A regular meeting of the Commissioners' Court of Brazos
nty, Texas was held in the Brazos County Commissioners
C rtroom in the Courthouse in Bryan, Brazos County, Texas,
b inning at 9:00 a.m. on Tuesday, February 1, 2005 with the

Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct l;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Mallard gave the invocation and led the
p4o dge of allegiance.
Under citizen input/and or concerns the following spoke:

Auditor's office and the County Judge for their help
with the new software on W2's.
The Court next heard a presentation of the quarterly
d inquent tax report presented by Shelburne Veselka,
r+~resentative of McCreary, Veselka, Bragg & Alen, P.C.

The Court next considered Budget Amendment #04/05-16.1
t t would reallocate funds for County Court at Law # 1. On
m (-ion by Commissioner Cauley, seconded by Commissioner
P ers, the Court voted unanimously to approve the budget
a 'ndment as submitted, a copy of which is attached.
The Court proceeded to consider the change of status of
e 'loyees as submitted on the attached Personnel Action
R t'uests. On motion by Commissioner Cauley, seconded by
C issioner Peters, the Court voted unanimously to approve
t changes as submitted.
The Court next considered the following Claims as
s mitted by the County Treasurer for payment:

The next matter before the Court was Amendment One to the
S 'ate of Texas Registration and Title System (RTS) Information
R ources and Support lease agreement for the use of State of
T as automation equipment. This amendment adds one
additional remote sticker printing system. Kristi Rowe Chief
D uty for the Tax Office explained the need for this. On

The next matter before the Court was a request from the
D trict Attorney's Office for approval of overtime pay for
t administrative secretaries. In a memo to the Court the
D# trict Attorney stated that due to an administrative
s retary's three-week absence from work, the other
a *inistrative secretaries are working extra hours to keep up
with their work and the work of the other secretary. He

On motion by the County Judge, seconded by
issioner Wassermann, the Court voted unanimously to

The Court next considered Equipment Schedule No. 4 to the
E ipment Lease Agreement 81194C1 between Brazos County and Bi
I orporated. On motion by Commissioner Cauley, seconded by
C issioner Peters, the Court voted unanimously to approve
Lease Agreement. A copy is attached.
The next matter for consideration by the Court was a
est submitted by the Director of the Information Technology
rtment to authorize the attendance of online budget
p paration training offered by SunGard Pentamation. Four
m 'hers of the Auditor's staff and three members of the
I ormation Technology staff would be attending. Total cost
f the '-2 day training is $600.00. On motion by Commissioner
C ley, seconded by Commissioner Peters, the Court voted
u nimously to grant the request from the Director of the
Ifformation Technology Department and authorized attendance by
Ab seven staff members.
The Court next considered the possibility of contracting
with a Health Insurance Consultant. On motion by Commissioner

AMENDM NT ONE [LEASE OF STATE OF TEXAS REGISTRATION AND TITLE SYSTEM
(RTS) INF RMATION RESOURCES AND SUPPORT] TO AGREEMENT FOR THE USE OF
STATE OF TEXAS AUTOMATION EQUIPMENT
THIS AMEND NT is made between the "State" and the "County" pursuant to the addition of SECTION 1.
Subch to A. 0 ha ter 520 Section 520.002 of the Texas Transportation Code as enacted by the 76'~ Legislature of

RTS workstal s/items directly from the State. This amendment incorporates all the terms and provisions
regarding res risibility for: equipment installation, RTS programming and hardware/software configuration,
security, main ance, equipment repair and replacement, equipment movement, unauthorized equipment use,
building elect I requirements, accountability/inventory of equipment, training, and supplies provided in the
Agreement for a Us6zf State of Texas Automation Equipment dated
In addition to a provisions of the original county agreement, TxDOT's responsibility for equipment installed at
non-county tax ssessor-collector sites; e.g. privately owned, for profit enterprises performing registration and title
functions for county tax office; will be limited to ensuring the equipment remains operational. The county will
be responsible r all training, user support, forms, supplies, user policy and procedures, etc., associated with this
leased equipm t. This amendment will remain in force for as long as the Agreement for the Use of State of Texas
Automation Eq ment remains effective.
This Amendm it provides a new option for the County to obtain additional RTS Information Resources and
Support not id tified in the Agreement for Use of State Automation Equipment. The process for requesting these
resources and l,i nnual cost and billing information associated with this lease are included in Exhibit A to this
Amendment.
RTS workstati s Identified below and/peripheral equipment identified on Exhibit A which are leased under the
provisions of amendment will be installed following approval of the County Commissioner's Court. This
amendment w 11 be signed below by the County Judge or will be supported by a certified copy of the

EXHIBIT "A" To Amendment One
State of Texas, County of Brazos
1. If a unty desires additional RTS information resources, e.g. workstations or peripheral equipment,
beyo that which is allocated by the State, the equipment and support may be leased at County oxnense
from State. Counties should contact their supporting Vehicle Titles and Registration Division Regional
Offic or information and the necessary form to amend their existing Agreement for the Use of State of
Texa utomation Equipment, that is, their "County Agreement".
2. Sub ing a signed amendment form to the supporting VTR regional office will constitute the County's
form quest to lease RTS workstations and will signify that the County Tax Assessor-Collector has the
funds ecessary to lease this equipment.
3. The t of leasing a basic RTS workstation will be $1,500 per year, except if the installation is at a new
site t t is a site where RTS has not previously been installed. In this case, a "one time" additional fee of
$2,50 for the first workstation will be charged. The cost of leasing other RTS information resources and
supp is reflected below. Counties will identify the type and amount of the equipment desired by
appr lately annotating this quantity below.
4. Durin the first year of installation, the county will be billed during the month immediately following the

1. EQUI ENT DESCRIPTION: Thirty-Six (36) HG-2205 HG-200 Units, as further described in the
invoice of shipping said Equipment. The Equipment is subject to the
applicable warranty sheet, which is attached hereto and incorporated
herein.
2. BILLI DATE: The first day of the following calendar month after the date of shipping.
3. FIRST AYMENT DATE: The last day of the calendar month in which the Billing Date occurs.

HOME ESCORTTM - FIELD EQUIPMENT
WARRANTYAND SUPPORT COVERAGE
1. General he term "Customer" used herein shall refer to the Customer, Lessee or Service Provider as specifically defined in the
Agreement hich incorporates this document. This warranty is provided only on BI Home EscortTM field equipment. For the
purposes o is warranty, BI Home EscortTM field equipment shall be defined as the following BI equipment identified by the BI
Incorporate rademark, trade name or logo: (i) Field Monitoring Device, (ii) Transmitter, (iii) Drive-BI Monitor and (v) Activator
(the "Equip nt"). The Equipment is warranted to be free from defects of workmanship or material under normal use and service,
and shall b ree from all liens, claims and encumbrances. Customer will be responsible for the proper use, management and
supervision the Equipment. Customer agrees that BI will not be liable for any damages caused by Customer's failure to fulfill
these respo bilities. Service requested for the Equipment outside the scope of this warranty will be furnished to Customer at BI's
standard rat and terms then in effect.
2. Term - T warranty coverage provided hereunder is available to the Customer for a period of twelve (12) months from the date of
receipt of th quipment by Customer (the "Coverage Term").
3. Service a Parts - BI will make all adjustments, repairs and replacement parts necessary to keep the Equipment in good working
order at no rge to Customer. All replaced parts will become the property of BI on an exchange basis. Replacement parts will be
new parts o parts equivalent to new in performance when installed in the Equipment. Service pursuant to this warranty will
normally be mished by BI or its designee. If persons other than BI or its designee perform maintenance or repair at Customer's
request, and a result further repair by BI is required to restore the Equipment to good operating condition, such repairs will be
chargeable t ustomer at BI's standard rates and terms then in effect. BI shall have full and free access to the Equipment to perform
this service. aintenance service required on the Equipment will be performed at BI's facility. All repairs are warranted to be free
from defect material and workmanship for a period of ninety (90) days from the date of repair.
4. Freight - uipment which is to be returned to BI for service under this warranty shall be returned in accordance with BI's RMA
policy.
5. Technical port - Technical Support entitles the Customer to remote diagnostic support, trouble-shooting by telephone and
assistance o taining service on Customer's Equipment during the applicable Coverage Term. BI's Customer Support Department
is available t ' e customer Monday through Friday from 8:00 AM to 5:00 PM Mountain Time by calling 1-800-241-9924. On-call
Customer S ort representatives are available for emergency situations between the hours of 5:00 PM and 8:00 AM Mountain
Time, or dur weekends or holidays.
6. Exclusion' The foregoing warranties will not apply if adjustment, repair or parts replacement is required because of accident,
transportatio y customer, neglect, abuse or misuse, air conditioning or humidity control, theft, fire or water damage, telephone
equipment or 4 mmunication lines failure, failure of foreign interconnect equipment, use of external materials which do not adhere to
BI specificat is, or causes other than ordinary use. BI shall not be required to adjust or repair any unit of Equipment or part if it
would be i actical to do so because of alterations in the Equipment, its connection by mechanical or electrical means to
unauthorized uipment or devices, or if the Equipment is located outside the U.S. THE EQUIPMENT IS INTENDED SOLELY
FOR THE URPOSE OF IDENTIFYING THE PRESENCE OR ABSENCE OF A PERSON UNDER SPECIFIC
CIRCUMST CES. THE PRODUCT IS NOT IMPERVIOUS TO TAMPERING OR MISUSE. ITS USE OR ASSIGNMENT IS
LEFT SOLE TO THE DISCRETION OF A RESPONSIBLE JUDICIAL OR CORRECTIONAL OFFICIAL.
7. Limitatio if Liability- BI's liability for warranty hereunder is limited to restoring the Equipment to good operating condition
provided that ustomer has complied with the manufacturers' requirements relative to the Equipment.
8. Return ' erial Authorization (RMA) Policy - Freight charges to and from BI's facility for Equipment eligible for return
hereunder sh be paid by BI when pre-authorized by a Return Material Authorization (RMA) number issued by BI's Customer
Support Dep ent, and only when BI's pre-printed shipping labels are used. BI's pre-printed shipping labels provide the Customer
with second y delivery to BI's facility. Freight charges incurred by BI for equipment which is returned in a manner which is
inconsistent h BI's pre-printed shipping labels, or without an RMA number will be charged back to the Customer. Customers who
have multipl ites will be provided shipping labels only at those sites which have a host system or an excess of fifty units. BI
reserves the right to deny service to any Customer who does not adhere to the conditions of this policy. BI's Customer Support
Department i vailable to the Customer Monday through Friday from 8:00 AM to 5:00 PM Mountain Time by calling 1-800-241-
5178.
9. Non-Warr ty Repairs - During the Coverage Tenn, Customers returning Equipment with damage that is not covered under this
warranty will contacted by BI for authorization to repair the Equipment. Such repairs are subject to BI's standard non-warranty
repair rates in ect at the time of the repair. Customers shall be subject to a minimum service charge of $50.00 for all such returns,
even if no re r is authorized. In the event BI is unable to obtain authorization to repair non-warranty damage within seventy-five
(75) days fro the date of a unit's receipt by BI, the unit will be returned and Customer will be subject to the minimum service
charge of $50

Registratiokis will be accepted on a First Come/First Serve basis and limited to 20 participants per seminar

Attending M public seminar
Two busin days prior to a seminar, registered participants will receive an e-mail reminding them that
they have r istered to attend an Internet seminar. The body of the e-mail will contain the seminar

On the day the seminar, participants may log into the web classroom 15 minutes before the listed
staiN time.
A telephon nnection is required to participate in the audio component of the seminar. If you are using a
