A regular meeting of the Commissioners' Court of Brazos
nty, Texas was held in the Brazos County Commissioners
C#rtroom in the Courthouse in Bryan, Brazos County, Texas,
b4tinning at 9:00 a.m. on Tuesday, July 5, 2005 with the
f 'lowing members of the Court present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct l;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the
citizens and officials that were in attendance.
Commissioner Cauley gave the invocation and led the
p dge of allegiance.
Under citizen input/and or concerns the following
sibbke:
Demetrios Basdekas
a) He said that unfortunately, he had not
received the information he had requested
at the last meeting. He could not stay
until the end of last week's meeting when
the County Judge was to give him the
information under Agency/Board/Committee
reports. The County Judge deferred to
legal counsel, Bill Ballard who informed
Mr. Basdekas that citizens' input should

not entail dialogue with the Court. Mr.
Basdekas asked if he would get the
information at the end of the current
meeting as he was told last week. The
County Judge said he would respond to his
open records request for information.
The Court next considered Budget Amendment #04/05-
3 1 through 34.4 that would reallocate funds for County
C rt at Law # 1, 272nd District Court, and Jail
Administration; and transfer funds from contingency to
tILe 272nd District Court. On motion by Commissioner
P ers, seconded by Commissioner Cauley, the Court voted
u nimously to approve the budget amendment as submitted.

The Court proceeded to consider the change of status
o employees as submitted on the attached Personnel
A ion Requests. On motion by Commissioner Peters,
s onded by Commissioner Cauley, the Court voted
imously to approve the changes as submitted.
The Court next considered the following Claims as
s mitted by the County Treasurer for payment:

The next matter before the Court was a request from the

i urance plans to newly hired employees of Brazos County.
T Personnel Manager explained her reasons for wanting to
discontinue. " Commissioner Cauley suggested charging the
i Jurance companies for services rendered. Commissioner
M lard said that he didn't think that was legal. He was also
c cerned about the liability of mailing payments on time,

The next matter before the Court was approval of a
S vice Contract with Fujitsu Computer Products of America for
m ntenance coverage of three (3) high-speed scanners. The
c t to Brazos County will be $1,595.00. The contract
c ences on July 20, 2005 and terminates July 19, 2006. On
m ion by Commissioner Cauley, seconded by Commissioner
P ers, the Court voted unanimously to approve the service
c tract with Fujitsu Computer Products of America. A copy of
tqo contractual agreement is attached.

The Court next considered a service contract with ABA
M#iah, Corp. for maintenance coverage on the Printronix 1500Q
p# nter in the data center. Total cost of the service
a eement is $1,595.00 and it runs from June 22, 2005 through
J e 21, 2006. On motion by Commissioner Cauley, seconded by
Cq#unissioner Peters, the Court voted unanimously to approve
t service agreement with ABA Moriah, Corp. for maintenance
coverage on the Printronix 1500Q printer. A copy is attached.
The next matter for consideration was approval of tax
refund applications from the following individuals and/or
companies:
a) Joe Wayne Clark, Over Payment $332.21
b) Sandra Brandt Easterling, Over Payment $8.00
c) Mary Deborah Rice, Over Payment $23.30
0 motion by Commissioner Peters, seconded by Commissioner
C 'ley, the Court voted unanimously to approve the tax refund
aftlications.
The Court next considered a request from Justice of the
P ce, Precinct 1 for permission to pursue a formal proposal

The Court next considered approval of the Vacating and
F al Plat of Indian Lakes Subdivision Phase IV in Precinct 1.
R hard Vance, County Engineer, stated that he had reviewed
tlt~ plat and offered the following comment:
1) Vacating Lots 31 through 36, block 9 and
Lot 11, Block 8, Indian Lakes Subdivision
Phase IV as recorded in Volume 6220, Page 120,
Official Records of Brazos County, Texas and
establishing a Final Plat of Lots 31-R through
36-R, Block 9 and Lots 11A-R, 11B-R, 11C-R
Block 8, Indian Lakes Subdivision Phase IV.
O 'motion by Commissioner Wassermann, seconded by Commissioner
P ers, the Court voted unanimously to approve the vacating
ait~ final plat of Indian Lakes Subdivision Phase IV subject to
t developer adding the comment noted by the County Engineer.
The Court next considered approval of the Final Plat of
I ian Lakes Subdivision Phase VII, 18.280 Acres in Precinct
1 Richard Vance, County Engineer, stated that he had reviewed

division Phase VII, 18.280 Acres as submitted.
The Court next considered acceptance of a Special
W ranty Deed for right-of-way on Peach Creek Road in Precinct
1 On motion by Commissioner Wassermann, seconded by
C issioner Peters, the Court voted unanimously to authorize
tj County Judge to accept on behalf of Brazos County a
Warranty Deed from J. W. and Joan Wilson Living Trust for the
expansion and improvements to Peach Creek Road.
The next matter before the Court was consideration of a
p ment authorization issued by the Justice of the Peace,
P cinct 4 office to Tharp's Printing Services in the amount
o $74.00 for letterhead stationery. On motion by
C$tamissioner Cauley, seconded by Commissioner Peters, the
C rt voted unanimously to approve payment of the payment
a horization in the amount of $74.00.
The Court acknowledged receipt of the Extension Service
r orts for May and June 2005 and acknowledged receipt of
r [orts from the following County and Precinct Offices showing
r&enues collected and remitted to the County Treasurer:

Under announcement of interest items and possible future
a#nda topics the following spoke:
County Judge
a) He received a letter from the Department of
Criminal Justice on recycled equipment and asked
the director of the Information Technology
Department if he'd seen it. Mr. Caldwell
replied that he had and that he was looking into
dealing with quite a bit of equipment. There
may be some complications with this route namely
the cost to the county. The Auditor said that
it was her understanding that if the Criminal
Justice Department did not like the equipment,
they could send it back. The Director of
Building Maintenance said that the Purchasing
Agent contacted him and that he does have the
materials to shrink wrap the equipment and will
try to do it.
There was no citizen input and/or concerns.
There were no Agency/Board/Committee reports by Court
mummers.
There being no further business to come before the Court,
too meeting was adjourned.

On-site Break- - Each ScanCare maintenance program includes on-site break-fix repair of Customer scanner, which includes spare parts,
labor and travel service of verified hardware failures. After a Technical Assistance Center (TAQ representative identifies a hardware proble n, a
service call will ' opened and logged. A Fujitsu Authorized Field Engineer (FAFE) will be dispatched to the product location to perfonn repair
service if there i o security, safety or physical requircincuts that would restrict access to the product. On-site visits do not include preventative
maintenance, m nance, training, consumables and cleaning materials, troubleshooting of software configuration, applications or set-up. Please
refer to FCPA''s s and Conditions.
nsnmabies - Each ScanCare maintenance program includes automatic delivery of consumable kit(s) to the end-user site. The number of kits
depend on scan model. Nate: The Consumable kits provided Customer during the maintenance period contain quantities of parts required for
cleaning and mai nce care of the Product based on normal use. Should Customer require additional consumables, Customer may purchase these
pans bycontacti a-local Fujitsu reseller.
- A FAFE schedules an on-site visit to thoroughly clean and replace any necessary consumable parts. Service will
s hours at a time to be mutually agreed upon between the FAFE:and Customer within 2 weeks of initiation.
