VOL PAGE COMMISSIONERS' COURT REGULAR MEETING OCTOBER 19, 2004 A regular meeting of the Commissioners' Court of Brazos C¢ ~nty, Texas was held in the Brazos County Commissioners C¢ ~rtroom in the Courthouse in Bryan, Brazos County, Texas, b( 'inning at 9:00 a.m. on Tuesday, October 19, 2004 with the f( lowing members of the Court present: Randy Sims, County Judge, Presiding; Eric Caldwell, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk, Absent. The attached sheet contains the names of the citizens and o ~icials that were in attendance. Commissioner Mallard gave the invocation and led the p ~dge of allegiance. There was no citizen input/and or concerns. The Court next considered Budget Amendment #03/04-50.1 tl :ough 50.6, which would reallocate funds for County Clerk- E[ ~ctions, 272nd District Court; transfer funds from C( to Court Support Costs, Health Department, C< ~ioners Court-Non Departmental, and 272nd District Court. On motion by Missioner Cauley, seconded by Commissioner Mallard, the ~rt voted unanimously to approve the budget amendment as }mitted, a copy of which is attached. The Court proceeded to consider the change of status of }loyees as submitted on the attached Personnel Action uests. On motion by Commissioner Peters, seconded by missioner Cauley, the Court voted unanimously to approve changes as submitted. Commissioner Peters }onded the motion. After some discussion in which Missioner Caldwell pointed out his concern for the wording said he would like it changed. Patti Sifuentez, Assistant ector of the Information Technology Department said that lgard is working on changes. Commissioners Cauley and ;ers withdrew their motion and second. Then on motion by ~missioner Caldwell, seconded by Commissioner Cauley, the irt voted unanimously to remove this item from the agenda. The Court next considered approval of the Brazos County 'roll for FY 2005 for the dates of October 1, 2004 through ~tember 30, 2005. On motion by Commissioner Mallard, ~onded by Commissioner Cauley, the Court voted unanimously approve the payroll in the amount of $33,561,000.00. The next matter for consideration by the Court was )ption of Brazos County Order #04-010 Directing that the ids normally deposited in a salary fund be deposited in the leral Fund. On motion by Commissioner Cauley, seconded by ~missioner Peters, the Court voted unanimously to adopt Order 1-010. A copy is attached. Or motion by Commissioner Mallard, seconded by Commissioner Pc ;ers, the Court voted unanimously to approve the contract. T~ County Judge asked if we had a contract with Blue Cross BI e Shield, whereupon Commissioner Mallard said not yet but it was close at hand. Commissioner Caldwell pointed out that t~ Court needed to first decide on appointing a Business Ag ociate and Privacy Officer to be listed on the last page. C¢ ioners Mallard and Peters agreed to amend their motion ar second to include naming Loraine Nichols, Human Resource Df ector as both. A copy of the Claim Administrator Business At ~ociate Agreement is attached. The County Judge read aloud a Proclamation #04-014 dc ~ignating the month of November 2004 as "Hospice Month". Court urges all citizens to learn more about hospice care ar to recognize the countless volunteers and professionals wi extend invaluable support to patients and their families their hours of greatest need. On motion by the County ge, seconded by Commissioners Caldwell, Peters, Mallard and ~ley the Court moved to proclaim the month of November, 2004 a "Hospice Month" throughout Brazos County. The next matter before the Court was adoption of R( ~olution #04-019 ordering the clerk of the court to cease c¢ _lecting fees of $5.00 for each civil suit filed in county c¢ irt, county court at law, probate court or district that h( _ps fund the First or Fourteenth Court of Appeals District. A~ ;hority to collect such fees is authorized in the Government C¢ ie Chapter 22.2021. The 78th Legislature authorized Brazos C¢ ~nty to file all appeals with the l0th Court of Appeals. On mc zion by Commissioner Cauley, seconded by Commissioner P( ;ers, the Court voted unanimously to adopt resolution #04- 0 with it becoming effective as of this date. After some d cussion and at the request of the District Clerk, C¢ 'ssioner Caldwell moved to amend the original motion to m~ Ge the effective date October 31, 2004. Commissioner Cauley s( ;onded the motion and it carried unanimously. The next matter for consideration by the Court was a r( uest submitted by the Jail Administrator, seeking approval f¢ out of state travel and payment of emergency expenses for Ir estigators Fred Kindell and John Pollock to travel to Cc 7ington, Kenton County, Kentucky to collect evidence in case ir 7olving aggravated sexual assault of a child. The Court next considered renewal of the LexisNexis On- ce Subscription Service for FY 2005. The District Judges, ~nty Court at Law Judges, Prosecutors in both the county ;orney and District Attorney offices and the Justices of the ice use the service. Total cost of the service is ),320.00. On motion by Commissioner Cauley, seconded by ~missioner Caldwell, the Court voted unanimously to renew the >scription. The next matter before the Court was approval to purchase ~ivirus software and support services for FY 2005. Cost of 5tware and support services is $8,918.00. On motion by ~nissioner Cauley, seconded by Commissioner Caldwell, the ~rt voted unanimously to approve the purchase of antivirus 5tware and support services. The Court next considered a request by the Information ~hnology Department for approval to purchase replacement :vets for the three remote Justice of the Peace offices. On motion by Commissioner Caldwell, seconded by ioner Cauley, the Court voted unanimously to table cc ~sideration until some questions have been answered. The Court next considered a request by the Research Valley P~ :tnership for a cash incentive of $10,000.00 to meet the r( uirement under the Performance Agreement between Genetic R~ ources International and Research Valley Partnership. Gary was previously employed by Texcon. b) He then asked the Jail Administrator for an update on the Chief Deputy who recently suffered burn injuries. He was informed that the Chief Deputy has a doctor's appointment on October 20, 2004 and might return to work next week.
