Payment authorization in the amount of $775.00 to Primeco International Corporation for translation services in the deposition of a robbery victim from China. TEXAS 77803 OFF: 979 / 361-4320 FAX: 979 / 361-4368 Paul Johnson is a licensed counselor who is used as an expert witness for juvenile hearings/trials. ADA-Shannon Flanigan and ADA- Margaret Lalk had a juvenile case in which the charge was Aggravated Sexual Assault of a child. Mr. Johnson was subpoena'd but during the course of the trial, ADA Flanigan and ADA Lalk, decided that Mr. Johnson's testimony was not necessary. Mr. Johnson had been on stand by and had cancelled two sessions on October 12, 2005, and 4 sessions on October 13, 2005. He is requesting compensation for the sessions that he had cancelled. Each session is $50.00 per session for a total of $300.00. There was a purchase order done for expert witness-Central Texas Mental Health, #00008083 in the amount of $300.00. The purchase order was done on the wrong vendor. It should have been for Paul Johnson. The purchase order was closed, due to it not being used. We are requesting that this payment authorization be approved. Thank you for your attention to this matter BRAZOS COUNTY, TEXAS COMMISSIONERS' COURT REGULAR MEETING NOVEMBER 29, 2005 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, November 29, 2005 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Mallard gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns. The Court next considered Budget Amendment #05/06-9.1 through 9.2, which would reallocate funds for County Court at Law # 1 and C.O. Issue 2004. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the changes as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 7013604 through 7013867 On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the Claims as submitted. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to adopt Resolution #05-018 whereby the Commissioners Court authorizes, consents, approves and confirms the action of the judges of the District Courts, County Courts At Law and the Juvenile Board of Brazos County, Texas to appoint Glynnis Gore to serve the District and County Courts At Law and perform any and all duties authorized by law as Magistrate, Associate Judge, and Juvenile Referee, effective January 1, 2006. Be it further resolved that the annual salary will be at a rate of $40,600.00 to be funded from the General Fund, that Mrs. Gore shall be classified for the purposes of receiving employee Vol Page aga Commissioners Court meeting November 29, 2005 3 benefits, as a part time employee and that the Magistrate's fee imposed as costs against the non-prevailing party in each case heard by the Magistrate shall continue to be $50.00. The next matter before the Court was approval of a payment authorization to Pitney Bowes, Inc. in the amount of $325.00 for postage meter rental. On motion by the County Judge, seconded by Commissioner Mallard, the Court voted unanimously to approve the payment authorization. The Court next considered a request for reimbursement in the amount of $17.31, submitted by the District Clerk. This was for the purchase of lunch for the District Clerk staff that were required to work at the International Education Week passport booth at the MSC on the Texas A&M University campus. Due to high demand, the staff members were unable to leave to take lunch. On motion by Commissioner Wassermann, seconded by Commissioner Cauley, the Court voted unanimously to approve payment of the reimbursement request. The next matter before the Court was approval of a payment authorization in the amount of $775.00 to Primeco International Corporation for translation services in a deposition. Due to the deposition taking longer than anticipated, it exceeded the purchase order amount. The Court next considered the request from Vess Oil Corporation to construct a road bore for a natural gas pipeline installation in the right-of-way of Democrat Road approximately 50 feet from its intersection with Plagens Road. The $500.00 fee was paid in May of 2000. The site is located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from Vess Oil Corporation and authorized the installation. A copy of the request is attached hereto. The Court next considered the addendum to the agenda that called for approval of a payment authorization in the amount of $300.00 to Paul Johnson, licensed counselor. This is for six counseling sessions he had to cancel to be on standby as an expert witness for the District Attorney's office. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the payment authorization. The company paid Brazos County the required fee of $1,000.00 ($500.00 per bore). Company representative, Eddie Picone contacted Ray Crow to notify the County that they constructed only one road bore (they were able to utilize an existing road bore of the other road) but he wanted the additional $500.00 paid fee to be applied to a future road bore on Democrat Road. Ray said he would note it in the office file. feel Ray may have forgotten about this as there was no information in any of the files. I remember the conversation between Ray and Mr. Picone as they spoke with each other here in the front office that day, and I made comment that this was the first time we'd ever dealt with a request of this type. Monday, November 14th, Mr. Picone of Vess Oil Corporation submitted a request to bore Democrat Road and wanted the $500.00 fee paid back in 2000 applied to this road bore as previously agreed between he and Ray. I talked to Katie Conner and explained the situation. She advised that we include this information with the court agenda request in order that Commissioners' Court understands that the fee was prepaid. O. K.
