V PAGE COMMISSIONERS' COURT Cd f REGULAR MEETING MAY 10, 2005 A regular meeting of the Commissioners' Court of Brazos ty, Texas was held in the Brazos County Commissioners C#rtroom in the Courthouse in Bryan, Brazos County, Texas, inning at 9:00 a.m. on Tuesday, May 10, 2005 with the lowing members of the Court present: Randy Sims, County Judge; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3, Absent; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. The County Judge gave the invocation and led the pledge o4jallegiance. There was no citizen input/and or concerns. The Court next considered Budget Amendment #04/05-26.1 t4tough 26.5 that would reallocate funds for the Constable, P cinct 1, Purchasing and C.O. Issue 2003, transfer funds f m Non-Departmental to the Health Department and record the v ue of donated property in the Sheriff's Department. A copy is attached. The Court proceeded to consider the change of status of e4tloyees as submitted on the attached Personnel Action ests. On motion by Commissioner Peters, seconded by Cq"issioner Wassermann, the Court voted unanimously to approve the changes as submitted. The Court next considered the following Claims as s#mitted by the County Treasurer for payment: 7006634 through 7006873 0 motion by Commissioner Peters, seconded by Commissioner W sermann, the Court voted unanimously to approve the Claims adfsubmitted. The next matter before the Court was a request from the E ension Service to change an employee's status from non- e mpt hourly to exempt salaried. This is necessary because t employee qualifies for the learned professional employee e mption and must therefore be compensated on a salary basis a4ldefined in the FLSA regulation. On motion by Commissioner P# ers, seconded by Commissioner Cauley, the Court voted u nimously to approve the request and change Charla Anthony, H ticulturist from non-exempt hourly to exempt salaried. The Court next considered the paving of Kathy Fleming Raid. In a memo to the Court Commissioner Wassermann 1 8 Page C missioners Court meeting May 10, 2005 3 explained that this work needed to go on even though the City o Millican incorporation is still in question. On motion by Commissioner Wassermann, seconded by Commissioner Cauley, the C rt voted unanimously to proceed with the paving of Kathy Fleming Road. On motion by Commissioner Cauley, seconded by C issioner Wassermann, the Court voted unanimously to a rove Resolution #05-002 for the submission of the grant a lication for the Brazos County Drug Court to the Office of t Governor, Criminal Justice Division and to authorize the C#nty Judge to accept such grant funds should they be tdidered. The next matter before the Court was the reappointment of individual to serve on the Brazos County Child Welfare B rd. On motion by Commissioner Peters, seconded by C issioner Cauley, the Court voted unanimously to reappoint M ci Clark to serve on the Brazos County Child Welfare Board. J~r term of appointment is April 1, 2005 through March 31, 2008. The Court next considered the amended policy on Sexual H4tassment, to be incorporated into the Brazos County Policy & Pftcedures Manual. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the revisions. A copy is attached. On motion by Commissioner Peters, seconded b Commissioner Wassermann, the Court voted unanimously to a rove Requisition #00004127 in the amount of $24,800.00 and a horize the County Judge to execute the document. The Court next considered renewal of Bid #2003-021, I ate Telephone System. This renewal will utilize the same t ms as the original agreement plus upgrade the juvenile s tem should the need arise, upgrade the investigative w kstation if necessary and provide the county with the o ion to utilize a DVD back up system when it is available f general release. Brazos County prohibits any form of sexual harassment. Unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature constitute sexual harassment. Sexual harassment shall include, but not be limited to sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature where: 1. submission to such conduct is made either explicitly a term or condition of an individual's employment; 2. submission to or rejection of such conduct by an individual is used as a basis for employment decision affecting such individual; 3. such conduct has the purpose or effect of unreasonably interfering with an individual's work performance or creating an intimidating, hostile, or offensive working environment. Men or women can be victims of sex discrimination. All claims of sexual harassment shall be taken seriously and investigated promptly. It is he intent that the privacy of the person involved will be protected to the extent necessary to conduct a proper investigation. While all claims of sexual harassment shall be handled with discretion, there can be no complete assurance of full confidentiality. If the investigation substantiates that the complaint is valid, immediate corrective action designed to stop he harassment and prevent its reoccurrence will be taken. Such corrective action may, in appropriate instances, include discipline up to and including discharge) of the offending person. r VJ~ h= Ad- 3.06 LILY ON SEXUAL HARASSMENT(continued) 3.06.4 REPORTING An employee who feels he/she has been or is being subjected to sexual harassment should immediately report the situation to: 1. his/her immediate supervisor 2. the elected official or department head who is responsible for the department in which they work. If, for any reason, the employee feels that reporting the harassment to the department head or elected official may not be the best course of action, the report should be made to the Director of Human Resource, and/or the Director of Risk Management. The supervisor, elected official or department head to whom the claim has been reported shall be responsible for seeing that prompt action is taken to investigate the claim, filing a notice of the claim with the Director of Human Resource and Director of Risk Management. " Stamping, engraving, permanent marker, or any other method that is not easily !l be suff cient for tagging the asset. Exceptio to tagging assets are land, buildings, and roads. In addition, assets such as guns and covert s eillance equipment may be exempt when the tagging of the asset may hinder the usefulne of the asset. Alternative records should be kept at the department to aide in the identific on of the asset, including cross-reference to serial numbers when available. Subchap r A -Assets Assigned to Employees Assets as gned to individual employees such as cell phones, laptops, guns, vehicles, pagers, and radios a to be documented by the assigning department and available for review by the Auditor' ! office. The documentation should include the employees name, a description of the asset, an available serial numbers and asset identification numbers if applicable, the date the asset was assigned to the employee and the initials of the employee indicating receipt of the asset. A changes to assets assigned to employees are to be documented at occurrence and the documen tion should be reviewed and initialed by the employee at least annually. Subchap r A - Annual Asset Certification In the fal f each year, the departments will be provided with a printout of the assets assigned to that dep ment. The department head or their designated representative will ensure that a complete ventory review of the assets assigned to the department is performed. Any required additions eletions/ changes are to be noted on the list and communicated to Purchasing with the appr riate documentation attached, such as a completed transfer form or police report. Once the apartment has completed the review, the elected official or department head is to certify to e accuracy of the list and return it to Purchasing. We feel tt these changes will provide the departments and the County as a whole with a more cost effec a and accurate system for accounting and tracking fixed assets.
