NOVEMBER 30, 2004
A regular meeting of the Commissioners' Court of Brazos
lnty, Texas was held in the Brazos County Commissioners
lrtroom in the Courthouse in Bryan, Brazos County, Texas,
inning at 9:00 a.m. on Tuesday, November 30, 2004 with the
lowing members of the Court present:
Randy Sims, County Judge, Presiding;
Eric Caldwell, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
icials that were in attendance.
The County Judge gave the invocation and led the pledge
allegiance.
There was no citizen input/and or concerns.
The Court proceeded to consider the change of status of
~loyees as submitted on the attached Personnel Action
uests. On motion by Commissioner Cauley, seconded by
missioner Peters, the Court voted unanimously to approve
changes as submitted.
The Court next considered the following Claims as

C~ ~ley, the Court voted unanimously to approve the Claims as

The next matter before the Court was to consider adoption
oJ Order 04-011, dividing one voting precinct and combining
voting precincts. Due to annexation of 91.56 acres of
1~ d by the City of Bryan, the new boundary lines do not
f¢ .iow the existing election precinct lines created by Brazos
lnty. This leaves the County in non compliance with Texas
~ction Code Section 42.007 that states "A Commissioners
~rt may not establish a count election precinct containing
t ?ritory inside a city with a population of 10,000 or more
unincorporated territory outside the city". On motion by
ssioner Cauley, seconded by Commissioner Peters, the
trt voted unanimously to adopt Order 04-011, dividing
e ~ction precinct 67 and combining it with election precinct
7 ~, and election Precinct 70A be extended to follow the new

R( ~olution #04-024 authorizing the establishment of a "Drug
C( ~rt Program" for those persons arrested for, charged with or
cz cted of possession/use of alcohol, drugs, firearms or
o4 dangerous weapons, use of force against another person
al the death or serious bodily injury to another. This is
pi suant to the Texas Health and Safety Code ~469.002.
I ~ded in the motion and second was the appointment of Dana
Z as Judge of the Drug Court Program.
The next matter before the Court was the addition of

P~ cinct 3 and Constable, Precinct 3. On motion by
Cz ioner Mallard, seconded by Commissioner Peters, the

The Court next considered awarding Bid No. 2005-001,
P 'chase of Motor Graders. Becky Stephens Senior Buyer,
r. .mmended acceptance of the bid submitted by Mustang
E Company with the Buy Back Option in the amount of
$ 53,750.00.

a) He received a letter from Dr. David McIntyre commending
Greg Petry of 9-1-1 for his help in teaching students.
He gave a presentation on his own time and did an
excellent job.

a) Announced that the Brazos Center had won an award from
Brazos Beautiful for the hard work they had done
maintaining the nice looking lawn.
Commissioner Caldwell
a) He attended a meeting last Tuesday at the Brazos
Valley Council of Governments office in which they
discussed transportation and regional mobility.
There being no further business to come before the Court,

Texas Health and Safety Code {}469.002 defines a Drug Court Program as follows: In this

Formal notice is hereby given that (applicant) Wellborn Special Utility District

The location or description of the proposed installation is more fully shown by 3

The County Engineer must be notified 72 hours prior to the beginning
of construction in order that he, or his designated inspector may
inspect the actual installation. '
2. All damage to the roadways and rights-of-way will be repaired to their
original condition to the satisfaction of the County Engineer.
3. Brazos County reserves the right to require Applicant to relocate or
lower any such line at no cost to Brazos County, should same
become necessary due to widening or lowering, or other alteration of
the roadway or right-of-way.
