B~ C¢ Bz A~ pz c~ s~ COMMISSIONERS' COURT REGULAR MEETING APRIL 13, 2004 A regular meeting of the Commissioners' Court of zos County, Texas was held in the Brazos County missioners Courtroom in the Courthouse in Bryan, ~zos County, Texas, beginning at 9:00 a.m. on Tuesday, 13, 2004 with the following members of the Court Isent: Randy Sims, County Judge, Presiding; Eric Caldwell, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk, Absent. The attached sheet contains the names of the ~izens and officials that were in attendance. Commissioner Caldwell gave the invocation and led pledge of allegiance. Under citizen input/and or concerns the following ~ke: Demetrios Basdekas - complained that it was taking too long to get an answer to a public records request. He once again asked for copies of items #15 and #16 from the February 24th agenda. He said he had received copies of the guidelines for tax abatements adopted by Brazos County. He then stated that although allowed by the legislature, tax abatements should not always be approved. He continued by saying that he didn't feel the county met its own guidelines when approving the Kent Moore Cabinets tax abatement. Finally he said that he didn't feel all his questions were answered in the open records request. The Court next considered Budget Amendment #03/04- 1 through 25.2, which would reallocate funds for the ~asurer's office and the Tax office. On motion by missioner Cauley, seconded by Commissioner Peters, the irt voted unanimously to approve the budget amendment submitted, a copy of which is attached. The Court proceeded to consider the change of status employees as submitted on the attached Personnel ion Requests. On motion by Commissioner Cauley, onded by Commissioner Peters, the Court voted ~nimously to approve the changes as submitted. The Court next considered the following Claims as .%mitted by the County Treasurer for payment: 20061823 through 20062021 Missioner Peters moved to approve the claims as )mitted. Commissioner Mallard seconded the motion. Commissioner Mallard seconded the motion and Court voted unanimously to approve the Claims and vel advances. The Court then voted on the original ion. It passed unanimously. The County Judge read aloud Proclamation %04-008 ignating April 24th as "Arbor Day". The Court joins h Brazos Beautiful along with the cities of Bryan and .lege Station to encourage the planting of trees in .s state in order to reduce erosion, clean the air, >vide habitat for wildlife etc. On motion by missioner Cauley, seconded by Commissioner Peters, the Irt moved to proclaim April 24th as "Arbor Day" ~oughout Brazos County. The County Judge then ~sented the signed Proclamation to Ms. Laura Tankersley inn, representing Brazos Beautiful. On motion by Commissioner Peters, seconded by missioner Caldwell, the Court voted unanimously to ~+pt Resolution %04-004 accepting responsibility for 10 ~cent of the cost of right-of-way acquisition for the rovement of State Highway 21 from Democrat Road to the rasota River. The Resolution will be forwarded to the :as Department of Transportation. Brazos County .1 contribute approximately $233,7000.00, which >resents ten percent (10%) of the estimated cost of ht-of-way acquisition. On motion by Commissioner ley, seconded by Commissioner Peters, the Court voted nimously to approve the Agreement. TxDOT will acquire right-of-way. A copy is attached. The Court next considered a request for approval of of state travel for Commissioner Mallard to travel to hington, D.C. with the Chamber of Commerce on a [islative visit from May 3 through May 6, 2004.
