BRAZOS COUNTY COMMISSIONERS COURT
THE COMMISSIONERS COURT OF BRAZOS COUNTY WILL MEET IN REGULAR
SESSION ON 28 FEBRUARY 2006 AT 9:00 A.M. IN THE COMMISSIONERS
COURTROOM OF THE BRAZOS COUNTY COURTHOUSE, 300 E. 26Tn STREET,
SUITE 115, BRYAN, TEXAS.
1. Invocation and Pledge of Allegiance - Commissioner Wassermann
2. Call for citizen's input and/or concerns.
Consider and take action on agenda items 3 -13:
3. Budget Amendment 05/06-21.1 thru 05/06-21.4.
4. Personnel Change of Status.
5. Payment of Claims.
6. Status of the Burn Ban as established by Brazos County Order 05-011, and possible
action.
7. Out of state travel for Emergency Management Coordinator Chuck Frazier and Deputy
Emergency Management Coordinator Michele Meade to attend the 2006 Web EOC User
Conference and Workshop in Baton Rouge, LA. Dates of travel are 16-19 April 2006.
8. Out of state travel for Commissioner Kenny Mallard to attend the Commissioners Court
Leadership Academy in Washington, D.C. Dates of travel are 23-28 April 2006.
9. Tax Refund Applications for the following:

10. Permission to accept the following property donated to the Brazos County Juvenile
Services Department:
a. Six (6) tee shirts from CC Creations valued @ $5.00/each
b. Six (6) "freebee" cards from Double Dave's Pizza valued @ $3.50/each.
c. Various types of clothes for indigent juveniles valued @ 85.00.
11. Award of Bid 2006-016, Removal of Existing Timber Bridges and Construction of Two
Lane Roadway Bridges at the following locations to Wakefield Bridge, Inc. based on best
price:
a. Ferrill Creek Road at Ferrill Creek
b. Deep Well Road at Sparks Branch Creek
c. Silver Hill Road at Thompson Creek
12. Payment of the 2006 Dues for membership in the County Judges & Commissioners
Association of Texas in the amount of $2,000.00.
13. Replat of Lot 1, Block 2, Phase 7 and Lot 2, Block 1, Phase 8 of North Country Estates,
Volume 5736, Page 279 (Phase 7) and Volume 6221, Page 142 (Phase 8), Official
Records of Brazos County, 3.05 acres, Green H. Coleman survey, A-10, Brazos County,
Texas. Site is located in Precinct 2.
14. Announcement of interest items and possible future agenda topics.
15. Call for citizen input and/or concerns.
16. Agency / Board / Committee reports by Court members.

REGULAR MEETING
FEBRUARY 28, 2006
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos County Commissioners
Courtroom in the Courthouse in Bryan, Brazos County, Texas,
beginning at 9:00 a.m. on Tuesday, February 28, 2006 with the
following members of the Court present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Wassermann gave the invocation and led the
pledge of allegiance.
There was no citizen input/and or concerns.
The Court next considered Budget Amendment #05/06-21.1
through 21.4, which would reallocate funds for the County
Clerk, and Tax Assessor-Collector;, and transfer funds from
Contingency to Juvenile Court Referee and Capital Improvement
Fund. On motion by Commissioner Peters, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached

hereto.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
7016597 through 7016863
On motion by Commissioner Cauley, seconded by Commissioner
Mallard, the Court voted unanimously to approve the Claims as
submitted.
The next matter before the Court was consideration of the
status of the Burn Ban. On motion by the County Judge,
seconded by Commissioner Peters, the Court voted unanimously
to table consideration and not reinstate the Burn Ban.
The next matter for consideration by the Court was a
request submitted by Chuck Frazier, Emergency Management
Coordinator seeking approval for out of state travel for
himself and Assistant Emergency Management Coordinator,
Michele Meade. Mr. Frazier and Mrs. Meade would be traveling
to Baton Rouge, Louisiana to attend the 2006 Web EOC User
Conference and Workshop April 16 through 19, 2006. On motion

by Commissioner Wassermann, seconded by Commissioner Cauley,
the Court voted unanimously to grant the request from the
Emergency Management Coordinator and approved payment of out
of state travel expenses for Mr. Frazier and Mrs. Meade.
The next matter for consideration by the Court was a
request seeking approval for out of state travel for
Commissioner Kenny Mallard. Commissioner Mallard would be
traveling to Washington D.C. to attend the Commissioners Court
Leadership Academy April 23-28, 2006. On motion by the County
Judge, seconded by Commissioner Cauley, the Court voted
unanimously to grant the request from Commissioner Mallard and
approved payment of out of state travel expense for
Commissioner Mallard.
The next matter for consideration was approval of tax
refund applications from the following individual and/or
company:
a) Delores Woodward Ttee, Over Payment $37.24
On motion by Commissioner Peters, seconded by Commissioner
Mallard, the Court voted unanimously to approve the tax refund
application.
The Court next considered authorizing acceptance of
donated property from CC Creations, Double Dave's Pizza and
clothing. CC Creations donated six (6) Tee Shirts valued at

$5.00 each, Double Dave's donated six (6) gift cards valued at
$3.50 each and clothing donation is valued at $85.00. These
were donated to the Juvenile Services Department for the JSCC
Program. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to accept the
donated property.
The Court next considered awarding the following bids:
a) Bid No. 2006-016, Removal of Existing Timber Bridges
and Construction of Two Land Roadway Bridges at the following
locations:
a) Ferrill Creek Road at Ferrill Creek
b) Deep Well Road at Sparks Branch Creek
c) Silver Hill Road at Thompson Creek
Becky Stephens, Assistant Purchasing Agent, recommended
acceptance of the bid submitted by Wakefield Bridge, Inc. On
motion by Commissioner Peters, seconded by Commissioner
Wassermann, the Court voted unanimously to accept the
recommendation of the Assistant Purchasing Agent and award the
contract to Wakefield Bridge, Inc. A copy of the bid
tabulation is attached.
The next matter before the Court was consideration of the
payment of the 2006 dues for membership in the County Judges
and Commissioners Association of Texas in the amount of
$2,000.00. On motion by the County Judge, seconded by

Commissioner Cauley, the Court voted unanimously to approve
payment of the dues.
The Court next considered approval of the Re-Plat of
Phase 7 and Lot 2, Block 1, Phase of North Country Estates in
Precinct 2. Richard Vance, County Engineer, stated that he
had reviewed the plat and found it to be in order. On motion
by the County Judge, seconded by Commissioner Cauley, the
Court voted unanimously to approve the Re-Plat of Phase 7 and
Lot 2, Block 1, Phase of North Country Estates as submitted.
Under announcement of interest items and possible future
agenda topics the following spoke:
Commissioner Cauley
a) Said that people along Sandy Point Road have
been calling about problems with dogs. He
has talked to the Sheriff and to Court
Council to see what can be done to give
these people some relief. He does not want
something terrible to happen before action
is taken.
County Judge
a) Asked Court Council, Rod Anderson if there
was a leash law in the County. He then said
we can't do that right? Mr. Anderson said
there are a few possibilities for doing
something like that, one being under the
rabies act. We have some authority, just
depending on how far the Commissioners want
to go with it.

David Abbe of Sandy Oaks
a) Described the situation with dogs.
Some are dropped off in the area. He
then described pit bulls pinning
people in their cars.
There was no citizen input and/or concerns.
Under Agency/Board/Committee reports by Court members,
the following spoke:
Commissioner Mallard
a) The City of Bryan is working on a
comprehensive plan on roadways. The City
can designate right-of-way in the ETJ. We
might get together and look at plans and
see how that matches up with our plans for
the future.
Commissioner Cauley
a) He deferred to Eric Caldwell, director of
the Information Technology Department.
Mr. Caldwell mailed the judges, auditor
and other elected officials information
concerning dockets on monitors in the
lobby of the courthouse rather than on the
bulletin board. It is a small start but
much more visible and more up to date.
b) Commissioner Cauley asked if this could be
accessed from home whereupon Mr. Caldwell
said that yes it could.

a) Asked for a future workshop on "ownership
of data" in Brazos County.

County Judge
a) He attended a lunch where they discussed
remarketing and remodeling the Bush Library
and making some changes for more interest.
b) There will be a workshop today at 10:00
a.m. to discuss the Task Force.
Commissioner Mallard
a) The V. G. Young Institute held a meeting
last week for Commissioners and County
Judges. Commissioner Mallard highlighted
the topics discussed at the annual meeting.

There being no further business to come before the Court,
the meeting was adjourned.

THAT WHEREAS, on 28 February 2006 the Court heard and approved a budget amendment for the
2005-2006 budget year for Brazos County, Texas; and
WHEREAS, an expenditure is necessary due to the necessity to meet unusual and unforeseen
conditions which could not be reasonably included in the original budget adopted 20 September 2005, the
following amendment(s) to the original budget are hereby authorized, as described on the attached page(s).
