To make arrangements, call (979) 361-4102. 0~ LY T COMMISSIONERS' COURT REGULAR MEETING APRIL 26, 2005 A regular meeting of the Commissioners' Court of Brazos C nty, Texas was held in the Brazos County Commissioners C rtroom in the Courthouse in Bryan, Brazos County, Texas, b inning at 9:00 a.m. on Tuesday, April 26, 2005 with the f lowing members of the Court present: Randy Sims, County Judge, Absent; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4, Presiding; Karen McQueen, County Clerk, Absent. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Wassermann gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns. The Commissioners Court considered the Addendum to the a nda first which was a presentation of the quarterly d inquent tax report presented by Shelburne Veselka, r resentative of McCreary, Veselka, Bragg & Allen, P.C. Al orneys at Law. The Court next considered Budget Amendment #04/05-24.1 t ough 24.3 that would reallocate funds for the Road and 1 91 &6 Page i mil C issioners Court meeting April 26, 2005 2 Bridge Department, Narcotics Task Force Grant, and Constable, P cinct 4. On motion by Commissioner Peters, seconded by C issioner Mallard, the Court voted unanimously to approve t budget amendment as submitted, a c y of which is attached. The Court proceeded to consider the change of status of loyees as submitted on the attached Personnel Action Rq~uests. On motion by Commissioner Peters, seconded by C issioner Wassermann, the Court voted unanimously to a rove the changes as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 7006145 through 7006385 motion by Commissioner Mallard, seconded by Commissioner Peers, the Court voted unanimously to approve the Claims as submitted. The next matter for consideration was approval of tax r' and applications from the following individuals and/or cdtDanies : a) First American Real Estate Tax Service, payment in error $1,957.09 b) One Forest Park, Ltd., Over Payment $240.52 c) Jorge Briones & Maria C. Ruiz, Over Payment $163.55 d) Thomas James & Linda J. Talley, Over Payment $89.75 041 motion by Commissioner Mallard, seconded by Commissioner 1 69 Page ac issioners Court meeting April 26, 2005 4 d 70 feet southeast of its intersection with OSR and the sgpond bore 250 feet from its intersection with Redbud Drive. T4 sites are located in Precinct 4. The County Engineer s :ted that all appeared to be in order and recommended a' roval. On motion by Commissioner Cauley, seconded by C issioner Peters, the Court voted unanimously to approve t request from CDM and authorized the installation. A copy of the request is attached hereto. The Court next considered authorizing work outside of c .nty rights-of-way for the health, safety and welfare of the g eral public. The Road and Bridge Department requested p mission to enter the private property of Jose L. Perez on B t Road in Precinct 4 to build a temporary fence around work so+ce to accommodate new bridge construction and to re-route c ek channel to align with bridge for proper drainage. On m ion by Commissioner Cauley, seconded by Commissioner P ers, the Court voted unanimously to authorize the work. The Court next considered acceptance of a Special W ranty Deed for right-of-way on Burt Road in Precinct 4. On m ion by Commissioner Cauley, seconded by Commissioner Wiz- sermann, the Court voted unanimously to authorize C issioner Cauley to accept on behalf of Brazos County a Sflfcial Warranty Deed from Jose L. The Court next considered approval of the Final Plat of N th Country Phase Ten, 35.00 Acres in Precinct 2. Richard V ce, County Engineer, stated that he had reviewed the plat a all appeared to be in order. Commissioner Wassermann moved t approve. Commissioner Mallard seconded the motion. Commissioners Wassermann, Mallard, Cauley and the County Judge voted "Aye''. Commissioner Peters abstained because the d eloper is his cousin. The next matter before the Court was the installation of al~top Sign located in Precinct 3. A public hearing was held 041 April 19, 2005 to hear commentary for and against the i tallation. On motion by Commissioner Peters, seconded by C issioner Mallard, the Court voted unanimously to install t stop sign at the intersection of Andert Road and Key E rgy Private Road. Under announcement of interest items and possible future alitnda topics the following spoke: Commissioner Mallard a) Said that the County Judge was in Austin testifying before the state legislature on revenue caps. He urged citizens to write representatives and ask that this be left up to the local level. Commissioner Cauley a) Commented the people need to realize that if caps are approved, local services will have to be cut. There was no citizen input and/or concerns. There were no Agency/Board/Committee reports by Court rs.
