invocation and led the pledge
of allegiance.
Under citizen input/and or concerns, the following spoke:
Demetrios Basdekas
a) Commented on the structural stability and
integrity of a bridge in his Precinct. He
inspected it and took pictures which he
passed around to the Commissioners. He
stated that the decking was not designed
properly. It was replaced three (3) years
ago. He said that he had brought these
inefficiencies to the attention of
Commissioner Peters and the County Engineer
and was told nothing could be done about
it. He doubts the Road and Bridge

Department will replace it properly. He
said that TxDOT estimates that the steel
beams were used at around 1905-1963.
The Court next considered Budget Amendment #05/06-13.1
through 13.2, that would reallocate funds for the Purchasing
Department, and transfer funds from Contingency to Court
Support Costs. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Peters, seconded by
Commissioner Wassermann, the Court voted unanimously to
approve the changes as submitted.
There were no Claims to be considered but on motion by
the County Judge, seconded by Commissioner Cauley, the Court
voted unanimously to table consideration.
The next matter before the Court was consideration of an
Amendment to the Interagency Contract between Brazos County,
City of College Station, City of Bryan and the Texas
Department of Transportation to extend the termination date
from December 31, 2005 to March 31, 2006. On motion by
Commissioner Cauley, seconded by Commissioner Peters, the

Court voted unanimously to approve the amendment. A copy is
attached.
The Court next considered the reappointment of
individuals to serve as fire commissioners on the Brazos
County Emergency Services District #4 Fire Commissioners
Board. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to reappoint
the following individuals:
a) Anderson Jones
b) Pat Fagan
c) Sue Moody
The reappointments become effective January 1, 2006 and
terminate December 31, 2007.
The Court next considered the reappointment of
individuals to serve as fire commissioners on the Brazos
County Emergency Services District #3 Fire Commissioners
Board. On motion by Commissioner Mallard, seconded by
Commissioner Cauley, the Court voted unanimously to reappoint
the following individuals:
a) Jerry Merker to 12-31-06
b) James Stuckey to 12-31-07
c) Bill Millberger to 12-31-06
d) Raymond Plagens to 12-31-07
e) Rusty Lewis to 12-31-06
The Court next considered suspension of the $30.00 Family
Protection fee following the issuance of Attorney General

Opinion GA-0387. In a memo to the Court, the County Auditor
explained that the Attorney General had determined that the
fee is unconstitutional based on Article I, Section 13 of the
Texas Constitution that provides that filing fees may only be
used for judicial support services. On motion by Commissioner
Mallard, seconded by Commissioner Peters, the Court voted
unanimously to suspend the Family Protection Fee until the
issue is resolved at the state level.
The next matter for consideration was approval for the
Purchasing Agent to advertise for the following bids:
a) Bid 2006-014,
b) Bid 2006-015,
c) Bid 2006-016,
d) Bid 2006-017,
e) Bid 2006-018,
f) Bid 2006-019,
g) Bid 2006-020,

On motion by Commissioner Wassermann, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the
Purchasing Agent to advertise for the previously mentioned
bids.
The next matter before the Court was consideration of an
amendment to the Group Medical Insurance Plan Policy
concerning coverage of lab and x-ray costs when the office
visit is not on the same day. Currently labs and x-rays are
paid by the employee and the amount goes toward the

deductible. With this amendment, the employee will only pay a
one-time $20 co-pay when the procedures are ordered by a
doctor. On motion by Commissioner Peters, seconded by
Commissioner Wassermann, the Court voted unanimously to
approve the amendment. A copy is attached.
The Court acknowledged receipt of the Extension Service
reports for October and November 2005 and acknowledged receipt
of reports from the following County and Precinct Offices
showing revenues collected and remitted to the County
Treasurer:

Auditor's office.
Under announcement of interest items and possible future
agenda topics the following spoke:
Commissioner Mallard
a) Habitat for Humanity will soon have a ground
breaking on one of the lots donated by
Brazos County.
Under citizen input and/or concerns, the following spoke:

Karen Hall
Asked the Court to meet again on Friday to continue
the ban on fireworks.
Eric Caldwell, Director of the Information Technology
Department.
Agreed with the fireworks ban

There were no Agency/Board/Committee reports by Court
members.
At 9:55 a.m. the County Judge announced the meeting
closed to the public so that the Court could meet in Closed
Executive Session to discuss personnel matters as allowed
under Section 551.074 of the Texas Government Code.
At 10:03 a.m. the County Judge announced the meeting open
to the public and that no action would be taken at this time
but the Court will meet in Special Session at 11:00 a.m. on
Friday, January 6, 2006.
There being no further business to come before the Court,
the meeting was adjourned.

conditions which could not be reasonably included in the original budget adopted 20 September 2005, the
following amendment(s) to the original budget are hereby authorized, as described on the attached page(s).

AMENDMENT TO INTERAGENCY CONTRACT
Amendment Number 1
It is mutually understood and agreed by and between the undersigned contracting parties to the
above numbered Interagency Contract to amend said contract as follows:
Development of a Concept for Regional Transportation Operations P2005350
for the Brazos Valley
The termination date is hereby extended from December 31, 2005 to March 31, 2006.
This amendment shall become effective when fully executed. All other terms and conditions of the
above numbered Interagency Contract not hereby amended remain in full force and effect.
