THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON
TUESDAY, MAY 13, 2003 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF

COMMISSIONERS' COURT
REGULAR MEETING
MAY 13, 2003
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos County Commissioners
Courtroom in the Courthouse in Bryan, Brazos County, Texas,
beginning at 9:00 a.m. on Tuesday, May 13, 2003 with the
following members of the Court present:
Randy Sims, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3, Absent;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Cauley gave the invocation and led the
pledge of allegiance.
There was no citizen input/and or concerns
The first matter was a presentation by Lori Hunnicutt,
representative of the Texas Association of Counties. Ms.
Hunnicutt presented the County with the Gold Star Safety
Award. This is a prestigious award for counties with the
highest degree of safety and success.

The Court next considered Budget Amendment #02/03-26.-
that would transfer funds from Contingency to the offices o'
Justice of the Peace, Precincts 1,2-2 & 3 and Constable
Precincts 1 & 3. On motion by Commissioner Cauley, seconded
by Commissioner Jones, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is
attached.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
20041991 through 20042232
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve
the changes as submitted.
The Court next considered authorizing County Employees to
participate in the 2003 Health & Safety Expo on Thursday, June
5, 2003. On motion by the County Judge, seconded by
Commissioner Cauley, the Court voted unanimously to authorize
County employees to attend the Health & Safety Expo.

The Court next considered appointments to the
Facilities Committee. On motion by the County Judge,
seconded by Commissioner Peters, the Court voted unanimously
to appoint the following individuals to the committee:
1. Carlos Guitron, Building Maintenance
2. Sheriff Chris Kirk
3. Commissioner Tony Jones
4. Ernie Laney, Information Technology
5. Arlene Parchman, Community Supervision
6. Justice of the Peace, Pct. 1 Charlie Ellis
7. County Court at Law II Judge Jim Locke
The next matter for consideration was the approval for
Application of Service for the DS1 Frame Relay Circuits for
Justice of the Peace Precinct 2-2. On motion by Commissioner
Cauley, seconded by Commissioner Peters, the Court voted
unanimously to approve the Application for Service. The
cost is $465.00 per month and a one time set up fee of
$281.50.
The Court proceeded to consider approval to rescind the
following RFP's:
a) RFP 2003-020 - purchase of Finance/Human
Resource Server
b) RFP 2003-022 - county data backup system
On motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to rescind the two
RFP's.
The next matter for consideration was the cancellation of
Commissioners Court on June 10, 2003. On motion by

Commissioner Peters, seconded by Commissioner Cauley, the
Court voted unanimously to cancel the June 10th meeting. The
Court members will be attending the North and East Texas
Judges and Commissioners Conference in Waco.
The Court next considered establishing a date and time
for a Public Hearing to hear arguments for and against the
setting of speed limits on Greens Prairie Trail in Precinct 1.
On motion by the County Judge, seconded by Commissioner Jones,
the Court voted unanimously to hold the Public Hearing on May
27, 2003 at 10:00 a.m. in the Commissioners Courtroom.
The next matter for consideration was the extension and
renewal of Brazos County Property and Casualty Insurance. On
motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the extension
and renewal. St. Paul agrees to limit the rate increase to 6
percent while the County agrees not to bid the coverage.
The Court next considered a request by the Brazos
Heritage Society for funds to redesign and print the Historic
Brazos County brochure. On motion by the County Judge,
seconded by Commissioner Cauley, the Court voted unanimously
to fund the project in the amount of $5,000 that will come
from contingency funds.
The Court next considered authorizing work outside of

county rights-of-way for the health, safety and welfare of
the general public. The Road and Bridge Department requested
permission to enter the private property of E. T. Sikorski on
Opersteny Road in Precinct 2 to clear out an existing
drainage channel (east of Opersteny Road) to allow water to
drain from the culvert under the roadway. On motion by
Commissioner Peters, seconded by Commissioner Jones, the
Court voted unanimously to authorize the work.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of
the general public. The Road and Bridge Department requested
permission to enter the private property of Jane Moore on
Dilly Shaw Tap Road in Precinct 2 to construct a temporary
fence for new bridge construction work site. On motion by
Commissioner Peters, seconded by Commissioner Cauley, the
Court voted unanimously to authorize the work.
The Court next considered approval of the Final Plat of
Bearden Addition, 2.424 Acres located in Precinct 1. Richard
Vance, County Engineer, stated that he had reviewed the plat
and offered the following comments:
1) Add to General Notes: #10. All brush and
small trees shall be cleared from the public
utility easement (PUE) along North Dowling
Road.
On motion by Commissioner Jones, seconded by Commissioner

Peters, the Court voted unanimously to approve the final plat
of Bearden Addition, 2.424 Acres subject to the developer
complying with the exception noted by the County Engineer.
The Court next considered approval of the Re-Plat of
Lot 3, Block 4 (6.51 Acre Tract) of the Re-plat of All of
Fawn Lake Estates in Precinct 2. Richard Vance, County
Engineer, stated that he had reviewed the plat and all
appeared to be in order. on motion by Commissioner
Peters, seconded by Commissioner Cauley, the Court voted
unanimously to approve the Re-Plat of Lot 3, Block 4
(6.51 Acre Tract) of the Re-plat of All of Fawn Lake
Estates as submitted.
Under announcement of interest items and possible
future agenda topics the following spoke:
Commissioner Jones
a) Said there will be a joint meeting
with the cities of Bryan and College
Station next Monday at 6:30 p.m. at
the Brazos Center to discuss health
care.
Commissioner Cauley
a) Informed the Court that we had received
a grant for $250,000 for the
construction of sewers on 28th street.
The funds are a community block grant.

a) Reminded the Court of the meeting for
department heads to discuss weapons of
mass destruction.
Under Agency/board/Committee reports by Court
members the following spoke:
County Judge
a) Had a meeting concerning the airport. John
Happ, representative from TAMU made the
presentation. He said that it appears that
Easterwood Airport would not be moved.
There was no citizen input and/or concerns.
There being no further business to come before the Court,
the meeting was adjourned.

Commissioners' Court, the following members were present:

THAT WHEREAS, on May 13, 2003 the Court heard and approved a budget
amendment for the 2002-2003 budget year for Brazos County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to meet
unusual and unforeseen conditions which could not be reasonably included
in the original budget adopted August 23, 2002 the following amendment (s)
to the original are hereby authorized, as described on the attached
page(s).

Customer applies for and agrees to purchase from the undersigned Verizon operatL:g telephone corgpany the services identified below
and as further described in Verizon's applicable tariffs (the "Services"), for a minimum period of'ik L1 0 (t consecutive
months following execution of this Application and commencement of Services hereunder (the "Service Period"). The Services will
be provided subject to the terms and conditions of Verizon's applicable tariffs in effect during the Service Period (the "Tariffs"), which
are incorporated by this reference, and subject to the availability of suitable facilities.
If Customer terminates this Application or any Services prior to expiration of the Service Period, Customer will promptly pay to
Verizon any termination and cancellation charges specified in the Tariffs. The rates for the Services shall be as set forth in the Tariffs.
Customer shall also pay all applicable charges, fees, taxes and tariff surcharges, including federal End User Common Line Charges,
charged pursuant to applicable law, regulations or Tariffs.

The provision of any additional locations and/or quantities of Services will be subject to Verizon's applicable Tariffs. Verizon may
assign or transfer part or all of this Application to any of its affiliates. Upon reasonable prior written notice to Verizon and consistent
with applicable Tariff supersedure or other regulatory requirements, Customer may assign or transfer this Application to any company
that is the successor to substantially all of its assets. All other attempted assignments shall be void without the prior written consent of
the other party.
Upon signature below by both parties, this Application and the Tariffs constitute the entire agreement between Customer and Verizon
regarding the Services, and supersede all prior oral or written quotations, communications, understandings or agreements. In the event
of a conflict between the Tariffs and this Application, the Tariffs shall control. Each party represents that its execution of this
Application is based solely on its independent assessment of the rights and obligations set forth herein and not on any other oral or
written quotations, communications, understandings or agreements.

County will construct 100 feet of temporary fence approximately 75 feet from the existing
bridge on Dilly Shaw Tap Road. This area will be used as temporary work space during
the construction of the new bridge. A new 5-wire fence will be built on the original fence
line and the temporary fence will be removed.
