10. Appointment of Ms. Christine Stanley and Dr. Marcia DeAvila to the Child Welfare
Board. Ms. Stanley is an Assistant Professor in the Department of Educational
Administration at Texas A&M. Dr. DeAvila is a Laming Facilitator with the Bryan
Independent School District. Both are residents of Brazos County.
11. Acknowledgement of the resignation of Mary Lou Dizerega from the Child Welfare
Board. Her resignation was effective 22 April 2003.

REGULAR MEETING
JULY 1, 2003
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos County Commissioners
Courtroom in the Courthouse in Bryan, Brazos County, Texas,
beginning at 9:00 a.m. on Tuesday, July 1, 2003 with the
following members of the Court present:
Randy Sims, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk, Absent.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Peters gave the invocation and led the
pledge of allegiance.
Under citizen input/and or concerns, the County Judge
announced that because of the 4th of July holiday, the deadline
will be tomorrow for submitting items for inclusion on the
next agenda.
The first matter before the Court was the Renewal of
Contract with Texas A&M University for pre-employment testing
of Sheriff's office applicants. The cost to conduct pre-
employment screenings has increased from $190.00 to $210.00

but the remainder of the contract remains the same. On motion
by Commissioner Cauley, seconded by Commissioner Peters, the
Court voted unanimously to renew the contract. A copy is
attached.
The next matter for consideration was a request from Joe
and Harriet Wills for a waiver of property tax penalties and
interest in the amount of $74.35. On motion by Commissioner
Jones, seconded by Commissioner Peters, the Court voted
unanimously to waive the penalties and interest in the amount
of $74.35.
On motion by Commissioner Mallard, seconded by
Commissioner Cauley, the Court voted unanimously to authorize
the County Judge to execute a Tax Resale Deed to the following
individuals:
Ruby Faye Baker and Julia Carter Coleman - Lot 4,
McQueen Addition, City of Bryan, Brazos County,
Texas.
The Court next considered a request by the Information
Technology Department for approval of consulting services to
be provided by Michael J. Pappafotis for the County Road and
Bridge Department, the Health Department Immunization System
and the CJIS Electronic Disposition Reporting to DPS. Cost is
$5,100.00. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve

The Court considered a second request from the
Information Technology Department. This was to approve
funding for 11 hours of Voter System enhancements. The
Software Group will provide the work at a cost of $1,265.00.
Commissioner Cauley moved to approve. Commissioner Mallard
seconded the motion. The Director of the Information
Technology Department noted that this did not need the Court's
approval because the enhancements can be done under hours
granted at no cost. On motion by Commissioner Cauley,
seconded by Commissioner Peters, the Court voted unanimously
to withdraw the motion and second and remove this from the
agenda.
The next matter before the Court was a third request from
the Information Technology Department to replace a printer
located in the Tax Assessor's office. On motion by
Commissioner Cauley, seconded by Commissioner Peters, the
Court voted unanimously to replace the printer at a cost of
$1,250.00.
The next matter before the Court was appointment cf Ms.
Christine Stanley and Dr. Marcia DeAvila to the Child Welfare
Board. On motion by the County Judge, seconded by
Commissioner Cauley, the Court voted unanimously to remove

The Court next considered the resignation of Mary Lou
Dizerega from the Child Welfare Board. On motion by the
County Judge, seconded by Commissioner Peters, the Court voted
unanimously to accept the resignation.
The Court proceeded to consider the following blanket
Purchase Order:
Bryan Radiology Health Department $2,000
On motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the Blanket
Purchase Order as submitted.
The Court next considered Budget Amendment #02/03-32.1
through 32.3, which would reallocate funds for Justice of the
Peace, Precinct 2 Place 1 and transfer funds from Contingency
to Building Maintenance and Eire Protection Division. On
motion by Commissioner Jones, seconded by Commissioner Peters,
the Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Jones, seconded by Commissioner
Cauley , the Court voted unanimously to approve the Claims as
submitted.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Peters, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the changes as submitted.
The Court next considered acceptance of a Warranty Deed
for right-of-way on I&GN Road in Precinct 1. On motion by
Commissioner Jones, seconded by Commissioner Cauley, the Court
voted unanimously to authorize the County Judge to accept on
behalf of Brazos County a Warranty Deed from Deliah Culberson
Fleming for the expansion and improvements to I&GN Road.
The Court next considered acceptance of a Warranty Deed
for right-of-way on I&GN Road in Precinct 1. On motion by
Commissioner Jones, seconded by Commissioner Peters, the Court
voted unanimously to authorize the County Judge to accept on
behalf of Brazos County a Warranty Deed from Fletcher German,
Jr. for the expansion and improvements to I&GN Road.
The Court next considered acceptance of a Warranty Deed

1) The 16 foot Public Utility Easements
(PUE) along Edge School House Road and
OSR should be 20 feet PUE.
2) All brush and small trees are to be
removed from all Public Utility Easements
along OSR and Wheelock Hall Road.
On motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Final Plat
of Skubal Subdivision, 8.487 Acres, 1 Block, 5 Lots subject
to the developer complying with the exceptions noted by the
County Engineer.
The Court next considered approval of the Final Plat of
High Hill Estates, 57.906 Acres 1 Block, 8 Tracts in Precinct
2. Richard Vance, County Engineer, stated that he had
reviewed the plat and offered the following comments:
1) All brush and trees are to be removed
from the new right-of-way dedication
area.
2) Add brush and small trees are to be
removed from all Public Utility
Easements along Locke Road and Wheelock
Hall Road.
3) Show existing right-of-way widths on
Locke Road and Wheelock Hall Road.
4) Add detail to clarify right-of-way
dedication in curve near intersection of
Locke Road and Wheelock Hall Road.
On motion by Commissioner Peters, seconded by the County
Judge, the Court voted unanimously to approve the final plat

of High Hill Estates, 57.906 Acres 1 Block, 8 Tracts subject
to the developer complying with the exceptions noted by the
County Engineer.
The next matter for consideration was a request for use
of State Lateral Funds (560060-656800) for the reconstruction
of, Edge Cut Off Road from OSR southeast for approximately
6, 800 L.F. The site is in Precinct 2. The County Judge asked
what the balance of the fund was and the Engineer replied that
it was about $75,000. The Engineer then said they would use
nearly all of it for the project. On motion by Commissioner
Peters, seconded by Commissioner Jones, the Court voted
unanimously to approve the request.
The Court next considered the request from Wickson Creek
Special Utility District to construct a road bore for
waterline installation in the right-of-way of Wheelock Hall
Road approximately 0.5 mile from its intersection with Locke
Road. The site is located in Precinct 2. The County Engineer
stated that all appeared to be in order and recommended
approval. On motion by Commissioner Peters, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the request from Wickson Creek Special Utility District and
authorized the installation. A copy of the request_ is
attached hereto.

The Court next considered approval of the Final Plat of

of Called 85.89 Acres in Precinct 2. Richard Vance, County
Engineer, stated that he had reviewed the plat and offered
the following comments:
1) All brush and trees shall be cleared from
all road rights-of-way and new right-of-way
dedication area along Carrabba Road.
2) All brush and small trees shall be cleared
from all Public Utility Easements along
roadways including Carrabba Road.
On motion by Commissioner Peters, seconded by Commissioner
Mallard, the Court voted unanimously to approve the final plat
of Skylark Springs Phase I, 18 Lots, 2 Blocks, 27.93 Acres
part of Called 85.89 Acres subject to the developer complying
with the exceptions noted by the County Engineer.
The Court acknowledged receipt of the Extension Service
reports for May 2003 and acknowledged receipt of reports from
the following County and Precinct Offices showing revenues
collected and remitted to the County Treasurer:

Under announcement of interest items and possible future
agenda topics the following spoke:
Commissioner Mallard
a) Said that there will be an Urban
Counties meeting July 9th and they will
have a roundtable discussion on budget
issues and ideas
Commissioner Jones
a) He will have a workshop soon on
facilities. The committee is working
on a timeline and funding for acquiring
facilities now.
Arlene Parchman, Director Community
Supervision
a) She sent out a memo concerning
legislature that affected her
department's insurance. She thought
it started September 2003, but found
out that it isn't until 2004. She
apologized to the Court.
Under Agency/Board/Committee reports by Court members,
the following spoke:
Commissioner Mallard
a) Went to the High Speed Rail meeting in
Washington D.C. last week. He saw 14
elected officials and feels like they got a
positive response. He testified on the
topic the second day. They are working on
a design from Killeen through this area to
Beaumont that is to begin running now. He
will soon have a listing of the things
accomplished in Washington D.C.

Agreement for Advisory and Consultative Services between Brazos County Office
of the Sheriff and the Psychology Clinic in the Department of Psychology at Texas
AQ.M University
This contract outlines an agreement between the Brazos County Office of the Sheriff
(henceforth referred to as Brazos County Sheriff) and tlie.clinical psychology program
in the Department of Psychology at Texas A&M University (henceforth referred to as
TAMU) regarding Advisory and Consultative Services between the two institutions. The
TAMU address for correspondence regarding services is TAMU Psychology Clinic, Department
of Psychology, Texas A&M University, 4235 TAMU, , Texas 77843-4235 (phone: 979-845-
8017; employer's I.D.#: 76-4000531; profession/ occupation: psychologist).
Brazos County Sheriff agrees to retain TAMU for a period of 12 months beginning October 1,
2003 and continuing until September 31, 2004 to furnish psychological evaluations of
Detention Officer or Deputy Sheriff candidates in accordance with regulations set forth in the
Texas Commission on Law Enforcement Officers Standards and Education. Specifically, each
evaluation will include: (a) a thorough clinical interview, (b) an appropriate global measure of
personality/psychosocial functioning, and (c) additional specific measure(s) of behavioral style
as indicated by other evaluation measures or referral questions posed by .
Fees and Reimbursement
Brazos County Sheriff agrees to pay and TAMU agrees to accept, as full compensation, the
sum of $210.00 per psychological evaluation. Payment will be based on the timely submission
of evaluation reports for the time period during which the referral for evaluation was made.
Evaluation Reports
TAMU, prior to receiving reimbursement under this Agreement, agrees to provide Brazos
County Sheriff with a copy of psychological evaluation reports generated on persons served
under this Agreement.
Financial Statements for Services Rendered
TAMU will provide Brazos County Sheriff a financial statement by the 10th day of each month
for services rendered during the previous month. Brazos County Sheriff agrees to pay TAMU
for services by the 8th working day of the month following receipt of the financial statement.
This contract may be subject to termination with 30-days notice for lack of timely
reimbursement.
Early Termination
This Agreement may be canceled upon 30 days written notice by either party. In the event
this Agreement is canceled, TAMU will be paid only for the time that services were actually
performed and when required evaluation reports are presented to Brazos County Sheriff
within three weeks of the cancellation of this Agreement.

Professional Liability and Credentials
Professional liability insurance provided to faculty supervisors and graduate students in clinical
psychology through the Department of Psychology will cover services provided through this
Agreement. TAMU agrees to provide the Brazes County Sheriff, if requested, with a copy of
current professional credentials and professional liability insurance applicable to acts,
omissions, or negligence in the course of performing services under this Agreement. TAMU
will not be held liable for information communicated in evaluation reports that may result in a
decision to dismiss or fail to hire an applicant. TAMU will not be held liable for misconduct,
poor job performance, or poor judgments made by officers following an evaluation TAMU
completes.
Additional Professional Issues
Students and faculty supervisors appointed by TAMU agree to comply with policies established
by the TAMU Psychology Clinic regarding code of ethics, confidentiality, and other issues
relevant to provision of consultative clinical services. This contract in no way obligates Brazos
County.Sheriff to rely exclusively on TAMU for the services described in this contract.
Renewals
Pending authorization from both Brazos County Sheriff and TAMU, this agreement may be
renegotiated for a specified period beginning October 1, 2004. Renewals of this agreement
may include an annual increase for services rendered.
Other Direct Costs
Regarding other direct costs, Brazos County Sheriff will pay the amount per completed
evaluation specified in the preceding section entitled "Fees and Reimbursement; the number
of evaluations will vary over the months in which this contract is in effect. Other direct costs
will be used by the TAMU Psychology Department for supplies, photo-reproduction, books,
journals, training tapes, software, equipment, professional dues, travel expenses, educational
development, and other directly related costs.

ITEM: Request from Wickson Creek Special Utility District to construct a road bore for
water line installation in the right of way of Wheelock Hall Road approximately 0.5 mile
from its intersection with Locke Road. Site is located in Precinct 2
SOURCE OF FUNDS: N/A
REQUIREMENTS:
A) No work will be permitted between front slope and/or back slope.
B) All installations shall be constructed in designated utility easements, if applicable. If no utility
easement exists, the installation(s) shall be 1) within 3-5' of and parallel to the right-of-way line
and/or 2) in the case of a road bore, perpendicular to the right-of-way line.
C) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county right-of-way.
D) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test
shall be conducted by an independent geotechnical testing firm; copies of all test results shall be
furnished to the office of the Brazos County Engineer.
E) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices forStreetsandHighways, published by the Texas Department of Transportation,
and all other State and Federal laws governing utility construction.

Formal notice is hereby given that (applicant) Wickson Creek special Utility District
proposes to place a (type) waterline within- across x the right-of-way of
(road) Wlieelock Hall Rd. in Brazos County, Texas as follows:

copies of the drawings attached to this notice.

1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that he, or his designated inspector, may
inspect the actual installation.
2. All damage to the roadways and rights-of-way will be repaired to their
original condition to the satisfaction of the County Engineer.
3. Brazos County reserves the right to require Applicant to relocate or
lower any such line at no cost to Brazos County, should same
become necessary due to widening or lowering, or other alteration of
the roadway or right-cf-way.
4, Brazos County will in noway be responsible for any damage which
might occur to any existing utility lines in the right-of-way.
5. The line will be constructed and maintained on the County right-of-way in
accordance with the Utility Accommodation Policy which was adopted by the
Texas Department of Transportation on May 29, 1989.
6. The line or lines will be constructed no less than twenty-four inches (24")
lower than the lowest part of the drainage or bar ditch and the drainage is tc
be considered at least two feet (2') below the center of the roadway,
