THE COMMISSIONERS COURT OF BRAZOS COUNTY WILL MEET IN REGULAR
SESSION ON 4 APRIL 2006 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM
OF THE BRAZOS COUNTY COURTHOUSE, 300 E. 26TH STREET, SUITE 115, BRYAN,

time positions for the remainder of the fiscal year:

6. Payment of Claims.
7. Cash Incentive request in the amount of $15,000.00 for TomorrowNow, Inc. from the
Brazos County Cash Incentive Fund.
8. Cash Incentive request in the amount of $14,000.00 for Texas A&M University from the
Brazos County Cash Incentive Fund.
9. Renewal of the contract with ChoicePoint Business and Government Services, Inc, for
unlimited access to AutoTrack with no increase in the monthly charge. Contract term is 1
April 2006 through 31 March 2007.

Justice of the Peace - Precinct 3 complex:
a. Requisition 00008504 balance due to JaCody, General Contractor, for
construction of the Justice of the Peace - Precinct 3 complex per contract.
b. Requisition 00008505 balance due to Fred Patterson, Architect, for architectural /
engineering services per contract.
c. Requisition 00008506 balance due to Ben Sanford, Telephone System
Consultant, for telephone consulting services per contract.
d. Requisition 00008507 -balance due to Ernie Sims, consulting fees.
15. Request from Wickson Creek Special Utility District to construct two (2) road bores in the
right of way of Cole Lane approximately 1,500 feet from its intersection with State
Highway 30 for water line installation. Site is located in Precinct 3.
16. Special Warranty Deed from W. W. Humphries Family Limited Partnership for
improvements to Old Reliance Road located in Precinct 2.
17. Payment authorization from the District Attorney's Office in the amount of $1,200.00 to
Barbara Sanford, Ph.D. for expert witness testimony. A purchase order was not obtained in
advance.
18. Payment authorization from the District Attorney's Office in the amount of $437.50 to
Cynthia Boyd, Ph.D. for expert witness testimony. A purchase order was not obtained in
advance.
19. Acknowledgement of the Monthly Reports submitted in March 2006. These reports are
available for review in the County Judge's Office.
20. Presentation by Barry Biggar, President & CEO of the Bryan / College Station Convention
and Visitors Bureau on the progress of Wayfinding signage in Brazos County.
21. Announcement of interest items and possible future agenda topics.

COMMISSIONERS' COURT
REGULAR MEETING
April 4, 2006
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos County Commissioners
Courtroom in the Courthouse in Bryan, Brazos County, Texas,
beginning at 9:00 a.m. on Tuesday, April 4, 2006 with the
following members of the Court present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Cauley gave the invocation and led the
pledge of allegiance.
There was no citizen input/and or concerns.
The Court next considered Budget Amendment 405/06-26.1
through 26.4, that would reallocate funds for the County
Clerk, Justice of the Peace, Precinct 2-1, transfer funds from
Contingency to District Clerk Collections, and record a
donation for the Sheriff's Department. On motion by
Commissioner Cauley, seconded by Commissioner Peters, the
Court voted unanimously to approve the budget amendment as

submitted, a copy of which is attached hereto.
The next matter before the Court was the relocation of a
position from the budget of the County Judge to the District
Clerk Collections budget. This is a Clerk I, Position 3
position at a Group 10, Step 2 level. On motion by the County
Judge, seconded by Commissioner Cauley, the Court voted
unanimously to approve the relocation.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
7017777 through 7018002
On motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the Claims as
submitted.
The next matter for consideration by the Court was a
request by the Research Valley Partnership in the amount of
$15,000.00 to meet the cash incentive requirement under the
Performance Agreement between TomorrowNow and the Research
Valley Partnership, Inc. On motion by Commissioner Peter,

seconded by Commissioner Wassermann the court voted
unanimously to approve the payment.
The next matter for consideration by the Court was a
request by the Research Valley Partnership in the amount of
$14,000.00 to meet the cash incentive requirement under the
Performance Agreement between Texas A&M University and the
Research
Valley
Partnership, Inc.
On motion
by the
County
Judge,
seconded
by Commissioner
Cauley the
court
voted
unanimously to approve the payment.
The Court next considered the renewal of the contract
with ChoicePoint Business and Government Services, Inc. for
unlimited access to Auto Track. There will be no increase in
the monthly charge. The renewal period is from April 1, 2006
through March 31, 2007. On motion by Commissioner Peters,
seconded by Commissioner Wassermann, the Court voted
unanimously to approve the renewal of contract. A copy is
attached.
The next matter before the Court was a request submitted
by the Dispute Resolution Center to house the Brazos County
Law Library in the offices of the center. On motion by the
County Judge, seconded by Commissioner Cauley, the Court voted
unanimously to relocate the Law Library from Blinn College to
the offices of the Dispute Resolution Center located at 3211

On motion by the County Judge, seconded by Commissioner
Cauley, the Court voted unanimously to receive, approve and
order filed as submitted the Treasurer's report for February
2006. A copy is attached to and made a part of these minutes.
The next matter for consideration was approval of tax
refund applications from the following individuals and/or
companies:
a) W. J. Properties, Over Payment $406.88
b) Nelda Webb, Over Payment $552.00
c) Janice Ansley, Over Payment $231.57
On motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to approve the tax refund
applications.
The Court next considered allowing Hunt Construction to
proceed with the purchase of metal buildings for the Exhibit
Hall, Covered Rodeo Arena and Animal Stall Bars for the Expo
Center. Cost for the purchases is $2,271,686.00. On motion
by Commissioner Peters, seconded by Commissioner Cauley, the
Court voted unanimously to give Hunt Construction permission
to proceed with the purchase of the above noted metal
buildings.
The next matter before the Court was considerations of
the following requisitions to encumber funds budgeted for

construction of the Justice of the Peace, Precinct 3 complex:
a) Requisition 00008504 - balance due to
JaCody, General Contractor for
construction of the Justice of the
Peace
b) Requisition 00008505 - balance due to
Fred Patterson, Architect
c) Requisition 00008506 - Balance due to
Ben Sanford, Telephone System
Consultant
d) Requisition 00008507 - balance due to
Ernie Sims, Consultant Fees
On motion by Commissioner Mallard, seconded by Commissioner
Cauley, the Court voted unanimously to approve the previously
noted requisitions a-d.
The Court next considered the request from Wickson Creek
Special Utility District to construct two road bores for
waterline installation in the right-of-way of Cole Lane
approximately 1,500 feet from its intersection with State
Highway 30. The site is located in Precinct 3. The County
Engineer stated that all appeared to be in order and
recommended approval. On motion by Commissioner Mallard,
seconded by Commissioner Wassermann, the Court voted
unanimously to approve the request from Wickson Creek Special
Utility District and authorized the installation. A copy of
the request is attached hereto.
The Court next considered acceptance of a Special

Warranty Deed for right-of-way on Old Reliance Road in
Precinct 2. On motion by Commissioner Peters, seconded by
Commissioner Wassermann, the Court voted unanimously to
authorize the County Judge to accept on behalf of Brazos
County a Warranty Deed from the W. W. Humphries Family Limited
Partnership for the expansion and improvements to Old Reliance
Road.
The next matter before the Court was consideration of a
payment authorization from the District Attorney's Office in
the amount of $1,200.00 to Barbara Sanford, Ph.D. for expert
witness testimony. A purchase order was not obtained in
advance. On motion by Commissioner Peters, seconded by
Commissioner Mallard, the Court voted unanimously to approve
the payment authorization.
The Court next considered a payment authorization from
the District Attorney's Office in the amount of $437.50 to
Cynthia A. Boyd, a therapist for expert witness testimony. A
purchase order was not obtained in advance. On motion by
Commissioner Cauley, seconded by Commissioner Peters, the
Court voted unanimously to approve the payment authorization.
The Court acknowledged receipt of the Extension Service
reports for February 2006 and acknowledged receipt of reports
from the following County and Precinct Offices showing

A copy of the Officials' reports can be viewed in the County
Auditor's office.
The next matter before the Court was a presentation by
Barry Biggar, President & CEO of the Bryan/College Station
Convention and Visitors Bureau on the progress of Wayfinding
signage in Brazos County. Mr. Biggar gave a progress report on
the Wayfinding project. They need to get approval of the
design, develop sign message, schedule, finalize sign location
plans, put together a bid package and implement the program.
There were no announcements of interest items and
possible future agenda topics.
There was no citizen input and/or concerns.
Under Agency/Board/Committee reports by Court members,

a) The Tobacco Settlement money distributed by
the state on April 4, 2001 totaled $14.6
million dollars. In April of 2006 the
state distribution is $72 million dollars.
He said that Brazos County has only been
using the interest.
There being no further business to come before the Court,
the meeting was adjourned.

PRICE:
CPBG agrees to provide Brazos County Attorney's Office with unlimited access to
AutoTrack at the rate of $ 200 per month for the period of 12 months beginning
April 1, 2006 to March 31, 2007.
SPECIAL CONDITIONS:
The flat rate would not apply to copies of "Premium Reports" which now consist of
(1) National and Florida criminal records and motor vehicle accident reports
(MVRS),
(2) Dun & Bradstreet Reports
(3) InfoUSA Reports
(4) Link It Analytical Reports
The "Premium Report" option will be turned off to prevent access from the menu. If you
require "Premium Reports" please notify us and we can arrange to have them billed in
addition to the flat rate price.

DATE OF COURT MEETING: April 4, 2006
ITEM: Request from Wickson Creek Special Utility District to construct two (2) road bores
in the right of way of Cole Lane approximately 1,500 ft. from its intersection with State
Highway 30 for water line installation. Site is located in precinct 3.
SOURCE OF FUNDS: N/A
REQUIREMENTS:
1. No work will be permitted between front slope and/or back slope.
2. All installation(s) shall be constructed in designated utility easements, if applicable. If no
utility easement exists, the installation(s) shall be 1) within 3-5' of and parallel to the right-of-
way line and/or 2) in the case of a road bore, perpendicular to the right-of-way line.
3. If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county right-of-way.
4. Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test
shall be conducted by an independent geotechnical testing firm; copies of all test results shall
be furnished to the office of the Brazos County Engineer.
5. Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of
Transportation, and all other State and Federal laws governing utility construction.

REQUEST FOR PROPOSED INSTALLATION IN COUNTY RIGHT-OF-WAY
TO THE COMMISSIONERS' COURT OF BRAZOS COUNTY, TEXAS
BRAZOS COUNTY COURTHOUSE
BRYAN, TEXAS 77803
Formal notice is hereby given that (applicant) Wickson Creek Special Utility District
proposes to place a (type) Waterline within x across x the right-of-way of
(road) Cole Lane in Brazos County, Texas as follows:
The location or description of the proposed installation is more fully shown by 3
copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that he, or his designated inspector, may
inspect the actual installation.
2. All damage to the roadways and rights-of-way will be repaired to their
original condition to the satisfaction of the County Engineer.
3. Brazos County reserves the right to require Applicant to relocate or
lower any such line at no cost to Brazos County, should same
become necessary due to widening or lowering, or other alteration of
the roadway or right-of-way.
4. Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines in the right-of-way.
5. The line will be constructed and maintained on the County right-of-way in
accordance with the Utility Accommodation Policy which was adopted by the
Texas Department of Transportation on May 29, 1989.
6. The line or lines will be constructed no less than twenty-four inches (24")
lower than the lowest part of the drainage or bar ditch and the drainage is to
be considered at least two feet (2') below the center of the roadway.
7. All sites will be barricaded during the construction period.
Construction of this line will begin on or after the 5 day of April 2006 .
