To make arrangements, call (979) 361-4102. . r ~~I COMMISSIONERS' COURT REGULAR MEETING MAY 20, 2003 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in Room 102 of the Brazos Center in Bryan, Brazos County, Texas, beginning at 6:30 p.m. on Tuesday, May 20, 2003 with the following members of the Court present: Randy Sims, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. The County Judge gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns The Court next considered approval of the minutes of the Commissioners' Court meetings held in March 2003 on the following dates: Regular Meetings - 4th, 11th, 18th and 25th Workshop Meeting - 4th On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the minutes as VOL 43 PAGE ala Commissioners Court meeting May 20, 2003 2 submitted. The Court next considered Budget Amendment #02/03-27.1, that would reallocate funds for the County Judge's department. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached. The Court next considered the following Claims as submitted by the County Treasurer for payment: 20042233 through 20042426 On motion by Commissioner Peters, seconded by Commissioner Jones, the Court voted unanimously to approve the Claims as submitted. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Cauley, seconded by Commissioner Mallard, the Court voted unanimously to approve the changes as submitted. The Court next considered approval of the FEMA Grant Application for Enhancement of Emergency Operation Center (EOC) for Brazos County Emergency Management. They are asking for a $100,000 grant to enlarge the existing EOC as mandated by the state plan. This is a 75o-25o match and any enhancement previously done after September 11, VOL q 3 PAGE D,13 Commissioners' Court meeting May 20, 2003 3 2001 will be considered an in-kind match. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the application and to accept any grants funds as may be tendered. The next matter before the Court was approval of the Title IV-E Child Welfare Services Contract Plan Change FY 03-01, Contract No. 70000001. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to approve the change FY 03 contract number from 70000001 to 200374031. The Court next considered approval of a Resolution calling for county officials to urge state legislators to seek statewide solution to the budget crisis. On motion by the County Judge, seconded by Commissioner Mallard, the Court voted unanimously to adopt the Resolution encouraging the Texas Legislature to seek a state-wide solution to the budget crisis instead of passing the burden to counties and their ad valorem taxpayers. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of 0. G. Tobias on Steep Hollow Road in Precinct VOL y 3 PAGE a14 Commissioners' Court meeting May 20, 2003 4 2 to clear out an existing fence line of brush for sight distance at curve in roadway. On motion by Commissioner Peters, seconded by Commissioner Jones, the Court voted unanimously to authorize the work. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Mitchell Keith on Old Bundick Road in Precinct 2 to remove an existing cattle guard to install one 18 inch x 24 foot culvert metal pipe at the driveway in the county right-of-way. On motion by Commissioner Peters, seconded by Commissioner Jones, the Court voted unanimously to authorize the work. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Ambrosio R. Alderete on Zweifel Road in Precinct 2 to construct a drainage channel across private property to drain water from Zweifel Road. On motion by Commissioner Peters, seconded by Commissioner Jones, the Court voted unanimously to authorize the work. VOL H-3 PAGE X15 Commissioners' Court meeting May 20, 2003 The Court next considered the request from Wickson Creek Special Utility District to construct a road bore for waterline installation in the right-of-way of Dilly Shaw Tap Road. The site is located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the request from Wickson Creek Special Utility District and authorized the installation. A copy of the request is attached hereto. The Court acknowledged receipt of, approve and order filed as submitted the Treasurer's Investment Report for quarter ending March 31, 2003. A copy of which is attached to and made a part of these minutes. 5 Under announcement of interest items and possible future agenda topics the following spoke: County Judge a) Said he will have an agenda item next week on the Request for Proposal on Health Care. Commissioner Jones a) Reminded the Court that he will be out the next two weeks. He will have something on the agenda soon concerning Patterson Architects and the County Court at law IT Courtroom. The Court needs to decide on where to put the IT department so that they move only one time. Demerle Giordano a) Informed the Court that the drought index is climbing and that the Court will need to decide on a fireworks ban for July 4`h 6 Under Agency/Board/Committee reports by Court members, the following spoke: Commissioner Mallard a) The Depository Committee met on Thursday at 2:00 p.m. and will continue to meet until a decision is made. He hopes to have something on the agenda before the end of May. Under citizen input and/or concerns, the following spoke: Demetrios Basdekas a) Noticed that attendance was low at the evening meetings. He asked if the Court intended to stick with the evening meetings. The County Judge said that yes they would continue with the evening meetings. Operations, Finance and Public Information. The grant award will go to the construction of additional space. This additional space will enlarge the EOC to support the functions of Logistics/Finance and Kvining. This will also allow us to have a single county-wide EOC during activation, thus eliminating duplication of resource management. This will also allow us the necessary support personnel, policy makers and other volunteer agencies to track all aspects of EOC operations. Increasing our existing EOC to accommodate the Incident Command System and necessary personnel, will require the construction of new walls, installation of new electrical outlets and telecommunications jacks, cabling, acoustical ceiling tiles, new HVAC ducting, and paint for the new walls. Anticipated footage is 1000 square feet. The modifications to the EOC will support secure communications equipment. The equipment requested to make our communications redundant such as conferencing bridges, video- conferencing equipment and ring down telephone notification systems, some of which is to be purchased with in-kind funding. Hot or Red lines are to be installed to connect the jurisdictions for those not inside the EOC. Additional equipment for operational support will be a small copier and fax machine. Once awarded, timeline will be established with grant protocol. Matching funding of 25% will be in-kind labor, materials, and equipment. The Brazos County Investment portfolio earned an average yield of 1.3553% on funds invested with TexPool for the quarter ending 03/31/2003. Investment interest deposited during the quarter was $58,448.75. Year to date invested funds interest was $129,987.44. The average Earnings Credit Rate on checking account interest during the past quarter was 1.66% netting $100,441.09 of interest earned for the quarter. Year to date checking account interest was $181,886.09. The total of interest earned year to date was $311,873.53. The weighted average maturity of the invested funds was 1 day due to the liquidity of funds invested with TexPool. Brazos County had an investment balance of $17,524,947.65 that carried a book value and market value of the same amount because all funds invested with TexPool carry a share price of $1.00 for all participants. The March 2003 TexPool Participant Statement provided confirmation of market value and shares owned at quarter end. According to a number of financial market commentaries, the economy could be headed for another recession. The war with Iraq, the deteriorating job market, higher inflation, and slow growth have all contributed to the "disappointing" economy. The 1.4 percent of growth in the 4'" quarter of last year combined with the 1.6 percent annual growth rate in the first three months of this year produced the slowest 6 months of growth since the last half of 2001. Some economists feel that "continued economic weakness could slow price increases even further, and test the Fed's desire to hold inflation at current levels." The 90-day U.S. Treasury bill (secondary market) averaged 1.13% for the month of March. 90-day financial Commercial Paper averaged 1.21% and 3-month Certificate of Deposits averaged 1.23%. Through investments with TexPool and by leaving as much cash as possible on deposit with the County depository bank, the Brazos County portfolio, at an average of 1.51%, has earned slightly more interest than possible with other short-term investments. With little hope of an economic rebound in the near future, Brazos County will continue to invest with TexPool and utilize the County depository bank as safe, liquid refuge for investment funds.
