A regular meeting of the Commissioners' Court of
B4~zos County, Texas was held in the Brazos County
C issioners Courtroom in the Courthouse in Bryan,
B zos County, Texas, beginning at 9:00 a.m. on Tuesday,
J y 12, 2005 with the following members of the Court
poi sent:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct l;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4,

Karen McQueen, County Clerk, Absent.
The attached sheet contains the names of the
citizens and officials that were in attendance.
Commissioner Mallard gave the invocation and led the
pledge of allegiance.
There was no citizen input/and or concerns.
The first matter before the Court was a presentation
b Shelley Veselka concerning delinquent property tax
c lection activity for the period of April 1, 2005
t rough June 30, 2005. The Court discussed the
p sibility of running a time frame that starts on August

1 t rather than July 1st because it might be more
a 'urate. The books are closed on June 30th and some
p tial payments aren't reflected until after July.
The Court next considered Budget Amendment #04/05-
3 1 through 35.3 that would reallocate funds for County
A orney and Constable, Precinct 2; and correct budget
ndments 11.2 and 12.3 initiated by the Auditor's
0 ice. On motion by Commissioner Peters, seconded by
C issioner Mallard, the Court voted unanimously to
approve the budget amendment as submitted. A copy of
wHich is attached.
The next matter before the Court was a request from
t1l Information Technology Department, for the payment of
f ing fees in the amount of $2,180.00 to the Department
o Homeland Security to petition for an Hl-B visa for
S hakar Ramasamy. After contacting the State Attorney
G eral's Office, opinions were reviewed it was found
t t such expenditures as this were permissible. On
m ion by Commissioner Peters, seconded by Commissioner
W sermann, the Court voted unanimously to approve
p ment of the filing fees. Commissioner Peters then
otrered an amendment to his original motion to include
e4oorsement subject to Mr. Ramasamy passing a background

c ck. Eric Caldwell, Director of the Information
T#hnology Department asked if the amended motion was
m nt to delay employment whereupon the County Judge
a ed why the hurry to hire this person. Mr. Caldwell

He went on to

. Caldwell said it would be some time before he dealt
with sensitive data. The Court asked the County Attorney

m'ion, not until the background check is complete.
The Court proceeded to consider the change of status
o employees as submitted on the attached Personnel
ion Requests. On motion by Commissioner Peters,
s#onded by Commissioner Wassermann, the Court voted
u nimously to approve the changes as submitted with the
e eption of the new hire for the Information Technology
artment.

The next matter before the Court was a request from

P sonnel Manager.
The next matter before the Court was approval of an
I eragency Cooperation Contract between Brazos County
a the Texas Transportation Institute for development of
a 'regional transportation operations concept for the
B zos Valley. The cost to Brazos County shall not exceed
$ 250.00. The contract begins when fully executed and
t minates on December 31, 2005. On motion by
C immissioner Mallard, seconded by Commissioner Peters,

The Court next considered approval of a payment

C issary. On motion by Commissioner Peters, seconded

authorize the Purchasing Agent to advertise for bids for

The next matter for consideration was approval for

S#plies for the Jail. On motion by Commissioner
W sermann, seconded by Commissioner Peters, the Court
v ed unanimously to authorize the Purchasing Agent to

The next matter for consideration was approval for

v ed unanimously to authorize the Purchasing Agent to
a ertise for bids for Oil Changes for Brazos County.
The Court next considered authorizing acceptance of
ated property from the Children's Museum. On motion

Wassermann, the Court voted unanimously to accept the
d ated property. A list of the donated property is
attached.
The next matter before the Court was the acceptance

The Court next considered a request from Martin L. Riley,

D+Velopment Regulations to allow an existing pipe fence to

2 The County Engineer's staff has examined the request and
recommended approval because the property owners have stated
t t the fence will be relocated when the property is sold or
o demand from Brazos County. On motion by Commissioner
P ers, seconded by Commissioner Wassermann, the Court voted
u nimously to approve the request for variance.
The Court next considered approval of the Re-Plat of
T tact 4-A of Adams Acres, 10.00 Acres in Precinct 2. Richard
V ce, County Engineer, stated that he had reviewed the plat
aril recommended acceptance. On motion by Commissioner Peters,
seconded by Commissioner Wassermann, the Court voted
unanimously to approve the re-plat of Adam's Acres as
s mitted.
The next matter before the Court was a request from Joe
S ultz, representing Texcon General Contractors for variance
t 'the Brazos County Subdivision and Development Regulations
t allow sanitary sewer lines to be constructed without
e asement in the proposed Meadowlark Subdivision Phase 1
1 ated in Precinct 1. The subdivision will be built as an
u an subdivision with streets that have curb and gutter along
wh a sanitary sewer collection system. The Road and Bridge
D artment staff reviewed the request and recommended

a roval. Commissioner Peters moved for approval. The County

a) Per the Subdivision and Development Regulations
(Article V, Section C, #27) the County will
have no maintenance responsibility back of
curb".
C issioner Mallard questioned the long cul-de-sac on the
plat with many lots along its length. Commissioner Peters
m ed for approval. The County Judge seconded the motion.
C issioners Peters, Mallard and the County Judge voted
'47e". Commissioner Wassermann abstained because Mr. Schultz
i his nephew. The Court voted to approve the request.

a) Thanked the Information Technology Department for
help with a check run problem. The departmental
stall was very helpful and they stayed late to
repair the problem.
Commissioner Mallard
a) There will be an Intergovernmental Committee
meeting July 18th. He would appreciate getting
some agenda items for discussion.
There was no citizen input and/or concerns.

THIS CONTRACT is entered into by and between the agencies shown below as Contracting Parties unde

ATTACHMENT A
DEVELOPMENT OF A CONCEPT FOR
JONAL TRANSPORTATION OPERATIONS
FOR THE BRAZOS VALLEY
Introdu ion/ Background
Within t Brazos Valley the Texas Department of Transportation (TxDOT), Brazos County, the
City of liege Station, the City of Bryan, and Texas A&M University all share a common goal
for oper, ng and maintaining the transportation systems: to provide the safest, most efficient
transport ion system possible with the resources available. As a result, each agency has
develop programs and deployed infrastructure that support the services that they provide.
These a cies also have a long history of collaborating and working cooperatively to manage
traffic re onally for construction projects, special events, or emergencies. However, as the
commun continues to grow, as systems and programs become more complex to develop and
sustain, d as funding becomes more difficult to secure, there may be a need for these agencies
to take a gional perspective, not only in coordinating activities associated with these special
events and situations, but also in the day-to-day operations of the transportation system as whole.
Locally, unique opportunity may exist to leverage the investment that has already been made in
the trans rtation infrastructure and the collaboration between the various agencies. This
cooperat e effort would improve transportation operations and safety in the region, and also
showcashe successful marriage between research and the community in the Brazos Valley.
As part Texas Transportation Institute's Intelligent Transportation Systems (ITS) research
program, he Institute has constructed a state-of-the-art laboratory - TransLinO Research Center
Laborato - that models the functions and capabilities of a full-fledged traffic operations center.
This lab tory facility contains the latest communications and computing systems and can
support r ional coordination and operations. In excess of $5 million has been expended in
developi the TransLink Laboratory. In addition, the laboratory is supported by a substantial
number highly trained traffic operations professional staff.
This faci ' y could serve as a central location for sharing, analyzing and distributing traffic- and
transport ion-related information and, if desired, serve as a command center for coordinating
local tra operations and responses in the community. What is needed at this juncture is a
feasibili study to identify what is possible, what is appropriate, what costs and benefits are
involved d what are alternative strategies for regional collaboration.
Purpose f Study
The purp e of this study is twofold:
1. T develop a regional concept for transportation operations for the Brazos Valley.
2. To! fully explore whether it is desirable to utilize the Texas Transportation Institute's
( I) TransLinko Laboratory in some manner for managing transportation operations in
t area and to examine alternative arrangements for staffing the center.

The firs ask will be to conduct a complete and accurate inventory of all the transportation
manage nt systems, activities, and resources that agencies use to manage traffic operations in
the Braz Valley. Planned improvements will also be documented. This inventory will not
only inch de hardware and field equipment, but will also identify which agencies are responsible
for the v ious traffic management functions and the current level of connectivity within the
region.
Task 2. evelop a Concept for Providing Regional Transportation Operations in the Brazos
Valley
TTI will ost a workshop that will involve representatives from the Texas Department of
Transpo tion (TxDOT), Texas A&M University (TAMU), Brazos County, the Brazos Valley
Metropo an Planning Organization (BVMPO), the transit district, the City of College Station,
the City Bryan, and others to develop a concept for operating and managing traffic operations
regional in Brazos Valley. Part of this workshop will be to identify which activities and
function might benefit from regional coordination, the role of each agency in performing those
function ! and the objectives that define the desired state of operations for the regional system in
the future; TTI will use the results of the workshop to develop a concept of operations document
that defi s how the local agencies envision achieving these objectives in the context of a
regional ansportation operations system.
As part this workshop, TTI, in conjunction with the local agencies, will assess the role that
TTI's Tr, sLine Laboratory could potentially serve within the context of a regional operations
concept. his potential role could include (1) continuing to function solely as a research and
develop tent laboratory not affiliated with local operations, (2) serving as a regional collector,
analyzer, d distributor of local transportation operations data, and/or (3) serving as a regional
operatio center responsible for developing and implementing regional control decisions. As
part of th assessment, the agencies will identify and assess the pros and cons associated with
using TT s TransLinko Laboratory in these different modes.
The resu of this work shop will be: 1)a preliminary recommendation of the role for TransLink
in region traffic operations; and 2) a listing of the types of traffic operations strategies (e.g.,
improve ignal timing) that might be realized through a regional traffic operations center.

TTI will lso work with the partner agencies to identify and establish the framework for
develop' the relationships, agreements, and procedures that need to be implemented to achieve
the deli vision. Examples of the types of issues and topics to be addressed in this task include

Along the member partners, TTI will also examine the time, money, staff, equipment, and
facility r ources needed to actualize and sustain the concept of regional operations. Specific
issues th will be addressed in this task include the following:

• at resources are needed to sustain and meet performance expectations?
• at are the staffing needs and alternatives to adequately operate the system?

Task 7. Document Findings and Recommendations
TTI will repare a final report documenting the findings of the study. TTI will work with staff
represent tives from the local agencies to develop recommendations and findings that are
consiste with local desires and objectives. The final document will contain the following:
• concept for regional operations of the transportation systems for the Brazos Valley.
• plan and schedule for the development and deployment of infrastructure necessary to
ieve this regional concept.
• tematives for staffing and operating the systems.
• plan for securing funding for sustaining cooperative and collaborative operations and
intenance of the systems.
The fina eport will provide decision makers with data needed to make decisions as to
how/wh er to proceed with this concept. The costs and benefits of the alternative strategies
will be vided as part of this study. Alternative roles for TransLink will be defined.
Particip ng agencies will be given an opportunity to review and comment on the report before
it is sub tted for consideration by the MPO Policy Board.
In additi to the final report, TTI will provide the MPO Policy Board with periodic updates of
the statu d preliminary findings throughout the duration of the project.
Project uidance
TTI wou like to establish both a policy and technical level advisory group to assist with the
conduct this study. The MPO Board might serve as the policy level oversight body. Each of
the invol d funding agencies might appoint someone to represent that agency on a technical
advisory anel.
Schedul
A summ of the proposed schedule and major milestone delivery dates is provided.
TTI anti . ates that a total of $50,000 is needed to complete this study. TTI, on behalf of
TAMU, willing to contribute $25,000 to conduct this study. The state agency and local
agencies xDOT, City of Bryan, City of College Station and Brazos County) are being asked to
provide ti -1 remainder of the funding for completing this study amounting to $6,250 from each
agency.

Interagency Cooperation Contract
General Terms and Conditions
Article I "I Amendments
This con ct may only be amended by written agreement executed by both parties prior to the expiration
of the co ract.
Article 4,1 Disputes
The Peq ing Agency shall be responsible for the settlement of all contractual and administrative issues
arising ofit of procurements entered in support of contract services
Article Records and Ownership
A. The rforming Agency agrees to maintain all books, documents, papers, accounting records, and
othe evidence pertaining to costs at its office during the contract period and for four years from the
date final payment under the contract. These materials shall be made available for inspection and
cop g by the Receiving Agency, by the State Auditor's Office, and by their authorized
repr ntatives. If the contract is federally funded, these materials shall also be made available for
insp ion and copying by the U.S. Department of Transportation and by the Office of the Inspector
B. Afte ompletion or termination of this contract, all documents prepared by the Performing Agency or
furni ed to the Performing Agency by the Receiving Agency shall be delivered to and become the
prop of the Receiving Agency. All sketches, photographs, calculations, and other data prepared
under his contract shall be made available, on request, to the Receiving Agency without restriction or
limit ion of further use.
C. The ceiving Agency shall own all title to, all interests in, and all rights to all intellectual property
(incl ing copyrights, trade and service marks, trade secrets, and patentable devices or methods)
arisi from or developed under this contract.
D. Exc to the extent that a specific provision of this contract states to the contrary, all equipment
purc sed by the Performing Agency or its subcontractors under this contract shall be owned by the
Rec ing Agency and will be delivered to the Receiving Agency at the time the contract is
com ted or terminated.
Article Subcontracts
A subco act may not be executed by the Performing Agency without prior written authorization by the
Receivin Agency. Subcontracts in excess of $25,000 shall contain all applicable terms and conditions of
this cont t. No subcontract will relieve the Performing Agency of its responsibility under this contract.
Article 5I, 'I Termination
This con ct may be terminated by satisfactory completion of all services and obligations contained in
this cont t, by mutual written agreement, or by either party unilaterally after 30 days' written notice to
the other arty. The Receiving Agency shall compensate the Performing Agency only for those eligible

expense at are incurred during this contract and that are directly attributable to the completed portion
of the w covered by this contract and only if the work has been completed in a manner satisfactory and
acceptab to the Receiving Agency. The Performing Agency shall neither incur nor be reimbursed for

Article Gratuities
Any pers in who is doing business with or who reasonably speaking may do business with the Receiving
Agency der this contract may not make any offer of benefits, gifts, or favors to employees of the
Receivin Agency. The only exceptions allowed are ordinary business lunches and items that have
received a advanced written approval of the Executive Director of the Texas Department of

Article Reference to Costs Principles and Circulars
Reimbur ment with state or federal funds will be limited to costs determined to be reasonable and

Institution;," or OMB Circular A-87, "Cost Principles for State and Local Governments." The parties
shall co ly with the requirements of the Single Audit Act of 1984, P.L. 98-502, ensuring that the single
audit repttt includes the coverage stipulated in OMB Circular A-133.
Article 9 ! Performing Agency Resources
All empl ees of the Performing Agency shall have adequate knowledge and experience to enable them
to perfo the duties assigned to them. The Performing Agency certifies that it currently has adequate
qualified rsonnel in its employment to perform the work required under this contract or will be able to
obtain ad uate qualified personnel from sources other than the Receiving Agency. On receipt of written
notice fr the Receiving Agency detailing supporting factors and evidence, the Performing Agency shall
remove f m the project any employee of the Performing Agency who is incompetent or whose conduct
becomes rimental to the work. Unless otherwise specified, the Performing Agency shall furnish all
equipmer t, materials, supplies, and other resources required to perform the work.
Article 1 Equal Employment Opportunity
The Perf ing Agency agrees to comply with Executive Order 11246, entitled "Equal Employment
Opportu as amended by Executive Order 11375 and as supplemented by Department of Labor
regulatio , 41 CFR Part 60. The Performing Agency agrees to consider minority universities for
subcontr s when the opportunity exists. The Performing Agency warrants that it has developed and has
on file ap opriate affirmative action programs as required by applicable rules and regulations of the
Secretarv f Labor.
Article 1 Nondiscrimination
A. The rforming Agency shall comply with the regulations of the U.S. Department of Transportation
relati to nondiscrimination in federally-assisted programs, including 49 CFR, Part 21; 23 CFR,
Subc pter C; and 41 CFR, Part 60-74 (the Regulations).
B. The rforming Agency, with regard to the work performed during this agreement, shall not
discri inate on the basis of race, color, sex, national origin, age, religion, or disability in the selection
and r ntion of subcontractors, including procurements of materials and leases of equipment.

C. In al olicitations either by competitive bidding or negotiation made by the Performing Agency for

equi ent, but not including routine purchase orders, each potential subcontractor or supplier shall be
noti d by the Performing Agency of the Performing Agency's obligations under this agreement and
the aulations.
D. The rforming Agency shall provide all information and reports required by the Regulations and
dire ves issued under the Regulations and shall permit access to its books, records, accounts, other
sour s of information, and facilities as may be determined by the Texas Department of
Tran 'ortation or the U.S. Department of Transportation to be pertinent to ascertain compliance with
the gulations or directives. If any information required of the Performing Agency is in the
excl ive possession of another who fails or refuses to furnish this information; the Performing
Age y shall so certify to the Texas Department of Transportation or the U.S. Department of
Tran ortation, whichever is appropriate, and shall set forth what efforts the Performing Agency has
mad o obtain the requested information.
E. In th vent of the Performing Agency's noncompliance with the nondiscrimination provision of this
agre ent, the Texas Department of Transportation shall impose such sanctions as it or the U.S.
Dep meet of Transportation may determine to be appropriate.
F. The rforming Agency shall include the provisions of paragraphs A through E in every subcontract,
including procurements of materials and leases of equipment, except routine purchase orders, unless
exert t by the Regulations or directives. The Performing Agency shall take such lawful action with
res to any subcontract or procurement as the Texas Department of Transportation may direct as a
meat of enforcing these provisions, including sanctions for noncompliance. In the event the
Perf ing Agency becomes involved in or is threatened with litigation with a subcontractor or
supp i r as a result of directions given by the Receiving Agency, the Performing Agency may request
the as Department of Transportation to enter into the litigation to protect the interests of the State.
In ad tion, the Performing Agency may request the United States to enter into litigation to protect the
inter is of the United States.
Article 1 Basis for Calculating Reimbursement Costs
The Rec Wing Agency will reimburse the Performing Agency for actual costs incurred in carrying out the
services thorized in Attachment A, Scope of Services, subject to the cost categories and estimated costs
set forth Attachment B, Budget. The Receiving Agency shall compensate the Performing Agency for
only tho eligible expenses incurred during this contract that are directly attributable to the completed
portion o ! he work covered by this contract, provided that the work has been completed in a manner
satisfact and acceptable to the Receiving Agency. The Performing Agency shall not incur or be
reimburs for any new obligations after the effective date of termination. The Performing Agency shall
bill the eiving Agency for actual travel expenses, not to exceed the limits reimbursable under state
law. Ou f-state or out-of-country travel by the Performing Agency requires prior approval by the
Receivin Aeencv.
Article 1 Funding
The Rec i ing Agency shall pay for services received from appropriation items or accounts of the
Receivin Agency from which like expenditures would normally be paid. Payments received by the
Performi Agency shall be credited to the current appropriation items or accounts from which
expendit s of that character were originally made. If for any reason subcontractors and suppliers, if
any, are at paid before the Receiving Agency reimburses the Performing Agency for their services, the
Performi Agency shall pay the subcontractors and suppliers all undisputed amounts due for work no
more than '.10 days after the Performing Agency receives payment for the work unless a different time is

specifie y law. This requirement also applies to all lower-tier subcontractors and suppliers and must be
incorpor d in all subcontracts. If the Performing Agency fails to comply with this Article, the
Receivi Agency may withhold payments and suspend work until the subcontractors and suppliers are
paid. Th Performing Agency is authorized to submit requests for reimbursement no more frequently than
monthly d no later than 120 days after costs are incurred.
Article 14. Conflict of Interest
The Per ing Agency shall not assign an employee to a project if the employee:
1. own in interest in or is an officer or employee of a business entity that has or may have a contract
with e state relating to the project;
2. has irect or indirect financial interest in the outcome of the project;
3. has formed services regarding the subject matter of the project for an entity that has a direct or
indir it financial interest in the outcome of the project or that has or may have a contract with the
Rec ing Agency; or
4. is a dFrent part-time or full-time employee of the Receiving Agency.
Article 1 Additional Work
A. If the erforming Agency is of the opinion that any assigned work is beyond the scope of this contract
and nstitutes additional work, it shall promptly notify the Receiving Agency in writing. The
writtnotice shall present the relevant facts and show how the work constitutes additional work.
B. If the eceiving Agency in its sole discretion finds that the work does constitute additional work, the
Rece ing Agency shall so advise the Performing Agency and a written amendment will be executed.
The 114 rforming Agency shall not perform any proposed additional work or incur any additional costs
befo the execution of an amendment.
C. The ceiving Agency shall not be responsible for actions by the Performing Agency or for any costs
incu d by the Performing Agency relating to additional work that is performed before an
ame ent is executed or that is outside the scope of the contract, as amended.
Article 1 Nonconforming Work
If the Per rming Agency submits work that does not comply with the terms of this contract, the
Receivin ! Agency shall instruct the Performing Agency to make any revisions that are necessary to bring
the work to compliance with the contract. No additional compensation shall be paid for this work.
Article 1 Authority of State Auditor
The state ditor may conduct an audit or investigation of any entity receiving funds from the state
directly der the contractor indirectly through a subcontract under the contract. Acceptance of funds
directly u der the contract or indirectly through a subcontract under this contract acts as acceptance of the
authority the state auditor, under the direction of the legislative audit committee, to conduct an audit or
investiga n in connection with those funds.
Article 1 Compliance with Laws
The parti shall comply with all federal, state, and local laws, statutes, ordinances, rules, and regulations
and with a orders and decrees of any courts or administrative bodies or tribunals in any manner
affecting a performance of this agreement. After receiving a written request from the Receiving
Agency, Performing Agency shall furnish the Receiving Agency with satisfactory proof of its
complian with this Article.

WITNESOTH, that:
WHERE , the County desires to secure the services of a construction consultant to provide
constructi inspection support for various Brazos county construction projects, including but
not limit I'proj o the: Exposition Center, Pct. 3 office renovation and jail facility construction and

WHERE, Brazos County desires that Sims provide construction consultation and support
services f the projects; and
WHERE , Sims represents and acknowledges that he is fully qualified and capable of

I Time
On or abo the last day of each calendar month during the term of this agreement, Sims shall
submit to he Purchasing Agent a statement for services rendered during that month. Each
statement all be in a form acceptable to the Brazos County Auditor and shall include such
detail of thl services may be requested by the County Auditor for verification purposes. This
statement s ll at a minimum include 'a description of his services, the day or days and the time
or times th Sims performed the services, and the total amount billed for services. After receipt
of a statement, the Purchasing Agent shall review the statement and approve it with
modificatio as he may deem appropriate and thereafter forward the statement with any
modificatio to the County Auditor for payment. The County shall pay these statements, as
approved b the County Auditor, within 30 days after approval of the statement by the County
Auditor.

It is expres understood and agreed that this agreement is for personal services of Sims and that
Sims shall rsonally perform all of the work necessary to provide the services set forth herein
and that no 1 -1 shall be performed by any employee, servant, agent, delegate or subcontractor of
Sims. All s vices shall be performed by Sims as an independent contractor. Sims may start and
cease work hereunder at will as long as authorized services are performed satisfactorily and in a

S. Term
This agree nt is effective August 1, 2005, and, unless terminated sooner in accordance with the

copyright wnership and interest in any information, programs, reports, documentation and/or
data to b or already developed, created or invented pursuant to this agreement or any other
service a ements that he may have had with the County.
10. Succe44ors and Assigns
The Coun and Sims bind themselves and their successors, executors, administrators and assigns

The Me, dowcreek Subdivision will be constructed as an "urban" subdivision with streets that
have c b and gutter. The Subdivision will have a sanitary sewer collection system and sanitary
sewer atment plant. Brazos County requires that all utility lines beneath the street pavement be
encas The Developer would like to request an exception to this requirement for the sanitary
sewer ains and service lines. The sanitary sewer lines are gravity flow lines that do not have
any pr sure in the pipes, unlike waterlines, which can rupture and damage the roadway. The
propo sewer lines will be constructed using 4", 6", 8" and 10" heavy wall PVC pipe as
requir in residential subdivisions in Bryan and College Station. The typical maintenance
requir for the sewer collection system is to remove a clog in a line. This is accomplished by
insertii it equipment in the line from a manhole or clean-out to remove the clog.
The D eloper feels that encasement requirement for sanitary sewer lines is unnecessary since it
is not ely that sewer line maintenance or repair could result in damage to a street.

Dear . Vance:
The adowcreek Subdivision will be constructed as an "urban" subdivision with streets that
have b and gutter. The Developer is requesting that the streetlights proposed for the
Subdi sion be installed behind the curb as typically done in an "urban" residential subdivision.
Placer i nt of the streetlights outside the street right-of-way would have them in the front yard of
the re, t ence and decrease their effectiveness in lighting the street. Lighting of the street
impro s the safety and security of the residential neighborhood. Attached are photographs
showi the typical locations of streetlights, in a similar residential subdivision in College
