VOL b PAGE 1.43 COMMISSIONERS' COURT REGULAR MEETING OCTOBER 5, 2004 Cd A regular meeting of the Commissioners' Court of Brazos ~nty, Texas was held in the Brazos County Commissioners C*rtroom in the Courthouse in Bryan, Brazos County, Texas, b4oinning at 9:00 a.m. on Tuesday, October 5, 2004 with the f lowing members of the Court present: Randy Sims, County Judge, Presiding; Eric Caldwell, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Caldwell gave the invocation and led the p dge of allegiance. Under citizen input/and or concerns, the Sheriff gave the C rt a progress report on the Chief Deputy saying his p gnosis for a complete recovery was good. There are no 3rd d ree burns or need for skin grafts and he will be released f#m the hospital soon. The Court next considered Budget Amendment #03/04-49.1 t1tough 49.8, which would reallocate funds for Juvenile S 'vices-TYC Parole, Brazos Center, Personnel, County Court at L , PAGE 144 C issioners Court meeting October 5, 2004 2 I L # 2, Health & Life Insurance Fund, 272nd District Court, I T C State Aid Grant and increase the budget of the Brazos V "ley Narcotics Task Force. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted u nimously to approve the budget amendment as submitted, a c ly of which is attached. The Court next considered Budget Amendment #04/05-1.1 t ough 1.4. This is a clerical error on the agenda and should r Id to consider Budget Amendment #04/05-1.1 through 1.6. The I a ndment would transfer funds from Commissioners Court to J Itice of the Peace, Precinct 1, transfer funds from C tingency to Courthouse Security, reallocate funds for C Inty Attorney, Sheriff Administration, and Certificates of 0 igation, Series 2003 and set up a budget for State Homeland S urity LETPP Grant. On motion by Commissioner Cauley, s onded by Commissioner Peters, the Court voted unanimously t !,approve the budget amendment as submitted, a copy of which i attached hereto. The Court proceeded to consider the change of status of e 'loyees as submitted on the attached Personnel Action R uests. The next matter before the Court was approval of a c tract with Texas A&M University to maintain and operate the f ilities at Easterwood Airport for fiscal year 2005. The term o ;the agreement is from October 1, 2004 through September 30, 2 5 and will cost the County $50,000 to fund the cost of craft Rescue and Fire Fighting coverage and $50,000 to fund t cost of administrative support at the airport. On motion b Commissioner Peters, seconded by Commissioner Caldwell, the C rt voted unanimously to approve the agreement and authorized t County Judge to execute the document. A copy is attached. On motion by Commissioner Peters, seconded by C issioner Cauley, the Court voted unanimously to adopt R olution #04-018 accepting responsibility for ten (10) p cent of the cost of right-of-way from Democrat Road to the N4*asota River that is currently estimated at $233,700.00 for t improvement of State Highway 21. The next matter before the Court was approval of the A eement to Contribute Funds between Brazos County and the T as Department of Transportation for the highway project on S to Highway 21 from Democrat Road to the Navasota River. B4pzos County assumes responsibility for an amount equal to t (10) percent of the cost of the project that is currently e imated at $233,700.00. Brazos County and the Texas D artment of Transportation agree to enter into a contractual a eement to acquire right-of-way. On motion by the County J ge, seconded by Commissioner Cauley, the Court voted i unanimously to approve the Agreement to Contribute Funds. A c y is attached. The Court next considered approval of the renewal for V untary Long Term Disability (LTD) Plan with Hartford Life, w' h no change in rates. Term of the agreement is November 1, 2 (1)4 through October 31, 2005. On motion by Commissioner M lard, seconded by Commissioner Caldwell, the Court voted u nimously to approve the renewal for Voluntary Long Term D' ability (LTD) Plan with Hartford Life. Cost to Brazos C Inty will be $20,218.00. On motion by Commissioner Cauley, s onded by Commissioner Peters, the Court voted unanimously t ;enter into contractual agreement with Texas Voting Systems. A opy of the contractual agreement is attached. i The next matter before the Court was an application for P ment #1 from McClure & Browne Engineering/Surveying, Inc. f work performed by Elliott Construction, Ltd. on the West 2 h Street Wastewater Improvements. This request is for $ ,121.59. On motion by Commissioner Cauley, seconded by C issioner Peters, the Court voted unanimously to approve p lment of the Payment Application #1. i The next matter for consideration by the Court was a opting Order #04-006 Prohibiting Outdoor Burning in Brazos I C nty. The payment authorization was $600.50 and i w for the repair of a computer. On motion by the County J11 ge seconded by Commissioner Peters, the Court voted i u ni.mously to approve the payment authorization and to e ablish a fee of $5.00 per compact disk fee for the public. The Court next considered approval of a Copier Lease A 'eement for the offices of the District Attorney and Human I R ources Department. The monthly lease cost for the new 4iers is $405.00 per month for the District Attorney's office and $450.00 per month for the Human Resources artment. On motion by Commissioner Peters, seconded by missioner Cauley, the Court voted unanimously to approve Lease Agreement for both offices. The next matter before the Court was approval to invoice M tang Tractor for the buy back of two (2) motor graders. T# buy back option is part of the sales agreement. On motion bf!,ICommissioner Peters, seconded by Commissioner Cauley, the C4prt voted unanimously to invoice Mustang Tractor for $1. 1,000.00 each. The next matter before the Court was to consider adoption o j Order 04-007 Permitting the Revision of the Subdivision P14t of Evergreen Estates. A copy of the Order is attached hereto. The Court next considered approval of the Re-Plat of i E rgreen Estates Subdivision in Precinct 2. Richard Vance, C 'nty Engineer, stated that he had reviewed the plat and all a eared to be in order. On motion by Commissioner Peters, s onded by Commissioner Caldwell, the Court voted unanimously tAllapprove the Re-plat of Evergreen Estates Subdivision as sAlbmitted. The Court next considered authorizing work outside of c my rights-of-way for the health, safety and welfare of the g eral public.
