Revisions to the acceptable waste items allowed at all Brazos County Citizens' Waste Collection Stations as limited to non-hazardous household waste only (bagged 35-55 gallons), with the exception of two collection sites housing white goods/metal collection containers at Mumford Road and FM 2038. This change eliminates acceptance of brush and tires at all stations. 20. Replat of Indian Lakes Phase VI, lots 1-R thru 8-R, block 13, 18.111 acres, J. M. Barrera survey, A-69, Brazos County, Texas (volume 6227, page 42, and volume 6654, page 72 official records of Brazos County, Texas). Site is located in Precinct 1. 21. Request from Sunset Ridge, LLP to construct a road bore in the right of way of North Graham Road (approximately 250 ft. northeast of its intersection with Ridge Loop in Sunrise Subdivision) for water line installation. Permission to enter Marvin Shealy's property located off Old Reliance Road for the purpose of determining the location of a Vess Oil Corp. pipeline to accommodate improvements to Old Reliance Road for the health, safety and welfare of the general public. VOL 70 PAGE 208 COMMISSIONERS' COURT REGULAR MEETING AUGUST 16, 2005 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos Center 3232 Briarcrest Drive, in Bryan, Brazos County, Texas, beginning at 6:00 p.m. on Tuesday, August 16, 2005 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Mallard gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns. The first matter before the Court was a presentation and update by the City of College Station on the proposed convention center project. College Station City Councilman, Ron Gay, introduced Ms. Kim Foutz, Director of Economic Development who gave a presentation on the project. She, along with the City Council, wanted the County and City of Bryan to feel included prior to the ground breaking. This is Vol 170 Page -q© R' Commissioners Court meeting August 16, 2004 2 the third time to try this project. They have an updated feasibility study, a TIF plan and a fiscal and economic impact plan. They are looking at the Northgate area as experts suggest that it be placed as close to campus as possible. She continued by stating that they are trying to create partnerships with a communication plan. With that in mind, there will be a town hall meeting to get input from citizens. The Court thanked City Councilman Gay and Ms. Foutz for the information. The County Judge presented the Court with the proposed budget for fiscal year 2006. The next matter before the Court was the establishment of a date and time for a Public Hearing on the proposed budget for fiscal year 2006. On motion by the County Judge, seconded by Commissioner Peters, the Court voted unanimously to set Tuesday, August 30, 2005 at 10:00 a.m., as the date and time of the public hearing. The Court next considered a proposal to increase tax revenues. The County Judge proposed a rate of $.9525. Although this is a $.02 decrease in the rate, because of higher appraisals, it will result in an increase over the effective rate. On motion by the County Judge, seconded by Commissioner Peters, the Court voted unanimously to increase Vol '7 0 Page 12 J 0 Commissioners Court meeting August 16, 2004 tax revenues. 3 The next matter before the Court was the establishment of a date and time for two (2) Public Hearings to discuss a tax increase. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to set the following dates and times for Public Hearings to discuss a tax increase: Tuesday, August 30, 2005 beginning at 2:00 p.m. in the Commissioners Courtroom and Friday, September 2, 2005 beginning at 3:00 p.m., also in the Commissioners Courtroom. The Court next considered Budget Amendment #04/05-40.1 through 40.4, which would reallocate funds for the County Attorney, Metropolitan Planning Office, and Certificates of Obligation Issue 2003; and move money from contingency to Community Supervision. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the change of status as submitted. Vol ' 1 o Page a l l Commissioners Court meeting August 16, 2004 4 The Court next considered the following Claims as submitted by the County Treasurer for payment: 7009872 through 7010077 On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as submitted. The next matter before the Court was considering an increase in the fees for the Dispute Resolution Center for civil cases filed in the District and County Clerk's offices. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to increase fees for civil cases from $10 to $15 for each case filed in a county or district court including a civil case relating to probate matters but not including a suit for delinquent taxes or a condemnation proceeding under Chapter 21, Property or a proceeding under Subtitle C. Title 7, Health and Safety Code. The next matter for consideration was approval of tax refund applications from the following individuals and/or companies: a) Juanita & Bill Fry, Over Payment $7.23 b) Alexandra C. Hasan, Over Payment $11.54 c) Steven Sutton, Over Payment $14.72 c) Vanderbilt Mortgage (2), Over Payment $6.57 & 13.49 e) Fit Tanning, Over Payment $73.12 f) Bill R. Thornal, Over Payment, $27.78 On motion by Commissioner Wassermann, seconded by Commissioner Vol °Z a Page al 2 Commissioners Court meeting August 16, 2004 5 Peters, the Court voted unanimously to approve the tax refund applications. The next matter before the Court was approval of a Contractual Agreement between Brazos County and Nextel for service to a Blackberry 7520. The Blackberry 7520 is used to configure e-mail, access the network from any location and cellular usage when necessary for the Senior Network Administrator. The cost to Brazos County will be $81.18 per month. The term of the contract is for a one year period. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to enter into contractual agreement with Nextel. A copy of the contractual agreement is attached. The next matter before the Court was the renewal of an agreement with Texas A&M University and Brazos County for the provision of pre-employment psychological screenings for peace officers and detention officers. The fee for evaluations is increased from $210.00 to $220.00 and includes a provision for evaluation results to be available within 3 days for the L-3 Form and the complete report within 14 days. The term of the agreement is from October 1, 2005 through September 30, 2006. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to renew the agreement with Vol f7 e Page ~2i 3 Commissioners Court meeting August 16, 2004 6 Texas A&M University and authorized the County Judge to execute the document. A copy is attached. The Court next considered a proposed increase in fees for on-site sewage facilities. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to table consideration. The Court next considered amending the current county retirement plan. This is a Consumer Price Index based annuity benefit increase of 50% for retirees who have an effective retirement date before 2005. The County Judge voiced concern over a 50% increase and suggested perhaps a 40% increase. Commissioner Mallard moved to approve the 50% increase. Commissioner Peters seconded the motion. Commissioners Wassermann, Peters and Mallard voted "Aye". The County Judge voted "No". Commissioner Cauley abstained. The motion passed to amend the current county retirement plan and approve a 50% increase for retirees who have an effective retirement date before 2005. This is to become effective January 1, 2006. The next matter before the Court was a request to amend the Master Agreement for Computer Assisted Legal Research with LexisNexis. This is pursuant to RFO #212-0-130 with the term commencing September 1, 2005 and ending August 31, 2006. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the request to amend the Master Agreement for Computer Assisted Legal Research with LexisNexis. The next matter before the Court was the appointment of two (2) individuals to serve on the Texas Workforce Commission's Local Workforce Development Board. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to appoint Bob Malaise, Economic Development Representative and Debbie Bush, Public Employment Service Representative to serve on the Texas Workforce Commission's Local Workforce Development Board. The Court next considered revising the acceptable waste items at all Brazos County Citizen Collection Stations. On motion by Commissioner Cauley, seconded by Commissioner Mallard, the Court voted unanimously to limit the collection sites to non-hazardous household waste with the exception of two sites (Mumford Road and FM 2038) who will also take white goods/metal collections. Brush and tires will no longer be accepted at any of the collection sites. This is to take effect immediately. The Court next considered approval of the Re-Plat of Indian Lakes Phase VI, Lots 1-R through 8-R, Block 13, 18.111 Vol o Page ~2I S Commissioners Court meeting August 16, 2004 8 Acres, in Precinct 1. Richard Vance, County Engineer, stated that he had reviewed the plat and recommended acceptance as submitted. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to approve the re-plat of Indian Lakes Phase VI, Lots 1-R through 8-R, Block 13, 18.111 Acres as submitted. The Court next considered the request from Sunset Ridge, LLP to construct a road bore in the right-of-way of North Graham Road approximately 250 feet northeast of its intersection with Ridge Loop in Sunrise Subdivision. This is for waterline installation. The site is located in Precinct 1. The County Engineer stated that all appeared to be in order and recommended approval. The Road and Bridge Department requested permission to enter the private property of Marvin Shealy on Old Reliance Road in Precinct 2 to determine the location of a Vess Oil Corporation pipeline to accommodate improvements to Old Reliance Road. On motion by Commissioner Peters, seconded Vol °1 Page a Commissioners Court meeting August 16, 2004 10 by Commissioner Wassermann, the Court voted unanimously to authorize the work. There were no announcements of interest items and possible future agenda topics. There was no citizen input and/or concerns. Under Agency/Board/Committee reports by Court members, the following spoke: Commissioner Mallard a) Met with the Intergovernmental Committee on Monday and discussed the following: 1. College Station has a good chance of getting the George W. Bush library. 2. Worked out a budget for the Horticulture Gardens at A&M and will be able to maintain them. 3. Floyd Associate Vice-President for Finance 4IOL 70 € r'E_.232 Brazos County Office of the Sheriff / TAMU Psychology Agreement 3 of 4 Agreement for Advisory and Consultative Services between Brazos County Office of the Sheriff and the Psychology Clinic in the Department of Psychology at Texas A&M University This contract outlines an agreement between the Brazos County Office of the Sheriff (henceforth referred to as Brazos County Sheriff) and the clinical psychology program in the Department of Psychology at Texas A&M University (henceforth referred to as TAMU) regarding Advisory and Consultative Services between the two institutions. The TAMU address for correspondence regarding services is Carolyn Ivison, TAMU Psychology Clinic, Department of Psychology, Texas A&M University, 4235 TAMU, Texas 77843-4235 (phone: 979-845-8017; employer's I.D.#: 76-4000531; profession/ occupation: psychologist). Brazos County Sheriff agrees to retain TAMU fora period of 12 months beginning October 1, 2005 and continuing until September 31, 2006 to furnish psychological evaluations of Detention Officer or Deputy Sheriff candidates in accordance with regulations set forth in the Texas Commission on Law Enforcement Officers Standards and Education. Specifically, each evaluation will include: (a) a thorough clinical interview, (b) an appropriate global measure of personality/psychosocial functioning, and (c) additional speck measure(s) of behavioral style as indicated by other evaluation measures or referral questions posed. Fees and Reimbursement Brazos County Sheriff agrees to pay and TAMU agrees to accept, as full compensation, the sum of $220.00 per psychological evaluation and the sum of $90.00 per psychological re-evaluation. Re-evaluations typically are required when the respondent answers evaluation questions in a manner that invalidates the test results. Payment will be based on the timely submission of signed L-3 forms and evaluation reports for the time period during which the referral for evaluation was made. L-3 Forms and Evaluation TAMU, prior to receiving reimbursement under this Agreement, agrees to provide Brazos County Sheriff with a copy of psychological evaluation reports generated on persons served under this Agreement. Specifically, TAMU plans to provide verbal feedback to Brazos County Sheriff, and make available for mailing or personal pick-up, the TCLOESE L-3 (Declaration of Psychological and Emotional Health) form within three days of completion of the testing. Within two weeks of the completion of testing, TAMU plans to make available the psychological evaluation report for mailing to, or personal pick-up by, the Brazos County Sheriff. Situations that alter these expectations will be discussed via phone or email by TAMU and Brazos County Sheriff as soon as either party becomes aware of the need to change expectations for a given referral. Financial Statements for Services Rendered TAMU will provide Brazos County Sheriff a financial statement by the 10th day of each month for services rendered during the previous month. Brazos County Sheriff agrees to pay TAMU for VOL")0 FACE 2,,33 Brazos County Office of the Sheriff / TAMU Psychology Agreement 4 of'4 services by the 8th working day of the month following receipt of the financial statement. This contract may be subject to termination with 30-days notice for lack of timely reimbursement. Early Termination This Agreement may be canceled upon 30 days written notice by either party. In the event this Agreement is canceled, TAMU will be paid only for the time that services were actually performed and when required evaluation reports are presented to Brazos County Sheriff within three weeks of the cancellation of this Agreement. Professional Liability and Credentials Professional liability insurance provided to faculty supervisors and graduate students in clinical psychology through the Department of Psychology will cover services provided through this Agreement. TAMU agrees to provide the Brazos County Sheriff, if requested, with a copy of current professional credentials and professional liability insurance applicable to acts, omissions, or negligence in the course of performing services under this Agreement. TAMU will not be held liable for information communicated in evaluation reports that may result in a decision to dismiss or fail to hire an applicant. TAMU will not be held liable for misconduct, poor job performance, or poor judgments made by officers following an evaluation TAMU completes. Additional Professional Issues Students and faculty supervisors appointed by TAMU agree to comply with policies established by the TAMU Psychology Clinic regarding code of ethics, confidentiality, and other issues relevant to provision of consultative clinical services. This contract in no way obligates Brazos County Sheriff to rely exclusively on TAMU for the services described in this contract. Renewals Pending authorization from both Brazos County Sheriff and TAMU, this agreement may be renegotiated for a specified period beginning October 1, 2006. Renewals of this agreement may include an annual increase for services rendered. Other Direct Costs Regarding other direct costs, Brazos County Sheriff will pay the amount per completed evaluation specified in the preceding section entitled "Fees and Reimbursement; the number of evaluations will vary over the months in which this contract is in effect. Other direct costs will be used by the TAMU Psychology Department for supplies, photo-reproduction, books, journals, training tapes, software, equipment, professional dues, travel expenses, educational development, and other directly related costs.
