To make arrangements, call (979) 3614102. 49, a1 COMMISSIONERS' COURT REGULAR MEETING MARCH 25, 2003 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, March 25, 2003 with the following members of the Court present: Randy Sims, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Jones gave the invocation and led the pledge of allegiance. The County Judge welcomed Commissioner Cauley back. Demetrios Basdekas welcomed Commissioner Cauley back also. He then proceeded to tell the County Judge how offensive it is that he is purposely mispronouncing his name even after having been corrected. He said that the County Judge was trying to affect his freedom of speech. The County Judge read aloud a Proclamation designating Vol L4 ~k Page Z Commissioners' Court meeting March 25, 2003 1 the week of April 7 through 13, 2003 as "Public Health Week". The Court encourages the citizens of Brazos County to recognize the need for a more healthful lifestyle and essential role that public health plays in their everyday lives. On motion by the County Judge, seconded by Commissioners Jones, Peters, Mallard and Cauley the Court moved to proclaim the week of April 7 through 13, 2003 as "Public Health Week" throughout Brazos County. The County Judge then presented the signed Proclamation to Mr. Ken Bost, representing the local Health Department. The Court next considered Budget Amendment #02/03-19.1 through 19.2, which would reallocate funds for the County Attorney and transfer funds from Contingency to Community Support. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached. The Court next considered the following Claims as submitted by the County Treasurer for payment: 20040461 through 20040690 On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as submitted. Vol Page a `1 Commissioners' Court meeting March 25, 2003 3 The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Cauley, seconded by Commissioner Mallard, the Court voted unanimously to approve the changes as submitted. The next matter for consideration by the Court was a request submitted by the Constable Precinct 1, seeking approval for out of state travel for two deputies. Deputies Archie Clark and Ernest Ortiz would be traveling to Gulfport, Mississippi to attend the " 23rd Annual Convention/Training" seminar April 3~d through the 6th 2003. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to grant the request from the Constable, Precinct 1. Travel expenses will be paid by LEOSE. The Court next considered a request from Constable Precinct 3, Wayne Thompson, to appoint Hugh Wallace as unpaid Reserve Deputy Constable. On motion by Commissioner Mallard, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from Constable Thompson to appoint Hugh Wallace as unpaid Reserve Deputy Constable subject to appointment being within the allotted number of deputies. The next matter before the Court was the request for authorization for overtime for a county employee to be paid Vol 1 Page 30 Commissioners' Court meeting March 25, 2003 4 from the Brazos Center budget. On motion by Commissioner Peters, seconded by Commissioner Jones, the Court voted unanimously to authorize the payment of overtime to train for the Pavilion Operations Manager position. Funds will come from the Brazos Center budget. The next matter for consideration was the renewal of the Agreement for Extended Services for Software Support and Maintenance with Tiburon, Inc. for support of the Sheriff's Office's mobile computers. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to renew the Agreement for Extended Services for Software Support and Maintenance for the period of May 1, 2003 through April 30, 2004. The cost will be $1,195.00. A copy is attached. The Court next considered an application for service with Verizon to maintain the T-1 line from the Sandy Point Jail to the Courthouse. On motion by the County Judge, seconded by Commissioner Mallard, the Court voted unanimously to table for lack of information. The Court next considered an Exemption from Competitive Bidding Requirements of Local Government Code, Section 262.024(a)(4). This is for the purchase of professional services - Engineering from CME Testing and Engineering. On Vol 4 a Page 3 I Commissioners' Court meeting March 25, 2003 5 motion by Commissioner Jones, seconded by Commissioner Peters, the Court voted unanimously to approve the Exemption of Competitive Bidding Requirements for fiscal year 2002-2003. On motion by Commissioner Peters, seconded by Commissioner Jones, the Court voted unanimously to adopt the Resolution and approved the Request for Waiver of Local Match Fund Participation Requirement on the Federal Off-System Bridge Program Projects. The Court next considered approval of the re-submitted Final Plat of Green Meadows Estates, 35.46 acres in Precinct 2. This was necessitated by the reduction in number of Vol 4 I~k Page 3,~Z Commissioners' Court meeting March 25, 2003 6 subdivision lots and the relocation of access easement(s) to FM 974. Richard Vance, County Engineer, stated that he had reviewed the plat and recommended acceptance as submitted. On motion by Commissioner Peters, seconded by Commissioner Jones, the Court voted unanimously to approve the resubmission of the final plat of Green Meadows Estates as submitted. Tiburon reserves the right to charge an administrative fee of 10% of the annual maintenance fees for semi- annual or quarterly invoices. BASIC SERVICES TIBURON will provide basic services as defined in the Statement of Work contained in Section 2 of the Extended Service Agreement for the software systems as defined in Exhibit A. Support for Computer Aided Dispatch, Message Switch and Corrections Management Systems is 24 hours per day, 7 days per week. Support for other products is from 8:00 a.m. to 5:30 p.m. Central Time, excluding weekends and normal TIBURON holidays, unless the "24/7" Service Option is selected. In all cases, call-out charges will apply as described below. Tiburon personnel will visit CLIENT site periodically and meet with management, operations and other user personnel to conduct an operations review of the systems and an analysis of the CLIENT's automation requirements. A report will be produced to include observations and recommendations regarding the CLIENT's use of the system. Working with the CLIENT, this review will be further documented in the form of a multi-year automation plan for the CLIENT. There will be no charge for this service if total annual maintenance exceeds $20,000. The following is paraphrased from the recently adopted Bylaws. Voting membership in the Tiburon User Group, as set forth herein, is included in the Basic Service. The quantity of voting members is based on the number of Tiburon products installed, with the appropriate software licenses, at the CLIENT. For purposes of establishing voting memberships, a product is defined as Phoenix - Computer Aided Dispatch, Police Records Management, Fire Management Information System, Jail Management Information System, and Communication & Interfaces. The Tiburon User Group Conference is held annually at a location to be determined. "2417" SERVICE OPTION $7,000 per year/per system (initial) Products not normally covered by 24-hour support may optionally be supported with 24-hour coverage (including TIBURON holidays). Applicable call-out charges continue to apply. If this option is not in force, technical support requests outside of covered hours are charged at technical service rates as defined below. NEW PRODUCTS Additional TIBURON software systems, subsystems and TIBURON provided third-party products, such as hardware, and networking software may be acquired under this Agreement. TIBURON installation, special tailoring, license fees and third-party peripherals required shall be charged at the then current Technical Services Rate or as quoted by TIBURON or the third party. Technical Service Rates Technical Services Rates shall be invoiced to CLIENT as incurred at the rates then in effect. A minimum of four (4) hours per occurrence will be charged for work conducted at TIBURON facilities and a minimum of eight (8) hours at CLIENT site for Technical Services not covered under Basic Services or "24/7" Service Option as described previously. 2. Materials, Travel and Per Diem Expenses When applicable, all special materials, plus travel and per diem expenses shall be charged to CLIENT at cost. 3. Call-Out Charges Systems not covered under 24/7 support, call-outs will be billed at $250 per call. After the first hour, the rate is $250 per hour with a two-hour minimum. If CLIENT's systems are covered under the 24/7 support, the off-hour call-out fee is $50. 4. Remote Access All charges in this Agreement are predicated on CLIENT providing the required hardware, software, and operating environment for dial-in service. RESOLUTION The State of Texas County of Brazos WHEREAS, the federal off-system bridge program is administered by the Texas Department of Transportation (the State) to replace or rehabilitate structurally deficient and functionally obsolete (collectively referred to as deficient) bridges located on public roads and streets off the designated state highway system; and WHEREAS, Brazos County, hereinafter referred to as the Local Government, owns bridges located and identified as shown on Page 4 of this Resolution; and WHEREAS, projects to remedy these bridges are included in the currently approved program of projects as authorized by Texas Transportation Commission Minute Order Number 108653 dated September 27, 2001; and WHEREAS, the usual fund participation ratio for projects on such program is 80 percent federal, 10 percent state and 10 percent Local Government; and WHEREAS, Texas Administrative Code, Title 43, Section 15.55(d) (43 TAC Section 15.55(d)) provides that under specified conditions the 10 percent Local Government match fund participation requirement may be waived with agreement by the Local Government to perform, or cause to be performed, an equivalent dollar amount of structural improvement work on other deficient bridges or deficient mainlane cross-drainage structures within its jurisdiction, such a project of structural improvement work being referred to as an "equivalent-match project"; and WHEREAS, the estimated local match fund participation requirement on the approved federal off-system bridge projects is $31,240, hereinafter referred to as the "participation-waived" projects, such participation requirement the Local Government proposes be waived and in return perform or cause to be performed equivalent-match project structural improvement work. The Local Government must be currently in compliance with load posting and closure regulations as defined in National Bridge Inspection Standards under US Code of Federal Regulations, Title 23, Section 650.303. 2. The equivalent-match project work increases the load capacity of the existing bridge or other mainlane cross-drainage structure, or upgrades the structure to its original load capacity with a minimum upgrade to safely carry school bus loading if located on a school bus route. 3. In performing, or causing to be performed, the equivalent-match project(s), the Local Government assumes all responsibilities for engineering and construction, and complying with all applicable state and federal environmental regulations and permitting requirements for the structures being improved. 4. The work on the proposed equivalent-match project(s) has not begun and will not begin until the local match fund participation waiver approval process has been completed. 5. The Local Government will be allowed three years after the contract award of the participation-waived project to complete the structural improvement work on the equivalent- match project(s). 6. Should this waiver request be approved, an appropriate written agreement or amendment to a previously executed agreement will be executed between the State and Local Government.
