Late charges were incurred because the department was unaware of the cancellation fee charged by the hotel. Department did not receive credit card statements until March 2006. 10. Request from Justice of the Peace, Pct 3, George Boyett for out of state travel to Reno, Nevada to attend .the National Judicial College Seminar on Special Jurisdiction May 1 through 11, 2006. Request from Wickson Creek Special Utility District to construct a road bore in the right- of-way of Hollow 'Heights Drive, approximately 300 feet from its intersection with Merka Road for water line installation. Site is located in Precinct 2. 19. Acceptance of Special Warranty Deed from Marc and Diana Fratessa for improvements to Deep Well Road located in Precinct 2 20. VOM PAGE 137 COMMISSIONERS' COURT REGULAR MEETING MARCH 28, 2006 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, March 28, 2006 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Wasserman gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns. The Court next considered Budget Amendment #05/06- 25.1 through 25.3 that would reallocate funds for the TJPC-G- Program Sanctions 1-2-3 and transfer funds from Contingency to the Road and Bridge Department, from CO Funds to the Information Technology Department. On motion by Commissioner Cauley, seconded by Commissioner Vol Z 8 Page I eo Commissioners Court meeting March 28, 2006 2 Peters, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the changes as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 7017574 through 7017776 On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the Claims as submitted. The next matter before the Court was consideration of the ban on outdoor burning. On motion by Commissioner Mallard, seconded by Commissioner Peters, the Court voted unanimously to remove this item from the agenda. The Court next considered the Brazos County Collections Implementation Plan in compliance with Senate Bill 1863 & OCA Model Program Components. The County Judge noted that although they are not on the plan at this time, he met with Juvenile Services and discussed Vol -78 Page 19. Commissioners Court meeting March 28, 2006 3 the plan. They are scheduled to be on board by December 2006. Tanya Oehlert, Collections Manager has met with all the JP's and everyone is on board with the plan. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the plan as presented. A copy is attached. The Court next considered approval of the following payment authorizations: a) A.J. Castiglioni, Jr. for court ordered psychiatric examination for the 85th District Court $425.00 b) A.J. Castiglioni, Jr. for court ordered psychiatric examination for the 272nd District Court $655.00. Purchase orders were not issued in advance. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the payment authorizations. The next matter before the Court was a request by the Jail Division asking the Court to approve a payment authorization in order to pay their portion of late fees billed on a Citibank credit card. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the payment authorization in the amount of $24.94. The next matter for consideration by the Court was a Vol -19'' Page L U Commissioners Court meeting March 28, 2006 request submitted by Justice of the Peace, Precinct 3, George Boyett seeking approval for out of state travel for himself to attend the National Judicial College at Reno, Nevada May 1-11, 2006. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to grant the request from Judge Boyett and approved payment of out of state travel expense for him. A copy is attached. The next matter before the Court was consideration of a contract with Ben Sanford & Associates, Inc. to analyze Brazos County communications needs, make recommendations and obtain new telephone systems and related equipment for a variety of locations over the next one to two years. Cost to Brazos County will be $29,650.00. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the contract. A copy is attached. The next matter for consideration was approval for the Purchasing Agent to advertise Bid 2006-024, Telecommunication System for Justice of the Peace, and Constable, Precinct 3. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to authorize the Purchasing Agent to advertise for bids for a Telecommunication Vol Page 0 Commissioners Court meeting March 28, 2006 6 System for Justice of the Peace, and Constable, Precinct 3. The Court next considered approval of the Final Plat of Stone Creek Farms Phase 2A, 27.409 Acres in Precinct 2. Richard Vance, County Engineer, stated that he had reviewed the plat and all was in order. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the Final Plat of Stone Creek Farms Phase 2A, 27.409 Acres. The next matter before the Court was acceptance of Stone Creek Farms Phase One roads in Precinct 2 for Brazos County maintenance. Gemstone Drive, Limestone Court and Stone Creek Drive and the drainage structures are in compliance with Brazos County's Subdivision and Development Regulations. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the previously noted roads for county maintenance. The Court next considered acceptance of the River Place Subdivision Phases One, Two and Three in Precinct 1 for Brazos County maintenance. River Ridge Drive, and River Place Court and the drainage structures are in compliance with Brazos County's Subdivision and Development Regulations. On motion by Commissioner Wassermann, seconded by Commissioner Cauley, the Court voted unanimously to approve the previously noted Vol Page 19-03. Commissioners Court meeting March 28, 2006 roads for county maintenance. 7 The Court next considered the request from Wickson Creek Special Utility District to construct a road bore for waterline installation in the right-of-way of Hollow Heights Drive approximately 300 feet from its intersection with Merka Road for water line installation. The site is located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from Wickson Creek Special Utility District and authorized the installation. A copy of the request is attached hereto. The Court next considered acceptance of a Special Warranty Deed for right-of-way on Deep Well Road in Precinct 2. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to authorize the County Judge to accept on behalf of Brazos County a Special Warranty Deed from Marc and Diana Fratessa for the expansion and improvements to Deep Well Road. Under announcement of interest items and possible future agenda topics the following spoke: County Judge a) Thanked Carlos Guitron, Director of Building Maintenance for the packet on the First Vol 7 Page I S O Commissioners Court meeting March 28, 2006 Baptist Church. He did a great job on a preliminary plan on where to place offices. Under citizen input and/or concerns, the following spoke: Commissioner Cauley a) Said he was still working on the issue of dangerous dogs. Chief Mann needs clarification on the old ordinance that was passed. The Court may need to update it or amend it. This needs to be on the agenda. Under Agency/Board/Committee reports by Court members, the following spoke: Commissioner Mallard a) Attended a hurricane disaster meeting where they discussed how to be prepared. They also discussed what went well and what did not with hurricanes Katrina and Rita. Functional drills will be held May 2, 3 & 4 from 8:00 a.m until 5:00 p.m. He thinks the elected officials should take time to be involved. Brazos County's group will meet at the EOC. County Judge a) He met with Red Cross this week. They are under new management. There will be a shelter rally on April 25th at the Brazos Center. They will be focusing more on emergency services. Commissioner Wassermann a) On April 22, 2006, Keep Brazos Beautiful is sponsoring its annual Trash Off in combination with Earth Day. They will meet at the J.C. The department has staff dedicated solely to the collections of fines, court costs, and attorney fees payable to Brazos County. a. Collections Manager b. Assistant Collections Manager c. Collections Clerk 2. It is natural expectation that all court costs, fines, and attorney fees are due at the pleading. 3. Before our offices establishes a payment agreement, the defendant, after disposition, must immediately complete an application for extension of time to pay. 4. Upon completion of the application, the defendant will be interviewed immediately to determine the payment amount and length of the agreement. If a defendant pled while incarcerated, the defendant is required to appear at the Collections Department within 24 hours from release. Should an offender be located out-of -town, a verbal agreement over the telephone is preformed, with such noted on the agreement. 5. The information is immediately verified. 6. The department establishes strict payment terms based on income and necessary expenses. A general rule of 50% in 48 hours etc. is not in place. Based on our formula, cases without the issuance of a Capias Pro Fine are generally satisfied within 61-day to 120 days, depending on the total ordered amount.(To be Implemented-tentatively scheduled on or before 4/1/06) 7. The alternative to payments is performing community service with Brazos County is not in place. (To be Implemented-tentatively scheduled on or before 4/1/06) 8. Phone calls are made the day following a missed payment. 9. Post cards are also mailed the following day that the payment is missed and then the second post card is mailed out and the following card states that the payment plan is being cancelled and a warrant will be started. 10. Pre-warrant calls are made when we are starting the process on the defendant. VOLTS PAGE 11. Post warrant calls are made after we have issued the warrant for the defendant. 12. As time permits, warrant officers from the Brazos County Sheriff's Office and Constables offices are used to execute outstanding Capias Pro Fine warrants should offender location be verified. 13. Neither Chapter 706 of the Transportation Code to deny the renewal of a defendant's driver's license or the Denying the renewal of vehicle registration Chapter 502.185, are not in place. Any staff member will research the defendants, that are less than or 61+ days past due, is referred to a staff member who utilizes tools to locate and track absconders. After the collections department diligently searches for the defendant for 60 days, the County will be contracting with a private attorney or public or private vendor. Any contact attempted and/or made via telephone, by mail, and in person is noted as an event in the Collections Department computer program. If applicable, a paraphrased log of the conversation is noted with the event as well. All cases referred to the Brazos County Collections Department are maintained and monitored as described above and in the Department Policies and Procedures notebook.
