COMMISSIONERS' COURT REGULAR MEETING MAY 2, 2006 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, May 2, 2006 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Wassermann gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns. The first matter before the Court ws a presentation by James Massey, Director of Facilities Coordination for Texas A&M University, on the need for a Community Emergency Operations Center. Demetrios Basdekas commended Mr. Massey on this proposal but asked about the absence of the Department of Public Safety in this. Mr. Massey assured they would play a part in this. Vol 79 Page I Ele Commissioners Court meeting May 2, 2006 2 The Court next considered Budget Amendment #05/06-30.1 through 30.5 that would reallocate funds for the Brazos Center, transfer funds from R&B Infrastructure Fund to Debt Service Fund, from Contingency to County Attorney, from Capital Project to Non Departmental; and recognize property donated to the Sheriff's Department. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the changes as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 7018734 through 7018999 On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the Claims as submitted. The next matter before the Court was consideration of a conceptual agreement between the cities of Bryan and College Station, Brazos County and Texas A&M University for a Vol -79 Page 1 $ 7 Commissioners Court meeting May 2, 2006 3 Community Emergency Operations Center. On motion by Commissioner Mallard, seconded by Commissioner Cauley, the Court voted unanimously to agree conceptually to participate in the development of an Inter Local Agreement to describe the operation and management of a Community Emergency Operation Center and upon the compilation of a mutually agreeable document, intend to commit to the financing required to operate the Community EOC for the benefit of those individuals for whom each organization is responsible. A copy is attached. The Court next considered a request from Constable Precinct 1, Archie Clark, to appoint Kent Shaffer, as a non- paid Deputy Constable. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to approve the request from Constable Clark to appoint Kent Shaffer as a non-paid Deputy Constable subject to appointment being within the allotted number of deputies. The next matter for consideration was approval for the Purchasing Agent to advertise Bid 2006-032, Collection Services for Delinquent Criminal and Civil Court Costs, Fines, Attorney's Fees and Restitution. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to authorize the Purchasing Agent to advertise for Vol Page S0 Commissioners Court meeting May 2, 2006 q bids for Collection Services. The Court next considered renewal of Bid 2006-026, Uniform Rental, for an additional two years. The vendor, G&K Services has assured the Purchasing Agent that there will be no increase in price. On motion by Commissioner Cauley, seconded by Commissioner Mallard, the Court voted unanimously to approve the renewal of Bid 2006-026. The Court next considered the declaration of property as "unusable" and authorizing the destruction or other disposal. This property was destroyed when it was dropped while being moved. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to declare the property as unusable and authorized its destruction or other disposal. The next matter before the Court was to consider granting permission for Hunt Construction to proceed with construction of the Expo Center and acceptance of the guaranteed price with clarifications. The County Judge presented Corbin Roberts with Construction. Commissioner Mallard commented that Mr. Roberts had worked hard to crunch the numbers to get them where they are now. Demetrios Basdekas commented on the Bond Attorney and gave his opinion on the legality of continuing with the project. He asked Court Counsel, Rod Anderson about Vol J 9 Page 199 Commissioners Court meeting May 2, 2006 5 his opinion on the subject. Mr. Anderson replied he has reviewed everything and agrees with Bond Counsel. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to grant Hunt Construction permission to proceed with construction of the Expo Center and accept the guaranteed maximum price of $15,538,256.00 with clarifications. Attached is the estimated budget for the completion of the center. The next matter before the Court was to consider granting permission for Hunt Construction to proceed with construction of the Sheriff's Administration Building and acceptance of the guaranteed price with clarifications. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to grant Hunt Construction permission to proceed with construction of the Sheriff's Administration Building and accept the guaranteed maximum price of $6,502,198.00 with clarifications. Attached is the estimated budget for the completion of the building. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the final plat of Covered Bridge Estates, 114.78 Acre Tract as submitted. The next matter before the Court was consideration of a payment authorization from the Sheriff's Office in the amount of $212.48 to Cain's Coffee Company. The invoice was never received. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the payment authorization. This GMP is based upon construction documents issued by Jim Singleton Architects dated Dumber 15, 2005, Addendums 1-5, Post Addendum 1 and scope review and verification with the apparent low bidders. The following VE items have been incorporated into the GMP: 1) VE #1 - Change the metal roof at the concessions/restrooms to a composite shingle roof at the covered arena. 2) VE #14 - Revise the feeders for service from the City transformer to the packaged unit MSB from 2500A to 1200A, 277/480V/3P. 3) VE #15 - Relocate panel C4 to hallway of stairway #118, change panel C4 from 100A to 225A, change feeder from 100A to 225A and relocate branch circuits C2-1, 2,3,11,29,31,34 to panel C4. Refer to log for cost identified. B_) An allowance of $204,700.00 is being carried for furnishing and installing the stall and rodeo equipment. WW is currently pricing based on drawings received from JSA. C.) The Contingency amount has been reduced and separated as follows: 1) Construction Contingency ($400,000.00) - To be utilized by Hunt Construction throughout the course of the project to cover coordination and completion of miscellaneous scope items between trades, overtime costs and other items required to complete the work shown on the construction documents. 2) Owner Contingency ($100,000.00) -To be utilized by Brazos County to cover owner requested changes or architect clarifications and modifications. All aspects of the cable network installation will be done according to EIA/T1A Category 6 568A standards and the National Electric Code B. This is a plenum installation, be aware of installation methods and practices. C. A pull string will be included on each major trunk for future additions. D. The network must be installed to Category 6 specifications, using 568-B pincuts. E. All pathways through fire rated walls will be sleeved and filled with fire putty. Fire wall sleeves should be no more than 50% full, or another sleeve will be provided and filled with fire putty. F. The 2°d floor Network Room (Room 227) shall contain 2 taco racks with a vertical wire manager in between and on either side. Horizontal wire managers will be mounted above and below each 48-port patch panel. The racks will be bolted to tTie floor and attached to the wall using ladder rack and-- brackets. The racks will be installed such that the front mounting surface is 1' 6" from the wall behind the rack. G. All cables will be installed from Room 227 to their respective locations. H. All Category 6 cables will be terminated on both ends with the specified RJ- 45 data jacks, into rack-mounted modular patch panels, using the 568-B pinout, regardless of data or telephone use. CATV cable shall be terminated on both ends and attached to modular CATV inserts mounted into modular faceplates at the workstation, and attached to modular CATV inserts installed into rack mounted modular patch panels. 1. Each data/phone drop location will contain 3 Category 6 cables of the cable type specified, terminated into blue modular Category 6 jacks and mounted into the specified faceplate. A blank will be used to fill the remaining unused port location unless it is to be used by a CATV insert. The faceplate will be clearly labeled, top and bottom with a printed label that fits inside the faceplate window. J. Cable pathways will be suspended using j-hooks at appropriate intervals. External Tie The Brazos County Sheriff's Office(BCSO) telephone system will be controlled by the PBX in the Brazos County Detention Center(BCDC). The data network will also be linked to the Brazos County Detention Center. These links necessitate a network tie be installed to link the two facilities together. B. Internal Tie An internal tie will be installed from Room 127 to Room 227. It will include a coaxial tie cable for CATV; a Category 5, 50 pair cable for incoming phone lines; the fiber entering the building running continuously to Room 227 in metal conduit, and a grounding tie cable to be run with (not in) the conduit to Room 227. All aspects of the cable network installation will be done according to EIA/TIA 568A standards and the National Electric Code B. The BCSO building is a plenum installation, be aware of installation methods and practices. C. The external building tie will be buried at least eighteen inches deep, and it's location marked every 150 feet with a permanent, visible marker. D. The external tie will consist of a buriable Corning 24 strand 62.5 MM fiber cable and a buriable Corning 12 strand SM fiber cable in a 2" conduit, and two unused 2" conduits with pull ropes. E. The fiber cables will be terminated in a wall mounted fiber enclosure on the BCDC side. Upon entering the BCSO building, the fiber cable entering the building will run continuously in metal conduit into Room 227 where the conduit will stop and the cable will terminate into a rack-mounted fiber enclosure into 6 pair SC connector housings. All fiber strands will be terminated using Corning SC connectors. F. A grounding rod will be installed near the tie entrance to the BCSO building with an attached grounding cable running inside the building with the tie cables/conduit and terminating on a grounding busbar mounted to the wall inside the building in Room 127. G. All pathways through fire rated walls will be sleeved and filled with fire putty. Fire wall sleeves should be no more than 50% full, or another sleeve will be provided and filled with fire putty. H. All cables, conduits, and fiber enclosures will be labeled clearly and correctly using printed labels. 1. All fiber adapter panels will have protective caps installed covering unused fiber connectors. An RG-6 coaxial cable will be run in the BCSO building in metal conduit along with the fiber cables from Room 127 to Room 227. A connecting grounding cable will be connected to the entrance busbar in Room 127 and run to Room 227 where it will be terminated and connected to the Room 227 busbar. E. A 50 pair Category 5 cable shall be run in the conduit with the fiber from Room 127 to room 227. It will be terminated on a wall mounted 110 block in Room 127 next to the incoming telephone box, and on a wall mounted 110 block in Room 227 next to the telephone system. F. All pathways through fire rated walls will be sleeved and filled with fire putty. Fire wall sleeves will be no more than 50% full, or another sleeve will be provided and filled with fire putty. G.
