Two additional road bores will be constructed in the right of way of V tage Hills Drive and parallel installations will be placed in the platted subdivision P lic Utility Easement. Site is located in Precinct 2. 25. R uest from Wellborn Special Utility District to construct (1) three road bores and a I oximately 8,065 ft. of water line installation in the right of way of Peach Creek Cut- O Road, and (2) one road bore on Peach Creek Road at its intersection with Peach C ssing Drive. COMMISSIONERS' COURT REGULAR MEETING AUGUST 31, 2004 A regular meeting of the Commissioners' Court of Brazos C 'nty, Texas was held in the Brazos County Commissioners Cq~rtroom in the Courthouse in Bryan, Brazos County, Texas, b4oinning at 9:00 a.m. on Tuesday, August 31, 2004 with the fq~lowing members of the Court present: Randy Sims, County Judge, Presiding; Eric Caldwell, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheets contain the names of the citizens and officials that were in attendance. Commissioner Peters gave the invocation and led the ply*dge of allegiance. There was no citizen input/and or concerns. The Court next considered Budget Amendment #03/04-44.1 tIltough 44.8, which would reallocate funds for District A orney, Constable, Precinct 3, Metropolitan Planning Office, J enile Services-Detention, Juvenile Services and Juvenile S~ivices Academy, Emergency Management-TEEX Domestic Preparedness, General Permanent Improvements, and Brazos C~4ter. On motion by Commissioner Peters, seconded by L G.; 0 PAGE i ~ ~ Cl issioners Court meeting August 31, 2004 2 C issioner Cauley, the Court voted unanimously to approve t budget amendment as submitted, a copy of which is a ached. The Court proceeded to consider the change of status of e loyees as submitted on the attached Personnel Action R uests. On motion by Commissioner Peters, seconded by C issioner Cauley, the Court voted unanimously to approve t changes as submitted. The Court next considered the following Claims as s mitted by the County Treasurer for payment: 20066368 through 20066655 D motion by Commissioner Cauley, seconded by Commissioner dwell, the Court voted unanimously to approve the Claims as submitted. The next matter before the Court was approval of a con'tractual Agreement between Brazos County and Ingram, Wallis & ompany for auditing the financial statements of Brazos Co my and the Brazos County Health Department for the years en ed September 30, 2005, 2006, 2007 and 2008. The cost to Br zos County will vary according to the degree of red, ponsibility involved and the experience level of the pe'sonnel assigned to do the audits. The next matter before the Court was approval of a C tractual Agreement between Brazos County and Ernest Sims to a as Construction Inspector for the Expo Center. The cost t Brazos County will be $40.00 per hour. On motion by C issioner Peters, seconded by Commissioner Cauley, the C Frt voted unanimously to authorize the County Judge to sign t contract with Ernest Sims as soon as it is drawn up by c nsel. A copy is attached. The Court next considered approval of a First Amended G nt Contract, an amendment to the existing Texas VINE Grant C tract extending the current grant contract through August 3 2005 and allowing the Office of the Attorney General to c ry over and expend existing funds from fiscal year 2004 i o fiscal year 2005. On motion by the County Judge, se onded by Commissioner Caldwell, the Court voted unanimously to approve the First Amended Grant Contract to the existing Teas VINE Grant Contract. A copy is attached. The next matter before the Court was approval of a Resolution Levying a Tax Rate for the County of Brazos for the Ta Year 2004. On motion by Commissioner Caldwell, seconded L 1 o PAGE 09 C issioners Court meeting August 31, 2004 4 b ,Commissioner Cauley, the Court voted unanimously to set the Valorum tax rate as follows and authorized the Tax essor-Collector to assess and collect taxes of Brazos C )II my in accordance with the following rate: $0.4093 for the purpose of maintenance and operations $0.0632 for payment of principal and interest on county debt $0.4725 Total Tax Rate A opy of the Resolution is attached. On motion by the County Judge, seconded by Commissioner M 'i lard, the Court voted unanimously to adopt a resolution 04- 0'i asking the Texas State Legislature to restore funding for c 'tically needed health and human services programs to the p ! ple of Brazos County and the State of Texas. This was n l" essitated due to the implementation of HB 2292 passed in t j 78th regular session that reduces the number of state lth and human services agencies and functions into five new a§~ncies. The negative impact from the lack of funding and st~vices will require local entities to make up the difference i ! funding. The Court next considered acceptance of the letters of ignation from the following three members of the Board of D~i ectors for the Brazos County Health Facilities development CbIrporation: L 6 0 PAGE 110 C missioners Court meeting August 31, 2004 5 a. The next matter before the Court was the appointment of C ; dy Gallego to the Board of Directors for the Brazos County Hi lth Facilities Corporation. On motion by Commissioner C dwell, seconded by Commissioner Cauley, the Court voted u nimously to appoint Candy Gallego to the Board of Directors foir the Brazos County Health Facilities Corporation. The Court next considered approval of the reappointment of t following individuals to the Board of Directors for the B zos Valley Council of Governments: a. Randy Sims b. Commissioner Carey Cauley, Jr. c. Councilman Joe Marin O motion by Commissioner Peters, seconded by Commissioner M lard, the Court voted unanimously to approve the r j ppointment of the above mention individuals. The next matter before the Court was a request by Charles Eti; is, Jr., Justice of the Peace, Precinct 1 for permission to p chase a computer from WTI, Inc. a state approved vendor, u Sing monies from the J.P. Technology Fund. On motion by C issioner Caldwell, seconded by Commissioner Cauley, the C rt voted unanimously to remove this item from the agenda. The Court next considered a request by the Treasurer's o ice for a printer and an auto sealer. On motion by C issioner Peters, seconded by the County Judge, the Court v ed unanimously to approve the two purchases at a cost of $ ,888.94 for the printer and $3,840.83 for the auto sealer. On motion by the County Judge, seconded by Commissioner C ! dwell, the Court voted unanimously to receive, approve and o er filed as submitted the Treasurer's report for July 2004. The Purchasing Department Buyer r' ommended acceptance of the low bid in the amount of $;,600.00 that was submitted by Fort Bend Services. On motion b ; Commissioner Caldwell, seconded by Commissioner Peters, the C rt voted unanimously to accept the recommendation of the B' er and awarded the contract to Fort Bend Services. A copy o! the bid tabulation is attached. The Court next considered awarding Bid No. 2004-035, C Leaning Supplies for the Jail. Pat Howard, Purchasing Agent, r ommended acceptance of the low bid submitted by Team S tems. On motion by Commissioner Mallard, seconded by C issioner Cauley, the Court voted unanimously to accept the r ommendation of the Purchasing Agent and award the contract t Team Systems. A copy of the bid tabulation is attached. The Court next considered awarding the Annual Contract f Inspection of Smoke Detectors/Fire Alarm Panels. The P chasing Department Buyer recommended acceptance of the low btXi in the amount of $7,980.00 that was submitted by A-1 Fire &'Safety. On motion by Commissioner Peters, seconded by C issioner Cauley, the Court voted unanimously to accept the r' ommendation of the Buyer and awarded the contract to A-1 F' e & Safety. On motion by Commissioner Mallard, seconded by C issioner Peters, the Court voted unanimously to renew the b ! at the same cost of $48,500.00. The contract term is f m October 1, 2004 through September 30, 2005. A copy is a ached. The Court next considered awarding Bid No. 04-115, Fuel. T Senior Buyer recommended acceptance of the bid submitted b Brennco Marketing. This was a joint effort by several 1' al government entities in an effort to realize cost s ings for all involved. On motion by Commissioner Peters, s onded by Commissioner Caldwell, the Court voted u nimously to accept the recommendation of the Senior Buyer a ! awarded the contract to Brennco Marketing. A copy of the b" tabulation is attached. The next matter before the Court was the purchase of a itional sound equipment for the courtrooms. During the i stallation process it was determined that additional mLcrophones and mixers were needed for the court reporters. T'is will cost an additional $2,240.00. The County Engineer must by notified 72 hours prior to the beginning of construction in order that he or his designated inspector may inspect the actual installation. 2. That all damage to the roadways and rights-of-way will be repaired to their original condition to the satisfaction of the County Engineer. 3. That Brazos County reserves the right to require Applicant to relocate or lower any such line at no cost to Brazos County, should same become necessary due to widening or lowering, or other alteration of the roadway or right-of-way. 4. That Brazos County will In no way be responsible for any damage which might occur to any existing utility lines in the right-of-way. 5. That the line will be constructed and maintained on the County right-of-way in accordance with the Utility Accommodation Policy which was adopted by the Texas Department of Transportation on May 29, 1989. 6.
