VOL 1 7 PAGE (02 COMMISSIONERS' COURT REGULAR MEETING APRIL 18, 2006 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos Center 3232 Briarcrest Drive, in Bryan, Brazos County, Texas, beginning at 6:00 p.m. on Tuesday, April 18, 2006 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. The County Judge gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns. The first matter before the Court was the introduction of the winners of the Public Health Week poster contest. Sara Mendez of the Health Department explained the contest and awarded certificates to the winners. The Court next heard a presentation of the quarterly delinquent tax report presented by Shelburne Veselka, representative of McCreary, Veselka, Bragg & Allen, P.C. Vol -17 Page (p13 Commissioners Court meeting April 18, 2006 2 Attorneys at Law. The Court next considered Budget Amendment #05/06-28.1 through 28.3, that would reallocate funds for the 272nd District Court and Justice of the Peace, Precinct 3 and transfer funds from Contingency to the Sheriff's Office. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the change of status as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 7018259 through 7018474 On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the Claims as submitted. The next matter before the Court was consideration of the revised Brazos County Animal Control Ordinance and adoption of Resolution #06-006. On motion by Commissioner Cauley, seconded by Commissioner Wassermann, the Court voted Vol -7 q Page (0 q- Commissioners Court meeting April 18, 2006 3 unanimously to approve the revised Ordinance and adopt Resolution #06-006, amending and updating the fees for the yearly registration of dogs and cats and the tagging of dogs and cats as required by the Brazos County Animal Control Ordinance. A copy of the revised Ordinance and Resolution #06-006 are attached. The Court next considered adoption of the revised Brazos County Sick Leave Pool Policy. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to approve the revised policy. A copy is attached. The next matter before the Court was consideration of a request by the County Auditor for authorization to sign the Quarterly Juror Reimbursement Claim. This is required by Senate Bill 1704, in which the Auditor certifies the amounts requested for reimbursement are due and payable pursuant to Section 61.0015(b) of the Government Code as required and that they are true and correct. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the request and authorize the County Auditor to sign the Quarterly Juror Reimbursement Claim. The Court next considered acceptance of the grant award for the 2006 Emergency Management Performance Grant. The grant Vol ? Page ( 5 Commissioners Court meeting April 18, 2006 q amount is $39,795.00. On motion by Commissioner Cauley, seconded by Commissioner Mallard, the Court voted unanimously to accept the grant funds. The next matter before the Court was the appointment of individuals to the Homeland Security Advisory Committee. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to appoint the following individuals to serve on the committee: a) Jim Mann, Deputy Sheriff, reappointment b) Kenny Mallard, Commissioner, Precinct 3, reappointment c) Chuck Frazier, Emergency Management Director, new d) Betsy Godwin, Emergency Communications Director, new The Court next considered approval of certification that shelter services were provided to evacuees of Hurricane Katrina and/or Hurricane Rita by A&M Church of Christ. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to certify that the sheltering costs incurred by A&M Church of Christ were reasonable, necessary and directly related to Hurricane Katrina and/or Hurricane Rita events and appear eligible for FEMA assistance. The Court next considered approval of the minutes of the Commissioners' Court meetings held in January 2006 on the following dates: Regular Meetings - 3Id, 10th, 17th, 24th, 31st Workshop Meeting - 11th, Special Meeting - 6th On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the minutes as submitted. The next matter for consideration was approval for the Purchasing Agent to advertise the following Requests for Proposal/Bids: a) RFP 2006-026, Internet Service Provider for Courthouse complex b) RFP 2006-027, Delinquent Ad Valorem Tax Collection Service c) Bid 2006-028, Temporary Employment Services On motion by Commissioner Cauley, seconded by Commissioner Vol ? 9 Page 67 Commissioners Court meeting April 18, 2006 6 Peters, the Court voted unanimously to authorize the Purchasing Agent to advertise the previously mentioned RFP'S and bid. The Court next considered the request from Wickson Creek Special Utility District to construct a road bore for waterline installation in the right-of-way of Hollow Heights Drive approximately 25 feet from its intersection with Merka Road. The site is located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the request from Wickson Creek Special Utility District and authorized the installation. A copy of the request is attached hereto. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of W. W. Humphries family Limited Partnership property on Old Reliance Road in Precinct 2 to excavate dirt to be used in the construction of the re-route of Old Reliance Road during the bridge structure replacement project. Vol `19 Page On motion by Commissioner Peters, & Commissioners Court meeting April 18, 2006 7 seconded by Commissioner Mallard, the Court voted unanimously to authorize the work. The next matter before the Court was consideration of a billing submitted by Sheiness, Scott, Grossman & Cohn, LLP for services rendered to the Brazos County Bail Bond Board. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve payment of the billing. The Court next considered approval of a payment authorization in the amount of $888.20 to Patricia J. Moore, D. 0. for testimony in a murder case. A purchase order was not obtained. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the payment authorization. There were no announcements of interest items and possible future agenda topics. Under citizen input and/or concerns the following spoke: Commissioner Mallard a) Said that he will be out of town next week. He will be traveling to Washington D.C. with the Leadership Academy. Vol 7 9 Page 0 Commissioners Court meeting April 18, 2006 Under Agency/Board/Committee reports by Court members, the following spoke: County Judge a) Had a good meeting at the school district concerning combining the Emergency Operations Center. They are working to get a resolution of support from all agencies before going forward in securing a location and funding. Commissioner Wassermann a) Saturday is the Texas Trash Off. It will be from 8:00 a.m. through 11:00 a.m. They will be meeting at Post Oak Mall. A letter was sent to all elected officials asking for volunteers. DEFINITIONS A. Abandonment: To desert or leave without care. B. Animal Control Authority: The person or persons designated by the County Judge to enforce this Article. C. Animal Shelter: Facility designated or recognized by Brazos County for the purpose of impounding and caring for dogs, cats, livestock, and miscellaneous domestic animals. D. Cat: Felis catus. E. Dog: Canis familiaris. F. Humane Manner: Care of a dog or cat to include, but not to be limited to, ventilation and sanitary shelter, wholesome food and water consistent with the normal requirements and feeding habits of the animal's size, species and breed. G. Licensing Authority: Any designated representative charged with administering the issuance and/or revocation of permits and licenses under provisions of this Article. The County Judge shall designate the licensing authority. H. Nuisance: A dog or cat shall be considered a nuisance if it: 1. damages, soils, defiles or defecates on private property other than the owner's or on public walks and recreation areas unless such waste is immediately removed and property disposed of by the owner; 2. causes unsanitary, dangerous, or offensive conditions; 3. causes a disturbance by excessive barking or other noisemaking; 4. chases vehicles, or molests, attacks or interferes with persons or other domestic animals on public or private property other than the owner's. Owner: A person having the right of property or custody of a dog or cat who keeps or harbors a dog or cat or knowingly permits a dog or cat to remain on or about any premises occupied by that person for more than 72 hours. Person: Any individual, corporation, partnership, organization or institution commonly recognized by law as a unit. K. Stray: Any animal running free with no physical restraint beyond the premises of the owner and/or keeper. L. Commercial Boarding Kennel: Facilities that board domestic pets for set fees year round. II. RABIES VACCINATION AND LICENSING - REQUIRED A. No person shall own, keep, or harbor any dog or cat over four (4) months of age within Brazos County- unless such dog or cat is vaccinated and licensed.. The provisions of this section do not apply to animals owned by a licensed research facility, or held in a veterinary medical facility, a government operated animal shelter or commercial boarding kennel. B. All dogs and cats shall be vaccinated against rabies by a licensed veterinarian in accordance with Texas State rabies law. C. A certificate of vaccination/license shall be issued to the owner of each dog or cat vaccinated. Each owner shall also receive a durable vaccination/license tag indicating the year in which it was issued. D. The licensing authority shall designate, when practicable, licensed veterinarians to collect the annual licensing registration fee. A licensed veterinarian who has been so designated shall register dogs and cats, and collect the annual licensing registration fee under the following terms and conditions: 1. If a licensed veterinarian vaccinates a dog or cat for rabies, he shall collect the annual licensing/registration fee, issue a rabies vaccination/license tag, and send to the licensing authority a copy of a form which shall include the following information: a. Name and address of pet owner; b. Description of the pet; c. Date of vaccination; d. Tag number; e. Other appropriate information. 2. A licensed veterinarian who has been designated to collect the annual licensing registration fee shall have all necessary forms and tags for registration provide to him by the licensing authority. The licensing authority shall establish a ht~ 9 PAGE 8D 2006 Animal Control Ordinance Page 3 collection procedure for the fees, a format for the tags, and shall record all dogs and cats registered, the name of the owner, and other appropriate information. E. Tags furnished by the licensing authority shall be of durable materials. A tag issued for a dog or cat must be attached to the collar of the animal and must be worn at all times. Tags are not transferable. A record of all tags issued shall be maintained by the licensing authority, and such records shall be available to the animal control authority. Records are to be kept for five years. F. Except as otherwise provided, the licensing period shall be for one year. Each applicant shall pay the appropriate fee annually and shall supply all information reasonably requested on forms supplied by the licensing authority. G. Upon receipt of the appropriate forms and payment of the scheduled fee, the licensing authority shall provide a tag for dogs and cats vaccinated by a veterinarian other than the one who has been designated to register dogs and cats, in which case the tag will be valid until the rabies vaccination is due again by law. H. License fees shall be waived for dogs serving the blind or deaf, or government owned dogs used for law enforcement. All other licensing provisions apply. III. OWNER RESPONSIBILITY A. No dog or cat shall be allowed to cause a nuisance. The owner of every dog or cat shall be held responsible for every behavior of such dog or cat under the provisions of this Article. IV. IMPOUNDMENT A. Any dog or cat found to be a stray or a nuisance may be impounded in the Brazos Animal Shelter by any citizen, and confined in a humane manner. Immediately upon impoundment of the dog or cat, the Shelter shall make every reasonable effort to notify the owner and inform such owner of the conditions whereby custody of the animal may be regained. B. Dogs and cats not claimed by their owners within a period of three (3) days in which the Shelter is open to the public shall become the property of the Shelter. The Shelter shall be entitled to dispose of such animals by adoption or by humane euthanasia. V. REDEMPTION A. Any dog or cat impounded may be redeemed by the owner thereof within three (3) business days upon payment of the impoundment fee. VOL 7 l PAGE 81 2006 Animal Control fhvllpeNN Page 4 B. Any dog or cat confined for rabies observation, court evidence or other purpose may be redeemed by the owner thereof upon payment of a fee. C. No dog or cat required to be licensed or vaccinated under this Article may be redeemed until the provisions for such licensing and vaccination have been fulfilled. VI. ABANDONMENT A. It shall be unlawful to abandon, desert or dump any dog or cat in Brazos County. VII. FEES A. Any and all fees required by this Article shall be set by resolution of the Brazos County Commissioners Court. VIII. RABIES CONTROL A. This Ordinance adopts the Rabies Control Act of 1981 as set forth in Chapter 826 of the Texas Health and Safety Code in parts that do not conflict with this Ordinance. IX. ANIMAL SHELTER A. This Ordinance adopts the Animal Shelter Act, Article 4477-6b, VATCS, in parts that do not conflict with the provisions of this Article. X. PENALTY A. Failure to comply with the terms of this Ordinance is a Class C Misdemeanor. Adopted by the Brazos County Commissioners Court this day of , 2006. Sims, County Judge e?1FA2E Do, BRAZOSCOUNTY BRYAN,TEXAS BRAZOSCOUNTY RESOLUTION A RESOLUTION OF THE BRAZOS COUNTY COMMISSIONERS COURT AMENDING AND UPDATING THE FEES FOR THE YEARLY REGISTRATION AND TAG OF CATS AND DOGS, AS REQUIRED BY THE BRAZOS COUNTY ANIMAL CONTROL ORDINANCE. Whereas, Section VI of the Brazos County Animal Control Ordinance provides that fees established under the Ordinance are to be set by Resolution of the Commissioners Court; and ` hereas, the Brazos County Commissioners Court is desirous of amending and updating said fees; .Now, Therefore, Be It Pfsofved that the fees under the Brazos County Animal Control Ordinance are set as follows: 1. The fee for Brazos County registration and tag is $15.00 per year for each dog or cat. 2. The fee for a replacement Brazos County tag is $1.00 per tag. The authority to establish this program is Chapter 57 of the Local Government Code (V.T.C.S.) sub-chapter E, 157.071 et se. (As amended September 1, 1997 and September 1, 2001.) 2.08.1 PURPOSE The purpose of the Brazos County Sick Leave Pool is to provide additional sick leave days to county employees in the event of a catastrophic illness or surgery or disability that prevents an employee from active employment. Days may be applied _ for from the Pool only after the employee has exhausted all accrued sick leave, vacation or compensatory time. 2.08.2 DEFINITIONS A. ADMINISTRATOR- means the person or department designated by the Commissioners Court to administer the County Sick Leave Pool Program. B. ELIGIBLE EMPLOYEE - means anyone who is an employee of Brazos County with 12 or more months of continuous employment with the county who is paid from the County General Fund, a County Special Revenue Fund or County Administered Grant and is eligible for sick leave under the existing Personnel Policies; has enrolled in the sick leave pool and has transferred at least one day of accrued sick time to the sick leave pool during the fiscal year. Elected Officials will not be considered eligible employees. C. IMMEDIATE FAMILY - is defined as those individuals related by kinship, adoption or marriage who are living in the same household or, if not in the same household, are totally dependent upon the employee for personal care or services on a continuing basis. D. CATASTROPHIC ILLNESS OR INJURY - is defined as a terminal, life threatening, and/or severe condition or combined conditions affecting the mental or physical health of the employee or an eligible family member that requires the services of a licensed health practitioner for a prolonged period of time and that forces the employee to exhaust all accrued leave time (sick leave, vacation leave, and compensatory time) and to lose compensation from the County E. LICENSED PRACTITIONER - means a practitioner, as defined by the Texas Insurance Code who practices within the scope of his/her license. F. BENEFIT APPLICATION - means an employee, prior to applying for benefits from the County Sick Leave Pool, must have enrolled in the County Sick Leave Pool and transferred at least one day of accrued sick leave time to the sick leave pool during the fiscal year. 2.08.3 ADMINISTRATION OF THE POOL A. At the direction of the Commissioners Court the Director o Human Resources shall serve as the Pool Administrator. The Pool Administrator shall be responsible for developing mechanisms to transfer accrued sick leave into and out of the Pool; developing rules and procedures for the operation of the Pool; and developing forms for contributing leave to, or using leave from the Pool. B. The Pool Administrative Committee shall be composed of the following members: County Judge, Human Resource Director and Legal Counsel. This committee shall be responsible for receiving and viewing all applications for use of leave from the Pool. 2.08.4 POOL Membership in the Sick Leave Pool is voluntary. A. All regular full-time employees are eligible to join the Sick Leave Pool by contributing a minimum of one (1) day or a maximum of four (4) days accrued leave. B. New employees may join the pool after 12 months of continuous employment. New employees must join the pool within thirty days after their anniversary date. Days donated will be subtracted from their accrued leave. C. Employees will only be able to join the Pool at a time designated each year by the Pool Administrator, or in the case of new employees, immediately upon completion of 12 consecutive months. uvL~ PIE "ut D. Membership enrollment forms must be submitted to the Human Resource department. Days donated will be subtracted from each member's accrued sick leave. E. Days donated become the property of the Brazos County Sick Leave Pool and cannot be returned in the event of membership cancellation. F. Employees on an approved leave of absence will retain membership in the Pool and will not be required to donate additional days. G. To maintain membership in the Sick Leave Pool, employees must donate a minimum of one (1) day or a maximum of four (4) days of sick leave each fiscal year during open enrollment designated by the Human Resource Director or at a time during the fiscal year designated by the Pool Administrator for general membership donations. Only one donation during the fiscal year is required to maintain membership in the Pool. 2.08.5 DAYS GRANTED Only members of the Sick Leave Pool-will be granted days from the Pool. A. Days will be granted only for catastrophic illness or surgery or other disability, which necessitates the absence from work for five (5) consecutive days or longer. In case of chemotherapy for cancer treatment, days can be granted for 1- 4 days absence. B. Pregnancy will not be covered by the Sick Leave Pool, but complications due to pregnancy or delivery will be considered. C. The pool may be used only by members for his/her personal illness or disability or for a family member whose illness and relationship to the employee meet the guidelines of the Family Medical Leave Act and the Brazos County Family and Medical Leave Policy. D. Days requested for stress related illness will be granted for hospitalized days only. E. The maximum number of days granted to an employee each year shall not exceed one-third of the total amount of time in the Pool at the time of the request or 90 days whichever is less. A member of the pool, who exhausts all of his/her accrued paid leave and compensatory time to which the employee is otherwise entitled, may withdraw from the pool for a non-catastrophic illness the exact number of days the member had contributed that fiscal year. 2.08.6 PROCEDURE A. An eligible employee must apply to the Director of Human Resource /Pool Administrator for permission to use time in the Pool. B. The Pool Administrator shall present the application to the Pool Administrative Committee, who shall determine eligibility. C. If the employee is determined to be eligible, the Pool Administrator shall approve the transfer of time from the Pool to the employee. The time shall be credited to the employee and shall be used in the same manner as accrued sick leave. D. An employee absent on sick leave assigned from the Pool is treated for all purposes as if the employee were absent on accrued sick leave. E. If a member is critically ill and unable to file an application for sick leave from the Pool, his/her Elected Official or Department Head may submit an application at the request of the employee's family. 2.08.7 FINAL AUTHORITY The Sick Leave Pool Administrative Committee shall have the final approval/disapproval of the employee applications. 2.08.8 APPLICATION FORMS Applications for donation of accrued sick time to the Brazos County Sick Leave Pool are available in the Human Resource department. The AAR and IP has replaced the use of FEMA Form 95-44, Emergency Management Exercise Reporting System (EMERS), as the method of reporting exercise results and required corrective actions. Participate in the Texas Regional Response Network (TRRN) by registering as a user and identifying resources that the jurisdiction(s) participating in the local emergency management program are prepared to make available to other jurisdictions through mutual aid. 1. Task Progress & Reporting As noted in the Fiscal Year 2006 Local Emergency Management Program Guide, continued participation in the EMPG program is in part conditioned on making proportional progress on your Work Plan tasks and the timely submission of progress and financial reports. a. Proportional Progress in Program Tasks. Proportional progress on Work Plan tasks means that I expect you to complete a portion of those tasks each quarter rather than deferring most planning tasks, training, exercises, and other activities until the last several months of the fiscal year. Those who try to complete a year's work in several months frequently fail when major emergencies occur late in the year. VOL -77 __}~r v ~ _l~ b. Financial Reports. Financial reports are due to the Division 30 days after the close of each quarter of the federal fiscal year. Your financial reports for the first quarter should have already been submitted. Subsequent reports are due on April 30, July 30, and October 30, 2006. These reports should be sent directly to the DEM Support Services Section at the P.O. box address at the top of the first page of this letter. c. Progress Reports. Your first semi-annual progress report is due to the GDEM Preparedness Section on April 15, 2006. The final progress report is due October 15, 2006. As noted previously, these reports should reflect progress in completing the tasks contained in your Statement of Work. d. Failure to complete the tasks outlined in the, approved Statement of Work or to subiri t quarterly financial reports and semi-annual progress reports by the required due dates is cause for elimination from the EMPG program.
