COMMISSIONERS' COURT REGULAR MEETING MAY 18, 2004 A regular meeting of the Commissioners' Court of azos County, Texas was held in the Brazos Center, 3232 iarcrest Drive in Bryan, Brazos County, Texas, ginning at 6:30 p.m. on Tuesday, May 18, 2004 with the llowing members of the Court present: Randy Sims, County Judge, Presiding; Eric Caldwell, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the tizens and officials that were in attendance. Commissioner Cauley gave the invocation and led the edge of allegiance. Under citizen input/and or concerns the following ,oke: Constable Marrow - presented his office's Racial Profiling Statistical Report to the Court. The Court next considered Budget Amendment #03/04- .1, that would record the budget for the VINE Grant arded by the Office of the Attorney General. The Court proceeded to consider the change of status employees as submitted on the attached Personnel tion Requests. The Reverend Green asked to speak about e staff accountant appointed by the Tax Assessor- llector. He said people inside the Courthouse and tside had interviews but he heard that the decision had en made prior to anyone being interviewed. Be that as may, the appointed person does not have an accounting gree. He thinks the Commissioners Court should make e Tax Assessor-Collector accountable for his actions. verend Green's wife Barbara, worked for 16 years in is position. The position was then reclassified with duced duties when Kristy Rowe came on board. One person that applied for the sition has an accounting degree but was never nsidered for the position. The County Judge said he uld recommend that we hold the personnel action on the aff accountant position until they can talk to the Tax sessor-Collector. Commissioner C ldwell asked if the Auditor's office was comfortable w th this person filling this position since it was r commended by the Auditor at budget time to create the p sition. The County Judge said that he didn't think the c trent Auditor had seen this and that it was the p evious Auditor who had made the recommendation for the c eation of the position. On motion by Commissioner the C unty Judge, seconded by Commissioner Peters, the Court ted unanimously to approve the changes as submitted th the exception of the change of status of Patricia S odgrass. The Court next considered the following Claims as s bmitted by the County Treasurer for payment: 20062743 through 20062949 motion by Commissioner Mallard, seconded by mmissioner Cauley, the Court voted unanimously to ,prove the Claims as submitted. The next matter before the Court was authorization ,r the Community Healthcare Endowment Fund (CHEF) Review to disburse CHEF funds for FY 2004-2005. Grant .nds are awarded to community groups, schools, non-profit 56, Page c]& Cou~meetingMayl8,2004 o ganizations and coalitions with 501©(3) status to c nduct healthcare programs. On motion by Commissioner P ters, seconded by Commissioner Caldwell, the Court voted u animously to approve the disbursement of $120,000.00 in C EF funds. The Court next considered approval of the Plan Change 04-01 for the Title IV-E Legal Services Contract b tween Brazos County and the Department of Protective and gulatory Services. The purpose of the change is to i corporate the Title IV-E Legal Services Cost Allocation P an and Budget for FY 04. On motion by Commissioner C uley, seconded by Commissioner Peters, the Court voted u animously to approve the plan change. A copy is a tached. The Court next reviewed the Regional Mitigation Plan aft. Michael Parks, representative of the Brazos Valley C uncil of Governments, spoke about the plan and the p ocess. On motion by Commissioner Cauley, seconded by mmissioner Mallard, the Court voted unanimously to a the draft. Mr. Parks will be back for formal )roval of the final plan because there may be changes by t state. The next matter for consideration by the Court was a r quest submitted by the Sheriff's Office seeking approval f r out of state travel for Investigator Fred Kindell to t avel to Atlanta, Georgia and Pensacola, Florida for the p rpose of following up leads on Homicide Case #03-6143. O motion by the Commissioner Peters, seconded by C mmissioner Caldwell, the Court voted unanimously to g ant the request from the Sheriff and approved payment of o t of state travel expense for Mr. Kindell. The next matter before the Court was a request by the I formation Technology Department for approval to replace a laser printer located in the Risk Management ~ment. On motion by Commissioner Cauley, seconded Commissioner Mallard, the Court voted unanimously to the request and authorized the expenditure of 23.00 to replace the laser printer. The next matter before the Court was a proposal from C ~rke and Wyndham Real Estate Investment Services for B azos County to allow Smiling Mallard Development, Ltd. t resurface the southernmost 1,800 feet of Arrington R ad in Precinct 1. The development company proposed to r surface the road at no expense to the county and will intain it for two (2) years. Richard Vance, County E 'ineer, stated that he had reviewed the proposal and o fered the following comment: It is explicitly understood that following the two (2) years of private maintenance, Brazos County may not continue to maintain said 1,800 feet as a paved surface due to the existing right-of-way and drainage being substandard. County Judge a) He spoke with the Tax Assessor- Collector and the Court will have the information on the tax freeze by the end of the week. There was no citizen input and/or concerns. Under Agency/Board/Committee reports by Court members, e following spoke: Commissioner Mallard a) At the Intergovernmental Committee meeting this he reported on a trip to Washington DC to discuss legislative issues. Commissioner Caldwell a) Also discussed was the noise ordinance from the Police Department. He is aware that communications equipment still is not synchronized between departments. That is being worked on. County Judge a) Bryan and Brazos County failed to qualify as a disaster area without insurance following the recent tornado. 36 homes were affected with 4 ol Page /0/ C nmissioners Court meeting May 18, 2004 9 being destroyed in Bryan. College Station had much less damage. Neither Bryan/College Station or Hearne will get federal assistance, however we are continuing to work on other efforts and avenues of assistance. b) He was very impressed with the drainage system in Bryan/College Station. Considering all the rain we got, it drained very quickly and most roads were clear. c) He discussed current legislation and meetings on capping government for school funding. Although SMD had hoped that Brazos would participate in the costs of said improvements on Arrington Road that is ~f the boundaries of VIL, SMD is prepared to absorb the costs associated with rfacing. These costs include the material and labor for the regrading, material nd drainage ditch work.
