REGULAR MEETING
JUNE 24, 2003
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos County Commissioners
Courtroom in the Courthouse in Bryan, Brazos County, Texas,
beginning at 9:00 a.m. on Tuesday, June 24, 2003 with the
following members of the Court present:
Randy Sims, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3, Absent;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Jones gave the invocation and led the pledge
of allegiance.
There was no citizen input/and or concerns
The first matter before the Court was an update on the
Expo Center, presented by Jim Singleton, Architect. He said
that he expected the permit from the Corps of Engineers to
begin construction to be issued by October. Commissioner
Jones asked why the delay when the original start date was
estimated to be in March of this year. Mr. Singleton
responded that it was the difference between a national permit

versus an individual permit. Originally were to get a
national permit but because the value of the property
increased we had to apply for an individual permit which takes
longer to obtain. Commissioner Jones asked for preliminary
costs or a budget. Mr. Singleton said the $18.5 mi'lion
dollars would pay for the first phase and that he would meet
with Commissioner Jones and discuss everything with him.
The next matter before the Court was a request by Judge
Ray Truelove to be reimbursed by the County for all out of
pocket medical expenses incurred as a result of his gastric
by-pass surgery. On motion by Commissioner Jones, seconded by
Commissioner Peters, the Court voted unanimously to take the
matter off the table and discuss it. The Court then
considered the original motion made by the County Judge and
seconded by Commissioner Mallard to deny payment. The County
Judge voted "Aye", and Commissioners Jones, Peters and Cauley
voted "Nay". The motion failed. Dr. Paul Roquet, physician
for Judge Truelove, spoke on his behalf. Commissioner Peters
then moved to remove this time from the agenda and direct the
county's third party administrator to accept and review the
claim in the amount of $26,150.00 based on updated medical
information provided by Judge Truelove as if it had been
properly submitted. The motion was seconded by Commissioner

Jones. Commissioners Jones, Peters and Cauley voted "Aye" and
the County Judge voted "Nay". The motion carried.
The next matter for consideration was the appointment of
Susan Gandy as a voting member of the Expo Committee. On
motion by the County Judge, seconded by Commissioner Cauley,
the Court voted unanimously to appoint Susan Gandy as a voting
member of the Expo Committee.
The Court next considered adopting a Resolutior
authorizing the County Judge to make application to the U. S.
Department of Justice for a grant to support the State
Criminal Alien Assistance Program that is administered by the
Sheriff's office. On motion by Commissioner Jones, seconded
by Commissioner Cauley, the Court voted unanimously to
authorize the County Judge to make application on behalf of
Brazos County to the U. S. Department of Justice and accept on
behalf of Brazos County such grant funds as may be tendered.
A copy is attached.
The Court next considered a request from Constable
Precinct 2, Donald Lampo, to appoint William J. Vanadore III
as unpaid Reserve Deputy Constable. On motion by Commissioner
Peters, seconded by Commissioner Cauley, the Court voted
unanimously to approve the request from Constable Lampo to
appoint William J. Vanadore III as unpaid Reserve Deputy

Constable subject to appointment being within the allotted
number of deputies.
The next matter before the Court was approval of the FY
03 Title IV-E Legal Services Contract, Plan Change FY 03-01,
Contract No. 7990003. On motion by Commissioner Peters,
seconded by Commissioner Cauley, the Court voted unanimously
to change FY 03 contract number from 7990003 to 2003074030.
A copy is attached.
The Court proceeded to consider the recommendation of the
Brazos County Community Healthcare Endowment Fund to fund the
following agencies for fiscal year 2003-2004:
a) Family Practice Foundation of the Brazos
Valley, Inc. $19,000
b) Girl scouts - Blue Bonnet Council $3,500
c) Health for All, Inc. $7,500
d) Hospice Brazos Valley $62,000
e) St. Joseph Regional Health Center
$18,000
On motion by the County Judge, seconded by Commissioners
Jones, Peters and Cauley the Court voted unanimously to accept
the recommendation of the Brazos County Community Healthcare
Endowment Fund to fund the previously named agencies for
fiscal year 2003-2004.
The Court next considered an Order relocating a temporary
early voting polling Place. On motion by Commissioner Jones,
seconded by Commissioner Cauley, the Court voted unanimously

to adopt the Order relocating a temporary early voting polling
place from the College Station Independent School District
offices to the Utility Customer Service Center in College
Station. A copy of the Order is attached.
The next matter was a request for an additional $27,000
in building maintenance account 650500 to finish this year's
maintenance. On motion by the County Judge, seconded by
Commissioners Jones and Cauley, the Court voted unanimously to
fund the additional $27,000 from contingency.
The Court next considered a request from the Purchasing

The Court next considered awarding the following bid:

Pat Howard, Purchasing Agent, recommended
acceptance of the bid submitted by Quick
Delivery. This excludes paper and small
furniture. On motion by Commissioner
Jones, seconded by Commissioner Peters,
the Court voted unanimously to accept the
recommendation of the Purchasing Agent
and award the contract to Quick Delivery.

On motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The Court next considered Budget Amendment #02/03-31.1,
which would transfer funds from Contingency to Constable,
Precinct 2. On motion by Commissioner Peters, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is
attached.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Jones, seconded by Commissioner
Peters, the Court voted unanimously to approve the Claims as

submitted. It was noted for the record that claims 20043164
through 20043184 were not included because they did not
require Commissioners Court approval.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve
the changes as submitted.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Judson E. Loupot
on Valley Circle in Precinct 1 to remove a cattle guard from
the existing driveway and installing a culvert pipe in the
existing ditch line. On motion by Commissioner Jones,
seconded by Commissioner Peters, the Court voted unanimously
to authorize the work.
The Court next considered approval of the Re-Plat of Lot
14, Block 1 of Wixon Oaks Subdivision in Precinct 2. Richard
Vance, County Engineer, stated that he had reviewed the plat
and all seemed in order. On motion by Commissioner Peters,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the Re-Plat of Lot 14, Block 1 of Wixon Oaks

Subdivision.

The Court next considered approval of the Re-Plat of Lot
9R, block 1, Vacating & Subdivision Plats of Lots 3 through
8, Block 1 of Deerfield Estates #1 in Precinct 3. Richard
Vance, County Engineer, stated that he had reviewed the plat
and all appeared to be in order. On motion by Commissioner
Jones, seconded by Commissioner Peters, the Court voted
unanimously to approve the Re-Plat of Lot 9R, block 1,
Vacating & Subdivision Plats of Lots 3 through 8, Block 1 of
Deerfield Estates 41.
The Court next considered setting the date and time for a
Public Hearing to consider setting speed limits on Lloyd Lane
in Precinct 2. On motion by Commissioner Peters, seconded by
the County Judge, the Court voted unanimously to set the
hearing for 7:00 p.m., Tuesday, July 15, 2003 at the Brazos
Center.
Under announcement of interest items and possible future
agenda topics the following spoke:
County Judge
a) Asked the Director of Emergency Management
to order foam for the rural fire departments
and have the invoice paid from the Road and
Bridge budget. The foam is to be delivered
to the Road and Bridge department. It comes
in 5 gallon containers at a cost of $17.00
each.

a) He is working on the Facilities Committee
meetings and will ask for a workshop when
ready with a recommendation.
Under Agency/Board/Committee reports by Court members,
the following spoke:
County Judge
a) At one time the Commissioners Court and the
EDC/Research Valley Partnership offered Koch
an incentive package for tax abatement.
Koch never complied with the conditions.
Koch forwarded a check for reimbursement of
taxes owed and cash incentives.
b) It appears that Continental will soon cease
to fly jets into Easterwood Airport in
College Station. He is working with the
Research Valley Partnership to keep them
here.
There was no citizen input and/or concerns.
There being no further business to come before the Court,
the meeting was adjourned.

Plan Change 03-01 /Correction to FY 03 Contract Number
Effective Date: May 7, 2003
The Department of Protective and Regulatory Services (PRS) and Commissioners Court of Brazos
County entered into a new contract effective September 1, 2002. The purpose of this plan change is
to correct the contract number for your FY 03 contract. The Title IV-E contracts were reprocured in
September 2002, which resulted in a new contract boilerplate and required a new contract number.
Your contract with number 7990003 ended on 8/31/2002 and the correct contract number issued for
FY 03 is 2003074030.
The Department and Contractor agree to Plan Change FY 03-01, effective May 7, 2003, affecting
FY 03 contract as follows:
• Change FY 03 contract number from 7990003 to 2003074030
The attached contract page is incorporated into this plan change for all purposes, reflect the changes
affected by this plan change for the contract period September 1, 2002 through August 31, 2003,
and supersede those attachments to the contract and any amendments, for the contract period
covered by this plan change.

Title IV-L County Legal Services Contract
Contract 2003074030
1. Parties. The Texas Department of Protective and Regulatory Services (PRS), hereinafter referred to as the
Department, and Commissioners' Court of Brazos County (a subdivision of the State of Texac), hereinafter
r Erred to as the Contractor, do hereby make and enter into this contract, which, i•::getber with its incorporated
documents constitutes the entire agreement under the above referenced contract number between the Departs-Zit
and the Confraci:lr. The Department and the Contractor make this contract for the following nrutaal
cccsiderations.
II. Authority to Contract. The Department is authorized to enter into this contract under Human Resources Code
Chapter 40. Pursuant to 40.0566 and 40.058, this contract is not subject to Chapter 771 or 791 of the
Government Code.
III. Governing Law. This contract shall be governed by and construed in accordance with the laws of the State of
Texas. Unless otherwise mutually agreed, venue will be in State District Court, Travis County, Texas. Resulting
payments shall be due and payable in Travis County, Texas.
IV. Contract Elements. Ibis contract between the parties and any successor or permitted assignee consists of the
signed written contract and all instruments incorporated by reference which are the documents listed in Section XI
of this contract. The contract includes all elements in this document and in the attachments. The Cost Allocation
Plan is a required attachment. This contract may be amended only in writing and by mutual agreement.
V. Financial Limitations and Considerations.
A. Funds Availability. This contract is at all times contingent upon the availability and receipt of federal funds
that the Department has allocated to this contract; and if funds for this contract become unavailable during any
budget period, this contract may be immediately terminated or reduced at the discretion of the Department.
B. Amount of Payment. The Department agrees to pay the Contractor from available federal funds for services
rendered in accordance with the terms of this contract upon receipt of a proper and verified statement and after
deducting any known previous overpayment made by the Department. If project income accrues, the
Contractor shall add the program income to funds committed to the contract services and shall use them to
further eligible IV-E objectives, or the Contractor shall deduct program income from the total allowable costs
in determining the net allowable costs on which the Federal share of costs is based.
C. Basis for Payment. The basis for payment for services rendered under this contract is indicated in the service
terms with the Cost Allocation Plan. The Contractor agrees to this basis for payment and to adhere to the fiscal
and billing policies and procedures of the Department. The Department is not obligated to pay unauthorized
costs or to pay more than the Contractor's allowable and actually incurred costs consistent with federal and
state regulations. The Contractor is responsible for submitting bills in an accurate and timely manner for each
quarter by the end of the following quarter and for notifying the Department of any need to expedite payment.
If the quarterly bills for the county average or are expected to average less than $1,000 per quarter, the County
may request, and the Contract Manager for the Department may grant written permission to submit bills on an
annual basis with the bill for each quarter submitted and documented separately but at the same time before the
end of the first quarter of the following fiscal year. The Department will make reasonable efforts to process all
bills received in an accurate and timely manner but does not warrant immediate payment.
D. The Contractor understands and agrees that:
1. The reimbursement made to the Contractor shall not exceed the Contractor's actual costs to provide the
services under this contract and that the Contractor's actual costs, both direct and indirect, must be
allowable, reasonable and allocable to Subtitle IV-E of the Social Security Act according to the Office of
Management and Budget Circulars A-87 and A-110, 40 TAC §§732.240-256 and any other applicable
Department regulations.

ORDER RELOCATING TiA4PORARY EARLY VOTING POLLING PLACE
WHEREAS, the Commissioners Court of Brazos County, Texas has established
four temporary early voting polling places in various locations in Brazos County; and
WHEREAS, the Commissioners Court is desirous to comply with section
85.062(d)(2) of the Texas Election Code which requires locating one temporary branch
early voting polling place in each Commissioner Precinct; and
WHEREAS, the Commissioner Court of Brazos County, Texas has been advised
by the College Station Independent School District School Board, that the current early
voting polling place, the College Station Independent School Administration Building,
will no longer be available for the use as a temporary early voting polling place; and
WHEREAS, the Commissioners Court is desirous of relocating the temporary
branch early voting polling place from the College Station Independent School
Administration Building located at 1812 Welch Street, College Station, Texas to the
College Station Utility Customer Service Center located at 310 Krenek Tap Road,
College Station, Texas, for the convenience of the voters;
NOW THEREFORE, BE IT RESOLVED BY THE COMNIISSIONERS COURT
OF BRAZOS COUNTY, TEXAS, THAT:
Pursuant to section 85.062(d)(2) of the Texas Election Code that one temporary
branch early voting polling place be established in each Commissioner Precinct in Brazos
County; and

Division, Voting Section, Department of Justice, Washington D.C. requesting the
preclearance of this Order pursuant to Section 5 of the Federal Voting Rights Act.

On this the 24' day of June 2003 at a regular meeting of the Commissioners' Court, the following
members were present:
Randy Sims, County Judge, Presiding
Tony Jones, Commissioner, Precinct 1;
E. Duane Peters, Commissioner, Precinct 2;
G. Kenny Mallard, Commissioner, Precinct 3;
Carey Cauley, Jr., Commissioner, Precinct 4;

The fallowing proceedings were held:
THAT WHEREAS, on June 24, 2003 the Court heard and approved a budget amendment for the
2002-2003 budget year for Brazos County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to meet unusual and unforeseen
conditions which could not be reasonably included in the original budget adopted August 23, 2002 the
following amendment(s) to the original are hereby authorized, as described on the attached page(s).
