COMMISSIONERS' COURT REGULAR MEETING APRIL 1, 2003 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, April 1, 2003 with the following members of the Court present: Randy Sims, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4, Absent; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Peters gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns The Court first heard a presentation by Rabon Metcalf Engineering concerning the intent, requirements and processes of the Storm Water Management Plan. A Public Meeting will need to be held to hear input from county residents. There is a website and there will be information packets put together for the public. VOL PAGE 55 Commissioners Court meeting April I, 2003 2 The Court next considered Budget Amendment #02/03-20.1 through 20.2, which would reallocate funds for the Brazos Center, and transfer funds from Contingency to County Welfare. On motion by Commissioner Jones, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached. The Court next considered the following Claims as submitted by the County Treasurer for payment: 20040691 through 20040911 On motion by Commissioner Jones, seconded by Commissioner Mallard, the Court voted unanimously to approve the Claims as submitted. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Act! Requests. On motion by Commissioner Jones, seconded hti Commissioner Peters, the Court voted unanimously to apps ;e- the changes as submitted. The next matter for consideration was approval of an Interagency Agreement with the County of Madison for the filing of a joint grant application with the Criminal Justice Division of the Office of the Governor for funding for the Brazos Valley Narcotics Task Force. On motion by Commissioner Mallard, seconded by Commissioner Peters, the Court voted VOL `F PAGE 56 Commissioners' Court meeting April 1, 2003 3 unanimously to approve the Interagency Agreement with the County of Madison and authorize the County Judge to accept such grant funds as may be awarded. The Court next considered appointment of individuals to serve on the Brazos Valley Council of Governments' Homeland Security Advisory Committee. On motion by the County Judge, seconded by Commissioner Peters, the Court voted unanimously to appoint the individuals named on the attached list. The next matter for consideration by the Court was a request submitted by the Jail Administrator seeking approval for out of state travel for Lt. David Drosche and Sgt. Jayson Lyday to travel to Caldwell, Idaho to extradite David Montoya Orta To Brazos County. The deputies will be gone April 7-8, 2003. On motion by commissioner Peters, seconded by Commissioner Jones, the Court voted unanimously to grant the request from the Jail Administrator and approved payment of out of state travel expense for the two deputies. The Court next considered a request from the Purchasing Department to use a room at the Brazos Center without charge for a meeting with local vendors. On motion by Commissioner Jones, seconded by Commissioner Peters, the Court voted unanimously to approve the request. The next matter for consideration was an application for VOL PAGE Z7 Commissioners' Court meeting April 1, 2003 4 service with Verizon to maintain the T-1 line from the Sandy Point Jail to the Courthouse. The basic fee is $694.00 per month. On motion by Commissioner Jones, seconded by Commissioner Peters, the Court voted unanimously to approve the application. The Court next considered approval of a requisition for Bid #2003-027 - Seal Coat Project. On motion by Commissione- Jones, seconded by Commissioner Mallard, the Coart enter unanimously to approve the requisition and stipulated t at i,. not exceed $415,000.00. The next matter for consideration was approval of a Maintenance Agreement with Ikon for the copy machine at the Juvenile Boot Camp. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the agreement. Cost will be $298.03. The Court proceeded to consider declaring certain county property as "salvage" and authorizing the destruction or disposal of this property. On motion by Commissioner Jones, seconded by Commissioner Peters, the Court voted unanimously to declare the attached list of property as "salvage" and authorized the destruction of disposal of the property. The Court next considered the request from Wickson Creek Special Utility District to construct a road bore for VOL q,~Z- PAGE 6-'9 Commissioners' Court meeting April 1, 2003 5 waterline installation in the right-of-way of Wallis Prairie Road approximately 100 feet from its intersection with Barnhill Lane. The site is located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Peters, seconded by Commissioner Jones, the Court voted unanimously to approve the request from Wickson Creek Special Utility District and authorized the installation. A copy of the request is attached hereto. The Court next considered the request from Patterson LP to construct a road bore for natural gas gathering pipeline installation in the right-of-way of Oak Lake Road approximately 6,700 feet east of FM 2038. The site is located in Precinct 2. Included with the request was a company check No. 1419 in the amount of $500.00. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the request by Patterson LP and authorized the installation. A copy of the request is attached hereto. The Court next considered approval of the Final Plat of North 974 Estates 9.984 Acres one block, 4 tracts in Precinct 2. On motion by commissioner Peters, seconded by Commissioner Jones, the Court voted unanimously to approve the final plat of the North 974 Estates as submitted. The Next matter before the Court was a presentation by the County Auditor of the Comprehensive Annual Financial Report. Demetrios Basdekas asked if this would be available on the county website. Katie Connor, Assistant Auditor said it would be on the site soon. Mr. Basdekas then asked the County Judge for information on the "state of the county'' Under announcement of interest items and possible future agenda topics the following spoke: Commissioner Jones a) Said that the Court needed to discuss why it would want to have a public hearing on Storm Water separate from the night meeting. The Court needs to decide on scheduling. County Judge a) On Tuesday, April 8th, the Extension Service will have a reception in the Commons Area of the Courthouse from 8:00 a.m. until 9:00 a.m. Susan Gandy a) Informed the Court that the new Director of Juvenile Services, Rhonda Gilchrist, was in the Courtroom. The County Judge welcomed her. WITNESSETH WHEREAS, Brazos County and Madison County wish to file a joint grant application with the Criminal Justice Division of the Office of the Governor, State of Texas, for funding in the amount of $650,000 for the Brazos Valley Narcotics Task Force, and WHEREAS, Brazos County and Madison County have agreed to contribute the total of $110,651 in matching funds if said joint application is approved; and WHEREAS, the source of funds would not normally be used for this purpose; and WHEREAS, Brazos County and Madison County believe it to be in their best interests to join in the application to develop a Narcotics Task Force; and WHEREAS, Brazos County and Madison County agree to each accept the responsibility to adhere to all pertinent federal state and local laws or regulations. NOW THEREFORE, IT IS HEREBY AGREED AS FOLLOWS: ARTICLE I PURPOSE 1.01 The purpose of this Agreement is to allow Brazos County and Madison County to file a joint application for a grant with the Criminal Justice Division, which continues the Brazos Valley Narcotics Task Force.
