PWinf~-,DEPUTY BRAZOS COUNTY COMISSIONERS COURT WORKSHOP SESSION THE COMMISSIONERS COURT WILL MEET IN A WORKSHOP SESSION ON TUESDAY 4 OCTOBER 2005 AT 10:30 A.M. This Workshop will be held in the Commissioners Courtroom of the Brazos County Courthouse, 300 East 26`s Street, Suite 115, Bryan, Texas for the purpose of reviewing the laws regulating real estate developments. 1. Call to Order 2. Review Local Government Code concerning County regulation of subdivisions. 3. Consider the Possibility of Relocating the Appraisal District and the Tax Office to a centrally located facility. 4. Adjourn The Brazos County Courthouse is wheelchair accessible. Office of the County Judge • 300 East 2dh Sl. • Suite 114 • Bryan, Texas 77803 • Fax: (979) 361-4503 COMMISSIONERS' COURT WORKSHOP SESSION OCTOBER 4, 2005 The Commissioners' Court of Brazos County, Texas met in a Workshop Session in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:30 a.m. on Tuesday, October 4, 2005, with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. Attached is a list of the citizens and officials in attendance. The Commissioner's Court met to review the Local Government Code that applies to County regulation of subdivisions. Commissioner Mallard explained the reasons for reviewing the subdivision regulations. The Texas Commission on Environmental Quality usually deals with storm water run off, while the County deals with the flood plain. He would like to find a way to deal with storm water before it becomes a problem and floods low lying areas within the flood plain. Commissioner Mallard asked Court Counsel, Bill Ballard, what the County could do. Mr. Ballard stated that Section 232 of Vol 73 Page the Water Code gives the county authority to set rules, what he seemed focused on is found in Chapter 26 of the Texas Commission on Environmental Quality. Mr. Mallard continued citing another problem being that of septic systems. Some systems have just enough land to run household waste. Let's say that, maybe they sell to a business that runs chemicals through the septic system that is designed for household waste only. He would like to see restrictions in place to prevent this from happening. The Health Department is looking into this but maybe this needs to be part of the Subdivision and Development Regulations and included on the plat of the property that is purchased. Richard Vance, County Engineer said that if the Court does adopt something like that, his department is not equipped to handle it. He would need personnel and office space to do the job. Also, the County could be liable if they adopt this and then don't monitor it. The County Judge asked if Mr. Vance had any idea how many employees it would take to start with. Mr. Vance replied that he thought it would take at least two employees to begin with. There are a lot of subdivisions being built. He said he could check with the city to see what they are doing and how many employees they have monitoring this problem. Vol -73 Page I IA Commissioner Cauley stated that it seemed like the Court needed to do a study and develop a comprehensive plan rather than doing this in a piece meal fashion. The County Judge asked what was the smallest acreage size for an aerobic system. Gary Arnold with the Road and Bridge Department replied one half acre. The County Judge then asked if there were any developers here that would like to speak on the topic. Bill Jeanes, Brazos County Risk Manager stated that the Texas Commission on Environmental Quality is doing this type of thing. He suggested they might be able to help us. Commissioner Peters said the problems seem to arise when developers come in with city sized lots in country subdivisions and use septic systems for sewage. He thinks the county should first look at Mr. Vance's request for employees because there is no need to make regulations that aren't going to be enforced. Bill Lero, local builder in Bryan, thought legislation allowed the County to turn over their review of the ETJ to the city. The Court may have to look into this. Richard Vance responded that he wouldn't want to turn authority over to the city because the County was maintaining the roads. Vol 73 Page II The next item to be discussed was the possibility of relocating the Appraisal District and the Tax Office to a more centrally located facility. Some optimal locations considered were the Briarcrest, Villa Maria area and the Bryan/College Station city line. This would be convenient for the citizens and still maintain the Tax Office in the county seat. Commissioners Peters and Wassermann were asked to serve on a committee to discuss combining the two offices in one location. Donald Ball, real estate investor said that he would like to see this happen.
