11. Appointment of Michael Clancey, College Station Police Chief, to the Brazos Valley
Council of Governments' Criminal Justice Advisory Committee, effective immediately.
Chief Clancey replaces Edgar Feldman on this committee.
12. Resolution #05-009 approving the budget of the Brazos County Emergency
Communications District for fiscal year 05-06, and providing an effective date.
13. Funding Addendum for the Brazos County Public Health District for fiscal year 2006,
commencing on 1 October 2005 through 30 September 2006.
14. Proposed change to the Brazos County Travel Policy, increasing the amount allowed for
mileage to 45.5 cents per mile from the current 40.5 cents per mile.
15. Request from the Information Technology Department to replace the computer user ID
request form with the proposed new Computer User Access form, and to require that this
form be completed with each personnel action form that concerns a new hire, retirement,
termination, resignation or job abandonment.
16. Request from the Information Technology Department for permission to utilize Law
Library funds to provide access within the courthouse to an online legal library for the
general public over a wireless internet connection.
17. Tax Refund Applications for the following:

REGULAR MEETING
OCTOBER 11, 2005
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos County Commissioners
Courtroom in the Courthouse in Bryan, Brazos County, Texas,
beginning at 9:00 a.m. on Tuesday, October 11, 2005 with the
following members of the Court present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Wassermann gave the invocation and led the
pledge of allegiance.
Under citizen input/and or concerns the following spoke:
Demetrios Basdekas
a) Apologized if he offended anyone last week while
speaking he said he would like to remind the Court of
the issue last week of the lack of communication with
the state. The life of a state trooper is just as
important as any other law official. Also he spoke
about the Board of Regents at TAMU and the submission
of the proposal to the President on bringing his
library here. He asked what the County's share was
of the $20,000,000 project. The County Judge said
that this was the first he had heard of a dollar
figure.

The Court next considered Budget Amendment #04/05-48.1
through 48.3, which would transfer funds to Sheriff-Jail
Division, Emergency Management and Commissioners Court from
Contingency. On motion by Commissioner Cauley, seconded by
Commissioner Mallard, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.
The Court next considered Budget Amendment #05/06-2.1,
which would transfer funds to Jail Administration and
Constables from Contingency. On motion by Commissioner
Peters, seconded by Commissioner Cauley, the Court voted
unanimously to approve the budget amendment as submitted, a
copy of which is attached hereto.
The next matter before the Court was consideration of an
amendment to the Brazos Valley Narcotics Trafficking Task
Force commander position changing this position from Exempt to
Non-Exempt status under the FLSA Guidelines. The County Judge
asked how much this would increase the budget. The Sheriff
responded that it would not. Comp time would be used and if
there were insufficient funds in the budget the needed funds
could come from the Crime Fund. On motion by Commissioner
Peters, seconded by Commissioner Wassermann, the Court voted
unanimously to approve the amendment to the Brazos Valley

Narcotics Trafficking Task Force commander position changing
this position from Exempt to Non-Exempt status under the FLSA
Guidelines.
The County Judge deviated from the order of the agenda
and next considered item number 9, the appointment of an
individual to act as Interim Director of Emergency Management
for Brazos County, to be effective at 5:00 p.m. on October 14,
2005. On motion by the County Judge, seconded by Commissioner
Cauley, the Court voted unanimously to appoint Michele Meade
to act as Interim Director of Emergency Management for Brazos
County, to be effective at 5:00 p.m. on October 14, 2005.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Peters, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the Claims as
submitted.

The next matter before the Court was a request from
Research Valley Partnership for approval of a cash incentive
of $50,000.00 to StarVision, Inc. On motion by the County
Judge, seconded by Commissioner Mallard, the Court voted
unanimously to remove this item from the agenda.
The Court next considered the appointment of an
individual to the Brazos Valley Council of Governments'
Criminal Justice Advisory Committee. On motion by
Commissioner Wassermann, seconded by Commissioner Peters, the
Court voted unanimously to appoint Laury Kasowski to the
Brazos Valley Council of Governments' Criminal Justice
Advisory Committee effective immediately.
The Court next considered the appointment of an
individual to the Brazos Valley Council of Governments'
Criminal Justice Advisory Committee. On motion by
Commissioner Peters, seconded by Commissioner Mallard, the
Court voted unanimously to appoint Michael Clancey to the
Brazos Valley Council of Governments' Criminal Justice
Advisory Committee effective immediately.
On motion by the County Judge, seconded by Commissioner
Mallard, the Court voted unanimously to adopt Resolution #05-
009 approving the budget of the Brazos County Emergency
Communications District. The resolution shall be effective

immediately upon its adoption and passage.
The next matter before the Court was consideration of a
funding addendum for the Brazos County Health District for
fiscal year 2006. The City of Bryan's contribution is
$10,000.00. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to agree to
the contribution.
The Court next considered a change to the Brazos County
travel policy. The current travel allowance is 40.5 cents per
mile. On motion by Commissioner Peters, seconded by
Commissioner Wassermann, the Court voted unanimously to
increase the travel allowance to 45.5 cents per mile.
The next matter before the Court was a request from the
Information Technology Department to replace the computer user
ID request form. On motion by Commissioner Cauley, seconded
by Commissioner Mallard, the Court voted unanimously to
approve the request.
The Court next considered a request from the Information
Technology Department to utilize Law Library funds to provide
access within the courthouse to an online legal library to the

by Commissioner Mallard, seconded by Commissioner Cauley, the
Court voted unanimously to approve the request.

The next matter for consideration was approval of tax
refund applications from the following individuals and/or
companies:
a) Rex-All Service Attn: Rex Warden, Over Payment
$43.05
b) E. J. Baca, Over Payment $31.83
c) J&R Family Trust Attn: Diane M. Davis, Over Payment
$15.84
d) Sally Ann Milavec, Over Payment $27.39
e) Green Tree Financial, Over Payment $6.51 and $29.67
On motion by Commissioner Peters, seconded by Commissioner
Mallard, the Court voted unanimously to approve the tax refund
applications.
The Court next considered a request from the Sheriff's
office for an exception to the County's travel policy
concerning the maximum reimbursement allowed for lodging.
Senior Investigator Kenny Elliott attended a Crimes Assessment
Committee meeting in Austin during the time hotels were full
of evacuees from Hurricane Rita. He had to take lodging at a
hotel whose nightly rate exceeded the lodging allowance by
$15.30. On motion by Commissioner Peters, seconded by
Commissioner Wassermann, the Court voted unanimously to grant
the request and allow full reimbursement.
The next matter before the Court was a request from the
Information Technology Department to approve payment of a
payment authorization to CDW Government Solutions for $287.00.

Due to receiving an incorrect order, the replacement being
more expensive and having to close out the original purchase
order it was necessary to generate the payment authorization
in the amount of $287.00. On motion by Commissioner Cauley,
seconded by Commissioner Peters, the Court voted unanimously
to approve the payment authorization.
The Court next considered awarding Bid No. 2005-042,
Culverts Various Types. Becky Stephens, Senior Buyer, made
the following recommendations:

Court voted unanimously to
accept the
recommendation of the Senior Buyer and award the contract to
as noted. A copy of the bid tabulation is attached.
The next matter before the Court was an amendment to the
2005-2006 exemptions from competitive bidding requirements,
adding Best Access System as an exempted vendor. On motion by
Commissioner Cauley, seconded by Commissioner Peters, the
Court voted unanimously to approve the addition of Best Access
System to the list of vendors who are exempt from competitive
bidding requirements.

The court next considered renewal of the option in the
mail processing contract with DeLucia Mail Service. DeLucia
has agreed to renew the contract with no increase in cost to
the County. On motion by Commissioner Peters, seconded by
Commissioner Cauley, the Court voted unanimously to renew the
contract with DeLucia Mail Service. A copy of the renewal
acceptance is attached.
The next matter before the Court was consideration of a
capital purchase of a digital video recording system from
Microview Systems for the detention center. Cost of the
recording system is $23,401.40. On motion by Commissioner
Cauley, seconded by Commissioner Peters, the Court voted
unanimously to approve the capital purchase.
The Court next considered approval of the Final Plat of
Sunrise Estates, 33.386 Acres, Block 1, Lots 1-15 and Block 2,
Lots 1-5 in Precinct 2. Richard Vance, County Engineer,
stated that he had reviewed the plat and all appeared to be in
order. On motion by Commissioner Peters, seconded by
Commissioner Wassermann, the Court voted unanimously to
approve the final plat of Sunrise Estates 33.386 Acres, Block
1, Lots 1-15 and Block 2, Lots 1-5 as submitted.
The Court next considered approval of the Final Plat of
North Country Estates Phase Eleven, 41.28 Acres in Precinct 2.

Richard Vance, County Engineer, stated that he had reviewed
the plat and all appeared to be in order. The County Judge
moved to approve. Commissioner Cauley seconded the motion.
Commissioners Wassermann, Mallard, Cauley and the County Judge
all voted "Aye". Commissioner Peters abstained because the
developer is related to him. The plat was approved as
submitted.
On motion by the County Judge, seconded by Commissioner
Peters, the Court voted unanimously to receive, approve and
order filed as submitted the Treasurer's report for August
2005. A copy is attached to and made a part of these minutes.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held in June, July and August
2005 on the following dates:
Regular Meetings - July - 5th, 12th, 19th, and 26th
Special Meeting - June - 15th
Workshop Sessions - July - 11th through 22nd 12th 19th
and 25th through 29th
August 1st through 5th
on motion by the County Judge, seconded by Commissioner
Cauley, the Court voted unanimously to approve the minutes as
submitted.
The County Judge next addressed the addendum to the
Commissioners Court agenda which was to consider approval of
the Final Plat of North Country Estates Phase Thirteen, 30.08

Acres in Precinct 2. Richard Vance, County Engineer, stated
that he had reviewed the plat and all appeared to be in order.
The County Judge moved to approve. Commissioner Cauley
seconded the motion. Commissioners Wassermann, Mallard, Cauley
and the County Judge all voted "Aye". Commissioner Peters
abstained because the developer is related to him. The plat
was approved as submitted.
There were no announcements of interest items and
possible future agenda topics.
There was no citizen input and/or concerns.
There were no Agency/Board/Committee reports by Court
members.
There being no further business to come before the Court,
the meeting was adjourned.

RESOLUTION
A RESOLUTION APPROVING THE BUDGET OF THE BRAZOS COUNTY
EMERGENCY COMMUNICATIONS DISTRICT; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the laws of the State of Texas provided for interlocal governmental agreements to
benefit the citizens of the State; and,
WHEREAS, the voters of Brazos County have approved the establishment of the Brazos County
Emergency Communications District in accordance with State law; and,
WHEREAS, the Board of Managers of the District have approved and adopted the Budget for
fiscal year 2005-2006; and,
WHERERAS, Section 772.309 of the Health and Safety Code requires the approval of the
District's budget by the Commissioners Court of the County located in the District and a
majority of the participating jurisdictions in the District; and
WHEREAS, the undersigned authorities have, in public meeting, approved the annual budget of
the District as submitted to them.
NOW, THEREFORE, BE IT RESOLVED by the Commissioner's Court of Brazos County,
Texas that:
1. The Commissioners Court of Brazos County, Texas hereby approves the annual budget of
the District as submitted to them and as provided for by law.
2. A copy of the budget is attached hereto as Exhibit "A" and incorporated herein by this
reference for all purposes.
3. This Resolution shall be effective immediately upon its adoption and passage
ADOPTED AND PASSED by affirmative vote this -LLJL day of (24jhe-~- 2005.

following contributions for fiscal year 2006 commencing on October 1, 2005 and ending on
September 30, 2006.
