installations in the right of way of Lometa Lane (from Old Highway 6 to UP Railroad /
FM 2154). Site is located in Precinct 1.

THE COMMISSIONERS COURT OF BRAZOS COUNTY WILL MEET IN REGULAR

In addition to the regular agenda, the Commissioners Court will consider and take action
on the following item(s):
1. Brazos County Resolution 05-011 providing for the public sale of property acquired by
Brazos County from delinquent taxes.

COMMISSIONERS' COURT
REGULAR MEETING
OCTOBER 18, 2005
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos Center 3232 Briarcrest
Drive, in Bryan, Brazos County, Texas, beginning at 6:00 p.m.
on Tuesday, October 18, 2005 with the following members of the
Court present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct l;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
The County Judge gave the invocation and led the pledge
of allegiance.
Under citizen input/and or concerns the following spoke:
County Judge
a) He welcomed the boys from cub scout troop 1861
in College Station and their leader Alton
Holmes. The scouts are working toward their
Eagle's Merit Badges.
b) He then read a statement for those wishing to
address the Commissioners Court outlining time
limits, limitations on the Court's ability to
comment on topics and instructing those speaking
not to use the forum for making personal attacks

on individual members of the Brazos County
staff.
The Court next heard a presentation of the quarterly
delinquent tax report presented by Shelburne Veselka,
representative of McCreary, Veselka, Bragg & Allen, P.C.
Attorneys at Law.
The Court next considered Budget Amendment #04/05-49.1
through 49.7, which would reallocate funds for Community
Supervision, and Juvenile Services; increase the budget of
Alternative Dispute Resolution, 2005 Certificate of
Obligation, and Exposition Center; and transfer funds from
Contingency to Child Protective Services and Emergency
Management. On motion by Commissioner Cauley, seconded by
Commissioner Mallard, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is
attached.
The Court next considered Budget Amendment #05/06-3.1
through 3.2, which would reallocate funds for the Road and
Bridge Department, and transfer funds from Contingency to
Justice of the Peace, Precinct 2-2. On motion by Commissioner
Cauley, seconded by Commissioner Peters, the Court voted
unanimously to approve the budget amendment as submitted, a
copy of which is attached.

cost of living raise given to an employee in the District
Attorney's office. On motion by Commissioner Wassermann,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the correction and increase the employee's pay to
reflect the 4% COLA.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve
the change of status as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted.
The next matter before the Court was the addition of
Exhibit "A" to the Texas Commercial Waste contract. The
exhibit is a change in the hauling fee from $100 per load to
$110 per load. On motion by the County Judge, seconded by
Commissioner Mallard, the Court voted unanimously to approve
Exhibit "A" to the Texas Commercial Waste contract. A copy is
attached.

On motion by Commissioner Peters, seconded by
Commissioner Wassermann, the Court voted unanimously to adopt
Resolution #05-010 designating the County Judge as the
authorized official to apply for, accept, decline, modify, or
cancel the grant application for the Indigent Defense Formula
Grant Program and all other necessary documents to accept said
grant. It is also resolved that the County Judge is
designated as the program director and contact person for this
grant and the county auditor is designated as the financial
officer for this grant.
The Court next considered adopting an Order relocating
the temporary early voting polling place. The Court was
notified by the College Station Utility Customer Service
Center located at 310 Krenek Tap Road, College Station, Texas
that it would no longer be available for the use as a
temporary early vote location. The Living Hope Baptist Church
located at 4170 S.H. 6 South, College Station, Texas offered
it's facility for use as a temporary early vote location but
later had to withdraw their offer. The City of College Station
has agreed to let the temporary early voting polling place be
located in the Lincoln Center located at 1000 Eleanor Street,
College Station, Texas. On motion by Commissioner Wassermann,
seconded by Commissioner Cauley, the Court voted unanimously

to relocate the temporary early voting location to the Lincoln
Center located at 1000 Eleanor Street, College Station, Texas
and to make submission to the Assistant Attorney General,
Civil Rights Division, Voting Section, Department of Justice,
Washington, D.C. requesting the pre-clearance of the Order
pursuant to Section 5 of the Federal Voting Rights Act.
The Court next considered the formation of a committee to
review the Emergency Management Coordinator applicants and to
appoint individuals to serve on the committee. On motion by
the County Judge, seconded by Commissioner Peters, the Court
voted unanimously to form a committee to review the Emergency
Management Coordinator applicants and to appoint the following
individuals to serve on that committee:

Michele Meade Brazos County Emergency Management

The next matter for consideration was approval of tax
refund applications from the following individuals and/or
companies:
a) Mary & Gilberto L. Hinojosa, Over Payment $233.13
b) Transcontinental Title Company, Over Payment $15.68
c) Pitt Stop Custom Carwash, $12.21
d) Pamela S. Wiley, Over Payment $145.66
e) Gary D. Wagner, Over Payment $27.00

On motion by Commissioner Peters, seconded by Commissioner
Wassermann, the Court voted unanimously to approve the tax
refund applications.
The next matter before the Court was the renewal of the
Stop Loss coverage with AIG. On motion by Commissioner
Mallard, seconded by Commissioner Peters, the Court voted
unanimously to renew the coverage for the period of November
1, 2005 through October 31, 2006. A copy is attached.
The Court next considered approval the capital purchase
of patrol vehicles for the Sheriff's Office and requisition
#00006382 in the amount of $156,001.00. On motion by
Commissioner Wassermann, seconded by Commissioner Cauley, the
Court voted unanimously to approve the capital purchase and
the requisition in the amount of $156,001.00.
The next matter before the Court was consideration of an
amendment to the 2005-2006 exemptions from competitive bidding
requirements. On motion by Commissioner Peters, seconded by
Commissioner Cauley, the Court voted unanimously to include
Automation Displays, Inc. on the list of vendors who are
exempt from competitive bidding requirements.
The Court next considered the declaration of surplus
property as salvage. This property was advertised for sale in
accordance with Local Government Code §263.152 and received no

bids. On motion by Commissioner Peters, seconded by
Commissioner Wassermann, the Court voted unanimously to
declare the property as salvage and authorized its destruction
or other disposal. A list of the property is attached.

Telephone to construct a road bore and 11,278 feet of buried
cable installations in the right-of-way of Old Highway 6 (from

The Court next considered the request from Sprint United

County through judgment of foreclosure for delinquent taxes.
On motion by the County Judge, seconded by Commissioner
Peters, the Court voted unanimously to direct the Sheriff of
Brazos County to conduct a sale on the first Tuesday in
December, 2005 in the manner prescribed by the Texas Rules of
Civil Procedure and § 34.05 (c) and (d) of the Texas Property
Tax Code.

meeting of the IGC on November 14 at the new
space above Doe's Restaurant near the La

b) He complimented Mr. Shelly Veselka for help
with five (5) lots that can be donated to
Habitat for Humanity.

a) He asked for clarification on the County Judge's
opening remarks especially not being able to
discuss something that was not on the agenda. He
asked if it wasn't true that the Court could
discuss a topic but were not required to.

a) Said her understanding of open meetings is that
you may not discuss. You may be able to answer a
simple direct question but that is it.
Under Agency/Board/Committee reports by Court members,

a) The IGC met on Monday and discussed a Joint
Operations Center.

the meeting was adjourned.

AMENDED ORDER RELOCATING TEMPORARY
EARLY VOTING POLLING PLACE
WHEREAS, the Commissioners Court of Brazos County has established four
early voting polling places in various locations in Brazos County; and
WHEREAS, the Commissioners Court is desirous to comply with section
85.062(d)(2) of the Texas Election Code which requires locating one temporary branch
early voting polling place in -each Commissioner Precinct, and
WHEREAS, the Commissioners Court has been notified that the College Station
Utility Customer Service Center, will no longer be available for the use as a temporary
early voting location; and
WHEREAS, the Commissioners Court adopted an Order on September 27, 2005
to relocate the temporary early voting polling place from the College Station Utility
Customer Service Center located at 310 Krenek Tap Road, College Station Texas to the
Living Hope Baptist Church located at 4170 S.H. 6 South, College Station, Texas; and
WHEREAS, the Commissioners Court has been notified by the church that it will
not be available for use as a temporary early vote location; and
WHEREAS, the City of College Station has agreed to let the temporary early
voting polling place be located in the Lincoln Center located at 1000 Eleanor Street,
College Station, Texas; and
WHEREAS, the Commissioners Court is desirous of relocating the temporary
branch early voting polling place from the College Station Utility Customer Service
Center located at 310 Krenek Tap Road, College Station, Texas to the Lincoln Center
located at 1000 Eleanor Street, College Station, Texas, for the convenience of the voters;
NOW THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS COURT
OF BRAZOS COUNTY, TEXAS, THAT:
Pursuant to Section 85.062(d)(2) of the Texas Election Code that one temporary
branch early voting polling place be established in each Commissioner Precinct in Brazos
County; and
THAT the Order adopted by the Commissioners Court on September 27, 2005
relocating the temporary branch early voting polling place fivm the College Station
Utility Customer Service Center located at 310 Krenek Tap Road, College Station, Texas
to the Living Hope Baptist Church located at 4170 S.H. 6 South be amended; and
THAT the temporary branch early voting polling place be relocated from the

Texas that the County of Brazos, Texas hereby directs the Sheriff of Brazos County, Texas to conduct a

Procedure and § 34.05 (c) and (d) of the TEX. PROP. TAX CODE.
