VOL 6 COMMISSIONERS' COURT REGULAR MEETING JUNE, 1 2004 C( C¢ b( f¢ t? c( c( r( A regular meeting of the Commissioners' Court of Brazos lnty, Texas was held in the Brazos County Commissioners lrtroom in the Courthouse in Bryan, Brazos County, Texas, · inning at 9:00 a.m. on Tuesday, June 1, 2004 with the lowing members of the Court present: Randy Sims, County Judge, Presiding; Eric Caldwell, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4, Absent; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and icials that were in attendance. The County Judge gave the invocation and led the pledge allegiance. The first matter before the Court was a presentation by Convention and Visitor's Bureau concerning the convention ter and a feasibility study. Barry Biggar, of the ~vention and Visitor's Bureau emphasized that the type of ~ter and its location are the most important issues when ~sidering a convention center. Mr. Biggar presented the ~ort of the feasibility study. On mc ion Commissioner Peters, seconded by Commissioner Mallard, Court voted unanimously to approve the budget amendments a~ submitted, a copy of which is attached. The Court proceeded to consider the change of status of ~loyees as submitted on the attached Personnel Action R( 'uests. On motion by the County Judge, seconded by Cc ioner Peters, the Court voted unanimously to approve changes with the exception of the personnel action form f¢ Tony Kutiper and to remove it from the list. The cost to Brazos ~nty will be $17.34 an inch for daily advertising and $17.84 inch for Sunday/Holiday advertising. The term of the Ltract is for twelve (12 months commencing on July 1, 2004 terminating June 30, 2005. On motion by Commissioner ers, seconded by Commissioner Caldwell, the Court voted ~nimously to enter into contractual agreement with The Eagle ~spaper. A copy of the contractual agreement is attached. On motion by Commissioner Peters, :onded by the County Judge, the Court voted unanimously to a ~rove the Exemption of Competitive Bidding Requirements. McClure & Brown E ineering/Surveying, Inc. recommended acceptance of the bid mitted by Elliott Construction, Ltd. with a base bid of $] 9,121.00. On motion by Commissioner Peters, seconded by sioner Caldwell, the Court voted unanimously to accept recommendation of Chad L. The Court next considered the request from Verizon to lstruct a road bore in the right-of-way of Clay Pit Road at intersection with Cedar Rock Court (a private road in .ar Rock Subdivision). The site is located in Precinct 1. County Engineer noted the following exception: Brazos County can approve the road bore under Clay Pit Road only; the road bores under Cedar Rock Court will require the approval of the subdivision developer/owner as this is not a county maintained subdivision. On motion Commissioner Caldwell, seconded by Commissioner Peters, the C ~rt voted unanimously to approve the request from S ;int/United Telephone and authorized the installation. A >y of the request is attached hereto. The Court next considered approval of the Final Plat of O. J. Tauber Estates, 33.764 Acres in Precinct 2. Richard ice, County Engineer, stated that he had reviewed the plat all appeared to be in order. On motion by Commissioner ers, seconded by Commissioner Caldwell, the Court voted ~nimously to approve the final plat of O. J. Tauber Estates, 32 764 Acres as submitted. The next matter before the Court was a request from reloper Jimmy Easterly for a variance to Brazos County's >division and Development Regulations concerning the 1,000 ~t maximum street length requirement for Candlebrook ~division located in Precinct 3. Commissioner Mallard noted tt this request was due to the flood plain. On motion by missioner Mallard, seconded by Commissioner Peters, the trt voted unanimously to approve the variance request. The Court next considered a request by the Road and .dge Department to have Bryan Texas Utilities install a :urity light on Brazos County Property located at 15227 rder Road in Brazos County, Texas. This property is .lized for parking and storage of Road and Bridge equipment materials. The site is in Precinct 1. On motion by missioner Caldwell, seconded by Commissioner Peters, the irt voted unanimously to approve the request. On motion by Cc 'ssioner Peters, seconded by Commissioner Mallard, the Cc ~rt voted unanimously to appoint Commissioner Caldwell as cr-liaison. The next matter before the Court was the cancellation of t~ Commissioners Court meeting of June 8, 2004. On motion by Cr 'ssioner Caldwell, seconded by Commissioner Peters, the Cr ~rt voted unanimously to cancel the Commissioners Court mc ~ting of June 8, 2004. There were no announcements of interest items and pr ~sible future agenda topics. There were no Agency/Board/Committee reports by Court mc Under citizen input and/or concerns, the following s ~ke: Pattie Tijerina, with the Information Technology Department informed the Court that the Director, Ernie Laney had been hospitalized over the weekend and could not present the report to the Court. She went on to say that the department has been seeking alternatives to the current TSG software. They have consulted with the Coalition of Urban Counties (CUC), and the Texas Association of Counties (TAC) and are looking at the "Odyssey" software. TAC is trying to develop software for counties. She went on to say that they had met with TSG about problems and enhancements needed. An enhancement package is planned for release in January but PAGE Co missioners Court meeting June 1, 2004 10 c] C] C( she needs more information to see how many of our problems are addressed. The Court asked her, as co-department head, to continue working on the problems with the software because we need to proceed with this and to also report to Commissioner Caldwell who is now the co-liaison. The County Judge asked Mrs. Tijerina to give the Court a copy of all passwords. Mrs. Tijerina also expressed concern to Pat Howard and the Court on the Purchasing Department's needs. She apologized if the department was given the impression that the Information Technology Department was not here to provide customer service. She will work to rectify all problems. At 10:17 a.m. the County Judge announced the meeting sed to the public so that the Court could meet in sed Executive Session to discuss personnel under tion 551.074 of the Texas Government Code. At 10:35 a.m. the County Judge announced the meeting ~n to the public and announced that no action would be :en on the Closed Executive Session. There being no further business to come before the irt, the meeting was adjourned.
