15. R ewal of Bid #2005-029R Temporary Employment Services, to Manpower
P sonnel Service, with a $0.04 increase for each salary position.
16. R uest from the Brazos Center for approval of a payment authorization to Pyramid
S ool Products, Inc. in the amount of $97.11 for a restocking fee and shipping charges.
17. R j' curd action of the Commissioners Court dated 19 April 2005 on the request from
P erson Petroleum.
18. P ission to enter Christopher Hereford's property located off Wilson Pasture Road for
t purpose of clearing the fence line of brush and low hanging limbs for approximately
1 ' in each direction from the curve for sight distance; for the health, safety and welfare
o he general public. Site is located in Precinct 2.
19. luest from Wickson Creek Special Utility District to construct a road bore in the right

A regular meeting of the Commissioners' Court of Brazos
ty, Texas was held in the Brazos County Commissioners
Cj+ rtroom in the Courthouse in Bryan, Brazos County, Texas,
b4oinning at 9:00 a.m. on Tuesday, June 7, 2005 with the
f lowing members of the Court present:
Randy Sims, County Judge, Absent;
Lloyd Wassermann, Commissioner of Precinct l;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4,
Presiding;
Karen McQueen, County Clerk, Absent.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Mallard gave the invocation and led the
pAfdge of allegiance.
There was no citizen input/and or concerns.
The first matter before the Court was the introduction of

I ependent School District. Commissioner Wassermann
idt roduced Maria Saldana and Sheedra Naeem. He thanked the
ty elected officials for their help in teaching the
st dents about county government.

The Court next considered Budget Amendment #04/05-30.1
t ough 30.7 that would reallocate funds for the Certificates
o Obligation Issue 2003, County Attorney, Extension Service,
R k Management, Community Supervision, and Jail
A' inistration and transfer funds from Contingency to the Road
a Bridge Department. On motion by Commissioner Peters,
s onded by Commissioner Mallard, the Court voted unanimously
t approve the budget amendment as submitted, a copy of which
i attached.
The Court proceeded to consider the change of status of
loyees as submitted on the attached Personnel Action
RIluests. On motion by Commissioner Peters, seconded by
ssioner Wassermann, the Court voted unanimously to
adorove the changes as submitted.
The Court next considered the following Claims as

The next matter for consideration by the Court was a
request submitted by the County Extension Agent, Dr. Alma M.

Fonseca has two events to attend. They are as follows:
a. The Pioneer Trail Tour, June 20-25, 2005 which

motion by Commissioner Wassermann, seconded by Commissioner
P ers, the Court voted unanimously to grant the request from

The next matter for consideration by the Court was a
r uest submitted by the 361St District Judge seeking approval
f out of state travel for himself. Judge Smith will be
t veling to the Judicial Division of the American Bar
A Iociation meeting August 4-8, 2005 in Chicago, Illinois. On
m ion by Commissioner Peters, seconded by Commissioner
W sermann, the Court voted unanimously to grant the request
f m the Judge Smith and approved payment of out of state
t vel expenses for him.
The Court next considered a request from the Metropolitan
P]nning Office for $8,333.00 to help support a feasibility
sl4dy for a Regional Transportation Operations for the Brazos
V+1ey project. The study is aimed at finding the best
a roaches for effectively managing and operating the
t nsportation system. On motion by Commissioner Cauley,

s onded by Commissioner Peters, the Court voted unanimously
t ',approve the request. After some discussion, Commissioner
C ley asked to amend his motion to include approval is
c' tingent upon the cities passing this also. The motion was
s onded by Commissioner Mallard and carried unanimously.
The next matter before the Court was the establishment of
a speed limit on Deer Park Drive in Precinct 1. The
r ommendation from the Road and Bridge Department was a speed
i it of 20 miles per hour. The Court discussed the fact that
a ublic Hearing had not been held on this matter. The County
E ineer stated that he has a copy of a law that gives the
C issioners Court the authority to do so without a Public
H ring. He said he would provide the Court with a copy of
t law. On motion by Commissioner Wassermann, seconded by
C issioner Peters, the Court voted unanimously to accept the
recommendation from the Road and Bridge Department and set the
s Feed limit at 20 miles per hour.
The Court next considered the approval of two (2)
i oices to Experian. The County Attorney's office has in the
p t, used the vendor for searches for suspects with
o 'standing warrants. They will no longer be using the vendor
d to rate increases and other factors. On motion by
Co issioner Cauley, seconded by Commissioner Peters, the

C rt voted unanimously to approve payment of the two (2)
i loices to Experian.
The next matter before the Court was the appointment of
i' ividuals to the Region 49, 800 MHz Regional Review
C ittee. On motion by Commissioner Mallard, seconded by
C issioner Wassermann, the Court voted unanimously to

The Court next considered the appointment of an

t Court voted unanimously to appoint Bryan City Councilman,
J on Bienski to serve on the Brazos Valley Council of
G I'ernments Intergovernmental Agencies Committee effective
i ediately and expires September 30, 2005.
The next matter before the Court was a request by the
C my Clerk for a waiver of the county travel policy
c cerning hotel reimbursements. The County Clerk will be
atll'ending the County and District Clerk's Association of Texas

A' ual Conference June 19-23, 2005. There is no host hotel.
Room accommodations are $105.00 per night. On motion by
C issioner Peters, seconded by Commissioner Wassermann, the
C rt voted unanimously to waive the travel policy concerning
h el accommodations.
The Court next considered renewing Bid No. 2005-029R,
T porary Employment Service. Pat Howard, Purchasing Agent,
r commended renewal because it is still the lowest bid
a hough there is a salary position increase of $0.04. On
m ion by Commissioner Peters, seconded by Commissioner
M 'lard, the Court voted unanimously to accept the
r ommendation of the Purchasing Agent and renewed the
c 'tract to Manpower. A copy of the bid tabulation is
a ached.
The next matter before the Court was a request from the
B zos Center for approval of a payment authorization to
P amid School Product, Inc. This is necessary due to a double
s pment and the assessment of a 20% restocking charge. On
m ion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve payment of the
p ment authorization in the amount of $97.11.
The Court next considered rescinding action on a request
b Patterson Petroleum that was considered during the

b Commissioner Cauley, seconded by Commissioner Peters, the
C rt voted unanimously to rescind action on a request by
PII terson Petroleum.
The Court next considered authorizing work outside of
c my rights-of-way for the health, safety and welfare of the
g feral public. The Road and Bridge Department requested
pmission to enter the private property of Christopher
H eford on Wilson Pasture Road in Precinct 2 to clear the
f ce line of brush and low hanging limbs for approximately
1 feet in each direction from the curve. On motion by
C issioner Peters, seconded by Commissioner Wassermann, the
C rt voted unanimously to authorize the work.
The Court next considered the request from Wickson Creek
S cial Utility District to construct a road bore for
waterline installation in the right-of-way of Falling
Wa'er/Fawn Lake Road at its intersection with Morning Star.
Thl site is located in Precinct 2. The County Engineer stated
th't all appeared to be in order and recommended approval. On
motion by Commissioner Peters, seconded by Commissioner
Ma 'lard, the Court voted unanimously to approve the request

No work will be permitted between front slope and/or back slope.
All installation(s) shall be constructed in designated utility easements, if applicable. If no
utility easement exists, the installation(s) shall be 1) within 3-5' of and parallel to the right-of-
way line and/or 2) in the case of a road bore, perpendicular to the right-of-way line.
If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county right-of-way.
Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test
shall be conducted by an independent geotechnical testing firm; copies of all test results shall
be furnished to the office of the Brazos County Engineer.
Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of
Transportation, and all other State and Federal laws governing utility construction.

1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that he, or his designated inspector, may
inspect the actual installation.
2. All damage to the roadways and rights-of-way will be repaired to their
original condition to the satisfaction of the County Engineer.
3. Brazos County reserves the right to require Applicant to relocate or
lower any such line at no cost to Brazos County, should same
become necessary due to widening or lowering, or other alteration of
the roadway or right-of-way.
4. Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines in the right-of-way.
5. The line will be constructed and maintained on the County right-of-way in
accordance with the Utility Accommodation Policy which was adopted by the
Texas Department of Transportation on May 29, 1989.
6. The line or lines will be constructed no less than twenty-four inches (24")
lower than the lowest part of the drainage or bar ditch and the drainage is to
be considered at least two feet (2') below the center of the roadway.
7. All sites will be barricaded during the construction period.
Construction of this line will begin on or after thel3t1day of June , 20 05.
